SD-when we initially applied these were owned by different people they are owned by

MW-adjust agenda and move on to item F. We had some discussion under public
comment on rezonings that were denied by city so the applicant has had discussion with
staff on going forward. Who is going to take lead>?
GR-I think what led us to this point was I was speaking to BK and concerns because
applicant has been up a couple times and concern is cost to applicant because PB and
CC were at different ends of spectrum on this. Applicant would like to come back and
see if a different use could fit those properties. Before we have them go to next step we
wanted a discussion on this.
MW-couple of things we can do here. Applicant woutd need to pay any fees. Attorney
indicated there is discrepancy with FLU and zoning. Steve?
SD-client is kind of reeting right now was planning on moving to design phase. If we cant
get heavy commercial on these two parcels client does not want to move forward with
the abandonment. My client is questioning the north parcel hasn't come twice the south
has come twice. Client couldn't get permit to build dog house on south parcel there is
nothing he can do with that parcel. Can't make money with the approved uses there
MW-there is a dentist office making money there right now
SD-my client cant make money with it. Heavy commercial ive talked to all of you about
this some are concerned about heavy commercial not sure which they are concerned
about. Client is looking at different options. Did not want to wait several months down
the road with it going back to PB and Council. Did not hear any issues with this from
staff or anything.
MW-this council has a huge responsibility and you know how the process works. The
PB is only a recommendation to the CC. The CC has the final say on these. Council
does not always follow that recommendation. I don't know that its our responsibility to
call and say I'm going to vote against this. If you want to call me I would tell what I
thought but I would also tell you I cannot tell you how I am going to vote because I have
a responsibility to listen to those. I never tell anyone how I am going to vote. I object to
the thing that people don't want to come to Okeechobee. Our previous administrator
would bend over backwards to make sure something got in.

MW-well you did
SD-these are facts. I've spoken to people from out of town and this is what they say. I I
want to live here and I want it to get better.
Phil Berger(?) - Dowling you want to know what you're know as? (???) Okeechobee has
a negative impression from a lot of people from that kind of decision. Were just asking
what it takes to get an investor to spend that kind of money.
Russell Stephens- investing in Okeechobee. We came here with intention of investing
in the city. This project is around 6.5 million but we intend to invest more. Light
commercial just doesn't work for us and if that was the case we would abandon the
project. And also abandon future plans we have here. We would like to work with you
on this and consider this a reasonable application. We thought residential was a real
need here. Failing that we hope you consider heavy commercial for this property.
NC-Discussion with Steve, they wanted to move to Heavy commercial. I'm not against
heavy commercial but then he went with the rest of those reasons. I am all for heavy
commercial but I am offended by both of you.
MW-as I said before we have options if we choose the applicant has submitted a
rezoning application

BK-with that application submitted and fee paid, ill just say it did kind of bother me that
the applicant did come before us spending that money and the discrepancies between
the FLU and Zoning map which have been an issue for years. When we turned away
Penrod last year my opinion was if it was multi family it would be different situation. They
come back and spend the money and get denied again. I would like to see us show
some grace and show we do want growth and improvements in this town. I would not
mind doing this administratively or do app without fees because we've already collected
monies. I've got the zoning permitted uses before I don't see any that I would object to.
JF- tonight we can say staff can move forward with this process
MC-can we administratively change the zoning map?
BS-if you mean city initiated we would take direction on this with the city as the applicant
Patty Burnette-Land use is not needed only a rezoning.
BK-would be a city initiated zoning if we wanted to do that
MW-do we want to instruct staff to come back with city initiated zone change?

permitted and get the process going. Thought it would be good to use same services
with Craig A Smith. Looking at items to be constructed, existing infrastructure get survey
in and conceptual construction plan. Jim Orth from Craig A Smith is here tonight to share
with you what we have come up with to get this completed. Believe we can get this part
down by end of Sep.
Jim Orth Craig A Smith and associates- We were the original engineers. There was a
shortage of money to finish and now as people have bought lots they are doing partials.
Be happy to look at what you got in there. Couldn't do a proposal for a permit because
of some changes and modifications. Want to get a summary of where we are today.
Goal is to finish the surface water mgmt. system so future owners will be ready to go.
MW-this wont get us to a point of applying?

E. Presentation of the scope and design of Cattlemen's Square in Flagler Park by
Calvin, Giordano & Associates (Exhibit 6).
Gianno Feoli- Want to go over what we have been talking about with the FPDRAC. We
are a multidisciplinary firm with a lot of experience including park. Our scope includes
creating a master plan for the 6 parks as well as doing a construction detail plan for
cattlemen's park. We are also looking at the street as it is a vital part of the park area.
What is there now is a lot of empty space. Our objectives were to do something authentic
and spoke to the culture of Okeechobee. In terms of park I think we have created an
exemplary landmark condition with threshold opportunities and synergy with park
system and park road. That includes the sculptures for the cattlemen's sculpture project.
Worked really hard with committee to make something authentic. Looking to stick to
native plants so no long term maintenance. Furnishings that are flexible for the area.
Looking at interactive kiosk which is a bit of a challenge because of the advertising
restrictions in the park. Pavers will have ample space in entrance. Numbers are a little
steep again these are schematic numbers we are pricing in the volatility in the market
right now. Beefier numbers are electrical and planting. We have some wiggle room as
we get into design and development where we could save some money. In terms of
comparison on per acre basis compared to other municipalities the cost of acre is around
450,000 an acre. We can always downgrade parts or phase the project but I thought
these numbers would compare to other municipalities.
MW-I am extremely disappointed I think you missed the point entirely. I thought you
understood this design detail. I think this is too much.
BK-I think its beautiful I love the design. However yes sitting in this seat I know our
budget constraints I'll admit I haven't been to any of the committee meetings. Is this a
culmination of what you and the committees have been working on?
G F-yes
BK-I feel that obviously we need to go back to what our expectations were in the use of
the committee and were we supposed to have periodic updates? Maybe I need to start
going to the meetings as well? Obviously these were ideas approved by the committee.
GF-we've had 3 meetings with the committee where we've presented the designs in
their entirety. Budget was first discussed at the last meeting in FPDRAC defense. We
don't want to design something you cannot build.
MW-when we approved this with OKMS they had a conceptual plan with what it was
going to look like, did you see that?
GF-the previous administrator had us combine that. My understanding is that the arts
and cultural alliance has spoken with donors.
MC-I'm kind of in between the other two. I think this is over the top, the Taj Mahal of how
this could look. I was under the impression that at the last meeting where we approved
the 98,000 we were going to have the money to install the sculptures. Where to find the
money is an issue, we don't have this in the budget. May have to have the community
raise more money. Not sure where the disconnect is this park is in the city limits but
hamrick trust is also involved. Community would need to be involved and I just don't see
us spending 6 mil dollars on these parks. I feel like we could make it very nice without
going this far. I agree that original florida is where we were with this. I thought we were

going to do the basis for all the parks and infrastructure and then start layering them
together.
BK-I love that you took it upon yourself to incorporate the street as part of the commercial
area. Would be wonderful to tie it in somehow. People stop in at the helicopter from out
of town all the time. Disconnect comes from obviously we didn't provide enough
guidance to the committee or you at any point. I appreciate the efforts but Im sure you
know now that this is getting scaled back. I look forward to what the parks will look like
and phasing the parks so they are coming up together.
GF-we expedited this park because there was a timeline for the sculptures
NC-will this be paid for by donors and grants and not taxpayer money?
MW-all the parks would have to be taxpayer and/or grants
MC-just because its in the city limits doesn't mean its only used by the City. This was a
community effort from the start.
NC-what about maintenance?
MW-we pay for maintenance
NC-A lot of maintenance involved in this park. I saw the rendition and you cant see any
buildings from the road
Bridgette Waldau OKMS — Design is beautiful, architect has been great to work with.
Because of the proposed price, we want to make a statement to make sure this whole
thing doesn't take away from our original vision 3 years ago. We never requested much
of these changes, all we wanted from you was to let us put in park 5. We promised you
we would make this a community project. The sculpture side of this has been private
donors who want to fund this. We understand people not wanting to spend tax dollars
on the arts but we are not forcing this on anyone. At beginning of year we were nailing
down the layout. There would have been no way we would have taken this project like
this and dropped in 10 large bronze statues willy nilly. Our infrastructure would not have
been as nice as this but it would have been very nice. OKMS wants to see a vibrant
downtown. I think parks can be upgraded with community tenacity. We do not want to
give up their vision but we've lost a lot of time from COVIDI9 and from having to go
through the Flagler Park Committee. We feel like were at a standstill and we need some
guidance.
Jennifer Tewksbury- As a citizen and member of the FPDRAC I feel like we've been
talking about this a long time and I appreciate continuing to speak on it. The committee
acknowledged that this would not likely be funded when it was provided to us.
Okeechobee has a lot of ideas that get put on shelves. We want the committee and
council to be in sync. Asking you have an open mind on how we can do this. In my
opinion, a lot of this should be funded by private members. The committee wants to do
a good job but we need some direction.
MW-OKMS I understand you want to move on this has been a while going. As I think
about it I think maybe we need to ask the park committee to have OKMS present their
plan for the park and have them look at it and try to work both plans together. Maybe
see if that's some way we could manage.
GR-OKMS right now is on a critical path so I think we need to provide them some
guidance because the sculptures are coming in dec or beginning of year. We cant store
them we need to put them into the ground and we need the concrete pads to do that.
The committee needs to work with OKMS on the footprints and other amenities. Critical
path is to get the pads out there and identify the location. I was concerned after the first
meeting and that's why I brought consultant in.
MC-the meeting where we agreed to spend the money for that plan. At that meeting
there was a lot of discussion that we would be in a position to put those sculptures into
the park.
DA-That money was for plans
MW-the money spent on architect the understanding was the construction plans for the
cattlemen's park. We have to decide what plan we are going with. I think we need to go
back to the park committee and go ahead and place those positions now. If we want to
go further with other stuff we can do that later.
MC-I thought we were going to have plans for where to put this
Jennifer Tewksbury-Is there even a consider what would be a sensible investment per
park? Architect needs something to work from?
MW-staff would need to work on that. I was thinking we were going with OKMS plan and
they were going to construct
NC-cattle already bought?
MW-being built they were all private donors. I think the city had committed the concrete
for the bases.

parameters listed to already work with. This is already established. Shoutd we go with
these amounts as limits?
MW-I think one of our issues is we just did something to cut our millage and now we are
going to talk about 885,000 dollars back. Would like staff to say based on our current
budget this is how much we put towards parks.
GR-I think we have clear direction on where council stands and we have some groups
here with common ground and we can move forward at next meeting.
MW-they meet on 16t" and we meet on 17 so we will know what they want
Kathy Scott FPDRAC-I have been here from the start of cattle drive and I am on
FPDRAC. We had no idea the costs would be that much. We all agreed as a committee
to put the brakes on. We know the economic position of our community so when these
numbers came up we said we need to stop. As a Park Board member we are going to
go back and they are going to ask how much do we have to work with. We've worked
on this for 6 months. We are all busy we want to volunteer but we need direction. Board
is going to ask if we don't have this how much do we have?
MW-My opinion is to let OKMS install it and we can add stuff later. I think we need to
get this going now and get it installed. GR you and IR can get together and see what we
have.

that was difficult to identify how much asphalt we need so these both have contingencies
in case of overrun.
DA-When this was originally presented asphalt is an estimate. There's always an
adjustment on asphalt. The intent was not to have to come back if we were over. Intent
has always been that asphalt is always an estimate. I had incorporated that into my

J. Motion to appoint the Mayor and one Council Member to the Okeechobee Utility
Authority Work Group
MW-in the June meeting OUA appeared before us to request change to interlocal
agreement to allow board members receive compensation. Had to go to county for their
approval and there was discussion about that and other items. Several years ago we
had a group to make change I think county has some concerns they want to change.
County Appointed Chairman Burrough and not sure the other. County is requesting this.
MC-I'll volunteer to work on that

K. Motion to approve disposal of Fire Department equipment (Exhibit 10)
MW-I talked to Chief today and one of his tasks is a list of equipment. He has some
thoughts on how we can sell or dispose some of the equipment. He has contacts with
other depts who need equipment we have and he may be able to negotiate with them.
GovDeals can sell stuff for much less than its worth.
DA-You can always put a minimum bid on GovDeals.
CS-I had spoken with Admin and India about GovDeals. I didn't understand you can
choose a minimum and I didn't want the city getting nothing from the sales. I was going

to explore all of the equipment and figure out how much this is worth. We will probably
try to govdeals first and use a price.
MC-some of this is already part of the contract
CS-yes this is all surplus equipment
MC-I agree we need to sell these
IR-whats before you tonight is just the disposal of equipment of items that are already
at the County. This is formality. You approved the items already in the interlocal but our
policies say this is the process.

VIII. CITY AliORNEY UPDATE
JF-City vs Brenda Kemp. We had a hearing today there was an error in the deed where
it included a homestead parcel it shouldn't have. That had to be resolved. S. Florida
BBQ has been around a long time they hired a lawyer and have agreed to pay the final
judgment in full. Kudos to Code Enforcement staff we have manual tracking system in
place for when notices are going out and timelines. Staff has been doing a great job with
cases and backlog.
IX. CITY ADMINISTRATOR UPDATE
GR-earlier today alluded about staff. Since I have been here I am probably the biggest
champion for this staff. They bend over backwards they communicate outstanding. I just
want to make that elear that staff works very well with the public. When we finish with
the CCRAC we need a workshop with the PB. We got 4 proposals in for RFQ and we
will come back to you with how we want to move forward
X. COUNCIL COMMENTS
NC-we talked about OUA board tonight. Its one thing to pay them $100 or so but we
shouldn't get involved in retirement or anything
BK-None
MC-Kudos to Code Enforcement CSX first time they were cited was 5 yrs ago and they
were out there today. No one realized has much junk they've piled and let the bushes
grow up around it. Anthony spoke with them today and they started cleaning up.
MW-Thank the City police dept quick to respond and I appreciate that
