Review and approve the 2020 Audited Financials - Debbie Goode, Carr, Riggs & Ingram (Exhibit 2). IR-thank you for entertaining Debbie Goode, Senior Auditor of the Firm, review everything with onsite auditors. They do interchange onsite auditors on a regular basis. Jennifer always interjects and looks at things in a fresh light. As it goes through, each person has the opportunity to make recommendations for other things to review. I feel confident when they leave, I also want to commend staff. They're actually the ones who do all the groundwork to make sure things run smooth, following policies and procedures. Payroll, bids, evaluations, all of these things are looked at. If they didn't happen at a staff level, it would roll in to the audit. Debbie Goode-first appreciate kind comments, interesting job we have. But we are tough, and you will see in many other reports have comments, clean audit report. Just do brief highlights. First on page 5, independent auditors report, clean unmodified opinion. Page 21 you will see that all other funds are rolled up. Go down the general fund, unassigned balance. Subsequent years expenditures has been budgeted. 7.7 million available fund balance. Are we financially sound, GFOA look at page 22, look at expenditures. 7.6 million for general fund. Back out capital outlay. About 7 million to operate for one year. Recommend to keep 2 to 3 months aside for operations, may have more money due to projects, 2 to 3 months is minimum balance. Written comments when see this number decreasing. Financially sound based on that criteria. Net change in fund balance $601,000 reduction this year. Look at total revenues and compared year to year. Revenues $130,000 less than last year. Areas less money, $126000 less, investment $119000 less. Taxes and intergovernmental revenues up slightly. $560000 more in expenditures. $277000 increased in general government due to salary increase and added positions. $208000 public safety increase over last year. Page 24 & 25, pension trust funds. Want to see breakdown, page 54 & 55, this schedule is a roll up to the numbers and breaks down in various plans. Page 63 shows budget to actual. Page 64 Police plan: very well funded net pension liability 1.4 million asset in your plan, more money than you need to payout. Positive 115% what liability is when compared to what is in the plan. Very well funded. Don't often see that. Don't know what's going to happen in the investment market. B. Page 70 — this is the OPEB liability is $29000 go up a little this year, differential because you allow retirees purchase insurance at the same rate as the employees, implicit rate, costing you more because of their age, booked as a liability, future liability, can fund this through a trust, not a large enough balance to do that. Page 75 — report on internal controls, totally clean report, no findings, Page 76 — everything clean Page 79 — complied with everything in FS. Again, totally clean report. India does an excellent job on your financial accounting. Required communication, not going thru the letter, estimates in financial statement are stated in this report that starts on page 7. Management signed a rep letter for disclosure. Every time we do unpredictable procedures. We change things up each year. So that is my presentation. The highlights of the FY October 1, 2019 through September 30, 2020, Audited Financial Statements [as provided in Exhibit 2]. The City reflects total assets exceeded liabilities by $19,628,412.00. The total revenues were $6,857,356.00, less total expenses of $7,629,895.00, which resulted in a$772,539.00 decrease in net position. Total net position decreased by $772,539.00 primarily as a result of $890,518.00 decrease in total assets, and an increase of $97,489.00 in total liabilities. Deferred inflows related to pensions decreased $238,912.00 and was offset by decrease of $23,454.00 of pension outflows. The decrease in total assets was primarily due to a$555,050.00 decrease in current assets due to a reduction of cash and investments in the current year to fund operations, a $201,205.00 decrease in noncurrent assets due to a decrease in net pension asset, and a decrease in capital assets of $134,253.00. The net change in current and noncurrent liabilities was $97,489.00 as current liabilities increased by $35,281.00 related to timing of payables and non-current liabilities increased by $62,208.00 resulting from an increase in the compensated absences by $32,286.00 and an increase in the Other Post-Employment Benefits liability obligation of $29,922.00. The City's governmental funds reported combined ending fund balances of $10,901,587.00 a decrease of $593,536.00 in comparison with the prior year. Approximately 72 percent of this total amount $7,890,762.00, constitutes unassigned fund balance, which is available for spending at the government's discretion. Assigned fund balances include $1,914,755.00 for subsequent year's expenditures. Public facilities fund balance of $1,046,855.00 plus law enforcement $15,990.00 are restricted funds based on their specific stipulated purpose. The remainder of fund balance is non-spendable inventory of $33,225.00. Page 63 provided the Budget to Actual for General Fund. Motion Carried. B. Consider settlement of a lien on 1206 SW 5th Avenue in the foreclosure case of City of Okeechobee v. Barbara Mills, in the Circuit Court of the Nineteenth Judicial Circuit in and for Okeechobee County Case NO. 47 2014 CA 000249, (City Case No. 190215011) (Exhibit 3). This property was the subject of a foreclosure action filed by the City in 2020. The property sold to a new owner before it was set for the foreclosure auction and the new owner purchased it subject to the lien. The new owner reached agreement with City staff of a recommended settlement of the lien. The original lien amount is $7,425. The recommended settlement is $3,667. The settlement amount is less than half of the original lien and will cover the City's attorney's fees and administrative costs. Staff recommends settlement of the lien for $3,667. CK just wanted to brief you. Settlement of a lien, foreclosure case file din 2020. Should the council concur, the settlement will become effective an the lien released. This is a court case, once it's in court, it has to be settled by council. That's why you recall the last one was signed by the mayor MC-how much of part of the settlement is the fines and legal fees. $2900 legal fees, balance $767. JF-this was not the person who caused the problems, they're the new owners. CK-the issue of the attorney's fees is for the city to determine with the attorney. It shouldn't be the person who negotiates what the attorney fees. are. MC-do we go down less than 10% of the original fines. CK-roughly 10% of fees. BJ-it didn't go for auction CK-it was sold before the auction occurred. BJ-when we have one of these, and they're making a settlement, I know they're paying less for the real estate, they know what the lien is prior to purchasing. We are trying to settle and get rid of the problem. I don't want to see us go 2 or 5 years and give it all back. When they purchase these properties they understand there is a lien on it. JF-very good point. Couple of considerations, scenarios happen, does go to foreclosure, entire lien is wiped off, the person has zero liability if they acquire after foreclosure. Trying to give some kind of incentive. They won't buy it if they know the city is not going to negotiate. Take that into consideration, the person purchasing didn't cause the problem, again goal 1 is to get the property cleaned up. Attorney's fees are hard costs, and court costs by the way. Penalties B. Potential white knight willing to purchase, want to encourage that type of behavior. After the auction, no attorneys fees, everything wipes off. These are going to be some of the MC-if we go to auction, we never get reimbursed for liens or attorneys fees. CK-lien is extinguished. JF-only in foreclosure, lien travels with property. CK-this is part 2. What id like to do tonight is to distinguish and get all to understand what the magistrate process vs. circuit court process. Roger had a trial this week so wasn't able to attend. Special Magistrate Process - Quasi-judicial hearing to determine violation and fine • Evidence • Notice & due process • Staff recommends fine based on schedule in City Code • Magistrate issues Lien/Order Florida Statutes 162.03 Staff recommends daily fine to accrue until property becomes compliant Code Violations and Fees • Minimum -- $25 • Maximum -- $500 City of Okeechobee Code Appendix G Table 3 CK-it's a little bit irregular, there's two parts in your code, Ch. 18 and citations can be issued. This schedule was adopted under alternate issue tickets. That's not the way the city has been operating but what was adopted. Staff uses this fine schedule to make recommendations to magistrate for daily fines. BJ-does this need to be updated. CK-not necessarily. It has three tiers. It does give you different citations to code. Typically staff comes in at the middle of the road. JF-even though the schedule was adopted by a different process, schedule is fine, past policy that was 90% reduction. BJ-timeframe with this. CK-when it is presented, staff recommends the number of days, WA-daily fines? B. Jenkins Handwritten Minutes, April 6, 2021 Regular Meeting, Page 6 of 14 CK-yes, if it's a situation where more major work was required, may recommend a longer period of time to get into compliance. Many times, no one shows up to hearings. A lot of times the property owner is not present. BJ-abandoned vehicle, penalty, lets say you gave them 14 days, nothing happens, where do we go? CK-statute allow s90 days after you file a lien to start the foreclosure process. WA-14 day grace period, day 15 starts daily fine. BJ-after 90 days? CK-no city has ability to file a foreclosure action. Statute allows, not saying you have to. Another words, absent property owner, that's the progression to follow if you choose to do that. WA-I'm in the construction trade, says here that working without a building permit, FBC violations, violations of southern building code, why does that fall under this code violations, not building dept. CK-those are things that have a regulatory requirements, enforcement comes under code enforcement. WA building official can't fine someone. It has to go through the magistrate process because they're entitled to due process. JF-building dept can say cease and desist. When this was adopted, you can have all the regulations you want, you have to have someone out looking. The eyes and ears would be conde enforcement officer. CK-typical for other cities JF-keep in mind too, this empowered code enforcement officer to write a ticket and impose a fine. It hasn't been exercised in the past. HS-it has been exercised. We took them to circuit court. JF-without a magistrate, notice or due process, writing ticket is a big deal, that's authority that's not exercised right. DW-may suggest, pretty long presentation, let her go ahead unless you have any specific questions. CK-absorb material, nothing that has to be done tonight. Magistrate shall consider the following factors in determining the amount of the fine: • Gravity of the violation • Actions taken to correct the violation • Any previous violations §162.09(2)(b), F.S. Magistrate issues Lien/Order • Time to comply • Daily fine begins after specified date to comply • Staff records Lien Statute allows magistrate to consider fine reduction request prior to City filing court action. §162.09(2)(c), F.S. (delegate this part of the process to the magistrate) If property comes into compliance — 1. Property owner may request fine reduction — forms asked what the reasons are 2. Hearing to consider fine reduction — typically have talked to staff 3. Magistrate issues Order determining fine reduction (if any), must be in compliance before considering reduction. B. Jenkins Handwritten Minutes, April 6, 2021 Regular Meeting, Page 7 of 14 Magistrate may reduce a fine imposed based on factors listed 162.09(2)(c), F.S. Factors may include: • the nature and circumstances of the violation • risk to public health or safety • length of time it took respondent to come into compliance • is respondent a repeat violator • The maximum fine that could have been imposed Two Potential Outcomes: • Compliance & Payment • Non-compliance or Non-payment of lien, at that point is when you would go to court Steps before filing suit: 1. Courtesy Card from City 2. Time to comply 3. Notice of Violation from City 4. Time to comply (typically 14 - 30 days) 5. Lien/Order issued by magistrate 6. Time to comply (typically 14 - 30 days) 7. Fine reduction request heard by magistrate 8. Time to comply (90 days) 9. Statute allows foreclosure action to occur 3 months after Lien/Order filed BK-last time we talked about an alternative avenue and when that will be, previous slide was talking about options. Saving your time and costs, and courthouse stuff, for people that are interested in cleaning up the city by purchasing these properties. If there is an option to get that done before going to foreclosure. CK-certainly appropriate, we have an absentee owner, honestly what I see, perspective buyer get in touch with owner and effectuate a sale, that's what you want. BK-I don't have the time to follow code enforcement stuff and publish on Facebook. Is there a way to let people know. At what point do they introduce themselves. Is there something to set up since we are about to revise that chapter? JF-I think that's a separate issue from the ordinance, remember there's a lien, anyone can see that. Nobody is ever surprised when they acquire the property. They knew exactly what is there. If they have questions, contact us. They can never claim ignorance, that's why its recorded. The city is always flexible with the fines. BK-inserting alternate avenue before you have filed. CK-no fees until action is filed in circuit court. JF-in the future this is not a fast-moving train, owner given multiple opportunities before it gets to the attorney. BK-so outside of a potential buyer, there's nothing for us to post that. Jus the luck of interested parties. JF-Chief, MDO, CK, and myself vetted pros and cons on getting information out there. Pros and Cons of city acquiring properties, putting on Facebook, came to the decision of not getting into another business. Ultimately decided to let it be. BJ-what you're saying there, once the property is sold our lien is wiped away. Why wouldn't the city put a bid in to cover the attorney's fees and costs to recover? JF-put in a bid $1 above judgement, we now own the property, the property has problems, we take city staff and money to clean up the property or leave it in the condition its in and get into B. Jenkins Handwritten Minutes, April 6, 2021 Regular Meeting, Page 8 of 14 the real estate marketing program, find a buyer to go through surplus, spending $10 to get $7 back. Believe me these are good questions, we went through several reiterations to see. CK-what we found, couple of matters coming up in auction, but they have huge tax liens on them. In doing this exercise, run a title report. $200 to find out what else is on the property. You are buying a liability. JF-one of the properties, economic development potential, in most cases you don't see the value. BJ-tax lien comes before anything. CK-sale at the courthouse at 11 am on April 14t". Two properties up for sale, interested in that, MDO can give them information. BP-huge education on this whole process, a lot more complicated than we realized. Always better even if we spend more time, get compliance before we get to any type of court action. Even includes a 3�d party buying and getting a reduction, at least recouping the taxpayers money. BJ-we have to stick to our guns, if we don't get a penny out of it, foreclose and clean up. BP-new owner doesn't comply. Its going to be really hard to do what we want to do fast and efficient. CK-many instances, we had a property sitting there, Walgreens wasn't getting a notice, when the demand letter was issued, we got their attention. Many times you get someone's attention when you file a foreclosure action. State law allows magistrate to authorize the City attor�ey to file circuit court action to foreclose the lien 3 months after lien is filed. §162.09(3), F.S. Circuit Court Process State law allows magistrate to authorize the City attorney to file circuit court action to foreclose the lien 3 months after lien is filed. §162.09(3), F.S. • City files suit to foreclose the lien (except homestead) • City records Notice of Lis Pendens • Purchaser is on notice of lien in public records Potential outcomes: 1. Prior to auction, voluntary buyer must satisfy the lien and achieve compliance. 2. Buyer purchases at auction. City lien is discharged by the sale. If no compliance, City may issue new Notice of Violation. Private sale prior to Foreclosure Judgement • Buyer contacts the city to determine amount of lien • Buyer purchases property subject to the lien Magistrate is no longer involved; Release of Lien is between buyer and City Release of Lien City Council may approve a release of lien when property is in compliance and • lien is paid in full OR • City agrees to reduced amount §162.09(3), F.S. Page 6 of presentation, we need to determine if we want the magistrate to file the action, right now foreclosure recommended to council, or go ahead and authorize magistrate to do automatically. CK-that is one decision, the fine reduction is the other. You will need to decide at some point. BJ-going to bring back to us JF-yes but we need advice. 2"d bite at the apple to ask magistrate to reduce fine, the magistrate makes an evidentiary determination. Coming to council is a 3rd request, we recommend it reside with the special magistrate, if it stays with you it puts you in an awkward position. I don't think you're going to see foreclosure. WA-again council come up with a matrix to give the guideline to go by DW-I think if you look on page 4, FS the magistrate has several factors he considers to reduce fine. I understand but my problem is, if we say first time offender, reduce a certain percent, but the problem is there may be factors he's considering that may warrant, death in family, heirs have taken over and corrected problem. We would have had this corrected a month ago, he may say I agree with you. That's my problem with setting a certain matrix, there may be other factors to consider by the judge. I agree there needs to be some punishment, if we're going to allow the magistrate to reduce the fines, we appoint him, he considers all those factors, that makes since if we want to relinquish authority and give guidelines. BK-administrative f3ee, another presentation. CK-in ordinance. Increase to $50 instead of $25. BK-FS guideline for admin fee, CK-I believe there is a max. BK-FS setting fines and fees, appendix g here's a ticket for abandon vehicle, political sign, we've been using the ticketing fee structure as a guideline. C K-yes BK-I wouldn't mind seeing increasing the admin fee to a very nice number and come up with a flat fee for a violation fine or fee, vs. appendix g because it really bothers me with all the reasons, now they're faced with a large amount of fines. We have a nice admin fee and a minimized daily accrual fee that when they come into compliance or go to the magistrate for a fine reduction, maybe we authorize magistrate to reduce it to $100 + admin fee, or just the admin fee thaYs going to cover our cost, and do away with appendix g, because sometimes it's not the middle of the road penalty that's assessed. It really comes down to personal bias, not speaking to new code officials, seen it in the past. So if we set a flat fee for a daily accrual fee, up the admin fee, and there is no negotiating admin fee, just requesting reduction of accrued fine. DW-do we have to justify the admin fee CK-typically not a large amount, could be a few $100 BK-recommend go to $200 and get rid of appendix g and set a minimum flat fee violation B. I think violations are a little different, somebody didn't cut grass or safety issues, different code enforcements here. I don't know what the average is. CK-staff suggesting 90% reduction, plus admin fee WA-do we know what the actual costs are? What does it cost to process a case? CK-we can certainly have staff provide that info. DW-lets try to get one of these solved, lets have them come up with the calculation, hard to defend going above what it costs. JF what may appear arbitrary, would be a minimum fee everyone would pay, that is what would smack it. Each case is very different. Make less subjective, but the mayor made a good point, there are unique situations and factors that come into play. DW lets have staff come back with recommended fee WA-have 3 categories, based on time. BP-admin fees aren't going to be what you think. JF-must be the actual staff costs. DW-can we have the staff look at this, they can discuss it, they know better than what we do. Then make a recommendation on the amount of fee. Look at different options, they know what works and doesn't work. That ok........yes. Fine reduction-consensus allow magistrate to do the fine reductions since he has all of the information BJ-don't have a problem with that, if it gets to a point where we think it's gone too far, we sent a message. MC-change of property, death in family, people inherit house have the problem. Limit the magistrate to a certain amount of money, come back to board. BK-you're back to the foreclosure stuff when we're talking about the 2nd bite of the apple, this is pre-foreclosure. MC-I'm AS-are you talking about change of ownership, kids don't know what's going on? MC-basically yes, now someone from out of town has inherited it, they'll still be liable for the fines, CK-it depends on the timing, if it's still under the magistrate, he'll consider that. Set parameters or give policy directions. MC-95% of the cases, magistrate can make that decision. There are situations, normally a change of ownership. Dw-y9ou don't think he'll consider that. AS he'll consider that. MC-in the future, we're going to limit DW-do we thin in general make that decision, yes ............. I'm really big on evaluations having received them, and having been a supervisor and provided them. Feel it's important to have an appropriate evaluation. Supervisory level shouldn't be the same for non-supervisory staff. Different level, I would just like to, spurred this year, we were emailed evaluations from Chief Peterson, same one for all employees. Don't agree with it, different level. In researching stumbled upon a 360-evaluation process. Talked to City attorney about this, basically what I'm interested in is the bottom-up evaluation. We affect staff lives, and it doesn't have to go that way. Implement 360 process. Attorney or HR explain. DW-City Clerk CC-defer to attorney because he has on hand experience with 360evalatuions. JF-360 review allows supervisor to be reviewed by the people they supervise and colleagues and a manager. Usually in a large organization, in my firm, when everyone is given an annual perFormance review. Anyone can provide comments on that persons supervisory or management skills. Compilation of comments with no names are given. You get the comments with no names. That's in a private company, public records don't come into play. I will tell you this, I did talk to lane about, this is not a tool to determine a promotion or more money, tool to help you become a better manager or supervisor.
