HELLO!
I'm Bea and I work in the General Services Department, which
coordinates the activities of the Code Enforcement Board. The main
function of the Code Enforcement Board is to enforce a variety of
City Ordinances.
I overheard the code compliance officer say that there was a
possible code violation on your property. He said:
Improved property in violation of section 8-11 (a) Code of
Ordinances; growth in excess of 8" & trash & weeds in need of
general cleaning. 3 & 4, Block 174, City of Okeechobee
By the time the boss finds out who owns the property, where
you live and writes down the code violation, you can easily have
the problem solved. It normally takes the boss 30 days to figure
everything out.

Pursuant to Fla. Statutes 162, & section 2-26 of the code of
ordinances of the City of Okeechobee, the undersigned Code
Inspector, being first duly sworn, and with personal knowledge of
the facts, hereby alleges the existence of uncorrected, or repeat,
violation(s) of the code of ordinances and gives notice herein to
the landowner or persons in possession, and hereby requests a
public hearing before the Code Enforcement Board, City of
Okeechobee, to hear the following:
1. Violation(s) of City Code Chapter/Section: 611 Code of Ord.

NOTICE IS HEREBY GIVEN that the alleged violation(s) will be
presented to the City Code Enforcement Board, in the City Council
Chambers, Municipal Centre, 55 S. E. third Avenue, Okeechobee,
Florida on the 2nd Tuesday of each Month, 19 99 , at 7:00
P.M. Call 763-3372 prior to the meeting, to verify that there is
a meeting.
If this violation(s) is found by the CODE ENFORCEMENT BOARD to
exist and you violate this section of the Ordinance again within
the following 2 years, that case may immediately receive a "NOTICE
OF HEARING" (which has the automatic $25.00 fee included.)
You have the right to obtain an attorney if you wish, and the

The code enforcement board for the city of Okeechobee, Florida
heard the above complaint regarding your real property located
within the City upon a code violation for the following violation:

needs general cleaning around trees and other items. Building has
been broken into.
Following the presentation of the complaint, the Board, by
majority vote, determined that a violation did exist, and imposed
the following penalty: that your land must come into compliance
with the applicable city code within upon receipt of notice.
Failing that, there would commence a fine upon the property in the
sum of $ 250.00 per day, until it comes into compliance.
We inform you that under the Florida Statutes, you have 30
days from the date of the meeting to file an appeal if you wish
wi th the circuit court. In the event you do not come into
compliance by the date specified by the Board, a certified copy of
the order will be filed in the local courthouse as a lien on the
property. If you do come into compliance, you must contact Bea at
(813) 763-3372, City Hall to so inform us of such compliance,
otherwise the lien will continue to accrue daily.
The effect of the lien is that for the time period it takes
you to come into compliance, you will owe the City the daily fine
that accrues, unless you come before the Board to ask that the fine
be reduced, or eliminated, which is discretionary with the Board.
Further, if you do nothing, the lien is valid for 20 years, and the
City has the option, after three months have elapsed, to foreclose
on the lien, and also collect costs and attorney fees.

ORDER
THIS CAUSE came on for public hearing before the Code
Enforcement Board, City of Okeechobee, on
March 9 , 19~, after
due notice to the respondent, and the Board having heard evidence
on the alleged violation by witnesses or affidavit, the Board
therefore makes the following findings:
(check appropriate box)
1. That the violation was corrected prior to the hearing, and
is accordingly dismissed.
2. That the respondent was in violation of the cited section
of the code but came into compliance prior to the hearing.
Therefore the case is dismissed.
3. That the respondent is granted an extension of time of
days without penalty to correct the violation, and the
matter is re-set for review the next hearing date of
19 , or as set by the Board, in which case respondent will
receive 10 days prior notice of the hearing.
4. That the respondent, as evidenced by his signature hereto,
acknowledges the violation and agrees to correct said violation on

Garbage/litter/rubbish; Dangerous conditions; Public
Nuisance and needs general cleaning around trees and other
items)
B. CONCLUSIONS OF LAW: After hearing testimony, member
O'Connor moved to fine case # 99-03-01 $250.00 per day
starting the day the notice is received. Seconded by
member Nelson. Motion carried.
C. ORDER: The Code Enforcement Board, City of Okeechobee,
has determined that you have violated the Code of Ordinances,
Section 8-2;8-11 & SSBC concerning your property located at
207 Southwest 2nd Street
If you do not correct the violation by notice of receipt,19
or notify the Code Enforcement Officer of the correction, the Board
imposes a fine of $ 250.00 per day commencing that date and
continuing daily until the violation is corrected and the city is
notified by you and verifies the correction, which ever first
occurs. Further, if you do not correct the violation by said date,
a certified copy of this order, and a claim of lien, shall be
recorded in the office of the Clerk of Circuit Court, Okeechobee
County, Florida, and once recorded, becomes a lien on real and
personal property pursuant to Florida Statute 162.
You have a
right, within 30 days, to appeal this finding and order by Writ of
Certiorarito the Circuit Court, Okeechobee County, Florida. If you
correct the violation prior to the above date, it is your
obligation to contact the Code Enforcement Officer to verify such

THIS CAUSE came on for public hearing before the Code
Enforcement Board, City of Okeechobee, on

due notice to the respondent, and the Board having heard evidence
on the alleged violation by witnesses or affidavit, the Board
therefore makes the following findings:

B. CONCLUSIONS OF LAW: After hearing testimony, member
O~Connor moved to fine case # 99-03-01 $250.00 per day
starting the day the notice is received. Seconded by
member Nelson. Motion carried.
C. ORDER: The Code Enforcement Board, City of Okeechobee,
has determined that you have violated the Code of Ordinances,
Section 8-2:8-11 & SSBC concerning your property located at
207 Southwest 2nd Street
If you do not correct the violation by notice of receipt,19

or notify the Code Enforcement Officer of the correction, the Board
imposes a fine of $ 250.00 per day commencing that date and
continuing daily until the violation is corrected and the city is
notified by you and verifies the correction, which ever first
occurs. Further, if you do not correct the violation by said date,
a certified copy of this order, and a claim of lien, shall be
recorded in the office of the Clerk of Circuit Court, Okeechobee
County, Florida, and once recorded, becomes a lien on real and
personal property pursuant to Florida Statute 162.

Certiorarito the Circuit Court, Okeechobee County, Florida. If you

Dear Mr, Markham:
As you requested, I am writing this note to explain the action of the code board at the
November 14 meeting in reference to this real property.
Your solution to the code violation was to obtain a release of the ongoing lien to
facilitate a new buyer in purchasing the property in order to clean up the violation. The City
attorney advised that under F.S. chapter 162, the statute only permits a release of lien if(1) the
property comes into compliance; or (2) the lien is foreclosed on by the City.
The compromise the board approved was the following:
1. The lien would continue to be ongoing against the property.
2. The amount of the lien ~ould be reduced to a total of$1500.00, and would be
released by the City if the new owner got the property to come into compliance
within 30 days of transfer of ownership, and the $1500.00 paid to the City.
3. If the new owner did not cause the property to come into compliance within the 30
days, the lien would continue in the original amount.
While the presence of the lien in the public record may make a transfer all but
impossible, this is all the board felt it could do under the constraints ofthe statutes.

Dear Bill:
On behalf of the prospective purchaser of the Tommy Gaughon property on S.W. 2nd St.,
you requested a clarification of the code board action on November 14.
I advised the board that under the provisions ofF.S. chapter 162, the board could not
release the ongoing fines levied against the property except in two circumstances: the property
has come into compliance; or the property is foreclosed by the City.
The actual order then, was to not release the lien, but to reduce the lien to $1500.00 if the
new owner came into compliance within 30 days of purchase, and notified the City to this effect.
I cannot predetermine how the board would vote on any case, but with this recommendation, I
am quite certain this is the action the board would take, once the property is cleaned up and in
compliance.
If the lien is an obstruction to the purchaser closing for purposes of title insurance or
bank financing, let me know, as I believe we can overcome those problems.

I. In response to the question the board had last meeting, the city is authorized to condemn
property declared as a nuisance, under Florida Statutes 166.411. While we have declared this
property to be in violation, we never actually declared it to be a nuisance.
Therefore, have Sue put this on the next available agenda, as an agenda item to declare
the property a nuisance under section 8-10, city codes. Mail certified notice to the owners, and to
the bank that has it financed Once we take this step, we can commence the condemnation.
While the court process will not be any faster than foreclosure, I believe this process permits us
to get around the existing mortgage on the land.
In the future, when we are dealing with real property that is in a condition like this one,
when we get to the code board, we should declare it to be a nuisance in addition to imposing
fines for failure to come into compliance.
II. On your question about chapter 162, look in section 162.09(3) and it will give you the
foreclosure process and the three month waiting period.

Dear Joey:
We have not received an answer from you in reference to the Gaughan property. On December
11, 2001 the Code Enforcement Board declared the property to be a public nuisance. According
to the City Code of Ordinances a public nuisance is defined as any unsightly, derelict or unsafe
building or structure which may constitute a hazard to safety, health, welfare or sense of public
aesthetics by reason of inadequate maintenance, dilapidation, obsolescence, or abandonment (see
enclosed photographs).
If we do not hear from you or no action is taken within five (5) days of receipt of this letter the
Code Enforcement Board will send a recommendation to the City Council to have the property
condemned and the building removed from the property.

Dear Mr. Larinson:
On behalf of the City of Okeechobee, Florida, I have been in contact with Joe Ulferts in
reterence to the bank mortgage on the Gaughn property here, and he referred me to you
concerning an ongoing foreclosure action.
Please bring me up to date on the action, its progress and anticipated date of final
judgment. As you may know, the code board for the City has imposed an on-going lien against
the real propelty tor code violations; I have received direction to condemn the property since it
has existed in its current state tor years.
If a reasonably ccrtain date is possible for the bank to take over and demolish the
SUlJcture, then it may pennit us to not take any action at this point. Regardless of which direction
is taken, there will be the matter of satisfaction of the city lien at some point in time.

0357 had made an agreement with the City that if they removed some concrete that had been left there
during the M & M Taddy project, then the owners would clean-up their property. Chief Tomey said he
was not aware of that agreement until today, so at this time he needed to withdraw these two cases
until the City removes the concrete.
Mark Goodbread addressed the board stating they are in the process of purchasing the Gaughan &
Nairnsey property with the intentions of cleaning it up and tearing down the old building once they
closed on the property in approximately forty-five days. He requested that the Code Board work with
them on paying the lien until they could get the property cleaned-up. Chief Tomey informed the Board
that this case had been under a fine of $250 per day since 1999 and that the total now came to
$302,262. Chairperson Worley reminded the Board that in similar cases they had reduced the fine to an
amount that would cover the cost incurred by the City. There was some discussion by the board
members as to what the City's cost had been in this case up until this point. Member Gamiotea felt a
new owner should not be punished for a violation that involved the previous owner, Member Nelson
agreed. Brad Goodbread addressed the Board stating once the property was cleaned they intended to
build something that would add to the tax base of the City. So even if the fine was reduced the City
would still realize an increase in revenue from the property each year. Member Montesi moved to
reduce the fine on Case# 01-0154 to $500 when the property is brought into compliance within forty-
five days of closing; seconded by Member Nelson.

Attorney Cook suggested to the Board a couple of areas for discussion in reference to the sign
ordinance. One was murals which at this time are not addressed in the existing sign ordinance and the
other was the use of temporary signs and banners. After a lenghty discussion among the Board
members, Member Gamiotea moved to schedule a workshop in order to review the sign ordinance in
more detail; seconded by Member Montesi.

LICENSE AGREEMENT
THIS AGREEMENT, BY AND BETWEEN THE CITY OF OKEECHOBEE, FLORIDA,
a Florida Municipal corporation (hereinafter "CITY"), Southern Construction and Development,
Inc., (hereinafter "OWNER(S)"), dated this 1<fL day of 1~ ,2005.
WHEREAS, OWNER (S) hold fee simple title to the following described real property
in Okeechobee County, Florida, to wit:
Lots 5 and 6 of Block 174, CITY OF OKEECHOBEE, according to the Plat
thereof recorded in Plat Book 1, Page 10 and Plat Book 5, Page 5, public
records of Okeechobee County, Florida; and
WHEREAS, City owns the following alleyway:
That 15 foot wide alleyway located between Lots 5, 6 and 7,8 of Block 174,
CITY OF OKEECHOBEE, according to the Plat thereof recorded in Plat
Book 1, Page 10 and Plat Book 5, Page 5, public records of Okeechobee
County, Florida; and
WHEREAS, the OWNER(S) desire to make certain improvements in the form of
landscaping, paving and maintaining an alleyway adjoining between the lots listed above in
said Block 174, which is an open, unimproved alleyway, which is owned by the CITY.
NOW, THEREFORE, in consideration of the mutual promises and covenants set forth
herein, the parties agree as follows:
1. The CITY hereby grants this revocable license for use of the alleyway with the
understanding the OWNER(S) will maintain the alleyway and should it ever
become necessary to remove any pavement, landscaping or any improvement
thereon, in order to allow either the installation, or maintenance of water, sewer,
or other utility lines or any other type of installation or construction, or for any
other reason chosen by the CITY, the pavement, landscaping or any
improvement thereon, will be removed by the OWNER(S) or their agents and/or
assigns at the OWNER(S) expense within seven days of receipt of written
request by the CITY for such removal. Should the CITY, for valid reasons,
require the removal of the pavement, landscaping or any improvements thereon
less than seven days notice, the OWNER agrees to exercise reasonable efforts
to comply with such requests.
2. OWNER(S) agree to contact their insurance company and require a rider be
added to their insurance policy with a certificate furnished to the CITY showing
the portion of the alleyway as herein described, to be used by them, insures the
CITY against any liability arising out of alleged injuries or other activities which
may occur within the alleyway. In any event, OWNER(S) agree and shall hold the
CITY harmless for any and all action, suit, claim, injury or cause of action of any
nature arising out of owner's permissive use, and indemnify CITY for such,
including costs and attorney fees.
3. That OWNER(S) shall not, by such improvements made to that described
alleyway, obstruct, close or otherwise restrict access to the alleyway for travel
thereon by the CITY or the general public.
4. That the OWNER(S) agree that this license is non-assignable without the
express written consent of the CITY; and if transferred, the covenants herein
shall bind themselves, their heirs and assigns, and said covenants shall run with
the land.

5. The City Clerk shall cause this agreement to be recorded in the public records
of Okeechobee County, Florida.
