MOU Renewal 2021-08-01 to 2022-07-31� (Tra�c Control Preemption MOUexten.cion 2021-2022J �►i�\���1��,���� MEMORANDUM OF UNDERSTANDING BETWEEN OKEECHOBEE COUNTY AND THE CITY OF OKEECHOBEE FOR THE ADMINISTRATION OF TRAFFIC CONTROL PREEMPTION This Renewal of Memorandum of Understanding (hereinafter "MOU"') is made and entered into effective the lst day of August, 2021, between OKEECHOBEE COL7NTY, a political subdivision of the State of Florida (hereinafter the "COUNTY") and the CITY OF OKEECHOBEE, a municipal corporation in the state of Florida (hereinafter the "CITY"). WHEREAS, the COi1NTY and the CITY are political subdivisions of the State of Florida, having a responsibility to provide certain services to benefit the citizens of Okeechobee County and the City of Okeechobee; and WHEREAS, the COiJNTY provides fire and emergency services withim both the county and the incorporated limits of the city; and WHEREAS, the COLTNTY has fire rescue stations within the City of Okeechobee; and WHEREAS, the CITY agrees that the COLJNTY sometimes needs to preempt the traffic control devices of the CITY for the purpose of swift and efficient movement of fire and rescue vehicles; and WHEREAS, the parties entered into a MOU effective August 1, 2020, to set out the general understanding of the working arrangement between the parties for the operation and management of traffic signal preemption and to provide predictability for the parties; and WHEREAS, the parties have operated under the MOU since its effective date and are satisfied with the other party's performance and both parties desire to extend the MOU for an additional year. NOW, THEREFORE, the parties set forth the following understandings for the purpose of renewing the working arrangement and procedures that have been contemplated by the COUNTY and the CITY, and in consideration of the premises, and in consideration of the mutual conditions, covenants and obligations hereafter expressed, it is agreed as follows: Recitals. The foregoing recitals are true and correct and constitute the material basis for this Renewal. Said recitals are hereby ratified and made a part of this Renewal of MOU. 2. Renewal. The MOU entered into effective August 1, 2020, is hereby renewed and extended for an additional one (1) year term, through July 31, 2022. All remaining terms, provisions, and conditions of the MOU entered into and effective on August 1, 2020, remain in full force and effect. Motion by Council Member Jarriel, seconded by Council Member Clark to read proposed Ocdinance No. 1230 by title only, regarding Comprehensive Plan Small Scale Future Land Use (FLU) Map Amendrnent Application No. 21-004-SSA [as provided in Exhibit 4]. Motion Carried Unanimously. Mayor Watford read proposed Ordinance No. 1230 by title only as follows: "AN ORDINANCE OF THE CITY OF OKEECHOBEE, FLORIDA; AMENDING THE CITY OF OKEECHOBEE COMPREHENSIVE PLAN ORDINANCE NO. 635 AS AMENDED, BY REVISING THE FLU MAP ON A CERTAIN TRACT OF LAND MORE PARTICULARLY DESCRIBED HEREIN FROM SINGLE FAMILY RESIDENTIAL (SFR) TO INDUSTRIAL (IND) (APPLICATION NO. 21-004-SSA); PROVIDING FOR INCLUSION OF ORDINANCE AND REVISED FLU MAP IN THE COMPREHENSIVE PLAN; PROVIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE." Motion by Council Member Jarriel, seconded by Council Member Keefe to adopt proposed Ordinance No. 1230. City Planning Consultant Mr. Ben Smith of LaRue Planning and Management Services presented the Planning Staff findings together with the Planning Board's review on July 15, 2021, and found the requested IND FLU designation for the subject property to be consistenfi with the City's Comprehensive Plan, reasonably compatible with adjacent uses, and consistent with the urbanizing pattern of the area. Mayor Watford opened the floor for public comment. Mr. Steve Dobbs, 209 Northeast 2"d Street, Okeechobee, was present on behalf of the applicant and available for questions. Motion Carried Unanimously. B. Motion by Council Member Chandler, seconded �y Council Member Clark to read proposed Ordinance No. 1236 by title only, amending Code Section 2-172 and Chapter 34 related to Fire Services Interlocal Agreement with Okeechobee County [as provided in Exhibit 5]. Motion Carried Unanimously. Mayor Watford read proposed Ordinance fVo. 1236 by title only as follows: "AN ORDINANCE OF THE CITY OF OKEECFiOBEE, FLORIDA; REVISING SECTION 2-172 AND CHAPTER 34 OF THE CODE OF ORDINANCES TO REFLECT CHANGES AS A RESULT OF THE CITY ENTERING INTO AN INTERLOCAL AGREEMENT WITH OKEECHOBEE COUNTY TO PROVIDE FIRE SERVICES WITHIN THE CITY; PF20VIDING FOR CONFLICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE." Motion by Council Member Jarriel, seconded by Council Member Clark to adopt proposed Ordinance No. 1236.
