Special Magistrate Azcona approved the April 12, 2022, Hearing Minutes. B. This being a Quasi-Judicial proceeding, Special Magistrate Azcona collectively administered an Oath to: Code Officers Smith, Curl; all affirmed. Code Officer Smith stated for the record all events regarding the Cases to be discussed occurred within the corporate limits of the City of Okeechobee. The Officer's notes, testimony, photographs, and support documents were all entered as part of the official record. V. CONTINUED CASES A. A Statement of Violation/Notice of Hearing (SOV/NOH) was mailed via USPS certified return receipt on January 4, 2022. The City has not received a notice of delivery as of the date of this hearing. The property was inspected and found to be non-compliant on January 25, 2022, February 16, 2022, and March 1, 2022. A SOV/NOH was mailed via USPS certified return receipt on March 29, 2022. The notice was received by Vicki Joiner on April 6, 2022. The property was inspected and found to be non-compliant on April 27, 2022 and May 3, 2022. Code Officer Smith testified that the property is in violation of Code of Ordinances Chapter 30, Sections 30-40 Junk, 30-41 Disabled vehicles, 30-43 Public nuisances, 30-44 General cleaning and beautification for disabled riding lawnmowers, untagged/disabled RV, and overgrown vegetation, piles of wood and the front of the home and roof in need of cleaning. The respondent is not a repeat violator. A Courtesy Card was mailed via USPS regular mail on March 14, 2022. The property was inspected and found to be non-compliant on March 22, 2022 and March 29, 2022. A SOV/NOH was mailed via USPS certified return receipt on March 29, 2022. The notice was received by Tom Nguyen on April 5, 2022. The properry was inspected and found to be non-compliant on April 27, 2022, and May 3, 2022. On March 1, 2022 Code Officer Smith inspected the property, still non-compliant. However, progress had been made, the grass and weeds had been cut. RA-Mr. Hyden is there anything you would like to add on behalf of the City of Okeechobee GH-no, your honor since the property is now in compliance RA-in the case of the City of Okeechobee vs. Carole Rosenberg LLC, Case #220222010; I will make a finding in this case based on the testimony and the exhibits presented by the City of Okeechobee certified Code Enforcement Officer Mr. Smith that the respondents in this case Carole Rosenberg LLC was in violation of Chapter 30, Section 30-41 for having a disabled vehicle, there is a untagged/disabled vehicle shown in the exhibits and also Section 30-44 General cleaning and beautification for overgrown grass and weeds. The certified Code Enforcement officer testified to the facts and my examination of the affidavits, exhibits and pictures taken by the certified Code Enforcement officers shows that there is factual basis for the findings. I see that there is a picture here of a vehicle without a tag with overgrown vegetation around it and a lot of vegetation that is here that must have been left for at least 6 months by looking at the length of the shrubs and the weeds that have grown around the premises. I will also make a finding in this case that the respondent was properly served, even though the certified mail was signed COVID19, it does say it was received by C. Rosenberg. Mr. Smith do we ever have the opportunity to ask someone from the Post Office about how it is written COVID19? Do you have an idea of why it was written like that? AS-I will let Code Officer Curl elaborate on that RA-oh okay CC-I did make contact with the Post Office, I was advised by the Master that the respondent received the mail even if COVID19 is written on the return receipt RA-oh okay CC-they didn't sign the card, but it was delivered to that address RA-okay I see CC-on the first one they actual signed the electronic device but refused to sign the card RA-okay I see, in combination with that fact and I can see all through here that the property was properly posted so and so there is proper notice in this case to give the respondent an opportunity to be here at this hearing and to be heard and they have made a choice and decided to remain silent in regard to the allegations in this case. So, we will take that as their choice. So, with this case it looks like according to the certified Code Enforcement Officer that the property did come into compliance and based on the City's recommendation there will be no further action in this case we will find the respondents in this case in violation, and it will be noted that they were in violation but has now come into compliance. However, they were in violation of Chapter 30 Section 30-41 Disabled vehicles and 30-44 General cleaning and beautification but have now come into compliance. Should they come into violation in the future they will be classified as repeat offenders. So, under these circumstances we will make that ruling today that there will be no further action and the city is not requesting any fees at this time AS-that is correct RA-alright so that will be so VI. NEW CASES A. Case Number 220104005; Clifford and Vicki Joiner, 309 Southeast 11 th Avenue, Violation of Code of Ordinances Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification (Exhibit 2). AS-violation of Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification for overgrown weeds, grass, trees, bushes, or shrubs. The respondent was first notified on December 16, 2021 via Courtesy Card. On January 3, 2022 Code Officer Smith inspected the property, still non-compliant. On January 4, 2022 a SOV/NOH mailed via USPS certified return receipt for the February 8'h Hearing, the city has not received anything back as of the date of this hearing. On January 4, 2022 Code Officer Curl spoke with the property owner Vicki Joiner who advised that they just received the notice and that they needed more time to correct the issue. On January 25, 2022 Code Officer Smith inspected the property, still non- compliant, however progress had been made, the grass had been cut, however, the trees, Page 2 of 5 VI. NEW CASES CONTINUED A. CONTINUED: bushes, and shrubs still in need of being cut. On February 16, 2022 Code Officer Smith inspected the property, still non-compliant. On March 1, 2022 Code Officer Smith inspected the property, still non-compliant. On March 29, 2022, a SOV/NOH mailed via USPS certified return receipt for the May 10th Hearing. The notice was received by Vicki Joiner on April 6, 2022. On April 8, 2022 Code Officer Curl spoke with Vicki Joiner and advised her on what needs to be done to bring the property into compliance. On April 27, 2022 Code Officer Smith inspected the property, still non-complaint. On May 3, 2022 Code Officer Smith inspected the property, still non- compliant. To comply with City ordinances, the property owner needs to cut the overgrown trees, bushes, and shrubs. The City recommends a fine of $50.00 per day, to begin 21 days after the date of the Special Magistrate Hearing on May 10, 2022, unless the property owner brings the property into compliance before that date, plus a$50.00 administrative fee. RA-Mr. Hyden is there anything else you would like to add on behalf of the city GH-the only question I have is for the Code Enforcement Officer is the fine recommend consist with the City's fee schedule AS-yes, it is GH-nothing further RA-okay in the case of the City of Okeechobee vs. Clifford and Vicki Joiner, Case #220104005; I will make a finding that based on testimony of the City's certified Code Enforcement Officer Mr. Smith and the exhibits presented this hearing I will make a finding that the respondents in this case are in violation of Chapter 30, Section 30-43 Public nuisances having overgrown weeds, grass, trees, bushes or shrubs and Section 30-44 General cleaning and beautification after hearing the sworn testimony of the certified Code Enforcement Officer and the exhibits presented in this case I see that there is sufficient factual basis for the city's allegations in this case and I see that there are pictures here taken by certified Code Enforcement Officer Smith of shrubs, overgrown vegetation clearly well beyond the fence line and creeping all the way into the streets. Also, the respondents in this case I am satisfied that they have been properly notified of the hearing pertaining to this case, a SOV/NOH were properly served they were sent certified mail and it was received and it was also collaborated by Code Enforcement Officer Curl by making contact with the respondents in this case and they are making efforts to correct this problem, and so the respondents have clearly been notified and this looks like it has been delayed trying to correct the problems. Since they have been properly notified about this hearing and them not being here today and have obviously decided not to be here today, they have chosen to remain silent taking that into consideration I will make the finding that in this case the City's recommendation of $50.00 per day, to begin 21 days after the date of today's hearing will be assessed unless the property owner brings the property into compliance before the date plus a $50.00 administrative fee and that is what we will do. B. Case Number 220329010; Tom Nguyen, 210 Southeast 3�d Street, Violation of Code of Ordinances Chapter 30, Sections 30-40 Junk, 30-41 Disabled vehicles, 30-43 Public nuisances, 30-44 General cleaning and beautification (Exhibit 3). AS-violation of Chapter 30, Sections 30-40 Junk, 30-41 Disabled vehicles, 30-43 Public nuisances, 30-44 General cleaning and beautification for disabled riding lawnmowers, disabled/untagged RV and overgrown vegetation, piles of wood and the front of the home and roof in need of being cleaned. Respondent was first notified on March 14, 2022 via Courtesy Card. On March 18, 2022 Mr. Nguyen spoke with Code Officer Curl stating that he had corrected the violations and asked that the property be inspected. On March 22, 2022 Code Officer Smith inspected the property, still non-compliant. On March 29, 2022 Code Officer Smith inspected the property, still non-compliant. A SOV/NOH and photos was mailed via USPS certified return receipt, it was received by Tom Nguyen on April 5, 2022. On April 5, 2022 Mr. Nguyen spoke with Code Officer Smith and he was advised what he needed to correct to bring the property into compliance. On April 27, 2022 Code Officer Smith inspected the property, still non-compliant, still in need of removing the debris/junk. On May 3, 2022 Code Officer Smith inspected the property, still non-compliant. To comply with City ordinances, the property owner needs to clean up and or remove junk and debris from the property. Based on the testimony of Officer Smith and examining the exhibits I see that there is more than sufficient factual basis for such findings in this case. By examining the pictures, I see that there is a camper in there that has been there for a very long time there is mold and moss growing around it, it looks like there is piles of debris that has been stacked underneath it, it looks like this vehicle has been immobile for probably years, it has not been maintained in anyway, it looks like the tag is expired, there is also a picture of a lawnmower that is inoperable, both vehicles look like they are inoperable and have been parked there for years, there is a lot of vegetation and junk being stored indefinity on the premises and it is unsightly, and there is a building here that I can see a lot of mold on the roof, and the respondent in this case was also properly notified and provided due process to be at this hearing today, to appear at this hearing today and respond to the allegations in this case, but has chosen to stay silent and chose not to be here. On the final exhibits here on April 27th, it looks like they are still non-compliant, however some stuff has been done but a lot of stuff is still there and evidence of the violations, there is still overgrown vegetation that is growing around the inoperable vehicles, there is still mold and moss around buildings and a lot of stored junk/debris is being kept. There is still vegetation up till May 3�d of this month that has not been taken care of and is still unsightly in this case. So, there is plenty of factual basis for these allegations and I will make the finding and follow the City's recommendation in this circumstance and fine the respondent in this case $50.00 per day to begin 21 days after the date of this hearing today May 10, 2022, unless the property owner brings the property into compliance plus a$50.00 administrative fee is reasonable and that is what we will order in this case. C. Case Number 220405015; Mary Alice McCormack, 904 Northwest 5th Street, Violation of Code of Ordinances Chapter 30, Sections 30-40 Junk, 30-43 Public nuisances, 30-44 General cleaning and beautification (Exhibit 4). AS-violation of Chapter 30, Sections 30-40 Junk, 30-43 Public nuisances, 30-44 General cleaning and beautification for junk all over the property, overgrown grass and weeds, trash, or debris all over the front and side of the property. The respondent was first notified on March 17, 2022 via Courtesy Card. On April 5, 2022 Code Officer Smith inspected the property, still non-compliant. On April 5, 2022, a SOV/NOH and photos were mailed via USPS certified return receipt, received by Walter Piscatelli on April 13, 2020. On April 27, 2022 Code Officer Smith inspected the property, still non-compliant. On May 3, 2022 Code Officer Smith inspected the property, still non- compliant. I will also make a finding in this case that the respondent Ms. McCormack has been properly notified as proof the city has presented a certified mail receipt that is signed by Walter Piscatelli and so I will make the finding that the respondent in this case has been properly served and I will follow the city's recommendation in this case to fine the respondent $50.00 per day to begin 21 days after the date of the hearing today May 10, 2022, unless the property owner brings the property into compliance before that date, plus a$50.00 administrative fee and that is what we will order.
