OFFICIAL MINUTES
CALL TO ORDER
Special Magistrate Azcona called the Code Enforcement Special Magistrate Hearing to order
on Tuesday, April 12, 2022, at 6:01 P.M. in the City Council Chambers, located at 55 Southeast
3'd Avenue, Room 200, Okeechobee, Florida. The Pledge of Allegiance was led by Special
Magistrate Azcona.
II. ATTENDANCE
Assistant Code Enforcement Officer Christina Curl called the roll. Special Magistrate Roger
Azcona, Esquire, City Attorney Greg Hyden, and Code Enforcement Officer Anthony Smith were
present.
III. CHANGES TO AGENDA
Special Magistrate Azcona asked whether there were any agenda items to be added, deferred,
or withdrawn; Item VII.A, Case No 200616010; Okeechobee Church Old Regular was added to
the agenda to be heard before Item V.A, Case No. 220112002; Straat Car Wash Property LLC.
IV. APPROVAL OF MINUTES AND ADMINISTRATION OF OATH
A. Special Magistrate Azcona approved the March 8, 2022, Hearing Minutes.
B. This being a Quasi-Judicial proceeding, Special Magistrate Azcona collectively
administered an Oath to: Code Officers Smith, Curl, and Mr. Warren Kelly; all affirmed.
Code Officer Smith stated for the record all events regarding the Cases to be discussed
occurred within the corporate limits of the City of Okeechobee. The Officer's notes,
testimony, photographs, and support documents were all entered as part of the official
record.
V. COMPLIED CASES
A. Case No. 220112002; Straat Car Wash Property LLC, 906 South Parrott Avenue [Legal
Description: Lots 3,4, and 5 of Block 6, SOUTH OKEECHOBEE, Plat Book 1, Page 12,
Okeechobee County public records]. No action on this matter was requested but is noted
for the record to have been in violation of International Property Maintenance Code
Chapter 3, Section 304.1.1 Unsafe conditions and Florida Building Code Chapter 1,
Section 105 Permits.
VI. NEW CASES
A. Case No. 220222009; Freddie and Ruby Minton, 302 Northeast 8'h Avenue [Legal
Description: Lot 17, RIVER RUN RESORT Plat Book 6, Page 18, Okeechobee County
public records].
Code Officer Smith testified that the property is in violation of Code of Ordinances
Chapter 30, Section 30-41 Disabled vehicles for multiple unregistered/inoperable
vehicles on the property. The respondent is a repeat violator. A Statement of
Violation/Notice of Hearing (SOV/NOH) was mailed via United States Postal Service
(USPS) on February 22, 2022. The notice was received by Ruby Minton on February 26,
2022. The property was inspected and found to be non-compliant on March 23, 2022
and April 5, 2022. To comply with City Ordinances, the property owner needs to remove
the disabled vehicles from the property. The City recommends a fine of $50.00 per day,
to begin 21-days after the date of the Special Magistrate Hearing on April 12, 2022,
unless the property owner brings the property into compliance before that date, plus a
$100.00 administrative fee.
Based on the evidence provided, Special Magistrate Azcona found Case No.
220222009 to be in violation of Code of Ordinances Chapter 30, Section 30-41
Disabled vehicles and imposed a fine of $50.00 per day plus a one-time
administrative fee of $100.00 should the property fail to come into compliance
within 21-days after the date of this Hearing.
B. Case No. 220222010; Carole Rosenberg LLC, 822 Southeast 8ih Street [Legal
Description: Lot 9 of Block 5, WILCOX SHORES, Plat Book 3, Page 5, Okeechobee
County public records].

Ordinances Chapter 30, Sections 30-41 Disabled vehicles, 30-44 General cleaning and
beautification for untagged/disabled vehicle, and overgrown grass and weeds. The
respondent is not a repeat violator. A Courtesy Card was mailed via USPS regular mail
on February 7, 2022. The property was inspected and found to be non-compliant on
February 22, 2022. A SOV/NOH was mailed via USPS certified return receipt on
February 22, 2022. The notice was received by C. Rosenberg, COVID 19 on March 4,
2022. The property was inspected and found to be non-compliant on March 1, 2022,
March 23, 2022, and April 5, 2022. To comply with City Ordinances, the property owner
needs to cut the overgrown grass and weeds, properly register, and tag the vehicle or
remove the vehicle from the property The City recommends a fine of $50.00 per day, to
begin 21-days after the date of the Special Magistrate Hearing on April 12, 2022, unless
the property owner brings the property into compliance before that date, plus a$50.00
administrative fee.
Based on the evidence provided, Special Magistrate Azcona ruled to defer Case No.
220222010 to the next Special Magistrate Hearing and instructed the Code
Enforcement Staff to post the property to ensure the property owners have been
properly noticed.
VII. FINE REDUCTION REQUESTS
A. Case No. 200616010; Okeechobee Church Old Regular, 201 Southwest 10th Avenue
[Legal DesCription: Commencing at the Southwest corner of Block 200, CITY OF OKEECHOBEE,
Okeechobee County, Florida, run thence South along the East right of way (ROW) line of Pensacola Street
for a distance of 180.00-feet for the point of beginning (POB). Thence continue South along the East ROW
line of said Pensacola Street for a distance of 40.00-feet, thence run Easterly parallel with the South ROW
line of Tuscaloosa Street for a distance of 100.00-feet, thence run North for a distance of 40.00-feet, thence
run West for a distance of 110.00-feet to a POB. Commencing at the Southwest corner of Block 200, CITY
OF OKEECHOBEE, run thence South along the East ROW line of Southwest 10"' Avenue for a distance of
220.00-feet for POB; thence run East, parallel with the South boundary line of said Block 200 for a distance
of 185.00-feet, thence run South, parallel with the East ROW line of said Southwest 10th Avenue for a
distance of 50.00-feet, thence run West, for a distance of 185.00-feet, to point on the East ROW line of the
aforesaid Southwest 10t'' Avenue thence run North along the ROW line for a distance of 50.00-feet to POB,
commencing at point on the East line of Pensacola Street 345.00-feet South of the South line of South Park
Street, run thence East along the South boundary line of Tuscaloosa Street and parallel with the South
boundary of Block 200, CITY OF OKEECHOBEE, for a distance of 110.00-feet for POB; thence continue
East for a distance of 75.00-feet, thence continue East for a distance of 75.00-feet, thence run South parallel
with the East ROW line of the aforesaid Pensacola Street for a distance of 150.00-feet, thence run West for
a distance of 75.00-feet, thence run North for a distance of 150.00-feet to POB, lying in and comprising a
part of Section 21, Township 37 South, Range 35 East].
Code Officer Smith testified that the property was found in violation of the Code of
Ordinances Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and
beautification on January 12, 2021, where a fine in the amount of $10.00 per day starting
21 days after proper notification plus a one-time $50.00 administrative fee was imposed.
The imposed fine began accrual on June 8, 2021. The property was brought into
compliance on April 4, 2022. The City recommends a fine reduction of 75 percent, plus
a$50.00 administrative fee, reducing the fine from $2,990.00 to $747.50 plus the $50.00
administrative fee, totaling $797.50.
Based on the evidence provided, Special Magistrate Azcona ruled to re ce the fine
by 75 percent, plus a$50.00 administrative fee.

A. CONTINUED:
AS-On January 12, 2022, a SOV/NOH was mailed via USPS certified return receipt for
the February 8th Hearing, violations to be corrected immediately, the case was brought to
our attention by the City Building Official Jeff Newell he had went out and took pictures.
Received on January 15, 2022, signature not legible. On February 1, 2022 Code Officer
Smith was advised by Jeff Newell, Building Official that he had spoken with the roofing
company and are moving forward with addressing the issues with roof. On February 2,
2022 Code Officer Smith inspected the property, not in compliance, business temporally
closed to correct the violations. On February 8, 2022, the case was withdrawn from the
Special Magistrate Hearing agenda, will be heard at a later date as they were still in
progress of getting the work completed on the roof. On February 24, 2022 Code Officer
Smith inspected the property, in compliance, the roofing issues have been addressed,
the photos taken on February 24th were taken by Code Officer Smith, myself as you can
see, they addressed all the damaged wood throughout the roofing system and the
Building Inspector J Newell also inspected the work and signed off that the roof is up to
code. On March 11, 2022, a SOV/NOH was mailed via USPS certified return receipt for
the April 12th Hearing. Received on March 16, 2022 by Ledian. The City recommends no
action on this matter, but request it be noted for the record to have been in violation of
IPMC Chapter 3, Section 304.1.1 Unsafe conditions and FBC Chapter 1, Section 105
Permits however the property has come into compliance and no lien/order was recorded,
no fine accrued

RA-okay, thank you. In the case of the City of Okeechobee vs Straat Car Wash
Property LLC, Case #220112002 I will make a finding in this case that the respondent in
this case was cited for IPMC for Unsafe conditions Chapter 3, Section 304.1.1 and FBC
Chapter 1, Section 105 for Permits and description of violation was that the roof was in
disrepair with water damage throughout the roofing system and work on the building
completed without permits and I have reviewed in this case the affidavits and the sworn
testimony of the certified Code Enforcement Officer and the exhibits submitted in this
case, I see a picture that the property and the owner was properly notified in this case,
there was a stop work order posted and the pictures being submitted as exhibits in this
case provided sufficient factual basis for the allegations in this case, I can see when I
exam the pictures that there is substantial damage to the property I can see broken roof
material and a lot of mold can be seen, cracks and disrepair even though the case was
continued to allow the respondent more time to fix the property and it did come into
compliance, the issues were corrected on or about February 24, 2022 I will make a
finding that based on the recommendation of the City even though there will be no
further action on this matter because the property did come into compliance I will make
a finding that the property was in violation until it was corrected on or about February
24, 2022 and with that being said I will follow the recommendation of the City and make
a finding that they were in violation prior to the violations being corrected. The city
requests no liens or fines to accrue at this time and no further action on this matter.

VI. NEW CASES
A. Case Number 220222009; Freddie and Ruby Minton, 302 Northeast 8th Avenue, Violation
of Code of Ordinances Chapter 30, Sections 30-41 Disabled vehicles (Exhibit 2).
AS- In violation of Chapter 30 Sec 30-41 Disable vehicles: multiple
unregistered/inoperable vehicles on the property. The respondent is a repeat violator.
On February 22, 2022, a SOV/NOH and photos were mailed via USPS certified return
receipt for the April 12th Hearing. Given 30 days to correct violations. Received by Ruby
Minton on 2/26/22. On March 23, 2022 Code Officer Smith inspected the property, still
non-compliant none of the violations had been addressed, photos taken by Officer
Smith. On April 5, 2022 Code Officer Smith inspected the property, still non-compliant.
To comply with City Ordinances the property owner needs to remove the disabled
vehicles from the property. The City recommends a fine of $50.00 per day, to begin 21
days after the date of the Special Magistrate Hearing on April 12, 2022, unless the
property owner brings the property into compliance before that date, plus a$100.00
administrative fee.

GH-just a couple of questions when you are referring to Officer Smith you are referring
to yourself, correct?

RA-okay, I will make a finding in this case of the City of Okeechobee vs. Freddie and
Ruby Minton, Case #220222009 that the respondents in this case have been cited for
Chapter 30, Section 30-41 for having disabled vehicles the description of the violation is
having multiple unregistered/inoperable vehicles on the property. I will also make a
finding in this case that the respondents have previously been in violation, and they are
considered repeat violators. I have reviewed the exhibits submitted by the certified Code
Enforcement Officer in this case and together with his sworn statements there is
sufficient factual basis for the allegations in this case. I see the current dates on the
exhibits in the pictures and there is plenty of vehicles that appear to be disabled and
inoperable because there is a lot of vegetation growing around them, it looks like they
have been parked for several months under the circumstances and it does not look like
they have tags on them and some of them are actually being covered I will also make a
finding that the respondent in this case was properly served with the notice of the
violation and I see that the certified mail was signed by Ruby Minton and the property as
of April 5 is still not in compliance so I will make that finding in this case. The City's
recommendation under the circumstances is reasonable, the city recommends a fine of
$50.00 per day to begin 21 days after the date of the Special Magistrate's Hearing today
April 12, 2022, unless the property owner brings the property into compliance before the
21 days and the respondent to pay a$100.00 administrative fee being that they are a
repeat violator and so that is what we will order in these circumstances in this case.

AS-In violation of Chapter 30, Section 30-41 Disabled vehicles for untagged/disabled
vehicle in the back of the property and Chapter 30, Section 30-44 General cleaning and
beautification, for overgrown weeds, and grass. On February 7, 2022, a Courtesy card
was mailed via regular mail, the photos you see were taken by myself, Code Officer
Smith. On February 22, 2022 Code O�cer Smith inspected the property, still non-
compliant. Photos taken by myself, Code Officer Smith. On February 22, 2022, a
SOV/NOH and photos mailed via USPS certified return receipt for the April 12t" Hearing.
Received on March 4, 2022 by C. Rosenberg COVID 19. On March 1, 2022 Code
Officer Smith inspected the property, still non-compliant. Photos taken by Code Officer
Smith, myself. However, progress had been made, the grass and weeds have been cut.
The tire needs to be removed and the disabled vehicle remains. On March 23, 2022
Code Officer Smith inspected the property, still non-compliant, the photos taken by
myself, Code Officer Smith. You can also see that the grass has become overgrown
again. On April 5, 2022 Code Officer Smith inspected the property, still non-compliant.
To comply with City ordinances, the property owner needs to cut the overgrown grass
and weeds. Properly tag and register vehicle or remove vehicle from the property. The
City recommends a fine of $50.00 per day, to begin 21 days after the date of the Special
Magistrate Hearing on April 12, 2022, unless the property owner brings the property into
compliance before that date, plus a$50.00 administrative fee.

RA-I am looking at the exhibit in this case and based on the return receipt it does say
that it was received by C. Rosenberg, but the signature says COVID-19, so I am not
feeling confident that indeed the respondent received it in this case as the signature
does not in any way co-inside with the last name of the person who received it
GH-I think what is likely the case is that he owner was suggesting on the return receipt
that there was a problem due to COVID19, I am not sure if there is a past practice as to
trying to determine the signatures of the owner, or if the post office has any kind of
procedure as to where they would just place COVID19 on there, without knowing that it
is hard to know, but it is a return receipt that came back from the post office in terms if
it's going to service its going to service I am not sure why someone wrote COVID19 on
there, I would assume that certainly wasn't Officer Smith and if the post office provided
that to us someone must have written that on there
RA-okay, so you are saying the SOV/NOH was properly received by the respondent in
this case from the postal service
GH-correct if the post office sent this back it would be on them to show that they done
this properly, I understand your honors concern with someone writing COVID19 on it,
but the problem is that the post office is the one who does this, but we have to assume
in the absence of hearing form Carole Rosenberg LLC that the post office somehow
committed some kind of fraud
RA-yes
GH-in the absence of that we have to go with that this and it could be something as
simple as the person signing for this was simply trying to say there was some issue due
to COVID19

GH-that said if this is going to service, I think it should with the procedures from the post
office and we should insure and I'm sure that Officer Smith would try to make contact, if
need be, I can always send a letter on firm letterhead or the City of Okeechobee
letterhead to this owner and remind them of their obligations this assist with this hearing
RA-okay because my concern is that if we make this finding and the lien starts accruing
and that if the property owner comes back in the future to challenge the lien in this case
and say that they never received it and we go back and see that there is no support and
the respondent actually places a signature of his name, that is my only concern Mr.
Smith if you could let us know and clarify this issue with the postal service if they
actually put the name in there or if they somehow handed it to the person for them to
sign and they didn't want to sign it because of COVID issues, at least we could have
some confirmation that they actually received it so this won't be an issue in the future

RA-okay for purpose of this hearing, Mr. Smith I don't actually feel comfortable with
making a finding in this case as the property was not posted and the person who signed
the certified return receipt signed COVID19 and it does not resemble the name of the
person who actually received it and I am not feeling that comfortable I think we should
defer this to the next meeting and continue to make contact with the owner in this case
and we will just defer it to the next hearing

VII. FINE REDUCTION REQUESTS
A. Case Number 200616010; Okeechobee Church Old Regular, 201 Southwest 10t" Ave;
Violation of Code of Ordinances Chapter 30, Sections 30-43 Public nuisances, 30-44
General cleaning and beautification (Exhibit 4).
AS-In violation of Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning
and beautification for overgrown grass, shrubs, and bushes. On December 16, 2020, a
SOV/NOH was mailed via USPS certified return receipt. On January 12, 2021, Special
Magistrate found them in violation and imposed a$10.00 per day fine, plus a$50.00
administrative fee. On April 21, 2021, Lien/Order was recorded at the County Clerk of
Court. Fine accrual began on June 8, 2021. On March 31, 2022, Code Officer Smith
spoke with Warren Kelly and advised him to get the property into compliance and the
fine would stop accruing. On April 4, 2022, Code Officer Smith inspected the property
and found the property to be in compliance. The City recommends a fine reduction of
75% plus a$50.00 administrative fee, reducing the fine from $2,990.00 to $747.50 plus
the $50.00 administrative fee, totaling $797.50

RA-Mr. Kelly, good evening, you heard the facts stated by the certified Code
Enforcement Officer Mr. Smith pertaining to the violations in this case, I am glad to hear
that the violations have been corrected and the property is now in compliance, the city is
recommending that the lien in this case be reduced by 75 percent all the way down to
$747.50 plus an administrative fee for the time that it was in violation, do you have any
objection or anything to add.

January 13, 2021 Code Officer Sterling spoke with Mr. Sheppard (863) 763-7347 advised

December 9, 2021 Assist. Code Officer Curl received a call from Ronald Gilman who asked if
he was able to enter the property. He was advised that we do not have
any control over who can enter the property, but we do have an active
code violation case against the property, and the property is still accruing
a daily fine. Mr. Gilman stated that he would try to get ahold of someone
who lives in town and see if they can get the property mowed and

March 31, 2022 Warren Kelly called in and spoke with Code Officer Smith and asked how
much was the fine that accrued on the property. I advised him that if
brought the property into compliance today the fine total would be
$3,040.00. He asked if there is anyway to get the total lowered and I
advised him to fill out a fine reduction form and the case could be heard
at the next hearing April 12th. He advised that his wife would be in to fill
out the form today.
April 4, 2022 Code Officer Smith inspected the property: in compliance, all the
overgrown vegetation was cut and cleaned up. Photos in file. Case
Closed.

CONCLUSIONS OF LAW: The owner of the property described above has been found in violation of: City Code

ORDER: The City of Okeechobee Code Enforcement Special Magistrate has determined you have violated City
Code of Ordinances Chapter 30, Section 30-43 Public nuisances and Section 30-44 General cleaning and
beautification concerning your property located at 201 Southwest 10'h Avenue, Okeechobee, Florida.
If you do not correct the violation 14 Days after proper notification or notify the Code Enforcement Officer of the
correction, the Magistrate imposes a fne of $10.00 per day, including a one-time administrative fee of
$50.00, commencing that date and continuing to accrue daily until the violation is corrected or the City
is notified by you and verifies the correction, which ever first occurs. Further, if you do not correct the
