He also asked for an update of what needed to be done to bring the property into compliance. I advised Mr. Davitt that I would give him an update once I completed an inspection of the property today. April 20, 2023 Code Officer Curl inspected the property, the property is still non-compliant, however progress has been made with the removal of the inoperable/abandon equipment and the beginning of the removal of the concrete piles, but the chemical containers and piles of crushed concrete still remain on the property. April 20, 2023 Code Officer Curl updated Mr. Coyle with the steps that the contractor will be taking to help lessen the dust from the crushing of the concrete. He was happy with the changes and stated that he could already see a difference. April 20, 2023 Code Officer Curl emailed Mr. Davitt with an update and photos of the work that has been completed. June 27, 2023 Code Officer Curl received an email from Mr. Davitt requesting that a compliance inspection be completed on the property. June 28, 2023 Code Officer Smith inspected the property, still non-compliant, the vegetation continues to be overgrown and large pile of crushed concrete debris. Photos in file. June 30, 2023 Code Officer Curl sent Mr. Davitt an email letting him know that the property is still non-compliant due to the overgrown vegetation and the large piles of crushed concrete debris. July 19, 2023 Representative from Diamond R Fertilizer came into the office and spoke with Code Officer Curl and Code Officer Smith about what was needed to be done to bring the property in compliance. CALL TO ORDER Special Magistrate Azcona called the Code Enforcement Special Magistrate Hearing to order on Tuesday, August 8, 2023, at 6:08 P.M. in the City Council Chambers, located at 55 Southeast (SE) 3rd Avenue (Ave), Room 200, Okeechobee, Florida. The Pledge of Allegiance was led by Special Magistrate Azcona. II. ATTENDANCE Code Enforcement Officer Christina Curl called the roll: Special Magistrate Roger Azcona. Esquire, and Code Enforcement Officer Anthony Smith were present. City Attorney Greg Hyden attended via Zoom. III. CHANGES TO AGENDA Special Magistrate Azcona asked whether there were any agenda items to be added, deferred, or withdrawn; there were none. IV. APPROVAL OF MINUTES AND ADMINISTRATION OF OATH A. Special Magistrate Azcona dispensed with the reading and approved the July 11, 2023, Minutes. B. This being a Quasi-Judicial proceeding, Special Magistrate Azcona collectively administered an Oath to: Code Officers Smith and Curl; all affirmed. Code Officers Smith and Curl stated for the record all events regarding the cases to be discussed occurred within the corporate limits of the City of Okeechobee. The Officer's notes, testimony, photographs, and support documents were all entered as part of the official record. V. NEW CASES A. Accordingly, for purpose of this definition, it is immaterial whether the junk items are claimed to have inherent value; whether such junk is evidenced by a title or certificate or origin; whether it is accumulated for salvage, resale or rehabilitation; or whether the items could eventually be made to be operative. This article shall not prevent authorized garage or yard sales, or displays at permitted non-profit events, or festivals. Refuse means all putrescible and nonputrescible solid wastes (except bodily waste) including, but not limited to, garbage, rubbish, ash, street cleanings, dead animals, abandoned automobiles, junk, and solid market and industrial wastes. Rubbish means nonputrescible solid wastes consisting of both combustible and noncombustible wastes, such as paper, cardboard, tin cans, yard trash, wood, glass, bedding, crockery and similar materials. Street advertising means the placement by a business owner, tenant, agent or custodian thereof, of signs or items for display to the general public outside of their building or structure, for advertising purposes on the grounds of the business. Untended vegetation means grass, weeds or underbrush in excess of 12 inches in height from the ground, dead trees, hedges or any dense growth of trees, vines or other vegetation which tends to create a danger to the public health, safety and welfare by creating a fire hazard; by providing a nesting, breeding or feeding area for insects, rodents, snakes or other species of pest and vermin, or disease bearing organism; or such vegetation impairing the ..sion of motorists or bicyclists or impeoing pedestrians to the extent that traffic and pedestrian safety is impaired; or by adversely affecting the aesthetic appearance to the property upon which the vegetation is located and adjacent properties. (Code 1982, § 8-1; Ord. No. 850, § I, 1-6-2004) Cross reference— Definitions generally, § 1-2. Sec. 30-40. -junk. (a) junk must be stored or located in a totally enclosed building or structure. Any item of tangible personal property, designed to be used in an environment which is protected from the elements, such as the interior of a building or structure, shall be irrebuttable presumed to be junk if the item is placed or stored outside such building or structure. (b) Any motor -driven device or vehicle and parts thereof in inoperable condition shall be irrebuttably presumed to be junk, regardless of whether such item could become operable with repair or assembly. For the purpose of this article, the term "inoperable condition" shall mean a condition of disrepair which renders the item inoperable in a normal manner, or in the manner for which the item was designed, for a period of time in excess of ten days. Not included within this definition are normally operating motor -driven devices, vehicles or farm equipment temporarily stored at a garage or repair facility for purposes of repair, for a period not to exceed ten days. (c) No owner or tenant, or authorized agent thereof, or custodian of any real property, commercial or industrial establishment, or private property owner within the City of Okeechobee, at any time place, dump, deposit, or otherwise permit or allow such placement, of abandoned property, junk, trash, rubbish, litter as defined by F.S. 403.413, or as by this ordinance, any garbage, stagnant water, waste, refuse, hazardous materials or other junk items on or at any location within the City of Okeechobee, regardless of zoning or land use designations; nor additionally cause or allow such items to be placed or located on any place or portion of the property if such would create a public nuisance, or hazard to the safety or welfare of the citizens or visitors to the City of Okeechobee. This prohibition shall not include garbage, refuse or yard trash properly set out for routine solid waste pickup by the authorized solid waste provider in the city. (d) Excepted from this general prohibition in subparagraph (c) is any established area within the City of Okeechobee that would be defined as a junkyard by local ordinance, or by state statute 339.241, or Federal Code 23 U.S.C. 136, and that lawfully pre-existed the prohibition of such junkyards by city ordinance on August 8, 1978, and would be considered a nonconforming use under current land development regulations. For any such existing nonconforming uses within the City of Okeechobee, the following standards are imposed for the protection of the city, its citizens and visitors: (1) It is the express policy of the city nat junkyards and the placement of jury items, by its nature, constitute an eyesore, and cause environmental hazards that are not acceptable within the City of Okeechobee. Accordingly, and for such non -conforming use, items of junk shall not be placed in open view of the public for display, advertising, sale, or hawking purposes. Any item defined as junk by this ordinance, or state or federal laws, shall be located in an area of the real property no less than a 50-foot set back from the front property line; 20-foot setback from side property lines; and 20-foot set back from rear property lines. The junk shall not be viewable from public rights of way, and shall be obscured from ordinary view of those persons passing upon the highways and municipal rights of way in the City of Okeechobee. If not otherwise obscured by foliage or shrubbery that complies with applicable city codes, the junk shall be obscured by the erection of an opaque fence, with a minimum height of eight feet. Any fence so placed shall not be permitted to encroach into the front property line set backs for the zoning district regardless of other codes to the contrary. The fencing material shall be either constructed of wood, or by hurricane fencing, with plastic slats woven through the fence fabric to make it obscure. Any fence so constructed shall comply with all other applicable city permitting process and codes. (2) In the event the real property on which the junk is located is greater than 100 feet in width from side property line to side property line, there shall be placed a 30-foot unobstructed vehicle access lane from the front property line to the rear property line for ingress and egress for fire and emergency services, and a similar 30-foot lane placed for every additional 100 feet of the width of the real property. (3) Any location meeting the definition of a junkyard under this ordinance or F. S. § 339.241, "Florida Junkyard Control Law", and as hereafter amended, shall be open at all regular business hours for inspection by environmental or law enforcement officers, city code compliance officers, and litter enforcement officer, to determine compliance with this ordinance and state laws. (4) Compliance by a property owner, tenant or agent with these code provisions shall not preclude an action for relief and enforcement by the city under applicable state statutes to enjoin a pubic nuisance, if in the opinion of the city the property and its contents do in fact constitute a public nuisance under state laws or these ordinances.
