April 24, 2023 Code Officer Curl received a call from the property owner, Ms. Tillis, stating that the property had been cleaned up and the fence had been taken down. I advised her that I would inspect the property to see if it is in compliance. The first compliant is at 525 SE 13th Ave and 515 SE 13th Ave, where roosters and chickens are being kept. The residences are occupied by a mother(525) and her son (515). The complaint believes that the son owns the animals. Below you will find our correspondence with the complaint Mr. John Wright who resides at 535 SE 13th Ave and the property overviews attached. The second complaint is at 1007 SW Park St, where at least three roosters are being kept. The compliant is Bryan Bormann at 1010 SW 2nd St. I have attached the videos that Mr. Bormann shared with me from this morning that he recorded at 6:35 am, 7:05 am and 7:30 am, along with the property overview. Code Enforcement will be conducting inspections of the properties and will be sending notices to the homeowners, however if Animal Control can be of any immediate assistance to try to provide some relief for the homeowners it would be greatly appreciated. It would be helpful as we investigate your complaint if you could provide a copy of the videos with the dates and times so we can follow up with Animal Control and start a Code Enforcement Case. Believe me when I say I feel your frustration and the frustration of some of the others who have also shared their story about their concerns with the chickens in this neighborhood. Our current ordinances do not specifically forbid raising chickens in the City limits. However, we do have some general ordinances that deal with nuisance animals concerning smell, noise, and if they are not penned or properly housed. I don't know if these ordinances were ever shared with you, so I'll do my best to find the appropriate sections for you to read. Our code enforcement officer also works with the Animal Control Officer who works out of the Sheriff's office. The City contracts with them for services dealing with all relevant animal control issues. The noise ordinance is in Section 30-82 (8). In reading this ordinance, in my interpretation, it puts the burden of proof on the individuals lodging the complaint. I'm not agreeing or disagreeing with that fact just stating how it appears to be written. It is hereby declared to be in the best interest of the city and its citizens not to allow individuals to have numerous animals in a noncommercial environment. Any household owning more than three animals shall provide,for their animals, Exhibit 6 confined pens and/or shelters with a facility for sanitary waste disposal. Again, in my opinion this ordinance is equally difficult to prove unless we have a group of people come forward with a complaint. The ordinance refers to the Animal Control Officer so likewise if the Animal Control Officer deems any of the 4 criteria under Section 10-7 are met then it would be up to them to notify our code enforcement to follow up. In reading a recent article in the Okeechobee News the newspaper was praising a young lady for her entrepreneurship in raising egg laying chickens. Enforcing such activities does become a challenge and news stories like this make it doubly challenging. Wright. I have resided at 535 SE 13th Avenue for 35 years. I retired from the Okeechobee County School Board,and I currently substitute teach from time to time for the School District. It is difficult when I cannot sleep properly due to the roosters making sounds at varies times during the day and night. The situation exists at 525 SE 13th Avenue and 515 SE 13th Avenue,where roosters and chickens are being kept within the city limits. Exhibit 6 The residences are occupied by a mother(525)and her son (515). I believe that he owns the animals. I believe that this situation has been addressed previously,as the owner of the home (525) was upset that neighbors complained. I have reported this to a female Code Enforcement Officer in person in 2022. She wrote the information down. I returned again to the office a few months later. No one was there, so I took a business card, and I wrote an email in January 2023. In February, I wrote a follow up email,and have yet to receive a reply.So, I am writing to find out what the next step is to have this annoyance removed. Also, in February, I attended a hearing meeting, and before it began, I spoke with 2 Code Enforcement Officers,and Hearing Official,and was told the City Administrator was the 4 person there. One of the Code Officers said that they would speak to Animal Control. After 2 weeks, I went out to the Animal Control Office with videos of the roosters, including the noise that they make for over 20 minutes at a time beginning very early in the morning. I am basically writing to find out what's happening with this situation, and what is the next step in the process to have these noisy animals removed from our neighborhood.
