Dear Mr Murray:
The code enforcement board for the city of Okeechobee, Florida
heard the above complaint regarding your real property located
within the City upon a code violation for the following violation:
Lots 25 & 26, Block 19, City of Okeechobee
Following the presentation of the complaint, the Board, by
majority vote, determined that a violation did exist, and imposed
the following penalty: that your land must come into compliance
with the applicable city code within 10 days of receipt of this
1 et ter. Failing that, there would commence a fine upon the
property ~n the sum of $ 150.00 per day, until it comes into
compliance.
We inform you that under the Florida statutes, you have 30
days from the date of the meeting to file an appeal if you wish
with the circuit court. In the event you do not come into
compliance by the date specified by the Board, a certified copy of
the order will be filed in the local courthouse as a lien on the
property If you do come into compliance, you must contact City
Hall to so inform us of such compliance, otherwise the 'lien will
continue to accrue daily.
The effect of the lien is that for the time period it takes
you to come into compliance, you will owe the City the daily fine
that accrues, unless you come before the Board to ask that the fine
be reduced, or eliminated, which is discretionary with the Board.
Further, if you do nothing, the lien is valid for 20 years, and the
City has the option, after three months have elapsed, to foreclose
on the lien, and also collect costs and attorney fees.
We would like to see you come into compliance upon receipt of
this letter to avoid these procedures, but failing to do so may
result in this action being taken.

ORDER
THIS CAUSE came on for public hearing before the Code
Enforcement Board, City of Okeechobee, on May 12 , 19 92 ,
after due notice to the respondent, and the Board having heard
evidence on the alleged violation by witnesses or affidavit, the
Board therefore makes the following findings:
(check appropriate box)
1. That the violation was corrected prior to the hearing, and
is accordingly dismissed.
2. That the respondent is granted an extension of time of
days without penalty to correct the violation, and the
matter is re-set for review the next hearing date of ,
19 , or as set by the Board, in which case respondent will
receive 10 days prior notice of the hearing.
3. That the respondent, as evidenced by his signature hereto,
acknowledges the violation and agrees to correct said violation on
or before , 19 , and notify the Board of the
correction and arrange for a re-inspection of the property by the
Code Enforcement Officer prior to said date. If the Board is not
notified by said date, or if the corrections have not been made,
the Board imposes a penalty of $ per day commencing on
, 19 , and continuing until the corrections have
been made to come into compliance with the Code. The fine may
become thereafter a lien on the real and personal property as
described in paragraph 4 herein.
X 4. That upon review of the evidence presented, the Board
issues the following:
A. FINDINGS OF FACT: Case #10-92-05 was in violation.
B. CONCLUSIONS OF LAW: A motion was made by Member
Palmore that a fine of $150.00 per day be imposed if
not in compliance 10 days after receipt of notice.
Seconded by member Montesi and motion carried.
I C. ORDER: The Code Enforcement Board, City of Okeechobee,

has determined that you have violated the Code of Ordinances,
I Section Ord 611 concerning your property located at Lots 25
and 26, Block 19, City of Okeechobee .
If you do not correct the violation by 10 days after receipt,
I or notify the Code Enforcement Officer of the correction, the Board
imposes a fine of $ 150.00 per day commencing that date and
continuing daily until the violation is corrected or the city is
notified by you and verifies the correction, which ever first
occurs. Further, if you do not correct the violation by said date,
a certified copy of this order, and a claim of lien, shall be
I recorded in the office of the Clerk of Circuit Court, Okeechobee
County, Florida, and once recorded, becomes a lien on real and
personal property pursuant to Florida Statute 162. You have a
right, within 30 days, to appeal this finding and order by Writ of
Certiorari to the Circuit Court, Okeechobee County, Florida. If you
correct the violation prior to the above date, it is your
obligation to contact the Code Enforcement Officer to verify such
compliance.

NOTICE OF HEARING
Pursuant to Fla. Statutes 162, & section 2-26 of the code of
ordinances of the City of Okeechobee, the undersigned Code
Inspector, being first duly sworn, and with personal knowledge of
the facts, hereby alleges the existence of uncorrected violations
of the code of ordinances and gives notice herein to the landowner
or persons in possession, and hereby requests a public hearing
before the Code Enforcement Board, City of Okeechobee, to hear the
following:
1. Violation of City Code Chapter/Section: Ord. 611 ·

Inspector to verify compliance, NOTICE IS HEREBY GIVEN that the
alleged violation in the City Council Chambers, City hall, 55 S.E.
¡ third Avenue, Okeechobee, Florida on the 2nd Tuesday of each
Month, 19 92 , at 7:00 P .M. Call 763-3372 prior to
the meeting.
If the violation is corrected and then recurs, the case shall
be presented to the CODE ENFORCEMENT BOARD even if the violation
has been corrected prior to the BOARD hearing.
You have the right to obtain an attorney if you wish, and the
BOARD will receive testimony and evidence at said PUBLIC HEARING,
shall make findings of fact as are supported by the evidence, and
shall issue appropriate orders as necessary to bring the alleged
violation into compliance, including the payment of a fine by the
Respondent(s). It is your obligation to insure that on accurate
record of the proceedings is taken for an appeal.

HELLO!
I'm Bea and I work in the General Services Department, which
coordinates the activities of the Code Enforcement Board. The main
function of the Code Enforcement Board is to enforce a variety of
City Ordinances.
I overheard the code compliance officer say that there was a
possible code violation on your property. He said:
Untended-Vegetation/Trash/Weeds on property on Lots 25 and 26,
Block 19, City of Okeechobee and needs to be cut and removed.
By the time the boss finds out who owns the property, where
you live and writes down the code violation, you can easily have
the problem solved. It normally takes the boss 30 days to figure
everything out.
