CASE NO. 27-93-8 TIITF/State of Florida / ORDER THIS CAUSE came on for public hearing before the Code Enforcement Board, City of Okeechobee, on Aug 10, , 19 93 , after due notice to the respondent, and the Board having heard evidence on the alleged violation by witnesses or affidavit, the Board therefore makes the following findings: (check appropriate box) 1. That the violation was corrected prior to the hearing, and is accordingly dismissed. 2. That the respondent was in violation of the cited section of the code but came into compliance prior to the hearing. Therefore the case is dismissed. 3. That the respondent is granted an extension of time of days without penalty to correct the violation, and the matter is re-set for review the next hearing date of , 19 , or as set by the Board, in which case respondent will receive 10 days prior notice of the hearing. 4. That the respondent, as evidenced by his signature hereto, acknowledges the violation and agrees to correct said violation on or before , 19 , and notify the Board of the correction and arrange for a re-inspection of the property by the Code Enforcement officer prior to said date. If the Board is not notified by said date, or if the corrections have not been made, the Board imposes a penalty of $ per day commencing on 19 , and continuing until the corrections have been made to come into compliance with the Code. The fine may become thereafter a lien on the real and personal property as described in paragraph 4 herein. X 5. That upon review of the evidence presented, the Board issues the following: A. FINDINGS OF FACT: After hearing testimony the board found case #27-93-8 to be in violation of Untended vegetation/ trash/weeds and needs general cleaning around trees and other items. B. CONCLUSIONS OF LAW: After hearing testimony Member Ballinger moved to given 10 days after receipt of notice to come into compliance. If not in compliance at this time a fine of 150.00 per day be imposed until compliance. Seconded by member 0, Connor. Motion carried. C. ORDER: The Code Enforcement Board, City of Okeechobee, has determined that you have violated the Code of Ordinances, Section Ord 611 concerning your property located at Lot 5 & _5 ,_Block 248, 1st addition to City If you do not correct the violation by 10 days of receipt of notice , or notify the Code Enforcement Officer of the correction, the Board imposes a fine of $ 150.00 per day commencing that date and continuing daily until the violation is corrected or the city is notified by you and verifies the correction, which ever first occurs. Further, if you do not correct the violation by said date, a certified copy of this order, and a claim of lien, shall be recorded in the office of the Clerk of Circuit Court, Okeechobee County, Florida, and once recorded, becomes a lien on real and personal property pursuant to Florida Statute 162. You have a right, within 30 days, to appeal this finding and order by Writ of Certiorarito the Circuit Court, Okeechobee County, Florida. If you correct the violation prior to the above date, it is your obligation to contact the Code Enforcement Officer to verify such compliance. 6. The main function of the Code Enforcement Board is to enforce a variety of City Ordinances. I overheard the code compliance officer say that there was a possible code violation on your property. He said: Untended vegetation/trash/weeds and needs genenal cleaning around trees and other items on lots 5 & 6, Block 248, 1st Addition to city By the time the boss finds out who owns the property, where you live and writes down the code violation, you can easily have the problem solved. Failing that, there would commence a fine upon the property in the sum of $ 250.00 per day, until it comes into compliance. We inform you that under the Florida Statutes, you have 30 days from the date of the meeting to file an appeal if you wish with the circuit court. The main function of the Code Enforcement Board is to enforce a variety of City Ordinances. I overheard the code compliance officer say that there was a possible code violation on your property. He said: Untended Vegetation/trash/weeds and needs general cleaning around trees and other items on lots 10, Block 46, 1st Addition to South Okeechobee By the time the boss finds out who owns the property, where you live and writes down the code violation, you can easily have the problem solved.
