OFFICIAL MINUTES
I. CALL TO ORDER
Special Magistrate Azcona called the Code Enforcement Special Magistrate Hearing to
order on Tuesday, May 11, 2021, at 6:30 P.M. in the City Council Chambers, located at
55 Southeast 3�d Avenue, Room 200, Okeechobee, Florida. The Pledge of Allegiance
was led by Magistrate Azcona.
II. ATTENDANCE
Assistant Code Enforcement Officer Christina Curl call�d the roll. Special Magistrate
Roger Azcona, Esquire, City Attorney Carlyn Kowalsky, Police Lieutenant Justin Bernst,
Code Enforcement Officer Anthony Smith, and Deputy City Clerk Bobbie Jenkins were
present.
III. CHANGES TO AGENDA
Special Magistrate Azcana asked whether there were any agenda items to be added,
deferred, or withdrawn; Case No. 210127003 was deferred to the June 8, 2021, Special
Magistrate Hearing as requested by City Attorney Kowalsky.
IV. APPROVAL OF MINUTES AND ADMINISTRATIC�N OF OATH
A. Special Magistrate Azcona approved the April 13, 2021, minutes.
B. This being a Quasi-Judicial proceeding, Special Magistrate Azcona collectively
administered an �ath to: Code Officer Smith and Assisfiant Code Officer Curl;
both affirmed. There were no respondents present. Code Officer Smith stated for
the record all events regarding the Cases to be discussed occurred within the
corporate limits e�f the City of Okeechobee. The Officer's notes, testimony,
photographs, and support documents were all entered as part of the official
record.

used as a residence, multiple disabled vehicles and debris on the side lot,
overgrown grass and weeds in the back, and the exterior of the structure needs
cleaning. The prop�rty is a repeat violator. The Statement of Violation/Notice of
Hearing (SOV/NOH) was mailed via United States Postal Service (USPS)
certified mail on March 19, 2021. The return receipt for the SOV/NOH was
returned on March 22, 2021, signed by Brad Goodbread. Code Enforcement Staff
corresponded twice with the property owner between March 19, 2021, and May
10, 2021. The property was still non-compliant when inspected on April 14, 2021,
and May 5, 2021, as the disabled vehicles were still there and the roof of the
home needed to be cleaned.

Code Officer Smi�h testified the property is in violation of Chapter 30, Section 30-
44 General cleaning and beautification for overgrown weeds, grass, bushes,
shrubs, trash around the store and dumpster, and a broken fence around the
property. A Courtesy Card was mailed via USPS regular mail on March 17, 2021.
Code Enforcement Staff corresponded twice with the property owner between
March 17, 2021, a�nd May 10, 2021. The SOV/NOH was mailed via USPS certified
mail/return receipt on April 1, 2021. The r�turn receipt for the SOV/NOH was
returned on April 8, 2021, signed by AEA C19. The property was still non-
compliant when inspected on May 5, 2021, as the fence around the property
remains broken.
Based on the evic�ence provided, Special IVlagistrate Azcona found Case No.
210401010 to be in violation of Code of Ordinances Chapter 30, S�ction 30-
44 General cleaning a beautification and imposed a fine of $50.00 per day
plus a one-time administrative fee of $50.00 should the property owner fail
to come into compliance within 21-days after the date of this Hearing.
C. Case No. 210405015; Capital C Inc, 307 Southwest 3�d Street [Legal Description:
Lots 3 and 4 of Block 182, CITY OF OKEECHOBEE, Plat Books 1 and 5, Pages
10 and 5, Okeechobee County public records]. Violation of International Property
Maintenance Code (IPMC) Chapter 3, Sections 304.1.1 Unsafe conditions and
304.7 Roof and drainage.
Code Officer Smith testified the property is in violation of IPMC Chapter 3,
Sections 304.1.1 and 304.7 for lack of roof, windows, and doors on the building
which prevents building security, in addition to weeds growing inside the building.
A Courtesy Card was mailed via USPS regular mail on March 11, 2021. Code
Enforcement Staff corresponded twice with the property owner befinreen March
11, 2021, and May 10, 2021. The SOV/NOH was mailed via USPS certified
mail/return receipt on April 5, 2021. The return receipt for the SOV/NOH was
returned on April 8, 2021, signed by C19. The property was still non-compliant
when inspected an April 27, 2021, and May 5, 2021, as the property was in the
same condition as the first inspection.

[Legal Description: Lot 51, OKEECHOBEE ESTATES ADDITION, Plat Book 3,
Page 20, Okeechobee County public records]. Violation of Code of Ordinances,
Chapter 30, Sections 30-43 Public nuisance and 30-44 General cleaning and
beautification.
Code Officer Smith testified the property is in violation of Chapter 30, Sections
30-43 and 30-44 for overgrown vegetation, junk, and debris on all four sides of
the home and carport. The property is a repeat violator. Code Enforcement Staff
corresponded with the property owner once between April 5, 2021, and May 10,
2021. The SOV/IVOH was mailed via USPC certified mail on April 5, 2021. The
return receipt for the SOV/NOH was returned on April 12, 2021, unsigned. The
prop�rty was still non-complaint when inspected on April 20, 2021, and May 5,
2021, as it was iro the same condition as the first inspection.
Based on the evidence provided, Special Magistrate Azcona ruled to defer
Case No. 210405013 to the next Hearing and instructed the Code
Enforcement Staff to post the property to ensure the property owners have
been properly n�ticed.
B. Case No. 210323005; Omar Nafal Zaben (La Placita Super Market), 1002
Northwest Park Street [Legal Description: Lots 15,16,17,18,19 and 20, Block 28,
NORTHWEST ADDITION, Plat Book 1, Page 25, Okeechobee County public
records]. Violation of Code of Ordinances Chapter 30, Sections 30-43 Public
nuisance and 30-44 General cleaning and beautification.
Code Officer Smith testified the property is in violation of Chapter 30, Sections
30-43 and 30-44 for a vehicle being parked in the right-of-way on the back side
of the property, urine odor coming from the fence line, with trash and debris
scattered all over fihe property and by the dumpster. The property is a repeat
violator. Code Er�forcement Staff corresponded with the property owner once
between March 23, 2021, and May 10, 2021. The SOV/NOH was mailed via
USPS certified m�il on March 23, 2021. The return receipt for the SOV/NOH was
returned on March 25, 2021, signed by Omar Zaben. The property was still non-
compliant when inspected on April 27, 2021, and May 5, 2021, as there was trash
all over the property, shopping carts left out, and beer bottles along the back
fence line.
Based on the evidence provided, Special IVlagistrate Azcona found Case No.
210323005 in violation of Code of Ordinances Chapter 30, Sections 30-43

Code Officer Smith testified the property is in violation of Chapter 30, Sections
30-43 and 30-44 for trash, broken toys, junk, debris, and tires stacked up against
the house. The pr�perty is a repeat violator. The SOV/NOH was mailed via USPS
certified mail on April 5, 2021. The return receipt for the SOV/NOH has not been
returned as of the Hearing date. The property was still non-compliant when
inspected on April 27, 2021, and May 5, 2021, as trash and debris remain strewn

Special Magistrate will conduct a public hearing on Tuesday, May 11, 2021,
6:30 at PM, or as soon thereafter as possible at City Hall, 55 SE 3rd Avenue,
Council Chamber, Room 200, Okeechobee, Florida.
The public is invited and encouraged to attend. The agenda may be obtained

The respondent is in violation of the violations made mention, recommend $100 per day beginning
21 days after the date of this hearing unless the property owner brings the property into

AS-they are in violation of 30-44 overgrown weeds, grass, bushes and shrubs, trash around store
and dumpster, broken fence around property. Not a repeat violator. Courtesy Card March 17,
2021. Two more communications between Mar 17 and 21, communicate pick up trash, water
vegetation, fix fence.
RA-examining evidence. These pictures represent the condition of this location and they remain
to be in the same condition.
AS-not consistently cleaned. Broken fence has not been repaired.
RA-do see the broken fence in the picture. SOV/NOH issued with correct date for them to appear
today. Mailed to respondent via certified mail and signed for by AEA C19. Properly served and
not returned. Under the circumstances, based on the testimony and evidence provided, the
respondent was properly served, violation of 30-44 and I do see the broken fence as shown in the
pictures. Make a finding there are not a repeat violator, properly noticed, and the City
recommendation is?
AS-$50 per day to begin 21 days after the CE Hearing unless brought into compliance before that
day plus $50 admin fee.
RA-find it is reasonable and impose $50 per day plus a$50 admin fee to begin 21 days after the
CE Hearing.
CK-the reason for the 21 days is to put a date certain in the orders. In the past it says 14 days
after proper notification and there is no date of when the fines are to begin. Since it takes about
4-5 days to get them noticed, we picked 21 days to allow time for notice and possible cleanup.

International Property Maintenance Code Chapter 3 Sections 304.1.1 Unsafe conditions and
304.7 Roof and drainage.
AS-this property is basically they violated IPMC 304.1.1 and 304.7. no windows or doors on
building, no roof and no way to secure building. Weeds growing inside the building. CC March 21.
Mar 11, to May 10 two more correspondences. Either repair building completely or demolish
building.
RA-mr smith you took these pictures. Doesn't look like new construction.
AS-haven't received any communication from the owners. Seemed like they started something
and didn't finish.
RA-after reviewing the files, factual basis for unsafe conditions, there is no roof, examining
SOV/NOH respondent was provided correct date of hearing, they have been informed of the
nature of violation of this case. Don't think this was an actual person to sign.
AS-believe the C19 is due to Covid-19
RA-CK do you think this has been properly noticed.
CK-I don't know what C19 means, I think we should give it another try. I think we did that last
hearing.
RA in this case, it was actually just sent Apr. 5. Mr. Smith did you speak with the property owner
AS-no I have not.
RA-and this was the first time you made attempts to contact someone
AS-yes, two attempts.
RA lets give this one more chance. Due diligence try to see if we can get a hold of someone in
this case. I do see the nature of the violation and it is clear but we need to try to get a hold of a
person to ensure they have been properly noticed. What is the Apr. 9th date
CC-that's when the city received the Return Receipt back.
RA-under the circumstances, is there anything else we can do.
CK-we will give it another try, the law requires us to submit it to the property owner of record.
That's really the only information we have. We'll see if we could find more info.

VI1. REPEAT VIOLATORS
A. Case Number 210405013; Charles and Lucinda Miller, 805 Southeast 10th Street, Violation
of Code of Ordinances Chapter 30, Sections 30-43 Public nuisance and 30-44 General cleaning
and beautification.
AS-violation of 30-43 and 30-44 overgrown vegetation and junk and debris on all 4 sides of home
and carport. They are repeat violators, July 12, 2019 violation of same codes overgrown
vegetation and junk in yard and carport. Aug 4, 2020 30-44 and 30-43. First notified on 4/5/21, we
communicated once more since then on 4/5/21 to 5/10/21 to comply the property owner needs to
clean debris on carport and in yard, overgrown vegetation has been cut at this time.
RA-I see there is no one signed but the RR came back. Did you hand deliver?
AS-no
RA-did you come in contact with anyone at this location
AS-no I haven't, no one is ever home
RA-repeat violator. Looks like someone is living in the home. Did you post anything?
AS-no I did not.
RA any arguments to support violators are properly noticed.

CK-no your honor, although this is a repeat violator, I would just like for the penalties to start
accruing sooner than the next hearing. Post property 14 days accrue fines after posting. We do
need to post the property. I would rather do that and make sure we have an airtight case moving
forward than risk having an argument over not having it properly noticed. Do the same as last
case. But stricter fine and stiffer fine because it being a repeat violator.
RA-wish we could follow up with the postmaster. They're not getting signed. There should be a
statement as to why it wasn't signed for. We will defer this case to allow for the CE Officer to post
the property and attempt to see if we can get an actual signature for the violation so that way we
will have two ways to verify that the respondent was properly served, post the notice and try to
get a signature. Defer one more time to allow for posting and to see if we can get a signed
SOV/NOH RR.
B. Case Number 210323005; Omar Nafal Zaben (La Placita Super Market) 1002 Northwest
Park Street, Violation of Code of Ordinances Chapter 30 Sections 30-43 Public nuisance and 30-
44 General cleaning and beautification.
AS-we received a complaint from a citizen about this property. Violating 30-43 and 30-44 truck in
the store parking in ROW on the back side of property, urine odor from fence line, trash and debris
scattered all over property and by dumpster. Repeat Jan. 2, 2017 violator, April 14, 2020, 30-43
and 30-44 overgrown grass, trash and debris on property. Jan. 8, 2021 violation of CH. 30-43 and
30-44 dumpster overflowing with debris scattered throughout property in neighborhood. First
notified 3/23/21 via SOV/NOH for this date. We communicated on one occasion from 3/23 to 5/10.
Also spoke with manager about debris and they said they will clean it up, that particular will be
cleaned up but there's more somewhere else. They leave trash beside the dumpster. Behind the
property, beer bottles and alcohol containers in the back.
RA-a lot of these pictures are pretty recent. Did you take these pictures
AS-yes
RA-make a finding in this case. Violation of 30-43 for trucks and carts parked in ROW and strong
odor of urine coming from fence line, CH. 30-44 trash and debris scattered all over property. Make
a finding they are repeat violators. I'll find they were properly noticed. NOV sent out and the proper
date is noted. Sent certified and signed for Omar himself. He's not here today. The pictures show
this.

AS-violation of 30-43 and 30-44 trash and broken toys, junk and debris, tires stacked up against
house. July and September 2019, March 3, 2020 and August 2020. All in violation of 30-43 and
30-44 junk and debris all over yard. Made first contact 4/5/21 communicated with them once
between 4/5 and 5/10 to comply with city ordinance. The property will need to be completely
cleaned and all junk removed.
RA looking at packet and looking for the signed RR. Do we have that?
AS-if it's not there, we may not have it. It may need to be deferred.
RA-CK anything to argue. I would suggest, any problem with posting and send certified notice at
the same time. Only thing from adjudicating this today, respondent not properly noticed. Need to
post property. I will defer this to June Hearing to allow AS to post and attempt another service for
next hearing date.

scattered first notified for this case on March 23, 2021. Communicated on one occasion I also
spoke with the Manager about the debris outside I will go back, and that debris will be cleaned
up then I go back and there is other trash and debris scattered. In the back a lot of beer bottles
on the ground.

contact on April 5, 2021, communicated with them once more between April 5, 2021, and May
10, 2021. The property will need to be cleaned up, remove all broken toys, trash and tires need
to be cleaned up.

Azcona noted he would be more comfortable in imposing a fine
in Case No. 210127006 as there is a factual basis for the
allegations of violation of Chapter 30, Section 30-43, and
Section 30-44 if it had been posted since January and all
correspondences mailed had not been returned. The violation
was noted in January, only the Notice to the Post Office Box
was delivered to the owner and the property was posted less
than two weeks from today. He ruled to defer the Case to the
next hearing to allow more time for the owners to bring the
property into compliance and instructed the Code Enforcement
staff to make every attempt to obtain a mailing address to send
the certified Notice. Whether or not the certified Notice is able
to be mailed, he would be more comfortable imposing the fine
at that time.

GENERAL REQUIREMENTS

SECTION 30'I
GENERAL
301.1 Scope. 7'he provisions of this chapter shall govern the
minimum condi[ions and the responsibilities of persons for
maintenance of structures, equipmenl and exter•ia� property.
301.2 Responsibility. The oxo�er of die premises shall main-
tain lhe structures and exlerior property in compliauce with
these requirements, except as otherwise provided for in this
code, A person shaU no[ occupy as owner-occupant or permit
another person to occupy pr•eu�rses that are not in a sanitary
and safe condition and that do not comply with d�e require-
ments of this chapter. Occupanls of a chve/li�ag :rnit, roon�nrg
�mif or housekeepirtg �mrf are responsible for keeping in a
clean, sanitary and safc condition thaC part of the d�ve!/ing
:rnit, raoming uni1, housekeeping rtnit or premises they
occupy and control.
30].3 Vacant structures and land. Vacant structures and
premises lhereof or vacant land shal! be maintained in a
clean, safe, sccure and sanitary condition as provided herein
so as not to cause a b(ighting problem or adversely affect the
public health or safety.
SECTION 302
EXTERIOR PROPERTY AREAS
302.1 Sanitation. Exlerra• property and pren:ises shall be
maintained in a clean, safe and sanitary condition. The occu-
pant shall keep that parl of the exleria• pi•operty that such
occ:rpan! occupies or controls in a ctean and sanitary condi-
tion.
302.2 Grading and drainage. Preinises shall be graded and
maintained to prevent the erosion of soil and to prevent the
accumulation of stagnant water thcreon, or within any struc-
lure loeated thereon.
Exception: Approved retention areas and reservoirs.
302.3 Sidewalks and driveways. 5idewalks, walkways,
slairs, driveways, parking spaces and similar areas shall be
kept in a proper state of repaer, and maintained free from haz-
ardous conditions.
302.4 Weeds. Preseises and exleria• proper•ty shall be main-
tained free Erom weeds or plant growth in excess of [JURIS-
�ICTION TO INSERT HEIGHT IN INCHES]. Noxious weed5 shail
be prohibited. Weeds shali be defined as all �rasses, annual
plants and vegetation, other than lrees or shrubs provided;
however, this term sh�ll not include cultivated flowers and
gardens.
Upon failure of the o�vner or agent having charge of a
property to cut and destroy weeds afier service of a notice of
violation, they shall 6e subject ta prosccu[ion in accordance
with Section 106.3 and as prescribed by the authority having
jnrisdiction. iJpon failure to comply with the notice of viola-
tion, any duly authorized cmployee of the jurisdiction or con-
trac[or hired by the jurisdiction shall be authorized to enter
upon the property in violation and cut and destroy [he weeds
growing thereon, and the costs ofsuch removal shall be paid
by the oumer or agent responsible for the property.
302.5 Rodent harbarage. Structures and ezferia• property
shalf be kept free from rodent harborage and i�rjesla[iwr.
Where rodents are found, they shall bo promptly extermi-
nated by approved processes chat will not bc injurious to
human health. After pest elimination, praper precautions
shall be taken to eliminate rodent harborage and prevenl rein-
festation.
302.6 Exl�aust vents. Pipes, ducts, conductors, fans or blow-
ers shall not discharge gases, steam, vapor, hot air, grease,
smoke, odors or other gaseous or particulate wastes direclly
on abutting or adjacent public or private property or that of
another tenanl.
302.7 Accessory structures. Accessory structures, including
delached garages, fences and walls, shall be maintained
strucNrally sound and in good rep¢ir.
302.8 Motor vehicles. Except as provided for in other regula-
tions, inoperative or unlicensed motor vehicles shall not be
parked, kept or stored on any prenrises, and vehicles shall not
at any time be in a state of major disassembly, disrepair, or in
the process of being stripped a� dismantled. Painting of vehi-
cles is prohibited unless conducted inside an approved spray
booth.
Exceptian: A vehicle of any type is permitted lo undergo
major overhaul, including body work, provided that such
work is performed inside a strucWre or similarly enclosed
area designed and approved for such purposes.

GENERAL REQUIREMENTS
302.9 Dcfacement af property. A person shall not wi(]fully
or wantonfy damage, mutilate or deface any exterior surface
of any structure or building on any private or pubtic property
by placing thereon any marking, carving or graffiti.
It sha!! be the responsibility of the o�+�ner to restore said
surface to an approver! state of maintenance and repair.
SECTION 303
SWIMMING POQLS, SPAS AND HOT TUBS
303.1 S�vimming pools. S�vimming pools shall be main-
tained in a clean and sanitary condition, and in good repair.
303.2 Enclosures. Private swimming pools, hot tubs and
spas, containino water more fhan 24 inches (6l0 mm) in
depth shall be completely surrounded by a fence or barrier
not IcsS than 48 inches (1219 mm) in height above the fin-
ished ground level measured on the side of the barrier away
fiom the pool. Gates and doors in such barriers shall be self-
closing and self-iatching. Vdhere the self-latching device is
less than 54 inches (1372 rnm) above the bottom of t6e gate,
the release mechanism shail be focated on the pool side of the
gate. Self-closing and self-latching gates shall be maintained
such that ihe gate will positively close and latch when
released from an open position of 6 inches (152 mm) from the
gatepost. An existing pool enclosure shall not be removed,
replaced or chan�ed in a manner that reduces its effcctiveness
as a safety barrier.
Exeeption: Spas or hot tubs �vith a safety cover tliat com-
plies with ASTYf F1346 shall be exempt from the provi-
sions of this section.
SECTION 304
EXTERIOR STRUCTURE
304.1 General. The exterior of a structure shall be main-
tained in good repair, struc[uratly sound and sanitary so as not
to pose a threat to the public health, safety or welfare.
30411 Unsafe conditions. The follo�ving sonditions
shall be dctermined as unsafe and shall be repaired or
replaced to comply with thc L�ter•national Building Code
or the Internalianal Existing &�itding Code as required for
existing buildings:
1. The nominal strength of any structural member is
exceeded by nominal loads, the load effects or tlie
required strength.
2. The auchorage of the floor or roof to walls or co1-
umns, and of walls and columns to foundations is
not capable of resisting all nominal loads or load
effects.
3. Structures or components thereof that have
reached their timit state.
4. Siding and masonry joints includin� joints
between the building envelopc and the perimeter
of windows, doors and sl.ylights are not main-
taioed, weather resistant or water tight.
5. Structaral members that have evidence of deterio-
ralion or that are not capable of safely supporting
afl nominat loads and load effects.
6. Poundation systems that are not firmly supported
by footings, arc not plumb and free from open
cracks and breaks, are not properly arrchored or
are not capable of supporting ail nominal loads
and resisting all load effects.
7. Exterior walls H�at are not ancl�or-ed to suppor[ing
and supported elements or are not plumb and free
of holes, cracks or breaks and loose or rotting
materials, are not properly anchored or are not
eapable of supporting ail nominal loads and resist-
ing all load effccts.
8. Roofing or roofing components that have defects
that admit rain, roof surfaces �vith inadequate
drainage, or any poition of the roof framing that is
not in good repair ���ith signs of deteriaralion,
fatigue or without proper anchorage and incapable
of supporting all nominal loads and resisting all
load effects.
9. Flooring and flooring components wikh defects
that affect serviceabiliry or flooring components
that shotv signs of deter•ia•ation or fatigue, are not
properly anchored or are incapable of supporting
all nominal loads and resisting all load effects.
10_ Veneer, cornices, belt courses, corbels, trim, watt
facings and similar de�orative features not prop-
erly anchored or that are anchored wikh connec-
tions not capable of supportino all nomiaal loads
and resisting all load effects.
11. Overhang extensions or projections including, but
not limited to, trash chutes, canopies, marquees,
signs, awnings, fire escapes, standpipes and
eahaust ducts not properly anchored or Chat are
ancho!•ed �vith conneotions not capable of support-
ing all nominat loads and resis6ng ail load elfects.
]2. Exterior stairs, decks, porches, balconies and all
siniilar appurtenances attached thereto, including
grrards and handrails, are not structurally sound,
not properly anchored or that are anchored �vith
cannections not capable of supporting all nominal
loads and resisting all load effects.
13. Chimneys, cooling to��ers, smokestacks and simi-
lar appurtenances not shuccurally sound or not
properly anchored, or that are anchored wi[h con-
nections not capable of supporting all nominal

GENERAL REQUIREMENTS
decay-resistant woods; shall be pcatected from the elements
and decay by paintin� or odier protective covering or treat-
ment. Peeling, flaking tuid chipped paint shall be eliminated
and surfaces repainted. Siding and masonryjoints, as wcll as
those bet�veen the building envelope and the perimeter of
windows, doors and skylights, shall be maintained weather
resistunt and water tiaht. Me[al surfaces subject to rust or cor-
rosion shall be coated to inhibit such rust and corrosion, and
surfaces with rust or corrosion shall be stabilized and coated
to inhibit future rust and eorrosion. Oxidation stains shall be
removed from exterior surfaces. Surfaces designed for stabili-
zation by oxidation are exempt from this requiremcnt.
[Fj 304.3 Premises identification. Buildings shall have
appro>>ed address numbers placed iii a position to be plainly
legible and visible from the street or road fronting the prop-
erty. These aumbers shall contrast with thcir background.
Address numbers shalt be Arabic numerals or alphabet let-
ters. Numbers shall be not less than 4 inches (102 mm) in
height wiU� a minimum stroke widtli of 0.5 inch (12.7 mm).
304.4 Structural members. Structural members shatl be
maintained fi•ee from de�er•io�•atim7, and shali be capable of
safcly supportin� [he imposed dead and live loads.
304.5 Found�tion walis. Foundation �valls shall be main-
tained plumb and free from open cracks and breaks and shall
be kept in such condition so as to prevent the entry oCrodents
and other pests.
304.6 Exterior �valis. Exterior walls shall be free from holes,
breaks, and loose or rottino materials; and maintained weath-
erproof and properly surface coated where required to pre-
vent deferioralion.
304.7 Roofs and drainage. The roof and flashing shall be
sound, tight and not have defects that admit rain. Roof drain-
age shall he adequate to prevent dampness or deterior•ation in
the waUs or interior port[on of the structure. Roof drains, �ut-
ters and do��mspouts shall be maintained in good repair and
frec from obsttvctions. Roof �vatcr shatl not be discharoed in
a manner that creates a public nuisance.
304.8 Decorative features. Cornices, belc courses, corbels,
terra cotta trim, wal] Yacings and similar decorative features
shall be maintained in good repair with proper anchorage and
in a safa condition.
304.9 Overhane extensions. Ovcrhang extensions including,
but not limited to, canopies, marquees, signs, metal awnings,
fice escapes, srzndpipes and erhaust ducts shall be maintained
in good repair and be property ni7cha•ed so as to be kept in a
sound condition. Where required. all exposed surfaces of
metal or wood shall be protected from the elements and
agains[ decay or rust by periodic application ofw�eather-coat-
ing matcrials, such as paint or similar surface treatment.
304.10 Stairways, decks, porches and b�lconies. Every
exterior stairway, deck, porch and balcony, and all appurte-
nances attached fhereto, shall be maintained stivcturally
sound, in good repair, with proper anchorage and capable of
supporting the imposed loads.
304.1] Chimneys and towers. Chimneys, cooling towers,
smoke stacks, and similar appurtenances shall bc maintained
structurally safe and sound, and in good repair. E:cposed sur-
faces of inetal or wood shall be protected from the etemen[s
and against decay or rust by periodic application oE'weather-
coating materials, such as paint or similar surface treatment.
304.12 Handrails and guards. Evcry handrail and grrard
shall be tirmly f'astened and capable of supporting normally
imposed loads and shall be maintained in good condition.
304.13 Window, skylight and daor frames. Every windo�v,
sl.ylight, door and (rame shall be kept in sound condition,
good repair and weather tight.
304.13.1 Glazing. Glazing materials shall be maintained
free from cracks and holes.
304.13.2 Openable windows. Every window, other than a
fixed window, shall be easily openable and eapable of
being held in position by window hardware.
304.14 Insect screens. During the period irom [DATE] to
[DATE7, every door, window and other outside opening
required for ventilntion of habitable rooms, food preparation
areas, food service areas or any areas where products to be
included or utilizcd in food for human consumption arc pro-
cessed, manufactured, packaged or stored shall be supplied
with approred tightly fittine screens of minimum 16 mesh
per inch (16 mesh per 25 mm), and every screen door used for
iasect control shall have a self-closing de��icc in good work-
ing condition.
Exception: Screens shail not be required �vhere adter
approved means, such as air curtains or insect repellent
fans, are employed.
304.15 Doors. Extcrior doors, door assemblies, operator sys-
kems if provided, and hard�vare shall be mai^tained in good
condition. Locks at all entrances to dwelling units and sleep-
ing u�its shal! tightly secure the door. Locks on means of
egress doors shall be in accordance with Seation 7023.
304.16 B�sement hatchways. Ever�� basement hatchway
shall be maintained to prevenf the entrance of rodenis, rain
and surface drainage water.
304.17 Guards for 6asement windows. �very basen�ent
window that is opcnable shall be supplied with rodent shields,
storm windo�vs or otlier approred protection against the entry
of rodents.
304.58 Suilding security. Doors, «�indows or hatchivays for
d���elling:�nils, room units or horrsekeeping:rnits shall be pro-
vided �vith devices designed to provide security tor the occ:r-
pants and property within.
304.18.1 Doors. Doors providing access to a rii>>e!ling
unit, rooming :rni� or housekeeping unit tl�at is rented,
leased or let shall be equipped with a deadbolt lock
designed to be readily openable from the side from which
egress is lo be made without [he need for keys, special
knowledgc or cffort and shall havc a minimum look throw
of 1 inch (25 mm). Such deadbolt locks shall be installed
according to the manufacturer's specifications and main-
tained in good workin� order. For the purpose of this sec-
tion, a sliding bolt shall not be considered an acceptable
deadbolt lock.
304.18.2 VVindows. Operable windo�vs Iocated in whole

Pursuant to Florida Statutes 162.02 and 162.12, Florida Statutes, and the Code of Ordinances of City of
Okeechobee, I(hereinafter the "City of Okeechobee), the undersigned Code Enforcement Officer hereby gives
notice of an uncorrected violation of the City of Okeechobee Code, as more particularly described herein, and

and trash that is scattered around the propertv and dumpster. Remove the truck
and store carts from the Citv right-of-way. Pressure clean fine line to remove the
strong urine order.

Pursuant to Florida Statutes 162.02 and 162.12, Florida Statutes, and the Code of Ordinances of City of
Okeechobee, I(hereinafter the "City of Okeechobee), the undersigned Code Enforcement Officer hereby gives
notice of an uncorrected vioiation of the City of Okeechobee Code, as more particularly described herein, and
hereby requests a Hearing before the Okeechobee City Code Enforcement Special Magistrate.

Inspector to verify compliance, with the Okeechobee City Code Section(s) cited herein, you are hereby called upon to take
notice that a Hearing will be held in this cause before the City of Okeechobee Code Enforcement Magistrate on the 11 th
day May. 2021 at 6:30 P.M., located at 55 SE 3rd Ave Okeechobee City Hali, Okeechobee Ftorida 34974 in
Council Chambers. The Magistrate will receive testimony and evidence at said Hearing and shall make findings of fact and
conclusions of law as are supported by the evidence and testimony, and shall make an order thereupon. You are entitled to be
represented by counsel, present evidence, and present testimony. Please be advised that any evidence presented to the
Magistrate for his consideration will be retained by Code Compliance Department. If ou f' appeaz at the heazing the
Magistrate may enter an Order of Violation, & impose a fine in your absence.

STATEMENT OF VIOLATION AND NOTICE OF HEARING
Pursuant to Florida Statutes 162.02 and 162,12, Florida Statutes, and the Code of Ordinances of City of
Okeechobee, I(hereinafter the "City of Okeechobee), the undersigned Code Enforcement Officer hereby gives
notice of an uncorrected violation of the City of Okeechobee Code, as more particularly described herein, and
hereby requests a Hearing before the Okeechobee City Code Enforcement Special Magistrate.

Unless Respondent corrects the vio(ation described herein by the date set forth above AND contacts the undersigned Code
Inspector to verify compliance, with the Okeechobee City Code Section(s) cited herein, you are hereby called upon to take
notice that a Fiearing will be held in this cause before the City of Okeechobee Code Enforcement Magistrate on the 11 th
day May. 2021 at 630 P.M., located at 55 SE 3rd Ave Okeechobee City Hall, Okeechobee Florida 34974 in
Council Chambers. The Magistrate will receive testimony and evidence at said Hearing and shall make findings of fact and
conclusions of law as are supported by the evidence and testimony, and shall make an order thereupon. You are entitled to be
represented by counsel, present evidence, and present testimony. Please be advised that any evidence presented to the
Magistrate for his consideration will be retained by Code Compliance Department. If you fail to a r at the hearing the
Magistrate may enter an Order of Violation, &c itnpose a fine in your absence.
