WITNESSETH WHEREAS, this Agreement concerns the property owned by Bella Rose located at 311 N.E. 2"d Street, Okeechobee, Florida 34972 ("Property"); and WHEREAS, the Special Magistrate conducted a hearing in Case No. 200312003 relative to the Property on March 9, 2021 resulting in a Report and Recommendation to the City Council of OkeecYiobee ("Recommendation") which recomrnended that Bella Rose's fines of $14,600.00 be reduced by fifty percent together with applicable administrative fees; and, W�EREAS, at the April 20, 2021 City Council Meeting, the City approved the Special Magistratc's Recommendation against Bella Rose which thereafter filed its Notice of Appeal to the Ninete��nth Judicial Circuit in and for Okeechobee County, Florida on May 19, 2021; and, WHEREAS, the Parties mutually desire to resolve their differences by entering into this Agreenient and believes that this Agreement is fair and reasonable, and each has assented freely and voluntarily to all of its terms without pressure, duress or coercion. NOW, THEREFORE, in consideration of the mutual covenants, promises, terms and conditians herein contained, and for other good and valuable considerations each to the other given, r��ceipt and sufficiency of which is acknowledged, it is mutually covenanted, promised and agreed a.s follows: 1. RECITALS. The above recitals are true and correct and are incorporated in their entirety by reference into this Agreement. 2. ADEOUACY OF CONSIDERATION. The consideration for this Agreement is the mutual benefits obtained by the Parties and the promises made by each to the other. The Parties admit the: adequacy of consideration for this Agreement. 3.. REPRESENTATION BY COUNSEL. Each party has had the opportunity to be represented by independent legal counsel of their own selection in the negotiation of this Agreeme:nt. The City is represented by R. Gregory IIyden, Esq. and Bella Rose is represented by Donn S. Dutton, Esq. The Parties understand the facts and terms of this Agreement and have had adequate �pportunity to become fully informed as to their legal rights and obligations and each is signing tl�.is Agreement intending to be bound by it. 4. REMEDIATION OF THE PROPERTY. As of the date of this Agreement, Bella Rose has iixlly remediated the property and it is in compliance with the City's Code of Ordinances. 5. SETTLEMENT SUM. The Parties acknowledge and agree that the Bella Rose shall pay the City the sum of $4,500.00 ("Settlement Sum") as and for its settlement of the accumulated fines and administrative costs inclusive of attorney's fees incurred in this action. Settlement Sum shall be paid by certified funds no later than August 31, 2021. If the Settlement Sum is not received by that date, this Agreement is deemed null and void. 6. FUTURE NON-COMPLIANCE. Bella Rose agrees that the Property shall remain in conzpliance during their period of ownership. The Parties acknowledge and agree that should ithe City issue a Notice of Violation relative to the property, Bella Rose shall remediate the propem� in no less than 24 hours from the date of receipt of the Notice of Violation. '7. MUTUAL REPRES�NTATIONS. The Parties represent to each other that each underst��nds and agrees that this Agreement constitutes the entire contract of the Parties. It supersec�es any prior understanding or oral agreements between them. Thus, any addendum modification or waiver of any of the terms of this Agreement shall not be effective unless it is expressed in an instrument of equal dignity by the Parties. 8. SENEFIT. All of the provisions of this Agreement shall inure to the benefit of and shall be binding upon the Parties, unless otherwise stated herein. 9. JURISDICTION AND VENUE. Flarida law shall govern the validity, construct:ion, interpretation and effect of this Agreement. The Parties agree that the courts of coinpetent jurisdiction sitting in the Circuit Court of the Nineteenth Judicial Circuit, in and for Okeechol�ee County, Florida shall have exclusive jurisdiction in any suit by the Parties to enforce their righ�s hereunder, and that venue is proper in that court. 1(J. COUNTERPARTS. This Agreement may be signed in one counterpart signature or more c�ounterparts each of which, when executed with the same formality and the same manner as the ori€;inal, shall constitute an original. 11. FAILURE TO ENFORCE. Each of the provisions of this Agreement are separate and independent of one another. Either party may insist upon the waiver of or the right of any party to cc�mpel performance of another provision of this Agreement. If any provision of this Agreement is held by a Court of competent jurisdiciion to be valid or unenforceable, the remaining provisions shall continue in full force and effect without being imp��ired or invalidated in any way. However, the Court having jurisdiction may adjust the equitie�; herein to accornplish the intent of the Parties as to any provision held invalid or unenforceable. 12. S�VERABILITY. Each of the provisions of this Agreement are separate and independent of one another. Either party may insist upon the enforcement of any provision of this Agreement without insistence upon the waiver of or the right of any party to compel performance of another provision of this Agreement. If any provision of this Agreement is held by a Court of competent jurisdiction to be invalid or unenforceable, the remaining provisions shall continue in full forcE; and effect without being impaired or invalidated in any way. However, the Court having jurisdicti'on may adjust the equities herein to accomplish the intent of the Parties as to any provision held inv��lid or unenforceable. 13. SUI2VIVAL. Any and all of the terms and provisions of this Agreement shall survive the execution and delivery of this Agreement and shall continue in force and effect indefinite,ly. 1��. ENFORCEMENT OF AGREEMENT. The Circuit Court having jurisdiction over this �cause shall retain jurisdiction to enforce all of the terms and provisions of this Agreement and the F`inal Judgment in this cause shall contain an express provision for the Court to retain jurisdictican for that purpose. 15�. ENTIRE AGREEMENT. The parties acknowledge that this Agreement contains the full ar�d complete agreement between and among them, and that there are no oral or implied agreemen�ts or understandings not specifically set forth herein. Each party acknowledges that no other parh�, or attorney of any other party, or any person, firm, corporation or any other entity has made any promise, representation, or warranty, whatsoever, express, implied, or statutory, not contained herein, concerning the subject matter hereof, to induce the execution of this Agreement. 16. M011IFICATION. The parties agree that no modifications of this Agreement may be made w:iless expressly agreed to in writing by the Parties. 17• PARAGRAPH HEADINGS. I want to come back around to this matter again, as we are: getting to the point where I will have to order a transcription, compile the record and prepare tPoe initial brief, and I truly believe that with a measure of reasonableness on both sides we will not have to embark upon that path. I appreciate the time and attention you gave to me when we discussed this matter recently. In short, n�y client seeks to appeal this decision of the city council because we do not believe that same is based upon evidence that was before the magistrate, and secondly that the fines are not supported by the pertinent municipal code and Florida law. Fir:�t, Mr. Rose is operating an active retail business and utilizing his adjacent warehouse space for I�is walk-in tub installation work in a commercially zoned area — which also happens to be across the� street from City Hall. Every morning products are delivered, unloaded, boxes are opened and packaging materials and debris are created. That typically takes place befinreen 8:00 a.m. and 11:00 a.m. — which coincidentally is when all of the pictures in the code-enforcement file were taken, according to the date stamps. By the end of the day that material has been packed up and removed. Throughout the summer months of 2020 this occurred. And during this time a number of photos we:re taken on different mornings — a snapshot in time — and warning notices were issued. Significan�Ely, each and every fime Mr. Rose received a notice he went to the code enforcement office to speak �vith them, and he promptly undertook necessary efforts to address any issues. ThE� notice letters generated and received in the latter half of September mark the events from which the imposition of the fines started. Mr. Rose says that upon receiving a Notice of Fine Letter on 9/21/2()20 he promptly went to the Code Enforcement Office to meet with Melissa Close, the in- office stafi� person there. Melissa also recognized the gravity of the matter, and she left the office to go and pE:rsonally visit the site with Mr. Rose. [Mr. Rose recounted this meeting at the code enforcemE:nt hearing before the Special Magistrate.] Rightly orwrongly, Ms. C/ose assured him that he was in compliance and fhere were no active violations. She also suggested to him that if he erected an opaque fence, there would be no further cause for trouble or notices in the future. Creg Hyden Letter July 21, 2021 Page 2 WE: can take notice of the fence permit that Mr. Rose took out on 9/21/2020 — the day of his conversateon with Ms. Close. This corroborates the conversation he had with her. Unfortunately she left the cit�� very quickly thereafter over personal and health-related reasons, and apparently did not document her conversation with Mr. Rose in the file. But there is this permit, which I have attached, which wo�.ild not have been pulled but for the suggestion of Ms. Close. The fence that was erected shortly thereafter conceals the view of any of packaging materials and debris that are generated daily. I w��uld submit that what we have here is a matter of detrimental reliance. Mr. Rose relied upon the iinformation and directives made to him by a city employee. Based upon the assurances made by AJIs. Close, and by him proceeding to erect an opaque fence, Mr. Rose had no reason to believe th��t he was still in violation. Much less did he have reason to know that on October 13, 2020 a fine ha�� begun to accrue on his now-compliant property. Moreover, there is no further document��tion in the department's file which shows that any violations were ongoing at this point. The last p�icture (that I can find) which the city has to rely upon is dated 09/10/2020. Nearly four months lat�r, in January of 2021, Mr. and Mrs. Rose learned that the fines had been accruing, even though a f��nce had been erected and their property was otherwise in compliance. Sec�ondly, F.S. 162.21 & Okeechobee Code of Ordinances SEC. 18-75 provide that the maximum �civil penalty shall not exceed $500.00 for each civil violation. The argument can be made that these are the appropriate code sections to apply. This is not a case where there is a continuous violation w�here the property owner is obstinately refusing to comply — wherein a daily fine may be appropriat��. Issues with the Bella Rose Day Spa were not that of a fixed, static violation, like an offending ��ign or structure or broken down car or boat which can be photographed on one da#e and shown to be exactly the same months later. This is an active warehouse / commercial site, and every picture is rlifferent. The conditions that were photographed were cleaned up every afternoon. As such, the irnplementation of these daily fines is procedurally flawed and improper. This is particularly the case given the complete absence of any evidence in the record to demonstrate that any of the violations were continuous in nature after October 13, 2020. The Roses have great love and respect for the community and deeply regret any difficulties that have �nsued as a result of their actions, or lack thereof. They also feel that they are being treated uni'airly and seek a mitigation of the penalties — and ultimately, an amicable resolution of this matter. Tc�wards that end, William Rose has authorized me to offer the sum of $2,500.00 in as a settlement of this matter and dismissal of the appellate action. March 12, 2021 In March 2020 the City provided the property owner with a Notice of Violation of Sections 30-43 and 30-44 of the City's Code of Ordinances. The City provided several additional notices after that. In August 2020, after proper notice, the Special Magistrate held a hearing and entered a Lien/Order against this property. He also testified 1:hat he came to the Police Department and spoke with former Code Enforcement Clerk, Ms. Melissa C;lose, who allegedly told him that "there were no fines, and everything was ok." Mr. Rose stated that whenever former Code Enforcement Officer, Mr. Fred Sterling, came to inspect the property and take pictures that Mr. Sterling did not confront him about the violations and that Mr. Sterling was surreptitiousl5- taking pictures and leaving without speaking with him concerning any violations. Mr. Rose requested that his fines be reduced to zero amount. In res��onse, City Attorney Carlyn Kowalsky presented the testimony of Officer Anthony Smith, who reiterated all the efforts by Code Enforcement to bring the Respondent's property into compliance. Mr. Smith testified under oath that the violations were first brought to the owner's attention on March 12, 2020 wheri a Statement of Violation and Notice of Hearing was received by a person who signed "Hailey M" at the address. Several Statements of Violation and Notice of Hearing were also served on the respondent. Officer Smith noted on the record that the Respondent, Mr. Rose, "had been difficult" to work with as he had made several attempts to contact him and leaving several messages concerning the violation. The ;property was inspected 8 times in 12 months and did not come into compliance until March 9, 2021. City Attorney Kowalsky, based on the testimony of Mr. Smith, recommended that the accumulated fines of $14,600.00 be reduced to fifty percent (50%) together with applicable administrative fees. Havin�; carefully considered the testimony and arguments of both parties, this Court also reviewed the records pertaining to this case and find that a second Statement of Violation and Notice of Hearing was served on June 19, 2020 and signed for by "Amanda Markham" at the address, and a third Statement and Notice was sent out and received/signed by "Hailey M." on July 21, 2020. Therefore, this court finds tha.t the Respondent in this case had sufficient notice regarding the Code violations in this matter. This court also finds that the al�eged state�nent th�t "there were no fines, and everything was ok" is refuted by tlie record as the Respondent was served with the Lien Order on September 28, 2020 signed and received by "Hailey M" on behalf of the Respondent. The 90-day letter was also received and signed for by "Hailey M" on January 19, 2021. It is interesting to note that "Hailey M." had received and signed for the Respondent on at least 4 occasions throughout this case with the first Statement and Notice served approximately one year ago on March 12, 2020.
