ORDER
THIS CAUSE came on for public hearing before the Code Enforcement Board, City of
Okeechobee, on

the Board having heard evidence on the alleged violation by witnesses or affidavit, the Board
therefore makes the following findings:

_ 1. That the violation was corrected prior to the hearing, and is accordingly dismissed.
_ 2. That the respondent is granted an extension of time of
days without penalty to
correct the violation, and the matter is re-set for review the next hearing date of
20_, or as set by the Board, in which case respondent will receive ten (10) days prior notice of
hearing.
_ 3. That respondent, as evidenced by his signature hereto, acknowledges the violation and
agrees to correct said violation on or before

X 4. That upon review of the evidence presented, the Board issues the following:
A. FINDINGS OF FACT:
Property located at 818 SE 10th Street, Okeechobee, FL
has been found to be a threat to the welfare of the community
due to the fact it has overgrown grass and a house which
needs to be boarded up and declared to be a nuisance
requiring immediate remedial action by the City.
B. CONCLUSIONS OF LAW
Property located at 818 SE 10th Street, Okeechobee, FL
is in violation of Chp. 8 Sec. 8-10 Public Nuisances.
C. ORDER: The Code Enforcement Board, City ofOkeechobee, has determined that you
have violated the Code of Ordinances, Section 8-10 concerning your property located at
818 SE 10th Street. Okeechobee. FL 34974
If you do not correct the violation by date of receipt of notification , or notify the Code
Enforcement Officer ofthe correction, the Board imposes a fine of$ 50.00 per day
commencing that date and continuing daily until the violation is corrected or the city is notified by
you and verifies the correction, which ever first occurs. Further, if you do not correct the
violation by said date, a certified copy of this order as a claim of lien, shall be recorded in the
office of the Clerk of Circuit Court, Okeechobee County, Florida, and once recorded, becomes a
lien on real and personal property pursuant to Florida Statute 162. You have a right within 30
days, to appeal this finding and order by Writ of Certiorari to the Circuit Court, Okeechobee
County, Florida. If you correct the violation prior to the above date, it is your obligation to
contact the Code Enforcement Officer to verify such compliance.
X 5. The Board finds and orders in addition:
Since the property has been declared a public nuisance and a threat to the
welfare of the community the Code Enforcement Board is recommending
to the City Administrator that the property be cleaned and the house boarded
up by the City with the cost being charged to the Evelyn P. Dasher Estate.

The corrective action outlined should be taken within five (5) working days from the date of receipt of this
letter and the Code Enforcement Officer contacted to verify compliance. Failure to take corrective action

If the violation is corrected then recurs, the case shall be presented to the Code Enforcement Board

Pursuant to Florida Statutes 162, & section 2-26 of the Code of Ordinances of the City of Okeechobee,
the undersigned Code Inspector, being first duly sworn, and with personal knowledge of the facts, hereby
alleges the existence of uncorrected violations of the Code of Ordinances and gives notice herein to the

Code Officier Tomey gave testimony that the attorney handeling the estate had been notified by
certified mail that Case #02-0216 was on to nights agenda. Code Officier Tomey said the property
appeared to be unrepairable at this point. Member Gamiotea advised the Code Board that he lived near
this property and he also felt it was unrepairable and dangerous. Member Montesi moved that Case
#02-0216 be declared a public nuisance and that a recommendation be made to the City Council to start
condemnation proceedings; seconded by Member Nelson.

Code Officier Tomey addressed the Board on behalf of Mr. Ordonez Case # 02-0351 stating he was
planning to clear the property around River Run Phase II and hoped the Code Board would reduce the
100 ft. buffer requirement to 50 ft. After some discussion as to whether the 100 ft. buffer applied to
unimproved (raw) land, Attorney Cook advised the Board it would not be necessary to take any action
and that he would meet with the Code Officiers and straighten it out so that Mr. Ordonez would not
have to go to any unnecessary expense.
Attorney Cook suggested the Code Board members study the City and County ordinances on signs and
he would prepare a draft updating the sign oridnance for the Board to consider at the next meeting.
The Code Board members reviewed the existing ordianance on disabled vehicles and reconsidered a
draft on disabled vehicles that the Board had rejected earlier this year. After a lengthy discussion as to
whether some exemptions should be made for cars that are being restored, race cars, hunting buggies,
etc., the Board decided to keep the existing ordianance in effect without any changes at this time.
City Administrator Bill Veach stressed to the Code Board members the importance of the need for
more clarity in regards to the existing ordiance on signs. Chairperson Worley assured the administrator
the Board would work towards a more specific and clear definition.

city should consider condemning the property. Under chapter 166 of Florida Statutes, a city is
authorized to condemn real property if necessary to abate a nuisance, and I understand the roof
has caved in, and transient people are in and out of the structure.
Your attorney, Mr. Montgomery happens to be known to me, and he is very familiar with
municipal law. I called his office and obtained the names of the heirs, so I could notify you in
addition to the notice of code violation. The requirements of the notice of code violation mustbe
complied with, as set out in the notice. I would prefer, as city attorney, to not pursue a
condemnation at present until we hear from each of you as to your intentions on the property. If
we can resolve this quickly, it would be to everyone's advantage. Ifwe cannot resolve it, then
the matter will have to proceed through the code process, which could result in fines against the
property up to $250.00 per day, and which would be a lien against the value of the property.

requiring immediate remedial action by the City.

Property located at 818 SE 10th Street, Okeechobee, FL
is in violation of Chp. 8 Sec. 8-10 Public Nuisances.
C. ORDER: The Code Enforcement Board, City ofOkeechobee, has determined that you
have violated the Code of Ordinances, Section 8-10 concerning your property located at
818 SE 10th Street. Okeechobee. FL 34974
If you do not correct the violation by
date of receipt of notification , or notify the Code

Enforcement Officer of the correction, the Board imposes a fine of$ 50.00 per day
commencing that date and continuing daily until the violation is corrected or the city is notified by
you and verifies the correction, which ever first occurs. Further, if you do not correct the

office of the Clerk of Circuit Court, Okeechobee County, Florida, and once recorded, becomes a

Dear Mr. Israel:
I have been made aware that this corporation has applied for a tax deed on the above real
estate here in Okeechobee, with a sale date of April 4th.
You may be aware that the property went through probate a couple of years ago, and the
heirs who now own the property appear to have essentially abandoned it. It is in such
disrepair that it most likely cannot be salvaged.
In the meantime, the City of Okeechobee Code Board has imposed liens against the
property of over $20,000.00, and we are very near filing a condemnation lawsuit against
the owners. I do not state this to derail your plans to purchase at tax sale, but whoever
eventually owns this property is going to have to deal with the code enforcement issues.
I cannot predict what the Code Board will do, but I believe they would be favorable to an
owner who cleans up the property, as far as reducing accrued liens. You may contact me
at the City for further information if you wish to do so.
