This email is to officially advise you that the Board of Adjustment at its regular meeting on November 18,
2021, approved your request to allow outdoor sales and storage in the Heavy Commercial Zoning District,
(Ref. Code Sec. 90-283(5)) located at 204 NW 13th Street for the proposed use of a storage facility with
the followinq conditions: a detailed site plan be submitted to staff providing type of landscape buffer and
location, precise location and height of fence, layout of paved parking/drive aisles, and drainage areas;
Rezoning Petition No. 21-006-R is approved by the City Council, and landscape buffering is provided to
the South and West.
There are two important timelines you need to be aware of regarding Special Exceptions. Per Sec.
70-348(4) of the City Land Development Regulations, Special Exception use; variance. Special
Exception use and variance approvals shall have a valid period of nof more than two years, prior
to which a building permif application must be submitted or the approval shall lapse. Per Sec. 70-
373(f), Nonuse. lf the special exception use granted by the board of adjustmenf should fail fo exisf
or fail to be used for a continuous period of 180 days, then such use shall lapse and the current
owner be required to reapply as provided in this division. In case of hardship, where the loss of
such special exception would maferially affect the integrity of any mortgage or other financing
arrangemenf on the subject real property, fhe board of adjustmenf may consider such hardship in
granting a renewal of such special exception.

I. CALL TO ORDER
Chairperson Hoover called the regular meeting of the Board of Adjustment for the City of
Okeechobee to order on Thursday, November 18, 2021, at 6:10 P.M. in the City Council
Chambers, located at 55 Southeast Third Avenue, Room 200, Okeechobee, Florida.
II. ATTENDANCE
Roll was taken by Board Secretary Patty Burnette. Chairperson Dawn Hoover, Vice
Chairperson Doug McCoy, Board Members Phil Baughman, Karyne Brass, Rick Chartier,
Mac Jonassaint, Joe Papasso and Alternate Board Member Jim Shaw were present.
Alternate Board Member David McAuley was absent.
III. AGENDA AND PUBLIC COMMENTS
A. There were no items added, deferred, or withdrawn from the agenda.
B. Motion by Board Member Papasso, seconded by Board Member Baughman to
approve the agenda as presented. Motion Carried Unanimously.
C. There were no comment cards submitted for public participation.
IV. MINUTES
A. Motion by Board Member Chartier, seconded by Board Member Papasso, to
dispense with the reading and approve the October 21, 2021, Board of Adjustment
Regular Meeting minutes. Motion Carried Unanimously:

CHAIRPERSON HOOVER OPENED THE QUASI-JUDICIAL PUBLIC HEARING AT 6:11
P.M.
A. Special Exception Petition No. 21-007-SE requests to allow outdoor sales and
storage in the Heavy Commercial Zoning District, (Ref. Code Sec. 90-283(5))
located at 204 NW 13t" Street for the proposed use of a storage facility.
1. No oath for testimony was administered.
2. City Planning Consultant Mr. Jim LaRue with LaRue Planning and
Management Services briefly reviewed the Planning Staff Report
recommending approval with conditions.
3. Mr. Muhammad Nooruddin, Registered Agent of the Property Owner, NASSA
Management Group, LLC was present (arrived at 6:15 P.M.) and available
for questions. Board Members discussed whether there was a need for
lighting and whether buffering/fencing was necessary.
4. No public comments were offered. For the record there were 15 surrounding
property owner notices mailed, signage was posted on the subject parcel and
the Petition was advertised in the local newspaper.
5. No Ex-Parte disclosures were offered.
6. Motion by Board Member Brass, seconded by Board Member Jonassaint to
approve Special Exception Petition No. 21-007-SE as presented in [Exhibit 1
which includes the standards and findings as required for granting petitions
per Code Section 70-373; and the Planning Consultant's analysis of the
findings] with the following special conditions: a detailed site plan be
submitted to staff providing type of landscape buffer and location, precise
location and height of fence, layout of paved parking/drive aisles, and
drainage areas; Rezoning Petition No. 21-006-R is approved by the City
Council, and landscape buffering is provided to the South and West. Motion
Carried Unanimously.

The matter for consideration by the City of Okeechobee Board of Adjustment is a Special
Exception to allow a storage facility in the CHV district. The property is a vacant 0.402 acre
parcel designated Commercial on the Future Land Use Map and is currently zoned Residential
Multiple Family. The applicant has submitted a concurrent request to rezone to Heavy
Commercial.
City Code Section 90-283 lists 'enclosed warehouse and storage' as a special exception use in
the CHV district.

Section 70-373(b) requires that the Applicant address the following standards for granting a
Special Exception during their presentation to the Board of Adjustment. The Applicant has
submitted, as part of the submission, brief statements and information addressing these
standards. These are repeated below in Times Roman typeface exactly as provided by the

Reason for rezoning and special exception applications

The prospective land use of this property is heavy commercial, and the current zoning is
residential multifamily (RMF). This property is directly across the street from Auto car shop and
next to an existing storage facility. As a result, it will blend in with the surrounding companies
and properly.
We intend to have open storage for RVs, boats, and vehicles, as well as maybe under the
covered shed. We intend to install an electric outlet for boats and RVs. Okeechobee is in
desperate need of a low-cost facility with an outlet to keep boats and RVs in working order.
The facility will be surrounded by a protective fence with code entry to get in and out for
security reasons. For security, the facility will be encircled by protective fence with code entry
to get in and out. For monitoring, a surveillance camera will be installed.
The operation will be carried out remotely or via the internet. At the location, there will be no
employee.
I feel the planned project will be a positive addition to Okeechobee and a decent use of the
vacantland.

Thank you for taking the time to go over my application 21-007-SE. Here are the answers to your inquiries.
1. A structure will not be constructed on a 0.4-acre land.
2. To match the neighboring storage property, the planned fence will be 6 feet tall with a 1-2-foot barb wire on the top
angle.
3. In the attachment with the retention ponds, I set out the suggested parking for RV or boats. In the attached sketch, I
incorporated the setback and the fence markings that the city requires. According to my calculations, it's 15 feet east,
west, and north, and 20 feet south. (fulfills the city's requirements)
4. The landscaping, trees, and shrubs are stated in the scratch, with the most important trees in the front and the
required trees across the property to meet city requirements.
5. Each tenant will be given a separate code, key, or smartphone access (considering the most cost-effective and secure
option) to the entrance gate for 24-hour monitoring, surveillance, and access.
6. The entire land will be covered in asphalt millings/gravel.
7. I hope this has answered all of your questions; please let me know if you have any more. I'll hire a firm to do the site
plan for further approval and development after it's approved.

requirements are being met, and should include:
• Proposed building footprint, dimensions and setback measurements from property lines
• Location and height of proposed fencing/gates
• Layout and dimensions of the paved parking facility including parking spaces and drive aisles
• Landscape buffer area location and dimensions
Also, please provide a description of how access to the facility will be handled. Will there be an automated gate system
for patrons? Will access be restricted at certain times of day or will it be unrestricted? Provision of this information will
assist me in making my recommendation to the Board of Adjustment and will assist the board members in their
decision making. Please let me know if you have any questions regarding the code requirements for this development
