The Special Magistrate, having given the Respondent's representative, Mr. Greg McKinless, an opportunity to be heard, and arguments from counsel for the City of Okeechobee, Mr. Greg Hyden, with testimony from Code Enforcement Officer Anthony Smith, reserved ruling on this matter for further consideration upon thorough review and consideration of the record. At the time of the hearing, Code Enforcement Officer Anthony reiterated the record facts causing the existing lien to accumulate to its present amount of $8,000.00 and stated the City of Okeechobee was recommending a lien reduction of 75% pursuant to the City's fine reduction schedule, and therefore reducing the lien to $1,987.50, plus a $50.00 administrative fee. The total amount due after the City's recommendation is $2.037.50. The property came into compliance on August 17, 2022, after being found in violation on February 8, 2022. (See transcript for specific details on the testimony of Mr. Smith). In response, Mr. McKinless, said Home Discounters, LLC bought the property and received the certificate of title on July 25, 2022, and obtained the writ of possession dated August 1, 2022. The former occupants were evicted on August 4, 2022. Immediately upon possession, they began renovation and cleaning up the property and brought it to code on August 15, 2022, when they called Code Enforcement to inspect the property. Home Discounter's LLC request that the fine be reduced further to 90% because they were only in possession for a short period even though the former owners were in violation for much longer period. 1 City Attorney, Mr. Hyden, asked Mr. Smith if the lien reduction in this case is consistent with the City's Lien Reduction schedule, in which case Mr. Smith affirmed that it is. This Court after reviewing the records pertaining to this case and having carefully considered the testimony of all witnesses and arguments of both parties, this Court finds that a lien reduction by 75%, which comes to the amount of Two Thousand Thirty-Seven Dollars and Fifty Cents ($2,037.50), including the $50 administrative fees, under the facts and circumstances of this case is reasonable and fair. While this court commends the new owners for immediately bringing the property into compliance with the City's Code Ordinances, the new owners were also under obligation to know of any existing liens due against the property from the former owner's code violations. A 75% lien reduction is already a substantial consideration to the new owners and any further reduction would be unjustified under the circumstances. Case No. 211202009; Home Discounters LLC (Melissa Dee Harden), 1008 Southwest 2' Street [Legal Description: Lot 17 and East half of Lot 16 of Block 4, SOUTHWEST ADDITION TO OKEECHOBEE, Plat Book 2, Page 7, Okeechobee County public records]. Code Officer Smith testified that the property was found in violation of Code of Ordinances Chapter 30, Sections 30-40 Junk, 30-43 Public nuisances, 30-44 General cleaning and beautification on February 8, 2022, where a fine in the amount of $50.00 per day starting 21-days after the date of the Hearing, plus a one-time $50.00 administrative fee was imposed. The imposed fine began accrual on March 9, 2022. The property was brought into compliance on August 17, 2022. Home Discounters LLC submitted a request for fine reduction on August 18, 2022. Home Discounters LLC requested that the fine be reduced by 90 percent as they brought the property into compliance immediately after they took possession of the property. The City recommends a fine reduction of 75 percent, plus a $50.00 administrative fee. Case No. 220128007; Perry Sylvester Arnold, Jr., 620 Northeast 4th Avenue [Legal Description: Lots 5 and 6 of Block 80, CITY OF OKEECHOBEE, Okeechobee County public records]. Code Officer Smith testified that the property was found in violation of Code of Ordinances Chapter 30, Sections 30-41 Disabled vehicles, 30-43 Public nuisances, 30- 44 General cleaning and beautification and Chapter 82, Section 82-124 Permits on March 8, 2022, where a fine in the amount of $50.00 per day starting 21-days after the date of the Hearing, plus a one-time $50.00 administrative fee was imposed. The imposed fine began accrual on April 5, 2022. The property was brought into compliance on July 26, 2022. Mrs. Selena Taylor submitted a request for a fine reduction on August 23, 2022. Mrs. Arnold requested that the fine be dismissed due to special circumstances. The City recommends a fine reduction of 75 percent, plus a $50.00 administrative fee. Case No. 220812010; Robbie Lee Melear and Tammy Lynn Jordan, 1004 Northwest 6th Street [Legal Description: East half of Lot 15 and all of Lot 16 of Block 17, NORTHWEST ADDITION TO OKEECHOBEE, Plat Book 1, Page 25, Okeechobee County public records]. Code Officer Smith testified that the property is in violation of Code of Ordinances Chapter 30, Sections 30-43 Public nuisances, 30-44 General cleaning and beautification and International Property Maintenance Code (IPMC)Chapter 3, Section 304.1.1 Unsafe conditions, for overgrown vegetation all over the property, the structure needs to be secured and the roof replaced. The respondent is not a repeat violator. A Courtesy Card was mailed via United States Postal Service (USPS) regular mail on July 28, 2022. The property was inspected and found to be non-compliant on August 11, 2022. A Statement of Violation/Notice of Hearing (SOV/NOH) was mailed via USPS certified returned receipt on August 12, 2022. The notice was returned/unable to forward on August 23, 2022. The property was inspected by Building Official Jeff Newell and A Notice of Condemnation was posted on August 22, 2022. A Notice to Appear was posted on the property and on the public notices board at City Hall on August 25, 2022. The property was inspected and found to be non-compliant on September 6, 2022. To comply with City Ordinances the property owner needs to remove all the overgrown vegetation, repair or replace the roof, secure the structure and general cleaning and maintenance of the structure and property. The City recommends a fine of$50.00 per day, to begin 21-days after the Special Magistrate Hearing on September 13, 2022, unless the property owner brings the property into compliance on or before that date, plus a $50.00 administrative fee. The imposed fine began accrual on October 26, 2020. The property was brought into compliance December 13, 2021, leaving an accrued fine of $103,300.00. The City recommended a 90 percent reduction plus a $50.00 administrative fee. Mr. Kinty requested that the fine be reduced to $1,000.00, as he was unaware that the lien had accrued to such a point as the documents were being sent to Mr. Charles Wadlington. Based on the evidence provided, Special Magistrate Azcona reserved ruling until the end of the week to review all evidence. The property was inspected and found to be non -compliant on March 4, 2021, June 25, 2021, and October 1, 2021. A Statement of Violation/Notice of Hearing (SOWNOH) was hand delivered to Mr. Prescott on November 3, 2021. The January 11 th Hearing was cancelled, case was postponed to February. A SOWNOH and Public Notice of Hearing Cancellation was hand delivered to Mr. Prescott on January 10, 2022. The property was inspected and found to be non -compliant on February 2, 2022.
