C&T, Awarded RFQ, Original SubmittalPROFESSIONAL ENGINEERING SERVICES AGREEMENT THIS AGREEMENT, hereinafter "Agreement," made and entered into the 22nd day of October 2021 by and between Culpepper and Terpening. Inc. hereinafter referred to as "PROFESSIONAL" and the City of Okeechobee, Florida, a municipal corporation, 55 SE 3' Avenue, Okeechobee, Florida 34974, hereinafter referred to as "CITY", for and in consideration of the following terms, conditions and covenants. I. PURPOSE OF AGREEMENT CITY intends to enter into an agreement with PROFESSIONAL for provision of Professional Engineering Services by the PROFESSIONAL and the payment for those services by CITY as set forth below. II. SCOPE OF SERVICES The PROFESSIONAL shall provide Professional Engineering Services in all phases of any project for which a PROJECT AUTHORIZATION has been issued by the CITY pursuant to this Agreement as hereinafter provided. These services will include serving as CITY'S professional consulting representative for the Project, providing professional consulting consultation and advice and furnishing customary Civil Engineering Services and customary services incidental thereto as described in the Project Authorization. The detailed scope of services to be performed and schedule of fees for those services shall be detailed in each Project Authorization. PROFESSIONAL shall work with the City Administrator, City Attorney, City Public Works Director, or other City staff in advising the CITY and the City Council regarding Professional Engineering Services. The services will be those customarily attendant to Civil Engineering Services including, but not limited to the following: A. Preparation of roadway location or alignment studies B. Preparation of roadway design C. Preparation of land acquisition documents D. Preparation of a hydrologic & hydraulic studies E. Preparation of storm drainage system design F. Preparation of new or retrofit storm water management design G. Preparation of floodplain studies H. Preparation and procurement of requisite environmental permits I. Performance of traffic counts J. Preparation of traffic studies and analysis K. Preparation of maintenance of traffic design L. Preparation of structural studies and design for bridges, culverts and retaining walls M. Preparation of construction documents N. Preparation of cost estimates O. Preparation of record drawings / as -built plans P. Review of plans, specifications and estimates developed by others, attend Technical Review Committee or other required meetings as requested. Q. Financial Analysis R. Construction Inspection Services S. GIS Mapping and Data Collection T. Presentation to the City Council. staff, and the public of reports, plans, and exhibits U. Other customary Professional Civil Engineering & Surveying Services Ill. Agreement 1. Term of Agreement Upon award of this Agreement, the effective date of this Agreement shall be the date of execution of this Agreement by both CITY and PROFESSIONAL. Term of this Agreement shall be for an initial period of three (3) years with the option of two (2) additional one-year renewal periods, upon the mutual agreement of the parties. At the option of the CITY, and upon the agreement of the PROFESSIONAL, this Agreement may be converted to or replaced at any time with a "Continuing Contract" as that term is used in Section 287.055, Florida Statutes (CCNA). 2. Project Authorization Each "Project Authorization" shall specify the Period of Service agreed to by the CITY and the PROFESSIONAL for services to be rendered under said "Project Authorization". 3. Compensation and Method of Payment 3.1 Fee Schedule CITY will compensate PROFESSIONAL for services under each Project Authorization. The fee due to the PROFESSIONAL shall be set forth in each Project Authorization and shall be in accordance with PROFESSIONAL'S personnel hourly rate schedule formalized in "Exhibit C" to this Agreement. PROFESSIONAL'S personnel hourly rate schedule may be updated annually prior to each optional renewal period. 3.2 Invoices PROFESSIONAL shall submit monthly invoices to the CITY no later than the last day of the month for work accomplished under this Agreement. Each invoice shall be detailed and include, but not be limited to, hours worked by each person assigned to the Project, date worked, and all ancillary expenses incurred and by whom. 3.3 Payment Payment for services rendered is due within Forty-five (45) days of receipt and approval of invoice by CITY. Payment is delinquent thirty (30) days following receipt and approval of invoice by CITY. 4. Reimbursable Expenses PROFESSIONAL shall be reimbursed only for approved out pocket expenses directly chargeable to the Project, at actual cost incurred. Reimbursable expenses will include travel, lodging and meals when traveling at the CITY'S request and on the CITY'S behalf. These expenses shall conform to rates and allowances set forth in Florida State Statute, Sec 112.061, regarding per diem and traveling expenses. Identifiable communication expenses, reproduction costs, and special accounting expenses not applicable to general overhead shall be reimbursed at actual cost. 5. Additional Services 5.1 Requests for Additional Services The undertaking by the PROFESSIONAL to perform professional services defined within this Agreement extends only to those services specifically described herein. If upon the request of the CITY, the PROFESSIONAL agrees to perform additional services hereunder, the CITY shall pay the PROFESSIONAL for the performance of such additional services an amount (in addition to all other amounts payable under this Agreement) based on an hourly fee in accordance with PROFESSIONAL'S current personnel fee schedule, plus reimbursable expenses so incurred by the PROFESSIONAL; unless a lump sum addendum to this Agreement is executed by the parties to this Agreement which addresses the additional services. 5.2 Changes in Scope/Conditions Additional services shall include revisions to work previously performed that: are required because of a change in the data or criteria furnished to the PROFESSIONAL, or a change in the scope of concept of the Project initiated by the C, or services that are required by changes in the requirements of public agencies, after work under this Agreement has commenced. 6. Use of Documents 6.1 Ownership of Original Documents All deliverable analysis, reference data, survey data, plans and reports or any other form of written instrument or document that may result from the PROFESSIONAL'S services or have been created during the course of the PROFESSIONAL'S performance under this Agreement shall become the property of and shall be delivered to the CITY after final payment is made to the PROFESSIONAL. 7. Termination 7.1 Termination for Convenience Either party upon a seven (7) day written notice to the other party may terminate this Agreement. In the event of any termination, PROFESSIONAL shall be paid for all services rendered to the date of termination including all reimbursable expenses. 8. City's Obligations 8.1 Data to be Furnished The CITY shall provide PROFESSIONAL with all data, studies, surveys, plat; and all other pertinent information concerning the Project in the possession of the CITY upon request. 8.2 Designated Representative The Designated Representative of the CITY to act with authority on the CITY behalf with respect to all aspects of the Project shall be identified in each Project Authorization. 9. Insurance. 9.1 Workers' Compensation The PROFESSIONAL shall procure and maintain, during the life of this Agreement, Worker's Compensation insurance as required by Florida Statutes, Chapter 440 for all employees of the PROFESSIONAL engaged in work on the Project under this Agreement. 9.2 Insurance Policy Limits PROFESSIONAL shall procure and maintain insurance policies with at least the following coverage and amounts, during the life of this Agreement: 9.2.1: General Liability Insurance. In a combined single limit of $1,000,000.00 per occurrence, $2,000,000.00 aggregate. 9.2.2: Automobile Liability Insurance. In a combined single limit of $250,000.00 each occurrence. 9.2.3: Professional Liability or Errors and Omissions Insurance. In a combined single limit of $1,000,000.00 aggregate. 9.3 Insurance Cancellation The PROFESSIONAL shall furnish to the CITY Certificates of Insurance allowing thirty (30) days, notice for any change, cancellation, or non -renewal. If the insurance policies expire during the terms of the Agreement, a renewal certificate or binder shall be filed with the CITY fifteen (15) days prior to the renewal date. 9.4 City to be Named Additional Insured The plans and specifications and other Agreement documents to be prepared by PROFESSIONAL pursuant to this Agreement shall require the insurance of liability of the person, individual, firm, or corporation which would, as professional, perform the work described in such plans and specifications. The amounts of insurance shall be determined by the CITY. The CITY shall be named as "additional insured" with regard to the coverage of such policies of insurance. In the case of State funded projects, State agencies such as the Florida Department of Transportation or Department of Environmental Protection, shall be named as "additional insured" with regard to the coverage of such policies of insurance. 9.5 Status of Claim. The PROFESSIONAL shall be responsible for keeping the CITY currently advised as to the status of any claims made for damages against the PROFESSIONAL resulting from services performed under this Agreement. General Conditions 10.1 Compliance with Laws The Professional, its employees, sub -contractors or assigns, shall comply with all applicable federal, state, and local laws, regulations, and requirements relating to the performance of this Agreement. 10.2 Applicable Laws and Venue The Laws of the State of Florida shall govern all aspects of this Agreement. In the event it is necessary for either party to initiate legal action regarding this Agreement, venue shall be in the Nineteenth Judicial Circuit for claims under state law and in the Southern District of Florida for any claims which are justiciable in Federal Court. 10.3 Indemnification For value received, which is hereby acknowledged, PROFESSIONAL shall indemnify and hold harmless the agency, and its officers and employees, from IiabilitiE!s, damages, losses, and costs, including, but not limited to, reasonable attorneys' fees, to the extent caused by the negligence, recklessness, or intentionally wrongful conduct of the design professional and other persons employed or utilized by the design professional in the performance of the contract. The PROFESSIONIAL further acknowledges that it is solely responsible for ensuring compliance and compliance of its subcontractors, suppliers, agents, assigns, invitees and employees with the terms of this Agreement. This paragraph shall survive the expiration or termination of this Agreement. 10.4 Waiver of Jury Trial Each party, to the extent permitted by law, knowingly, voluntarily, and intent onally waves its right to a trial by jury in any action or other legal proceeding arising out of relating to this Agreement and the transactions it contemplates. This waiver applies to an action or legal proceeding, whether sounding in agreement, tort or otherwise. 10.5 No Discrimination PROFESSIONAL and its agents will not discriminate against any person on the grounds of race, color, creed, national origin, handicap, age, or sex, in any activity under this Agreement. 10.6 No Lobbying Pursuant to Chapter 216.947, F.S., the PROFESSIONAL is prohibited from the expenditure of any funds under this Agreement to lobby the Legislature, the judicial branch or another state agency. 10.7 E-Verify PROFESSIONAL has verified that its employees are authorized to work n the United States and certifies that a good faith effort has been made to properly identi-`y employees by timely reviewing and completing appropriate documentation, including but not limited to the Department of Homeland Security, United States Citizenship, and Immigration Services Form 1-9. Answers to questions regarding E-Verify as well as instructions on enrollment may be found at the E-Verify website: www.uscis.gov/e-verify. PROFESSIONAL shall expressly require any sub -contractor's performing work or providing services pursuant to this Agreement to likewise utilize the United States Department of Homeland Security's E-Verify system to verify the employment eligibility of all new employees hired by the sub -contractor during the Agreement term. 10.8 Professionals Duties Regarding Public Records 10.8.1. Compliance with Florida Laws PROFESSIONAL must provide public access to all records concerning this Agreement according to applicable Florida laws including Chapter 119, Florida Statutes. If PROFESSIONAL asserts any exemptions to Florida's Public Records laws, PROFESSIONAL has the burden of establishing and defending the exemption. PROFESSIONAL'S failure to comply with this section is a breach of this Agreement. The records subject to Chapter 119 may include, in addition to prepared documents, such communication as e-mails, text messages, inter -office memorandums, social media, and photographs or images; a person or entity may request Public Records via e-mail, or by oral or written request, and a response to such a request must be prompt; it is the responsibility of the PROFESSIONAL to establish an in-house policy in reference to such records, and to identify and retain such communications in the normal course of business in the event a request is made to produce these records. 10.8.2. No person or entity other than the PROFESSIONAL or the CITY shall have any rights or privileges under this Agreement in any capacity whatsoever, either as third -party beneficiary or otherwise. 10.10 Assignment PROFESSIONAL shall not assign, delegate, sublease or otherwise transfer any portion of its rights and obligations as set forth in this Agreement without prior written consent of the CITY. Any attempted assignment in violation of this provision shall be void. 10.11 Waver No waiver of any term of this Agreement constitutes a waiver of any other provision, whether similar or dissimilar. No waiver of any term constitutes a continuing waiver. No waiver is binding unless signed in writing by the waiving party 10.12 Severability If any term of this Agreement is for any reason invalid or unenforceable, the rest of the Agreement remains fully valid and enforceable. 10.13 Entire Agreement This Agreement constitutes the entire agreement between the parties and supersedes all prior and contemporaneous agreement, representations, and undertaking. No supplement, modification, or amendment of this agreement will be binding unless it is in writing and signed by both parties. 10.14 Interpretation Unless the context requires otherwise: The term "including" contemplates "including but not limited to." 10.15 Survival All provisions of this Agreement which by their terms bind either party after the expiration or termination of this Agreement shall survive the expiration or termination of this Agreement. 10.16 Force Nlajeure Notwithstanding any provisions of this Agreement to the contrary, the Parties shall not be held liable for any failure or delay in the performance of this Agreement that arises from fires, floods, strikes, embargoes, acts of the public enemy, unusually severe weather, outbreak of war, restraint of Government, riots, civil commotion, force majeure, act of God, or for any other cause of the same character which is unavoidable through tre exercise of due care and beyond the control of the Parties. Failure to perform shall be excused during the continuance or as a result of such circumstances, but this Agreement shall otherwise remain in effect. This provision shall not apply if the "Statement of Work" of this Agreement specifies that performance by the PROFESSIONAL is specifically required during the occurrence of any of the events herein mentioned. 11. For over 40 years, Culpepper and Terpening (C&T) has been providing unparalleled multidisciplinary consulting services to our clients throughout the Treasure Coast. C&T is a Woman Owned Business and meets the requirements of 288.703, Florida Statues. This project will be managed out of our Ft. Pierce Office, which is located 40 minutes from the City Hall. Local Knowledge — C&T staff have worked in the City of Okeechobee and throughout the Treasure Coast for decades and are part of the success of many communities in the region. We live and work in the area and look forward to helping the City protect and improve the quality of life for its residents. If a disaster does strike, our team is trained and ready to help as we did with debris removal monitoring for the City, following Hurricane Irma. The reimbursement request to FEMA was approved without any delays as a result of our comprehensive documentation efforts. We were here through Hurricanes Frances, Jeanne, Wilma; the wildfires in Port St. Lucie; as well as the most recent disasters. We have applied for, been awarded, and managed the contracts for over $40 million in Hazard Mitigation Grant funds for our clients. Our Project Manager has numerous FEMA certifications, including ISG300 and ISG400 (Intermediate and Advanced Incident Command System training). A Qualified and Experienced Interdisciplinary Team — C&T is a multidisciplinary firm, staffed by civil engineers, planners and surveyors. Our senior management team has over 100 years of combined experience on the Treasure Coast. Our years of experience have resulted in valuable relationships with local, regional, state, and federal regulatory agencies, including Okeechobee County, FPL, FDOT, FDEP, and SFWMD. We realize funding is a vital part of any project and we can help with our experience with legislative appropriations, grant administration, LAP funded projects (both on and off -system) and State Revolving Fund projects. With over 30 years of experience, nine years in Okeechobee, Kelly Cranford, P.E. will be our Project Manager. She will use her engineering experience in both the private and public sectors to scope projects, establish and maintain the project schedule, monitor the budget, and lead the implementation teams. Prior to joining C&T, Ms. Cranford was the Capital Program Manager for the City of West Palm Beach, where she gained invaluable understanding of managing funding sources and coordinating with various stakeholders. She was responsible for project development, scheduling and implementation of projects under $40-million bond as well as the 5-year CIP program and looks forward to helping the City of Okeechobee stay on track with their vision for the future. Ms. Cranford was responsible for reviewing and approving site plans, engineering development applications, and building permits for compliance with local codes and standard engineering practices while with the City of West Palm Beach; served on the Okeechobee County Technical Site Plan Review Committee for almost a decade, and currently manages the review and approval of irrigation and surface water Work Authorization applications for the 7000 acre Southern Grove and Tradition Community Development Districts in western St. Lucie County. With the long awaiting return of economic development, our team can help the City with the backlog of development application reviews. He has over 29 years of construction management including design -build, LAP funded, drainage retro-fit, and emergency repair projects. His experience allows our CEI team to be pro -active and detect and resolve issues before they delay schedules or result in large budget over -runs. Elliot Brown, PE will assist Kelly with any transportation related activities required by the City. Eliot has over 10 years of experience with multifaceted transportation projects throughout the Treasure Coast. The C&T Team Knows Municipal Engineering — At C&T, we share the City's goal to protect and improve the quality of life for present and future residents. We are committed to providing the City with timely and professional service throughout the term of this contract, providing effective implementation of all assigned tasks. Our project managers are hands-on experts in the type of design, permitting, and survey required to provide the services outlined in RFQ ADM 01-32-07-21. A significant portion of the infrastructure improvement budget is funded for water quality (TMDL) and stormwater projects. Our team understands the regulatory requirements and has implemented water quality projects using low-cost technologies for many of our clients. Our CEI team completed Sagamore Stormwater Treatment Area (STA), McCarty Road Water Farm, and numerous baffle box installations which were funded through SFWMD and FDEP grants. In addition, C&T provides continuing services to several investor - owned utility companies, including FPL, BellSouth, Comcast and Hometown Cable. Our Project Manager will be Kelly Cranford, P.E. (Kcranford(a)-ct-eng.com, 772-464-3537). She currently manages (master plan modeling, permitting, and seasonal management for irrigation supply, flood protection, and water quality treatment) the stormwater systems for three Community Development Districts ranging in size from 2200 to 3500 acres. In addition to the typical civil engineering design experience, she has FEMA PA Certifications, including ISG300 and ISG400 (Intermediate and Advanced Incident Command System training). Following Hurricane Irma, she submitted over 20 HMGP grant applications for clients, totaling over $8.5 million and has hands-on experience in disaster recovery. Only one of the applications was declined for funding. She also worked with Martin County to submit almost $5 million in HMGP grant applications in 2020. She was the Capital Improvement Program Manager and Land Development Engineer for the City of West Palm Beach, responsible for the annual CIP budget as well as additional projects funded through a $40 million bond. Page 5 of 54 RFQ ADM 01-32-07-21 Professional Engineering Services Stormwater Design: C&T's ability to quickly identify stormwater issues, design/prepare/permit construction plans, and provide professional services during construction has made us the "go to" engineer for privately held utility expansion projects across the state. As part of one our recent projects, we evaluated a 10,000-acre watershed in western Martin County and successfully designed a replacement stormwater system which relied on gravity rather than the existing pumps. This `natural mimic' system not only met the state water quality requirements through the use of vegetative buffers, but provided substantial operational savings to our client through the elimination of artificial pumping operations. The City of Okeechobee is dependent upon a federally regulated tailwater conditions within Lake Okeechobee, which vary greatly throughout the year. We will use our understanding of the area constraints along with our experience to help resolve existing drainage and water quality issues within the City. Our proposed solutions will include a benefit -cost analysis of alternative solutions based on both the long-term project cost and environmental impact to the community. Local Area Project (LAP) Experience: C&T has the most extensive LAP (Local Area Project) experience of any other local firm in the Treasure Coast area. Over the past six years, C&T has provided design and/or CEI services on approximately $15 million dollars worth of construction value on twenty (20) different LAP Projects on the Treasure Coast. C&T Sr. Vice President, Stefan Matthes, PE, and CEI Division Manager, Marcelo Dimitriou, PE, have both received Certificates of Training from the FDOT for Local Agency Project Administration. Company COO, James P. Terpening, PE, has completed the FDOT's Agency Certification Training Program to better understand the `inside' details of the LAP program. Mr. Terpening is well -versed in the processes involved in "schedule float" and "fire walling." CEI Qualifications: C&T is fully qualified to provide outstanding CEI services to the City of Okeechobee. Over the past 17 years, C&T has provided CEI services on public and private projects of approximately $1 billion in value including over 250-lane miles of transportation projects. Our CEI experience includes some of the region's most significant public improvement projects, including: the recently completed 1-95 and SR 76 Interchange improvement project; Green River Parkway; SR 76 & US 1 intersection improvement; Crosstown Parkway; Walton Road; Florida's Turnpike Interchange at Becker Road; the South-West Annexation Infrastructure Improvement Programs (Village Parkway, Community Boulevard, and Discovery Way) and Water and Sewer expansion/ improvement projects for both the City of Port St. Lucie and the City of Stuart. All of these projects were successfully brought in on, or ahead of, schedule and under budget. Business/Occupational Licenses: State of Florida Board of Professional Engineers License #4286; and State of Florida Board of Professional Surveyors and Mappers License #LB4286; C&T has also saved our communities substantial costs by performing "pro-bono" work on several City improvement projects. Task Approach As a full -service survey, engineering and land planning firm, C&T has the diversification of qualified personnel to address any critical time frame. It is not unusual for us to perform assignments on an expedited schedule. We understand that the scope, schedule, and budget of every project is critical, regardless of the magnitude of the work. Scheduling, Progress Management, and QA/QC Our long track record of successfully completed projects is largely due to our superior organization, flexibility, and dedication to `catching up' after unexpected delays. We will meet with the City at the start of the project to develop a scope of work and project schedule that will allow for timely and informed decision -making. Each week, we update our schedule, and cross-check our expectations with what has been completed. We then share this information with the client as part of a regular progress report. Unfortunately, even the well -planned projects hit unexpected bumps in the road. However, with such a high level of organization, the C&T Team can identify these issues as soon as they arise and immediately develop a strategy for getting back on track. C&T orchestrates its quality assurance/ quality control (QA/QC) process by planning and overseeing the project at critical milestone points. The Project Manager, along with other team members, manages subconsultants, manpower availability, and internal assignments through weekly reviews and meetings as necessary; this will allow us to devote adequate resources to the project in the face of changing demands for production staffing. Our QA/QC procedures are integral components of our goal to provide excellent planning services to the City, resulting in the project remaining on schedule and within budget. Communication and Project Planning Our Project Management approach will focus on your ideas and make them a reality through a guided planning and design process that revisits the project goals. For all size projects, the process is most effective when cost, schedules and values are integrated during the beginning stages. We work proactively to identify issues and challenges early in the process when solutions can be incorporated into every part of the project plan. Our Project Manager is responsible for Quality Assurance through the life of the project. Our track record of successfully completed projects is largely due to our superior organization, flexibility, and dedication. Each week, we update our schedule, and cross-check our expectations with what has been completed. This information is then shared with the City in the form of a regular progress report. Quality Control / Qualify Assurance (QAQC) Quality Control and Quality Assurance is essential to the successful completion of any project. At C&T, we work to assure our clients that all project items are designed or constructed in accordance with the required specifications and standards. We understand that we serve as the owner's agent/representative and as such, we assume a proactive stance to aggressively anticipate both the needs of our clients and any potential problems that could come up through the process in order to effectively develop solutions, before the overall program schedule is adversely impacted. Our objective is to maintain the project schedule, stay within scope, and minimize project cost- all with the goal of providing superior quality products and services. Depending on the particular project, monthly, and if necessary, weekly progress meetings are hosted by the C&T Project Manager with the City Project Manager, or other appropriate officials. During these progress meetings, quality control review and workload projections are discussed, and if required, adjustments are initiated. Design plans and reports will be reviewed by another of C&T's in-house design professionals (PE level), and when necessary, by representatives of C&T's CEI Division. These reviews are conducted by individuals who do not have an affiliation with the particular project. This review/quality control method gives an opportunity for a cold review of the calculations and modeling and construction plan designs, in order to make sure that nothing was missed. Page 7 of 54 RFQ ADM 01-32-07-21 Professional Engineering Services of quality control gives us the opportunity to evaluate plans based on constructability issues as opposed to `what we think works,' which is ultimately designed to save the County time and money in the implementation of any particular project or activity. The specific QA/QC program that C&T utilizes is based upon a systematic approach to ensure that project design minimizes and mitigates errors and potential construction issues. The QA/QC program dovetails with the standard submittal review process and begins at the development of the project scope and will be implemented as follows: Accounting C&T utilizes Deltek's Vision Financial Management System accounting software to track projects on a daily basis. The software provides a "real-time" accounting of all projects. Weekly project progress reports include financial updates and are available for the client. This allows any cost or scheduling concerns to be resolved immediately and efficiently, keeping the project on time and within budget. Even the most well -planned projects hit unexpected bumps in the road, however, with such a high level of organization, the C&T Team can identify these issues as soon as they arise and immediately develop a strategy for getting back on track. Schedule Maintenance and Ways to Recover Unforeseen Conditions - Oftentimes, unforeseen conditions, utilities or design issues can cause delays to the project becoming reality. With our local knowledge and history with the City, we delve deeply to find existing conditions on the project sites which might impact implementation. We can proceed with resolving the potential issues while the design details are finalized. There are many ways in which to recover lost time. Adding additional resources without clear guidance can often be a waste of valuable resources and possibly time. There are very few projects where simply adding `more bodies' will result in project schedule recovery. To effectively implement a recovery program, the method of recovery must be tailored to meet the individual client's goals and objectives and address the reason for the delay. Simple projects generally have simple solutions; while the more complex projects can generally be dissected into multiple phases and tasks with achievable deadlines and objectives. Management's ability/responsibility to view projects in a 3-dimensional perspective is essential when working on complex projects. Various work assignments can run in parallel, versus in series, in order to meet or recovery from projected milestones. For example, several years ago, the City of Port St Lucie CRA had to achieve construction commencement on the City Center project on a certain date or lose potentially critical project funding sources. After careful evaluation of the situation, three teams were assigned the project with each team consisting of a design professional, CADD technician and engineering assistant. Each team was assigned a task area, and the Project Manager oversaw the progress of each team, coordinated the sub -consultants and acted as liaison with the client. The end result was that by applying the necessary resources to the project at hand, C&T was able to provide the City with the necessary approvals in a timely manner allowing them to secure the necessary project funding allowing development activities to proceed. Cost Control and Value Engineering Culpepper & Terpening takes pride in putting our decades of experience to use when providing value engineering considerations in the development of construction methods and materials needs for any given project. Our objective through this assessment is to determine what will have the net result of reducing costs while enhancing reliability, maintainability, aesthetic, safety, and security criteria of the job. When C&T looks at a project, one of the very first things that we take the time to explore is where we can find some cost savings. By continually monitoring the project, we look for ways in which cost savings may be achieved and returned to the County. Once a schedule is input into our project management software system, all of the C&T Project Managers can monitor the status of their assigned job. Checklists developed during the project Scoping process are carried throughout the project in order to monitor compliance with budget and schedule. Project management software can track staff activity, daily or weekly, as it is input by the individual staff members. Contract Compliance and Enforcement of Industry Standards Culpepper and Terpening, Inc. (C&T) is committed to providing unparalleled quality service to our clients and maintaining an organized contract administration process. Each phase of a contract and work authorization is managed through our Deltek FMS software system allowing all Project Managers to monitor the budget and schedule of any given project each day. At C&T, select members of each discipline in our organization are tasked with attending and participating in professional associations and maintaining publications and newsletters. This project incorporated complete street elements such as a multi -purpose trail, continuous sidewalks, reducing travel lanes from 12-14 feet to 10 feet, pedestrian refuge islands at cross -walks, ADA compliant crossing, pedestrian lighting, irrigation, and landscaping. The eastern portion of the project included a continuation of the Chain of Lakes Trail. Project was funded through LAP with on-line progress submittals to FDOT. Project construction costs were lowered by utilizing the existing curb and gutter, drainage inlets, and sidewalk in areas where the existing infrastructure was still in good condition. To keep within the City's budget and timeframe, much of existing road surface was micro -surfaced to give the project a fresh look without the added expense of milling and resurfacing the roadway. Tennis Court Facility (City of Winter Haven) Project Engineer — Responsible for design and permitting of complete renovation of 60-year-old facility as part of design -build team. The new facility included 8 clay courts, 4 pickle ball courts, a practice court, parking, shaded observation deck, and pro -shop. Project was completed within 270 days and within budget. FEMA Assistance (Polk County Utilities, FL) Project Manager - Worked with Polk County Utility staff develop and prioritize Hazard Mitigation Grant Program (HMGP) projects and complete grant applications for the highest ranked sites. The PD&E study evaluated a wide range of alternatives including roadway capacity improvements, multimodal and premium transit alternatives, and bicycle and pedestrian accommodations. Improvements considered included roadway widening, managed lane concepts, High Occupancy Vehicle (HOV) lanes and dedicated premium transit lanes, intersection and operational improvements, and multimodal improvements such as pedestrian ways, bicycle lanes, greenways, and transit stations. Disputes between CITY and contractor: PROFESSIONAL shall act as initial interpreter of the requirements of the Agreement documents and judge of the acceptability of the work there under and make decisions on all claims of CITY and contractor(s) relating to the acceptability of the work or the interpretation of the requirements of the Agreement documents pertaining to the execution and progress of the work. 10. Applications for Payment: Based on PROFESSIONAL's on -site observations as an experienced and qualified design professional, and on review of applications for payments and the accompanying data and schedules: a. SCHEDULES AND TIME CONSTRAINTS Within ten (10) days after receiving the Notice to Proceed, the PROFESSIONAL shall provide a schedule and an anticipated payment schedule.
