V. NEW BUSINESS
A. Site Plan Review Application No. 22-002-TRC, to construct a 44-unit, multifamily
residential development on 4.24 acres located at 309 NE 4th Street, Lots 1 through 12,
Block 110 and 121, CITY OF OKEECHOBEE, PBS 1 and 5, PGS 10 and 5, Public
Records of Okeechobee County.
1. City Planning Consultant Mr. Ben Smith of Morris-Depew Associates, Inc. briefly
reviewed the Planning Staff Report. The subject site is located on two city blocks,
separated by NE 4th Street, with each block proposed as a separate development phase.
In addition to the 44 dwellings units, the Applicant is proposing storage facilities on both
parcels, and a pool and office building on the southern parcel.

needed from Okeechobee Utility Authority (OUA). Regarding solid waste disposal, site

These should be provided in appropriate locations which allow for access by Waste
Management and provision of screening.
The Applicant has provided a traffic analysis prepared by Mackenzie Engineering &
Planning, Inc. which demonstrates available roadway capacity for 42 dwelling units.
Though this is less than the 44 units that the Applicant is proposing, the traffic report is
appropriate as 44 dwelling units exceeds the allowable density of the site.
Regarding access and internal circulation, site plans for both parcels are designed with
throughway access bisecting the middle of the blocks. This configuration is optimal as
the access points are mid -block and ingress/egress is available on either roadway.
Internal circulation of the residential component is sufficient. However, vehicular access
areas are proposed on both parcels for the storage buildings which seem excessively
wide (80 to 93 ft). These features reduce the landscape buffering and create an
unorganized and potentially unsightly curb cut. Redesign of these features should be
considered, as it out of place for a storage amenity that will be utilized only by the
residents of this development. Sufficiency of fire truck access and egress needs to be
addressed by the Fire Department.
The plans depict one dedicated loading space for each parcel. However, only the
absence of wheel stops seems to indicate that the area in front of these spaces should
not be utilized for standard parking spaces. These areas in front of loading spaces
should be marked with striping to denote `no parking' to ensure loading spaces are
clearly evident. Loading spaces cannot be obstructed.

No dumpster enclosure is depicted on the site plans. The Applicant should demonstrate
a proposed location for waste storage that will comply with Waste Management pickup
standards.
The proposed use is consistent with the Comprehensive Plan and the zoning code and
is compatible with surrounding uses. Multifamily in this location provides a transition
between high intensity commercial property to the West and the low density residential
to the East; and should not be detrimental to the adjacent church properties. The
development provides moderate density housing options in close proximity to US 441
corridor and downtown Okeechobee, which will provide support for the existing
commercial in this area.
The dimensional standards review appears to meet the requirements of the City's Land
Development Regulations (LDR's) except for the following: commercial public use of the
amenities cannot be permitted; plans depict 22 dwelling units on both parcels, though

large enough for 21 dwelling units; Northern parcel only provided with 20 ft setback from

proposed around the parking area; no fencing proposed at this time although plans must
demonstrate compliance with pool barrier requirements; and no connections provided

6.6.4 Types III, IV, or V Construction.
In buildings of Type III, Type IV, and Type V construction, fire walls shall be permitted to terminate at the
underside of roof sheathing or deck in accordance with 6.6.4.1, 6.6.4.2, or 6.6.4.3.
6.6.4.1
Fire walls shall be permitted to terminate at the underside of roof sheathing or deck, provided that all of
the following criteria are met:
(1) The roof assembly within 48 in. (1220 mm) of each side of the fire wall is of fire retardant —
treated wood.
(2) The roof is provided with not less than a Class B roof covering.
(3) Openings in the roof are not located within 48 in. (1220 mm) of the fire wall.
6.6.4.2
Fire walls shall be permitted to terminate at the underside of the roof sheathing, where the roof
sheathing or deck is constructed of approved noncombustible or limited -combustible materials or of fire
retardant —treated wood for a distance of 48 in. (1220 mm) on both sides of the wall.
6.6.4.3
Fire walls shall be permitted to terminate at the roof sheathing or deck, provided all of the following
criteria are met:
(1) The underside of the roof sheathing or deck is protected with 5/8 in. (16 mm) Type X gypsum
board applied directly beneath the underside of the roof sheathing or deck.
(2) The Type X gypsum board is supported by a minimum of 2 in. (51 mm) ledgers attached to the
sides of the roof framing members.
(3) The Type X gypsum board is applied on both sides of the fire wall for a minimum distance of 48
in. (1220 mm) on both sides of the fire wall.
(4) Openings in the roof are not located within 48 in. (1220 mm) of the fire wall.
(5) The roof is covered with a minimum Class C roof covering.
2. The fire wall must extend a minimum of 18 inches beyond the exterior wall.
There may not be any openings in the exterior wall within 48 inches of the fire
wall on either side. If there are overhangs or balconies, the fire wall must
extend to the outer edge of them.
6.9.1 Horizontal Termination of Fire Walls.
6.9.1.1 Fire walls shall be continuous in one of the following situations:
(1) From exterior wall to exterior wall and extending at least 18 in. (455 mm) beyond the exterior
surface of exterior walls
(2) From an exterior wall extending at least 18 in. (455 mm) beyond the exterior surface of exterior walls to a
fire wall with the same fire resistance rating
(3) From fire wall to fire wall, with the same fire resistance ratings
6.9.1.2 Fire walls shall be permitted to terminate at the interior face of exterior sheathing, siding, or
other exterior finishes where the exterior sheathing, siding, or other exterior finishes are
noncombustible or limited combustible and
6.9.2 * Horizontal Projecting Elements.
Fire walls shall extend to the outer edge of horizontal projecting elements such as balconies, roof
overhangs, canopies, marquees, and architectural projections that are within 48 in. (1220 mm) of the
fire wall, unless otherwise permitted by 6.9.2.1, 6.9.2.2, or 6.9.2.3.
6.9.2.1 Fire walls shall not be required to extend to the outer edge of horizontal projecting elements without
concealed spaces where both of the following conditions are met:
(1) The exterior wall behind and below the projecting element has not less than a 1-hour fire resistance
rating for a distance not less than the depth of the projecting element on both sides of the fire wall.
(2) Openings within such exterior walls are protected by assemblies having a fire protection rating of not less
than % hour.
6.9.2.2 Fire walls shall not be required to extend to the outer edge of noncombustible horizontal projecting
elements with concealed spaces where all of the following conditions are met:
(1) A wall having a fire resistance rating of not less than 1-hour extends through the concealed space.
(2) The projecting element is separated from the building by construction having a fire resistance rating of
not less than 1 hour for a distance on each side of the fire wall equal to the depth of the projecting
element.
(3) Openings within such exterior walls are protected by assemblies having a fire protection rating of not less
than 3/4 hour.
6.9.2.3 Fire walls shall not be required to extend to the outer edge of combustible horizontal projecting elements
with concealed spaces where all of the following conditions are met:
(1) The fire wall extends through the concealed space to the outer edges of the projecting elements.
(2) The exterior wall behind and below the projecting element has a fire resistance rating of not less than 1
hour for a distance not less than the depth of the projecting elements on both sides of the fire wall.
Trees, shrubbery, and other landscaping must allow for firefighters to access all
sides of the building and to advance hose to those locations.

Fire department access roads shall be provided such that any portion of the facility or any portion of an
exterior wall of the first story of the building is located not more than 150 ft (46 m) from fire
department access roads as measured by an approved route around the exterior of the building or
facility.
The size of the buildings, and the fact that they are not sprinklered, will require
a fire flow of 1750 gpm. This will require two hydrants, one at the north
entrance and one at the south. The distance from the hydrant to the building
limits the flow it can be credited with.
18.4.5.3 Buildings Other Than One- and Two -Family Dwellings.
18.4.5.3.1
The minimum fire flow and flow duration for buildings other than one- and two-family dwellings shall be
as specified in Table 18.4.5.2.1.
18.4.5.3.2
Required fire flow shall be reduced by 75 percent when the building is protected throughout by an
approved automatic sprinkler system. The resulting fire flow shall not be less than 1000 gpm (3785
L/min).

The maximum fire flow capacity for which a fire hydrant shall be credited shall be as specified by Table 18.5.4.3.
Capacities exceeding the values specified in Table 18.5.4.3 shall be permitted when local fire department operations
have the ability to accommodate such values as determined by the fire department.
