CALL TO ORDER Special Magistrate Azcona called the Code Enforcement Special Magistrate Hearing to order on Tuesday, August 9, 2022, at 6:00 P.M. in the City Council Chambers, located at 55 Southeast V Avenue, Room 200, Okeechobee, Florida. The Pledge of Allegiance was led by Special Magistrate Azcona. II. ATTENDANCE Assistant Code Enforcement Officer Christina Curl called the roll. Special Magistrate Roger Azcona, Esquire, City Attorney Greg Hyden, Code Enforcement Officer Anthony Smith were present. III. CHANGES TO AGENDA Special Magistrate Azcona asked whether there were any agenda items to be added, deferred, or withdrawn; there were none. IV. APPROVAL OF MINUTES AND ADMINISTRATION OF OATH A. Special Magistrate Azcona approved the July 12, 2022, Hearing Minutes. B. This being a Quasi -Judicial proceeding, Special Magistrate Azcona collectively administered an Oath to: Code Officers Smith, Curl, and Ms. Ruby Minton; all affirmed. Code Officer Smith stated for the record all events regarding the Cases to be discussed occurred within the corporate limits of the City of Okeechobee. The Officer's notes, testimony, photographs, and support documents were all entered as part of the official record. V. FINE REDUCTION REQUESTS A. Case No. 220222009; Freddie L. and Ruby L. Minton, 302 Northeast (NE) 8th Avenue (Ave) [Legal Description: Lot 17, RIVER RUN RESORT, Plat Book (PB) 6, Page (PG) 18, Okeechobee County (CO) public records]. Code Officer Smith testified that the property was found in violation of Code of Ordinances Chapter 30, Sections 30-41 Disabled vehicles, on April 12, 2022, where a fine in the amount of $50.00 per day starting 21-days after the date of the Hearing, plus a one-time $100.00 administrative fee was imposed. The imposed fine began accrual on May 3, 2022. The property was brought into compliance on May 23, 2022. Ms. Minton submitted a request for fine reduction on June 8, 2022. The City recommends a fine reduction of 50 percent, plus a $100.00 administrative fee. Based on the evidence provided, Special Magistrate Azcona ruled to reduce the fine by 50 percent and an additional $200.00, plus a $100.00 administrative fee. A payment plan of $50.00 a month due on the 5th of each month was granted. VI. COMPLIED CASES A. Case No. 220601006; Yolanda Maby Cuevas, 704 Southwest (SVN) 6th Street (St) [Legal Description: commencing at the NE corner of Block 191, OKEECHOBEE, according to the plat thereof recorded in PB 5, PG 5, public records of Okeechobee CO, Florida (FL), thence run South (S) along the East (E) Boundary Line (BL) of said Block 191 and the West (W) right-of-way (ROW) line of SW 7th Ave (Okeechobee Ave) for a distance of 300.10-feet (ft) to a point on an extension (POE) W of SW 6th St (3rd St); thence run W along said extension of SW 6th St for a distance of 200.00-ft for a point of beginning (POB); thence continue W along the North (N) BL of SW 6th St a distance of 50.00-ft; thence run N parallel with the W ROW line of SW 7th Ave a distance of 76.17-ft; thence run E parallel with the N ROW line of SW 6th St a distance of 50.00-ft; thence run S a distance of 76.17-ft to the POB lying in and comprising a part of the abandoned FL E Coast Railroad (RR) ROW and S Curve St, and commencing at the NE corner of Block 191, according to the plat thereof recorded in PB 5, PG 5, thence run S along the E BL of said Block 191 and the W ROW line of SW 7th Ave for a distance of 223.93-ft for POB; thence continue South along said E BL of Block 191 and the W ROW line of SW 7th Ave for a distance of 76.17- ft to a POE W of SW 6th St; thence run W along said extension of SW 6th St for a distance of 200.00-ft; thence run N parallel with the W ROW line of said SW 7th Ave for a distance of 76.17- ft; thence run E for a distance of 200.00-ft to the POB. Case No. 220601005; Grand Lake Investments Inc, NW 5th St [Legal Description: Lots 20,21, and W half of Lot 22 of Block 99, CITY OF OKEECHOBEE, PB 5, PG 5, Okeechobee CO public records]. Code Officer Smith testified that the property is in violation of the Code of Ordinances Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification for a vacant lot with overgrown grass, and weeds. The respondent is not a repeat violator. A Courtesy Card was mailed via USPS regular mail on May 11, 2022. The property was inspected and found to be non -compliant on May 31, 2022. A Statement of Violation/Notice of Hearing was mailed via USPS certified return receipt on June 1, 2022. The notice was returned unclaimed/unable to forward on June 27, 2022. A Notice to Appear was posted on the property and on the public notices board at City Hall on June 28, 2022. The property was inspected and found to be non -compliant on June 28, 2022, July 18, 2022, and August 2, 2022. To comply with City Ordinances the property owner needs to cut the overgrown grass and weeds. The City recommends a fine of $50.00 per day, to begin 21-days after the Special Magistrate Hearing on August 9, 2022, unless the property owner brings the property into compliance on or before that date, plus a $50.00 administrative fee. Based on the evidence provided, Special Magistrate Azcona found Case No. 220601005 to be in violation of Code of Ordinances Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification and imposed a fine of $50.00 per day plus a one-time administrative fee of $50.00 should the property fail to come into compliance within 21-days after the date of this Hearing. Vill. DELINQUENT BUSINESS TAX RECEIPTS A. Case No. 220630012; Rene Rimes, 105 SW 3Id Ave [Legal Description: Lots 4,5,6 of Block 168, OKEECHOBEE, PB 5, PG 5, Okeechobee CO public records]. The respondent is a repeat violator, Case #210519011. The respondent was first notified on February 22, 2022 via SOV/NOH, received by Ruby Minton on February 26, 2022. On April 12, 2022 Case presented to the Special Magistrate, found in violation of Chapter 30, Section 30-41 Disabled vehicles. A fine of $50.00 per day, to begin 21 days after the date of this Hearing, unless the property owner brings the property into compliance before that date, plus a $100.00 administrative fee. On May 23, 2022 Code Officer Smith inspected the property: in compliance, removed the disabled vehicle and registered the other. Photos in file. On June 1, 2022 Compliance Letter and Fine Reduction Request form mailed via USPS certified return receipt, received by Ruby Minton on June 6, 2022. On June 6, 2022 Mrs. Minton called in and spoke to Code Officer Smith and asked how her fine went up to $1,100.00. I Code Officer Smith explained that the fine started on May 3, 2022 and ran up to May 23, 2022 and $100.00 administration fee. She claimed that she was told that the fine was 700.00 dollars a few days ago. She was advised that she should fill out the fine reduction form and turn it in to get her scheduled for next hearing. On June 8, 2022 Ruby Minton came into the office and dropped off the Request for Fine Reduction. Code Officer Curl advised her that she would receive a notice in the mail of when the reduction would be heard in front of the Special Magistrate. On June 8, 2022 SOV/NOH mailed via USPS certified return receipt for the August 9th Hearing, received on June 13, 2022, signature not legible. The City recommends a fine reduction of 50% plus a $100.00 administrative fee, reducing the fine from $1,000.00 to $500.00 plus the $100.00 administrative fee, totaling $600.00 RA -okay, Ms. Minton do you understand how the fines accrued in your case RM-yes, I do RA -okay so since there was a finding of violation and there was a fine ruled by this Hearing that after 21-days from the date and that was May 31 that a fine of $50.00 per day was going to accumulate plus a $100.00 administrative fee. My understanding is that on May 23d the property was corrected, and we do appreciate that you were able to correct that, so the total fine in this case was $1,100.00 but Code Enforcement is agreeing to reduce your fine by 50% and now it is only $600.00, 1 understand that you complain as to why your fine has gone up but the City is recommending that your fine be reduced by 50% do you have any further objection besides that RM-my only concern that I have is that the truck was moved on the 19th and they have it marked as the 23rd- but that truck was moved on the morning of the 19th RA -okay RM- I do have neighbors up and down the street that can verify to that, if need be, I don't feel that I should be charged for those days RA -okay so you are saying that the vehicle was moved on the 19th RM-yes RA -did you call code enforcement right after it was moved RM-1 spoke to him about that RA -okay I am going to give Mr. Smith an opportunity to respond to that AS-1 spoke to her after the fact I think she really spoke to Code Officer Curl and Code Officer Curl let me know to go check it when I came back to work on the 23rd, I believe she called on Friday if I am not mistaken, I am off work on Fridays, so I came and checked it on Monday RA -it looks like you fined her till May 231d did you make an adjustment for that or are you still asserting that it was not in compliance until May 23rd AS-1 can't say if it was in compliance on the 19th because I did not go inspect it on the 19th I did not go until the 23rd RA -when were you made aware that the respondent was in compliance AS -on May 23 rd, that Monday when I got to work RA -so you were not made aware until May 23rd AS-1 did not find out about it until the 23rd as I was off Page 2 of 7 V. CONTINUED: RA -okay AS -they called on a Friday when I was off, I was unable to go check until the 231 RA -okay I am going to ask the City Attorney, Mr. Hyden is there anything you would like to add on behalf of the City GH-just a quick question, the fee and fine reduction is constant with the City's policies correct AS -yes, that is correct GH-nothing further RA -okay, thank you Mr. Hyden. Ms. Minton you are saying the vehicle was removed on the 19th RM-yes sir RA -okay you said the vehicle was removed on the 19th that would reduce the fine by how much Mr. Smith AS-$100.00 RA -by a $100.00, okay AS -yes RA -okay would the City be willing to AS -I'm sorry it would be $200.00 wouldn't it, four days correct at $50.00 a day RA -yes and if we reduced that by 50% AS -that would be $400.00 plus the $100.00 administrative fee RA -correct, so if we take that into consideration Ms. Minton that it was corrected on the 19th and still adding the 50% reduction you would have objection if the fine was reduced to $500.00. Would that be fair to you, I mean the City has already bending backwards to reduce it by 50% and giving the credit that the violation was corrected on the 19th RM-yes if I can get payments RA -how long will it take you to pay $500.00 Ms. Minton to satisfy the fines in this case RM-I probably can't do payments over $50.00 maybe $60.00 a month as I only receive Social Security each month RA -I don't know if we can bring it down that far Ms. Minton. Mr. Smith what is the lowest amount of payment that the City is willing to go down to AS-1 don't have a number, I am fine with $50.00 a month I don't have a problem with it, it will just take a while RA -okay RM-if I see that I can pay more I will RA -can you pay at least $60.00 a month or $50.00 a month RM-I will pay $50.00 a month and if I can see that I can pay $60.00, 1 will pay $60.00 RA -okay so you can pay at least $50.00 a month and if you have more you will pay more RM-yes sir RA -will you be able to pay that consistently for the next ten months RM-yes sir, I hope I can get it paid off RA -alright so the City is okay with it AS-1 am fine with it RA -okay Mr. Hyden as the attorney for the City are you okay with it GH-I am not going to veto Code Officer Smith RA -okay Mrs. Curl you can make the arrangement for that CC -yes RA -I just want to make sure the Code Enforcement Office is able to make arrangements to accept payment from Ms. Minton CC -I will send you an agreement in the mail that is typed up for you sign and to send back to me Ms. Minton RM-okay so when will you be able to make your first payment Ms. Minton RM-all my bills have been paid and I only have $100.00 in the bank so it will have to start next month RA -okay so your first payment will be due September 1 st or August 30th RM-I don't get paid until the V so maybe around the 4t' or 5th Page 3 of 7 V. AS -violation of Chapter 30, Sections 30-40 Junk, 30-41 Disabled vehicles, 30-43 Public nuisances, 30-44 General cleaning and beautification for an engine block and car parts all over the front yard, several untagged/disabled vehicles and overgrown grass and weeds. The respondent is not a repeat violator. The respondent was first notified via Courtesy Card on May 11, 2022. On May 20, 2022 Code Officer Curl received a call from the tenant Steven Jackson, he stated that he could be reached at 772-713-1181 and that the landlord got the grass and weeds cut and that the vehicles parked along the side of the yard are not disabled they are just untagged. He also stated that he would hopefully have the engine put back in his truck this weekend and be able to clean up the front porch and yard. Mr. Jackson was advised to clean up and organize the debris/junk around the yard and to keep the grass and weeds cut and that we would allow his more time to get all the vehicles insured and tagged as long as we can see progress being made. On May 31, 2022 Code Officer Smith inspected the property: non-compliance. On June 1, 2022 SOV/NOH mailed via USPS certified return receipt for the August 9th Hearing, received by Maby Cuevas on June 9, 2022. On June 22, 2022 Code Officer Smith received a call from the property owner who stated that the tenant was working on getting the property into compliance and it would be ready for inspection on Monday 27th of June for inspection. On June 28, 2022 Code Officer Smith inspected the property: still non -compliant. On July 18, 2022 Code Officer Smith inspected the property: in -compliance. Photos in file. The City recommends no action on this matter, but request it be noted for the record to have been in violation of Chapter 30, Sections 30-40 Junk, 30-41 Disabled vehicles, 30-43 Public nuisances and 30-44 General cleaning and beautification. My examination of the exhibits in this case show there are several vehicles parked against the fence and it looks like they are disabled and they have not moved for at least several months it looks like they have been there for a while there is overgrown grass all around the vehicles and I am not seeing any tags on the vehicle they look disabled and just parked there, some of the hoods are open and in these pictures dated it looks like there is plenty of factual bases for these allegations I see plenty of overgrown weeds and I also see an engine block that is kept in the property and I will also make a finding the respondent was properly notified via Courtesy Card on May 11, 2022 which gave the respondent in this case plenty of opportunity to correct the situation and come into compliance, however they did not come into compliance until July 18, 2022 when the certified code enforcement officer came and inspected the property and only at that time was it found that the property came into compliance. Based on the City's recommendation no action on this matter because the property did come into compliance, but for purpose of the record that they were in violation from May 11, 2022 till July 18, 2022. is the City asking for anything else, Mr. Smith AS -no we are not RA -Mrs. Curl CC -no sir RA -okay next case VII. To comply with City Ordinances, the property owner needs to cut all the overgrown vegetation. CONTINUED: AS -no Creech Construction is a construction company that you could get to build on that property it is actually owned by a company called Grand Lake Investments Inc so that is where we sent it RA -okay when you conducted a diligent search for the owner the only one that came up was AS -Grand Lake Investments Inc RA -Grand Lake Investments is the registered owner from where, the property appraiser AS -yes RA -and this was the only contact that you could obtain AS -yes CC -and the address that we mailed to is the registered agents address on Sunbiz as well RA -okay, Mr. Hyden could you think of anything else for us to make an attempt to get ahold of these people other than posting because it sounds like these are people from out of town GH-I believe the City has exhausted the efforts that they are normally supposed to do. Unfortunately, this does occur on occasion where someone does not claim their mail, but I think they have done everything that they can do obviously if a lien order does go out we can do regular mail as well as certified mail and we can do background checks to see if we can try to track down the officers of the entity but in terms of today the City has down what they need to do to provide proper notice AS -also to correct you on that statement it is a local company because we sent it local RA -okay that is what I wanted to hear that the City for the purpose of this Hearing today is sufficient. I will find in the case of the City of Okeechobee vs, Grand Lake Investments Inc, Case #220601005 based on the testimony of the certified Code Enforcement Officer Mr. Smith and the exhibits presented at this Hearing that there is sufficient bases for the allegations in this case and the respondent is in violation of Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification for having a vacant lot with overgrown grass and weeds. On review of the exhibits and hearing the testimony of the certified code enforcement officer in this case I see from the exhibits in this case there is a lot of overgrown vegetation and has not been kept and I will make a finding that the respondent is in violation and I will also make a finding in this case that even though the SOV/NOH was mailed via USPS certified return receipt it came back unclaimed and unable to forward that the City of Okeechobee has satisfied the requirements of the law as the purpose of notice in this case by posting the Notice to Appear at the property itself and at City Hall. The responded was first notified via Notice Letter in July 2021. On February 3, 2022 Delinquent Reminder mailed out via regular mail. On February 21, 2022 Ashley Weikert called and spoke with Mrs. Rimes and was advised that she would be into the office to pay the delinquent BTR on February 25, 2022. She didn't show. On March 16, 2022 Final Penalty Notice mailed out via regular mail. On March 29, 2022 Code Officer Smith hand delivered a penalty notice. On July 6, 2022 SOV/NOH mailed via USPS certified return receipt for the August 9, 2022 Hearing, received by P. Cortes on July 11, 2022. On July 7, 2022 Received emails from India ref to the status of the account and Mrs. Rimes stating that she was unable to provide payment and she would pay before August 9th. On August 3, 2022 Rene Rimes came into City Hall and paid delinquent BTR and paid BTR for next year. The City recommends no action on this matter, but request it be noted for the record to have been in violation of Chapter 50 Section 50-43 Delinquent Tax Receipt.
