May 10, SOV/NOH mailed via USPS certified return receipt for the June 13th Hearing to the Jennifer May 15, 2023

June 1, Code Officer Curl received a call from Mr. William Hair; he stated that the yard has
2023 been mowed and cleaned up and that the asbestos survey was completed and
received, and the application for demolition has been submitted. I asked him to
email me a copy of the asbestos survey and the demolition application.
June 7, Code Officer Smith inspected the property: still non-compliant, overgrown
2023 vegetation was cut, trash and debris removed from the property, however the
building remains unsecure.
June 9, Code Officer Curl verified with Ashley in the General Services Department that an
2023 application was received today for demolition, however it has not been approved.
Copy of permit application and asbestos summary placed in the file.
• To comply with City ordinances, the property owner needs to address the unsafe roof
and structure either by making the necessary repairs or demolition, secure the
residence.
City Recommendation:
The City recommends a fine of $100.00 per day, to begin 21 days after the date of the Special
Magistrate Hearing on May 9, 2023, unless the property owner brings the property into
compliance on or before that date, plus a $50.00 administrative fee.

Code Officer Curl observed the above-mentioned property to be in violation of Chapter 10,
10-3 Limitation as to the number of animals, 10-8 Public nuisance, Chapter 30, Sections
30-40 Junk, 30-43 Public nuisances, 30-44 General cleaning and beautification.
International Property Maintenance Code (IPMC) Chapter 3, Section 304.1.1 Unsafe
conditions, for having several chickens and a rooster roaming freely on the property
making noise continuously, overgrown grass,weeds, bushes or shrubs,trash, yard debris
or junk all over property, roof, and structure in unsafe conditions.
January 24, 2023 Courtesy card, phots, city ordinances mailed vis USPS regular mail, given 14-days to correct
violations.
February 6, 2023 Mr. Lang property's owners husband called into the office and spoke with Code Officer Curl
reference to the notice that was received he asked for an extension, his work#772-564-2797 cell
#772-559-0722 both are state phones do not text. He was advised of the work that needs to be
completed to bring the property into compliance. He stated that he would keep us updated every
14-days.
February 24, 2023 Mrs. Jennifer Hair called into the office and spoke with Code Officer Curl, she stated that the
property was just put into her name as it has been in probate and the person staying in the home
is basically a squatter but they have been working on the yard and it has been cleaned up, they
are also working on the roof and once the tenant is out on March 17, 2023 they will be putting in
for a permit to demolish the structure, her contact#863-447-8029. She was advised that we have
it on the schedule for Monday to do an inspection and once we have that completed, we can give
her an update on the status of the property.
February 27, 2023 Code Officer Smith inspected the property: still non-compliant, made progress with the
cleaning of the property however the roof is still in disrepair, items in the yard still need to be
removed, and the car porch still needs to be cleaned. Photos in file.
March 2, 2023 Code Officer Curl tried to call Mrs. Hair; no answer left message asking her to return my call to
discuss the status of the property.
March 2, 2023 Code Officer Curl received a call back from Mrs. Hair, I updated her on the status of the
property and advised to give us an update after they take possession of the property on March
17th

March 23, 2023 Code Officer Curl inspected the property, still non-compliant. Photos in file.
March 24, 2023 SOV/NOH and photos mailed via USPS certified return receipt for the May 9th Hearing. The
certified return receipt has not been received back as of the date of the May 9th Hearing.
April 24, 2023 Code Officer Curl posted the property and City Hall for the May 9' Hearing. Photos in the file.
April 24, 2023 Code Officer Curl inspected the property, still non-compliant. The roof and the structure
remain unsafe, the overgrown vegetation and the trash debris remain, the structure now
appears to be vacant and unsecured.
May 4, 2023 Code Officer Smith inspected the property, still non-compliant. Photos in file.
May 4, 2023 Code Officer Curl spoke with Ashley in the General Services Department she stated that a
permit for a reroof had been pulled in 2022 but it is set to expire on May 16, 2023, however no
work has been completed and no other permits have been applied for.
May 9, 2023 Case presented to the Special Magistrate and the case was deferred to the next Special
Magistrate Hearing on June 13, 2023 to allow the property owner more time to come into
compliance.
May 10, 2023 SOV/NOH mailed via USPS certified return receipt for the June 13' Hearing to the address of
record and to Jennifer Hair. Received by Jennifer Hair on May 15, 2023.
June 1, 2023 Code Officer Curl received a call from Mr. William Hair (863) 801-2754; he stated that the yard

Pursuant to Florida Statutes 162.02 and 162.12, Florida Statutes, and the Code of Ordinances of City of
Okeechobee, I(hereinafter the "City of Okeechobee),the undersigned Code Enforcement Officer hereby gives
notice of an uncorrected violation of the City of Okeechobee Code,as more particularly described herein, and
hereby requests a Hearing before the Okeechobee City Code Enforcement Special Magistrate.

notice that a Hearing will be held in this cause before the City of Okeechobee Code Enforcement Magistrate on the 13th
day June, 2023 at 6:00 P.M., located at 55 SE 3rd Ave Okeechobee City Hall,Okeechobee Florida 34974 in
Council Chambers.The Magistrate will receive testimony and evidence at said Hearing and shall make findings of fact and
conclusions of law as are supported by the evidence and testimony,and shall make an order thereupon.You are entitled to be
represented by counsel,present evidence,and present testimony. Please be advised that any evidence presented to the
Magistrate for his consideration will be retained by Code Compliance Department. If you fail to appear at the hearing the
Magistrate may enter an Order of Violation,&impose a fine in your absence.

OBJECTIVE OF WORK:
Integrative Environmental Solutions was contracted by the owner to determine to what level if
any asbestos exists and to what extent the coverage is at the subject structure.
SITE DESCRIPTION:
The subject structure is located 1004 NW 4th St. Okeechobee, FL.,Okeechobee County (Figure
1). The structure is a single-family home with approximately 1316 sq. ft. of living space. It
consists of 2 bedrooms, 1 bathroom, I living/dining room, I kitchen, outside storage room,
inside storage room,and an open carport area. The home was constructed in 1964. There has
been little upkeep over the years and the structure maintains most of the original construction.
METHODOLOGY:
On May 24, 2023, at approximately 1400 hrs. the structure was first visually inspected for signs
of asbestos. After the visual inspection five(5)samples were collected at key locations inside
the home and outside the home (Figure 2). Photographic documentation of the property was
collected and can be found in Appendix A. The samples were collected on known asbestos
containing materials. The samples were shipped to a certified laboratory for analysis. The
laboratory results arc highlighted in Table I and the laboratory documentation is in Appendix B.
The finding results are limited to the date and time of the inspection.
