Special Magistrate Azcona called the Code Enforcement Special Magistrate Hearing to order on Tuesday December 13, 2022, at 6:00 P.M. in the City Council Chambers, located at 55 Southeast 3rd Avenue, Room 200, Okeechobee, Florida. The Pledge of Allegiance was led by Special Magistrate Azcona. II. Special Magistrate Azcona approved the October 11, 2022 Hearing Minutes. B. This being a Quasi-Judicial proceeding, Special Magistrate Azcona collectively administered an Oath to Code Officers Smith, Curl, Mrs. Pamela Arnold, Mr. Vernon Arnold, Mr. Perry S. Arnold, and Mrs. Selena Taylor V. FINE REDUCTION REQUESTS CONTINUED A. Case No. 220128007; Perry Sylvester Arnold Jr., 620 Northeast 4th Avenue, Violation of Code of Ordinances Chapter 30, Sections 30-41 Disabled vehicles, 30-43 Public nuisances, 30-44 General cleaning and beautification. Chapter 82, Section 82-124 Permits (Exhibit 1). AS- violation of Chapter 30, Sections 30-41 Disabled vehicles for untagged vehicles, 30-43 Public nuisances for junk/debris covering the entire property and the exterior of the home in need of cleaning, 30-44 General cleaning and beautification for stack of lumber, tires, and electrical cords and Chapter 82, Section 82-124 Permits for two unpermitted structures. On July 26, 2022 property was inspected by Code Officer Smith and found to be in compliance. On August 23, 2022 Fine Reduction request received from the guardian of Mr. Arnold. On August 23, 2022 SOV/NOH mailed via USPS certified return receipt for the September 13th Hearing, received by Perry S. Arnold and Selena Taylor on August 26, 2022. On September 13, 2022 Case presented to the Special Magistrate; property owners guardian requested that the fine be dismissed due to special circumstances. The City recommended that the fine be reduced by 75 percent, plus a $50.00 administrative fee. Special Magistrate Azcona reserved ruling until on or before the next Hearing to review all evidence. On September 23, 2022 SOV/NOH mailed via USPS certified return receipt for the October 11 th Hearing, received by Perry S Arnold on September 30, 2022. On October 11, 2022, the case was presented to the Special Magistrate for ruling on fine reduction. The property owner's guardian provided the Adjudication as to Incapacity. The Special Magistrate reserved ruling to on or before the next Hearing to review all evidence. On October 24, 2022 SOV/NOH mailed via USPS certified return receipt to the property owner, the guardian, and the care giver for the November 8th Page 1 of 8 V. FINE REDUCTION REQUESTS CONTINUED A. On November 7, 2022 Code Officer Curl called Mrs. Pamela Arnold at 863-801-4643, she was advised that the November 8th Hearing had been cancelled due to an unforeseen emergency and that the next hearing would take place on December 13th at 6 pm and that an updated notice would be mailed to her. She provided her email: parnold863gmail.com. SOV/NOH and Hearing cancellation notice emailed to Mrs. Arnold. SOV/NOH and Notice of Hearing cancellation mailed via USPS certified return receipt to property owner, guardian, and caregiver for the December 13th Hearing. Received by Selena Taylor on November 10, 2022 and by Perry Arnold on November 16, 2022. The City is requesting the Special Magistrate's Fine Reduction ruling from the September 13th hearing be noted for the record. RA-Mr. Perry Arnold you are here, and you have some people here, okay that is Mr. Arnold, I will give you a status I have started an order I have reviewed everything you have gave me, I have reviewed the record, I am reviewing everything in this case, I am half way through the order, I have not issued it yet, should be done within the next few days, but I have just had some many surgeries since the last time I have seen you I have had at least two surgeries and with trial and my physical health it has not been so good and I could not finish it and I got backed up with trial and everything. I just wanted to let you know that I have absolutely have not forgotten about you, I will have an order soon definitely no later than by the end of the year. Are there any concerns about it PA-just waiting on the order RA-you will get it, since you are here, is there anything you would like to add or for me to consider in your case PA-there is something I would like to add RA-oh okay, go ahead PA-I know you are reviewing everything, and I would like to know if you have had the chance to review Judge White's order and all the medical reviews RA-I have PA-and that you are taking into consideration all the medical reviews and taking into consideration all these doctors spoke to him RA-sure, that is part of the order, and I am taking everything into consideration along with the testimony and the documents, I have reviewed everything it is just a matter of finalizing my order PA-and that their conversation with him was about five minutes when they made their decisions RA-sure PA-and I didn't know if you had a chance to review what they had to say and what Judge White had to say RA-I am taking into consideration the guardianship case, and the ruling of Judge White and every testimony that was presented in the case and every document that was submitted in the case including the guardianship situation and the findings okay PA-and are you taking into consideration everything that has happened after the fact RA-we have concluded that hearing and I will consider everything that was presented at the Hearings, so I will have that order soon, okay, alright, like I said I should have it within the next few days, I still have other things going on also, but I am optimal health right now, well the last few days since I had surgery. Case No. 220913009; Jeanel Jerome, Northwest 7th Street,Violation of Code of Ordinances Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification (Exhibit 2). AS-violation of Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification for having large piles of debris in the right of way and roadside, the entire length of the block. The respondent is not a repeat violator. The respondent was first notified on August 29, 2022 via Courtesy Card. On September 13, 2022 Code Officer Smith inspected the property; still non-compliant. On September 13, 2022, a SOV/NOH and photos were mailed via USPS certified return receipt for the November 8th Hearing. The notice was received by Jeanel Jerome on September 20, 2022. RA-okay, Mr. Hyden is there anything else you would like to add sir GH-no sir RA-Mr. Smith I see your packet presented with exhibits for this particular case, the pictures taken; you took these photos Mr. Smith AS-yes, they were RA-are the dates that appear on them represent the date the pictures were taken AS-yes, it is RA-and do these pictures accurately represent the condition of the property at the time they were taken AS-yes, they do RA-okay, I will make a finding in the case of the City of Okeechobee vs. Jeanel Jerome, Case #220913009; I will make a finding based on the testimony of the certified Code Enforcement Officer Mr. Smith and the exhibits presented at this Hearing that the respondent in this case are in in violation of Chapter 30, Section 30-43 Public nuisances for having large pile of debris in the right-of-way and along the roadside the entire length of the block and, Chapter 30, Section 30-44 General cleaning and beautification there is certainly more than sufficient facts to establish the violations in this case, in review of the exhibits in this case there is factual basis I can see a lot of debris, I can see pictures of cut up trees and debris that is unsightly on the side of the road so there is sufficient factual basis for the code enforcement violation in this case. What is the City's recommendation for this case Mr. Smith AS-no action be taken at this time just be noted for the record to have been in violation of Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification RA-okay, anything else Mr. Hyden GH-no sir RA-okay so based on the City's recommendation I find that it is reasonable, and I will follow the city's recommendation in this case and no action will be taken at this time, but it will be noted for the record that the respondents in this case was in violation of Chapter 30, Sections 30-43 Public nuisances, 30- 44 General cleaning and beautification B. Case No. 220913011; Ernesto Ramirez, Northwest 7th Street, Violation of Code of Ordinances Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification (Exhibit 3). AS-violation of Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification for having large piles of debris in the right of way and roadside the entire length of the block. On October 22, 2022 Code Officer Curl inspected the property, the large piles of debris have been removed, in compliance, case closed. The City recommends no action on this matter, but request it be noted for the record to have been in violation of Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification RA-anything else you would like to add Mr. Hyden for the City GH-no sir RA-okay, based on the testimony of the certified Code Enforcement Officer for the City I will make a finding in the case of the City of Okeechobee vs. Ernesto Ramirez, Case #220913011, I will make a finding based on the testimony of the certified Code Enforcement Officer Mr. Smith and the exhibits presented at this hearing that there is sufficient factual basis for the allegations of the code violations in this case I would like to ask, Mr. Smith I see that these pictures in support of the violations in this case did you take the pictures AS-yes, I did RA-okay and these pictures accurately represent the conditions of the property at the time they were taken AS-yes, and also Code Officer Curl took the photos on October 22, 2022 Pape 3 of 8 VI. CONTINUED: RA-okay on those bases I will make a finding that there is sufficient factual bases along with the testimony and the exhibits presented to support the violation and I will find that in this particular case even though the property owners did come into compliance they were in violation prior to coming into compliance, in the case of the City of Okeechobee vs. Ernesto Ramirez, Case #220913001 that they were in violation of Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification, I will also make a finding in this case for the record including the previous case Jeanel Jerome there was sufficient notice to the property owner of the violation and they did correct the violations in this case. What is the City's recommendation in this case Mr. Smith AS-The City recommends that no action be taken on this matter, but request it be noted for the record to have been in violation of Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification RA-okay, Mr. Hyden is there anything you would like to add sir GH-no sir RA-based on the City's recommendation and the representation of council and the certified code enforcement officer I will follow the recommendation in this case that no action be taken on this matter, but it will be noted that the respondents were in violation prior to coming into compliance in this case C. Case No. 221020010; Zaben Omar Nafal (La Placita Supermarket), 1002 Northwest Park Street, Violation of Code of Ordinances Chapter 50, Sections 50-91 Levied, 50-94 Duty of seller as to collection of tax; failure of purchaser to pay bill (Exhibit 4). AS-violation of Chapter 50, Sections 50-91 Levied for tax collected on the sale of propane gas, 50- 94 Duty of seller as to collection of tax for failure of purchaser to pay bill for delinquent Utility Taxes. The respondent is not a repeat violator. The respondent was first notified on March 15, 2022 via Courtesy Letter. On July 28, 2022 the second delinquency letter was mailed via regular mail from City Hall. On October 18, 2022 Code Officer Curl received an email from the City of Okeechobee Account Supervisor Melissa Henry stating that La Placita Supermarket had not paid their Utility Taxes since June and they are delinquent from July—October. She provided the two Courtesy letters that were mailed with no response. On October 20, 2022 Code Officer Smith hand delivered a SOV/NOH to Omar Nafal. On October 24, 2022, an email from Mrs. Henry stating that the delinquent utility taxes were paid on Friday October 21, 2022. Case closed. The City recommends no action on this matter, but request it be noted for the record to have been in violation of Chapter 50, Sections 50-91 Levied, 50-94 Duty of seller as to collection of tax. RA-Mr. Smith the exhibits that are attached to the alleged violation in this case these are all and accurate representations of the letters that were sent to the respondent in this case AS-yes, they are RA-okay, Mr. Hyden is there anything you would like to add GH-no sir RA-okay I will make a finding in this case of the City of Okeechobee vs. Zaben Omar Nafal (La Placita Supermarket) Case #221020010; that the respondents in this case were cited for violation of Chapter 50, Sections 50-91 Levied for tax collected on the sale of propane gas, 50-94 Duty of seller as to collection of tax for failure of purchaser to pay bill for delinquent utility taxes. I have examined the exhibits in this case and together with the testimony of the certified code enforcement officer I will make a finding in this case that the respondents in this case were in violation and they were also properly notified via normal channels of communication email and written letters to the owners of the La Placita Supermarket and they responded and corrected the matter and as of October 24, 2022 the respondent in this matter did come into compliance and the case was closed as of October 24, 2022 as the taxes were paid and what is the City's recommendation Mr. Smith AS-no action on this matter, but request it be noted for the record to have been in violation of Chapter 50, Sections 50-91 Levied, 50-94 Duty of seller as to collection of tax RA-Mr. Hyden is there anything else you would like to add on behalf of the City of Okeechobee GH-no sir RA-okay, so based on the recommendation of the city and the council for the City of Okeechobee I will make a finding that there is sufficient factual basis in this case and that the respondent was in violation and even though they have come into compliance it will be noted for the record that they were in violation in this matter from when they were first notified on March 15, 2022 until the Paae 4 of 8 VI. COMPLIED CASES CONTINUED C. CONTINUED: case was closed on October 24, 2022, no action will be taken at this time, but it will be noted D. Case No. 220908008; Ida Harrell, 1706 Southwest 2nd Avenue, Violation of Code of Ordinances Chapter 30, Sections 30-40 Junk, 30-43 Public nuisances, 30-44 General cleaning and beautification (Exhibit 5). AS-violation of Chapter 30, Sections 30-40 Junk for having a washer and a grill in the middle of the yard, 30-43 Public nuisances for having debris all over the property, 30-44 General cleaning and beautification for overgrown grass, weeds, bushes, and shrubs. The respondent is not a repeat violator. The respondent was first notified on August 23, 2022 via Courtesy Card. On September 8, 2022 Code Officer Smith inspected the property, non-compliant. A SOV/NOH and photos were mailed via USPS certified return receipt for the October 11th Hearing. The notice was returned on October 18, 2022. On September 13, 2022 Property owner Dena Villarreal called and stated that she had moved the washing machine and grill, and the grass had been mowed. She also asked about what else needed to be done and if a hearing had been scheduled. Code Officer Curl advised her on what needed to be done to bring the property into compliance and that the Hearing was scheduled for October 11th at 6:00 pm. On September 22, 2022 Code Officer Smith inspected the property, still non-compliant. On October 5, 2022 Code Officer Smith/Curl inspected the property, still non-compliant. On October 6, 2022 Dena Villarreal called in (863) 801-6342 and spoke with Code Officer Smith advised that she had begun addressing the violations and she wanted to know what else she to do to bring the property into compliance. I advised her to cut back and shape the large shrub in the front yard and remove all the items from the front and side of the property. I also advised her how much time she had to bring the property into compliance before fines start to accrue. On October 11, 2022, the Case presented to the Special Magistrate, found in violation of Chapter 30, Sections 30-40 Junk, 30-43 Public nuisances, 30-44 General cleaning and beautification. A fine of $50.00 per day to begin 21-days after the date of the Special Magistrate Hearing on October 11, 2022, unless the property owner brings the property into compliance on or before that date, plus a one-time $50.00 administrative fee imposed. Fine accrual will begin on November 1, 2022. On October 18, 2022, Lien/Order mailed via USPS certified return receipt. On October 24, 2022, Code Officer Curl received a call from Dena stating that she would like an inspection done to see what else she needs to be done. Code Officer Smith inspected the property: in compliance, Case Closed. On October 28, 2022, Code Officer Curl received a call from Dena inquiring about the status of the inspection. I advised her that Code Officer Smith inspected the property on October 24th, and he put the property into compliance and closed the case. The City recommends no action on this matter, but request it be noted for the record to have been in violation of Chapter 30, Sections 30-40 Junk, 30-43 Public nuisances, Section 30-44 General cleaning and beautification. RA-Code Officer Smith I see that there is a lot of exhibits presented here with this case, I believe we already made a finding on this case AS-yes sir RA-alright, what is the City's recommendation on this matter AS-the City recommends no action on this matter, but request it be noted for the record to have been in violation of Chapter 30, Sections 30-40 Junk, 30-43 Public nuisances, 30-44 General cleaning and beautification RA-alright, Mr. Hyden anything else you would like to add on behalf of the City GH-no sir RA-okay, Thank you Mr. Hyden. I will follow the recommendation of the City and the representation of council in this case the respondent was already found in violation even though they did come into compliance in this case prior to the beginning of the fine we will note for the record that they were in violation, and they were properly notified and they responded and fixed the property coming into compliance I will take no further action based on the recommendation of the City E. Case No. 220812010; Robbie L. Melear and Tammy L. Jordan, 1004 Northwest 6th Street, Violation of Code of Ordinances Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification, International Property Maintenance Code (IPMC) Chapter 3, Section 304.1.1 Unsafe conditions (Exhibit 6). AS-violation of Chapter 30, Sections 30-43 Public nuisances for overgrown vegetation all over the Paae 5 of 8 VI. COMPLIED CASES CONTINUED E. CONTINUED: property, 30-44 General cleaning and beautification for the property and structure in need of cleaning and upkeep. IPMC Chapter 3, Section 304.1.1 Unsafe conditions for a hole in the roof and unsecured structure. The respondent is not a repeat violator. The respondent was first notified on July 28, 2022 via Courtesy Card. On August 11, 2022 Code Officer Smith inspected the property, still non-compliant. On August 12, 2022, a SOV/NOH and photos mailed via USPS certified return receipt for the October 11th Hearing. The notice was returned/unable to forward on August 23, 2022. On August 22, 2022 Building Official Jeff Newell completed an inspection and provided photos and tax lien documentation. On August 25, 2022 Code Officer Smith posted a Notice to Appear at the property and City Hall for the September 13th Hearing. On September 6, 2022 Code Officer Smith inspected the property, still non-compliant. On September 13, 2022, the case was presented to the Special Magistrate, found in violation of Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification and IPMC Chapter 3, Section 304.1.1 Unsafe conditions. A fine of $50.00 per day, to begin 21 days after the date of the Special Magistrate Hearing, unless the property owner brings the property into compliance on or before that date, plus a one-time administrative fee of $50.00 imposed. Fine accrual will begin on October 4, 2022. On September 19, 2022 Code Officer Smith posted the Lien/Order at the property and City Hall. On September 22, 2022 Lien/Order was mailed via USPS certified return receipt. The lien/order was returned/unable to forward on October 2, 2022. On October 4, 2022 Code Officer Smith inspected the property: still non-compliant, Recorded Lien/Order at the Okeechobee County Clerk of Court. File # 2022013046 Fine accrual of $50.00 per day plus a $50.00 administrative fee to begin on October 4, 2021. On October 5, 2022 Code Officer Smith posted the lien/order at the property and City Hall. On October 27, 2022 Jason Tomlinson, stopped by the office and stated that he just purchased the property at auction and will be bringing it into compliance this weekend. On October 31, 2022 Code Officer Smith inspected the property: still non-compliant, photos in file. There has been major progress made at this time however the roof and the boarding up of the home still remains. On November 7, 2022, Code Officer Smith inspected the property: in compliance, photos in file. The roof has been blue tarped, and all the windows and doors have been secured. With the previous corrections and the corrections made today the property is in compliance. On November 23, 2022 Trustee's Deed recorded transferring ownership to Orion of America LLC, 650 NE 2nd Avenue, Apt. 2611, Miami, FL. 33132. The City request it be noted for the record that the property was brought into compliance on November 7, 2022. Leaving a fine balance of $1650.00 plus administration fee of$50.00 totaling: $1700.00. RA-okay, Mr. Hyden anything else you would like to add on behalf of the City GH-no sir RA-I have a quick question, the fine balance in this case is $1,650.00 how did you compute that AS-it started accruing $50.00 a day on October 4th and came into compliance on November 7th RA-how many days all together AS-how many days all together that would be thirty something RA-so the fine was $50.00 per day AS-yes it was RA-times how many days CC-there is a sheet in there that shows how we computed it AS-yes, a fine accrual sheet RA-oh there is CC-it should be at the very end of it RA-oh I missed that one, oh okay, so I see that did you prepare this calculation AS-no Code Officer Curl did RA-how did you prepare this Mrs. Curl CC-take the number of days and times it by the daily fine amount, which is fifty dollars a day RA-and how many days all together was this place not in compliance and fined $50.00 a day CC-I would have to look at the sheet AS-it was 33 days RA-so if you take 33 days and times it by $50.00 you end up with $1,650.00 CC-yes RA-okay sounds good, that is good enough for me. I will make a finding on this case that the property was already found in violation and a lien/order was issued and it was properly received, and the certified Code Enforcement Officer did get in touch with the person who purchased the property and Paae 6 of 8 VI. CONTINUED: it has come into compliance and the city's recommendation in this case is reasonable under the circumstances and based upon the calculation on what was previously order of the fine and the number of days they were not in compliance after the finding in the previous hearing there is still a fine balance of 1,650.00 plus a $50.00 administrative fee so there is an existing fine balance of $1,700.00 in this case. Case #2208120010, City of Okeechobee vs. Robbie Lee Melear and Tammy Lynn Jordan. F. Case No. 221027007; Rafael and Glorybee Corona, Southeast 10th Avenue, Violation of Code of Ordinances Chapter 54, Section 54-51 Parking in residential neighborhoods (Exhibit 7). AS-violation of Chapter 54, Section 54-51 Parking in residential neighborhoods for several commercial semitrucks being parked on residential property for extended period of time. The respondent is a repeat violator. The respondent was first notified on October 27, 2022 by SOV/NOH mailed via certified return receipt. On October 31, 2022 Code Officer Smith inspected the property, still non-compliant. On November 2, 2022 Code Officer Curl returned Mrs. Glorybee Corona call, and she was advised on what needed to be done to bring the property into compliance. She asked if there was any way for them to keep the semis on the property, she was advised the only one for them to remain on the property was for them to be parked within an enclosed garage and she would need to obtain permits to build the garage. She was also advised not to contact any code officer via their personal social media or personal phones that all contact should be made during business hours on business phones or emails. On November 3, 2022 Code Officer Smith received an email from Mrs. Corona stating that they are working on getting the semis moved and will hopefully have that done by Saturday. On November 7, 2022 SOV/NOH and November 8th Hearing cancellation notice emailed to Mrs. Corona. SOV/NOH for the Dec 13th Hearing and the November 8th hearing cancellation notice mailed via USPS certified return receipt. The notice was received by Jorge Rodriguez on November 10, 2022. On November 17, 2022 Code Officer Smith inspected the property: in compliance, photo in file. Case Closed. The City recommends no action on this matter, but request it be noted for the record to have been in violation of Chapter 54, Section 54-51 Parking in residential neighborhoods. RA-Mr. Smith there are exhibits attached, you took these photos AS-yes RA-and these pictures accurately represent the conditions of the property on the date they were taken AS-yes, they do, also Code Officer Curl took pictures as well RA-okay, anything else you would like to add Mr. Hyden on behalf of the City GH-no sir RA-okay so I will make a finding in this case of the City of Okeechobee vs Rafael and Glorybee Corona, Case #221020010 based on the testimony of the certified Code Enforcement Officer Mr. Smith and the exhibits presented at this hearing in this case that there here is sufficient factual basis for the allegations of code violation in this case and I can see that in the pictures that there is a big semitruck parked in there and based off the pictures and the code enforcement officer big commercial semitrucks should not be parked in residential neighborhoods and I will also make a finding the respondents were properly notified and they did take the proper course of action and did correct the problem even though they came into compliance we will note for the record that they already have a prior violation even though they have a prior violation the City still recommends in this case that it be noted for the record and no further action be taken on this matter.
