The Pledge of Allegiance was led by Special Magistrate Azcona. II. ATTENDANCE Code Enforcement Officer Christina Curl called the roll. Special Magistrate Roger Azcona, Esquire, City Attorney Greg Hyden, Code Enforcement Officer Anthony Smith were present. III. CHANGES TO AGENDA Special Magistrate Azcona asked whether there were any agenda items to be added, deferred, or withdrawn; there were none. IV. APPROVAL OF MINUTES AND ADMINISTRATION OF OATH A. Special Magistrate Azcona approved the December 13, 2022, Hearing Minutes. B. This being a Quasi-Judicial proceeding, Special Magistrate Azcona collectively administered an Oath to: Code Officers Smith, Curl, Mrs. Pamela Arnold, Mr. Vernon Arnold, Mrs. Selena Taylor, Mr. Perry S. Arnold, Jr., and Mr. Charles Holt; all affirmed. Code Officers Smith, Curl stated for the record all events regarding the Cases to be discussed occurred within the corporate limits of the City of Okeechobee. The Officer's notes, testimony, photographs, and support documents were all entered as part of the official record. V. FINE REDUCTION REQUESTS CONTINUED A. Case No. 220128007; Perry Sylvester Arnold, Jr., 620 Northeast 4th Avenue [Legal Description: Lots 5 and 6 of Block 80, CITY OF OKEECHOBEE, Plat Book 1, Page 10 or Plat Book 5, Page 5, Okeechobee County public records]. Code Officer Smith testified that the property was found in violation of Code of Ordinances Chapter 30, Sections 30-41 Disabled vehicles, 30-43 Public nuisances, 30-44 General cleaning and beautification and Chapter 82, Section 82-124 Permits on March 8, 2022, where a fine in the amount of $50.00 per day starting 21-days after the date of the Hearing, plus a one-time $50.00 administrative fee was imposed. The imposed fine began accrual on April 5, 2022. The property was brought into compliance on July 26, 2022. Mrs. Selena Taylor submitted a request for a fine reduction on August 23, 2022. Mrs. Arnold requested that the fine be dismissed due to special circumstances. On October 11, 2022, Mrs. Arnold submitted an Adjudication as to Incapacity into evidence The City recommends a fine reduction of 75-percent, plus a $50.00 administrative fee. Based on the evidence provided, Special Magistrate Azcona ruled to reduce the fine by 100- percent, reducing the fine to zero. VI. COMPLIED CASES A. Case No. 221119009; David Salas and Olga Lidia Jimenez, 503 Northeast 3rd Street [Legal Description Lots 10,11,12 of Block 118, CITY OF OKEECHOBEE, Plat Book 1, Page 10 and Plat Book 5, Page 5, Okeechobee County public records]. No action on this matter was requested but is noted for the record to have been in violation of Code of Ordinances, Chapter 54, Section 54- 51 Parking in residential neighborhoods, Chapter 30, Sections 30-43 Public nuisances. B. Case No. 221118022; Anne M. Land, 500 Northwest 16th Street [Legal Description: Lot 1 and East half of Lot 2 of Block 69, CONNERS HIGHLANDS, Plat Book 1, Page 21, Okeechobee County public records]. No action on this matter was requested but is noted for the record to have been in violation of Code of Ordinances Chapter 30, Section 30-41 Disabled vehicles. VII. NEW CASES A. Case No. 221025009; Charles E. Holt, 1010 Southwest 11 th Avenue [Legal Description: Lots 19 and 20 of Block 22, SOUTHWEST ADDITION TO OKEECHOBEE, Plat Book 2, Page 7, Okeechobee County public records]. Code Officer Smith testified that the property is in violation of Code of Ordinances Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification for having overgrown vegetation and debris all over the property. The respondent is not a repeat violator. A Courtesy Card was mailed via United States Postal Service (USPS) regular mail on October 10, 2022. The property was inspected and found to be non-compliant on October 22, 2022. January 10, 2023, Special Magistrate Hearing, Page 1 of 4 VII. NEW CASES CONTINg6 89 A. CONTINUED: A Statement of Violation/Notice of Hearing (SOV/NOH) was mailed via USPS certified return receipt on October 25, 2022. The notice was received by Charles Holt on October 28, 2022. The property was inspected and found to be non-compliant on December 8, 2022 and January 4, 2023. To comply with City Ordinances the property owner needs to remove all overgrown vegetation and debris from the property. The City recommends a fine of $50.00 per day, to begin 21-days after the Special Magistrate Hearing on January 10, 2023, unless the property owner brings the property into compliance on or before that date, plus a $50.00 administrative fee. Based on the evidence provided, Special Magistrate Azcona found Case No. 221025009 to be in violation of Code of Ordinances Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification and imposed a fine of$50.00 per day plus a one-time administrative fee of $50.00 should the property fail to come into compliance within 21- days after the date of this Hearing. B. Case No. 221119010; Okeechobee Commons, LTD do Property Tax Eagle, 402 Northwest 10ih Street [Legal Description: Lots 1 to 6 Inc., Lots 14 to 26 Inc., and all vacated alley lying between Lots 1 to 6 and Lots 21 to 26 and South half of vacated alley lying between Lots 7 to 13 and 14 to 20 of Block 29, CITY OF OKEECHOBEE, Plat Book 1, Page 10, Okeechobee County public records]. Code Officer Smith testified that the property is in violation of Code of Ordinances Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification for having several roofs in need of repair/replacement and overgrown vegetation all over the property. The respondent is not a repeat violator.A Courtesy Card was mailed via USPS regular mail on October 25, 2022. The property was inspected and found to be non-compliant on November 17, 2022 and November 19, 2022. A SOV/NOH was mailed via USPS certified return receipt on November 19, 2022. The City has not received the SOV/NOH nor receipt of signature card as of the date of this Hearing. The property was inspected and found to be non-compliant on December 21, 2022. A Notice to Appear was posted on the property and on the public notices board at City Hall on December 27, 2022. The property was inspected and found to be non-compliant on January 3, 2023. To comply with City Ordinances the property owner needs to remove all the overgrown vegetation and complete the roof repairs/replacements. The City recommends a fine of $75.00 per day to begin 21-days after the Special Magistrate Hearing on January 10, 2023, unless the property owner brings the property into compliance on or before that date, plus a $50.00 administrative fee. Based on the evidence provided, Special Magistrate Azcona found Case No. 221119010 to be in violation of Code of Ordinances Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification and imposed a fine of$75.00 per day plus a one-time administrative fee of $50.00 should the property fail to come into compliance within 21- days after the date of this Hearing. C. Case No. 221118020; Michael Ethan Holsombach, 1010 Southeast 5'h Street [Legal Description: Lots 2 and 3 of Block 6, WRIGHT'S FIRST ADDITION TO OKEECHOBEE, Plat Book 1, Page 13, Okeechobee County public records]. Code Officer Smith testified that the property is in violation of Code of Ordinances Chapter 30, Sections 30-41 Disabled vehicles, 30-43 Public nuisances, 30-44 General cleaning and beautification for having an untagged/disabled boat, overgrown vegetation, and debris all over the property, the exterior of the structure in need of being cleaned, and the roof repaired/replaced. The respondent is not a repeat violator. A Courtesy Card was mailed via USPS regular mail on October 25, 2022. The property was inspected and found to be non-compliant on November 16, 2022. She stated that "Mr. Arnold 1 comprehends very little of what is actually being said, so when they said the car needed to be removed along with this being done...what stuck was the car being removed so he called his brother, and his brother immediately went and removed the car..." The family was not aware of the violations until Mr. Arnold went to jail. Ms. Salena Taylor testified stating that "it was not until a stranger had brought her a letter from her brother's mailbox that she seen the letter from Code Enforcement, and she immediately went to find out what can be done to stop this." Ms. Christina Curl of the Okeechobee Code Enforcement stated she was at the scene and explained to Mr. Arnold what was going on and that things needed to be corrected. At the time, Ms. Curl felt he acted like he understood what she was saying to him. City Attorney, Mr. Hyden, asked Mr. Smith if the lien reduction in this case is consistent with the City's Lien Reduction schedule, in which case Mr. Smith affirmed that it is. Mr. Hyden argued that the city has a policy of how they recommend fine reductions and certainly sympathize with the guardianship matters but all residents and applicants have to be treated the same way. He further stated, if we start parceling out that a homeowner is involved in some type of litigation that gets more sympathy than a different type of litigation then the city opens itself up to claims of nepotism, so the city has established a policy by which it provides consistent recommendations on requests for fine reductions. This is a property owner, there is an obligation to maintain the property that was not done, and a fine was imposed pursuant to the rules that govern our staff and the city ordinances. I think the city was consistent with the fine reduction that was recommended so we stand by that fine reduction. Code Officer Smith testified that the property was found in violation of Code of Ordinances Chapter 30, Sections 30-40 Junk, 30-43 Public nuisances, 30-44 General cleaning and beautification on February 8, 2022, where a fine in the amount of $50.00 per day starting 21-days after the date of the Hearing, plus a one-time $50.00 administrative fee was imposed. The imposed fine began accrual on March 9, 2022. The property was brought into compliance on August 17, 2022. Home Discounters LLC submitted a request for fine reduction on August 18, 2022. Home Discounters LLC requested that the fine be reduced by 90 percent as the property was brought into compliance immediately upon them taking possession. The City recommends a fine reduction of 75-percent, plus a $50.00 administrative fee. Code Officer Smith testified that the property is in violation of Code of Ordinances Chapter 30, Sections 30-40 Junk, 30-43 Public nuisances, 30-44 General cleaning and beautification for having a washing machine and a grill in the middle of the yard, debris, and overgrown vegetation all over the property. The respondent is not a repeat violator. A Courtesy Card was mailed via United States Postal Service (USPS) regular mail on August 23, 2022. The property was inspected and found to be non-compliant on September 8, 2022. A Statement of Violation/Notice of Hearing (SOV/NOH) was mailed via USPS certified returned receipt on September 8, 2022. The City has not received the SOV/NOH nor receipt of the signature card as of the date of this Hearing. The property was inspected and found to be non-compliant on September 22, 2022 and October 5, 2022. The Pledge of Allegiance was led by Special Magistrate Azcona. II. ATTENDANCE Assistant Code Enforcement Officer Christina Curl called the roll. Special Magistrate Roger Azcona, Esquire, City Attorney Greg Hyden, Code Enforcement Officer Anthony Smith were present. III. CHANGES TO AGENDA Special Magistrate Azcona asked whether there were any agenda items to be added, deferred, or withdrawn; there were none. IV. APPROVAL OF MINUTES AND ADMINISTRATION OF OATH A. Special Magistrate Azcona approved the August 9, 2022, Hearing Minutes. B. This being a Quasi-Judicial proceeding, Special Magistrate Azcona collectively administered an Oath to: Code Officers Smith, Curl, Mrs. Pamela Arnold, Mr. Vernon Arnold, Mrs. Selena Taylor, Mr. Perry S. Arnold, Jr., and Mr. Greg McKinless; all affirmed. Code Officer Smith stated for the record all events regarding the Cases to be discussed occurred within the corporate limits of the City of Okeechobee. The Officer's notes, testimony, photographs, and support documents were all entered as part of the official record. V. FINE REDUCTION REQUESTS A. Case No. 211202009; Home Discounters LLC (Melissa Dee Harden), 1008 Southwest 2nd Street [Legal Description: Lot 17 and East half of Lot 16 of Block 4, SOUTHWEST ADDITION TO OKEECHOBEE, Plat Book 2, Page 7, Okeechobee County public records]. Code Officer Smith testified that the property was found in violation of Code of Ordinances Chapter 30, Sections 30-40 Junk, 30-43 Public nuisances, 30-44 General cleaning and beautification on February 8, 2022, where a fine in the amount of $50.00 per day starting 21-days after the date of the Hearing, plus a one-time $50.00 administrative fee was imposed. The imposed fine began accrual on March 9, 2022. The property was brought into compliance on August 17, 2022. Home Discounters LLC submitted a request for fine reduction on August 18, 2022. Home Discounters LLC requested that the fine be reduced by 90 percent as they brought the property into compliance immediately after they took possession of the property. The City recommends a fine reduction of 75 percent, plus a $50.00 administrative fee. Based on the evidence provided, Special Magistrate Azcona reserved ruling until on or before the next Hearing to review all evidence. B. Case No. 220128007; Perry Sylvester Arnold, Jr., 620 Northeast 4"' Avenue [Legal Description: Lots 5 and 6 of Block 80, CITY OF OKEECHOBEE, Okeechobee County public records]. Code Officer Smith testified that the property was found in violation of Code of Ordinances Chapter 30, Sections 30-41 Disabled vehicles, 30-43 Public nuisances, 30- 44 General cleaning and beautification and Chapter 82, Section 82-124 Permits on March 8, 2022, where a fine in the amount of $50.00 per day starting 21-days after the date of the Hearing, plus a one-time $50.00 administrative fee was imposed. The imposed fine began accrual on April 5, 2022. The property was brought into compliance on July 26, 2022. Mrs. Selena Taylor submitted a request for a fine reduction on August 23, 2022. Mrs. Arnold requested that the fine be dismissed due to special circumstances. The City recommends a fine reduction of 75 percent, plus a $50.00 administrative fee. Case No. 220812010; Robbie Lee Melear and Tammy Lynn Jordan, 1004 Northwest 6th Street [Legal Description: East half of Lot 15 and all of Lot 16 of Block 17, NORTHWEST ADDITION TO OKEECHOBEE, Plat Book 1, Page 25, Okeechobee County public records]. Code Officer Smith testified that the property is in violation of Code of Ordinances Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification and International Property Maintenance Code (IPMC)Chapter 3, Section 304.1.1 Unsafe conditions, for overgrown vegetation all over the property, the structure needs to be secured and the roof replaced. The respondent is not a repeat violator. A Courtesy Card was mailed via United States Postal Service (USPS) regular mail on July 28, 2022. The property was inspected and found to be non-compliant on August 11, 2022. A Statement of Violation/Notice of Hearing (SOV/NOH) was mailed via USPS certified returned receipt on August 12, 2022. The notice was returned/unable to forward on August 23, 2022. The property was inspected by Building Official Jeff Newell and A Notice of Condemnation was posted on August 22, 2022. A Notice to Appear was posted on the property and on the public notices board at City Hall on August 25, 2022. The property was inspected and found to be non-compliant on September 6, 2022. To comply with City Ordinances the property owner needs to remove all the overgrown vegetation, repair or replace the roof, secure the structure and general cleaning and maintenance of the structure and property. The City recommends a fine of$50.00 per day, to begin 21-days after the Special Magistrate Hearing on September 13, 2022, unless the property owner brings the property into compliance on or before that date, plus a $50.00 administrative fee. I asked where they slept because the house is extremely small, and Mrs. Taylor reported they "slept on the floor...even in the kitchen". Further, she reported that AIP has one child for whom he signed over custody to foster care in 1974. /en/ Name and address of extended care facility (if any): N/A Alleged incapacity is: Limited cognitive functioning due to a history of two brain aneurysms resulting in memory loss and cognitive impairment. DIAGNOSIS: AIP was admitted to JFK hospital in West Palm Beach and to HCA Florida Trauma Center in Ft. Pierce due to 2 separate incidences of brain bleeds. PROGNOSIS: Poor RECOMMENDED COURSE OF TREATMENT: AIP will benefit from nursing care services coming into his home regularly to help manage his hygiene and nutrition. AIP will further benefit from having someone help manage his disability income and pay his bills. A full physical assessment is also recommended. AIR will best be served by residential care in a memory care facility. II. AIP claims he does not know if he has a primary care physician nor the last time he had a medical check-up. I called the Senior Service Case Manager (Betty Simmons) who claims she has no record of AIP. Mental Health Examination: I administered the St. Louis University Mental Status Examination (SLUMS). AIP score was in the"dementia" range for a person with less than a high school education. (AIP has an 8th grade education) AIP claimed he has 3 children but did not know their names. His hygiene is poor. His nails were crusted with dirt, his hair, body and clothing were soiled. The house is neglected to the point of having no water because the "well caved in". Three dogs live in the home with AIP and Ms. Widdon who said "he (AIP) cannot feed himself, let alone these dogs...people just dropped the big dog off to him". AIP claims he can read so I had him read a short passage. He struggled through but could not finish the entire sentence. Ms. Widdon claims she writes and reads for AIP. Functional Assessment: AIP lacks daily functioning activities. He cannot drive, maintain personal hygiene, or cook for himself. It is evident that AIP and his home have been severely neglected. If any of the three parts of the comprehensive examination were not indicated or could not be accomplished for any reason, the reason for the omission must be explained. CALL TO ORDER Special Magistrate Azcona called the Code Enforcement Special Magistrate Hearing to order on Tuesday, March 8, 2022, at 6:01 P.M. in the City Council Chambers, located at 55 Southeast 3rd Avenue, Room 200, Okeechobee, Florida. The Pledge of Allegiance was led by Special Magistrate Azcona. II. ATTENDANCE Assistant Code Enforcement Officer Christina Curl called the roll. Special Magistrate Roger Azcona, Esquire, City Attorney Greg Hyden, and Code Enforcement Officer Anthony Smith were present. III. CHANGES TO AGENDA Special Magistrate Azcona asked whether there were any agenda items to be added, deferred, or withdrawn; there were none. IV. APPROVAL OF MINUTES AND ADMINISTRATION OF OATH A. Special Magistrate Azcona approved the February 8, 2022, Hearing Minutes. B. This being a Quasi-JudiciaY proceeding, Special Magistrate Azcona collectively administered an Oath to: Code Officers Smith, Curl; all affirmed. Code Officer Smith stated for the record all events regarding the Cases to be discussed occurred within the corporate limits of the City of Okeechobee. The Officer's notes, testimony, photographs, and support documents were all entered as part of the official record. V. COMPLIED CASES A. Case No. 200824010; Yvette Banner, 913 Northwest 91h Street [Legal Description: Lot 7 of Block 43, CITY OF OKEECHOBEE, Plat Book 5, Page 5, Okeechobee County public records]. No action on this matter was requested but is noted for the record that the evidence gathered, and the lien/order recorded on this case was filed on the incorrect address. A Release of Lien was recorded on February 14, 2022, releasing the property of all sanctions. VI. CONTINUED CASES A. Case No. 210125007; Glenn Frank Prescott, 1009 Southwest Park Street [Legal Description: Lot 3 and West half of Lot 2 of Block 4, SOUTHWEST ADDITION TO OKEECHOBEE, Plat Book 2, Page 7, Okeechobee County public records]. Code Officer Smith testified that the property is in violation of Code of Ordinances Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification for an unsecured house, house in need of being cleaned, overgrown grass, weeds, trees, bushes, and shrubs. A Statement of Violation/Notice of Hearing (SOV/NOH) was hand delivered to Mr. Prescott on February 16, 2022. Code Officer Smith met with Mr. Prescott at the property to advise him on what needed to be done to bring the property into compliance on February 17, 2022. The property was inspected and found to be non- compliant on March 1, 2022. To comply with City Ordinances, the property owner needs to cut all the overgrown vegetation, clean and secure the home. The City recommends a fine of $25.00 per day, to begin 21-days after the date of the Special Magistrate Hearing on March 8, 2022, unless the property owner brings the property into compliance before that date, plus a $50.00 administrative fee. Based on the evidence provided, Special Magistrate Azcona found Case No. 210125007 to be in violation of Code of Ordinances Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification and imposed a fine of $25.00 per day plus a one-time administrative fee of $50.00 should the property fail to come into compliance within 21-days after the date of this Hearing. To comply with the City's Code of Ordinances, the property owner needs to remove all trash and debris and clean up the toys by placing them neatly against the building. The City recommends a fine of $50.00 per day, to begin 21-days after the date of this Hearing, unless the property owner brings the property into compliance on or before that date, plus a $50.00 administrative fee. The respondent is not a repeat violator. A SOV/NOH was mailed via USPS certified return receipt on January 28, 2022. The notice was received by Perry Sylvester Arnold on February 2, 2022. The property was inspected and found to be non -compliant on February 14, 2022, and March 1, 2022. To comply with City Ordinances, the property owner needs to remove the untagged vehicle, all the junk and debris from the property, obtain permits for the two structures and clean the exterior of the home. The City recommends a fine of $50.00 per day, to begin 21-days after the date of the Special Magistrate Hearing on March 8, 2022, unless the property owner brings the property into compliance before that date, plus a $50.00 administrative fee.
