permit application must be submitted or the approval shall lapse.

I. CALL TO ORDER
Chairperson Hoover called the regular meeting of the Board of Adjustment for the City of
Okeechobee to order on Thursday, March 18, 2021, at 6:00 P.M. in the City Council Chambers,
located at 55 Southeast Third Avenue, Room 200, Okeechobee, Florida, followed by the Pledge
of Allegiance.
II. ATTENDANCE
Roll was taken by Board Secretary Patty Burnette. Chairperson Dawn Hoover, Vice Chairperson
Doug McCoy, Board Members Phil Baughman, Karyne Brass, Rick Chartier, and Mac
Jonassaint were present. Alternate Board Member Jim Shaw was present. Board Member Felix
Granados and Alternate Board Member Joe Papasso were absent with consent. Chairperson
Hoover moved Alternate Board Member Shaw to voting position.
III. AGENDA
A. There were no items added, deferred, or withdrawn from the agenda.
B. Motion by Board Member Chartier, seconded by Board Member Baughman to approve
the agenda as presented. Motion Carried Unanimously.
IV. MINUTES
A. Motion by Board Member Baughman, seconded by Vice Chairperson McCoy to dispense
with the reading and approve the January 21, 2021, Board of Adjustment Regular Meeting
minutes. Motion Carried Unanimously.

6:02 P.M.

proposed use of outdoor storage, building trades contractor within a Heavy
Commercial Zoning District, (Ref. Code Sec. 90-283 (5)) located at 108 Southeast
5ih Avenue for the proposed use of an electrical contractor's office, with tool and
equipment storage with the following conditions: install some type of slatting or
screening on the chain link fence for the entire perimeter of the property. Motion
Carried Unanimously.

The Applicant is requesting a variance for relief from City Code Section 90-105(b)(1)
which requires a 10 foot side setback for single family residences in the RSF-1 zoning
district. The request is to allow a south side setback of 5 feet.
The subject property is only 40 feet wide and approximately 9,365 square feet. Though
it does not meet the minimum lot width of 75 feet and the minimum lot area of 10,000
square feet required for single family dwellings in the RSF-1 district, the right to
construct a single family dwelling is guaranteed by Section 90-32(a) which states:
A lot in a residential zoning district which is nonconforming because of'insufficient area, which has
at least 4,000 square feet and 40 feet frontage, and was in separate ownership on the date of
enactment of these regulations, may be used to build a single family dwelling.

Property appraiser sales records indicate that this lot has been in existence since at
least 1976. Due to the narrowness of the property, the applicant has stated they are
requesting this variance to enable the construction of a 24 foot wide single family

Applicant Comment: In order to allow for the construction of a 24' wide residence, the 5'
setback would allow that dimension. The other setback would remain unchanged and the
property adjoining the south line is a public park and would be completely unaffected.
Staff Comment: Using the property appraiser site and the City zoning map, staff
searched for other narrow lots in the RSF-1 district. Staff was only able to locate
three other lots narrower than 50 feet: one of which was 47 feet wide, one 43 feet
wide, and one 20 feet wide. Clearly, the narrowness of this property is a fairly unique
condition that should be considered a hardship to development.
2. Specify the minimum variance required including height, lot area, size of structure, size of
yard, sefback, buffer or open space. (Applicant should explain why the requested variance is
the minimum necessary to overcome the hardship.)
Applicant Comment: Allow for a 5' setback along south property line.
Staff Comment: The plans provided by the applicant depict a 24 foot wide structure
and actually, a 6 foot setback on the south side, not a 5 foot setback. However,
granting the applicant's request for a 5 foot setback will provide the applicant and
builder with some flexibility at time of building permit submittal. Additionally, a 25 foot
wide single family dwelling is still fairly narrow by modern construction practices. We
agree that a 5 foot variance is appropriate in this circumstance.
Section 70-374(c) Findinqs Required for Grantinq a Variance:
This section states the Board of Adjustment must find that the following six conditions
exist. The Applicant's responses are presented below in Times Roman typeface, followed
by Staff Comments in Arial typeface. Staff has made no attempt to correct typos,
grammar, or clarify the Applicant's comments.
1. Special conditions and circumstances exist which are peculiar to the land or structure
involved, and are not applicable to other land or structures in the same zoning districf.
Applicant Comment: Because the lot is narrow and long, the reduction to a 5' setback along
the south property line would allow the new residence to be a acceptable 24' in width.
Staff Comment: Staff finds the 40 foot wide lot width to be a peculiar circumstance
among properties in the RSF-1 zoning district.
2. The special conditions and circumstances do not result from actions of the applicant.
Applicant Comment: The lot was sold as is to my grandparents in 1976.
Staff Comment: This lot has been in existence since 1976 and was created prior to
ownership by the applicant.

3. Literal interpretation and enforcement of the Land Development Code would deprive the
applicant of rights commonly enjoyed by other properties in the same zoning districts under
the terms of the Land Development Code, and would work unnecessary and undue hardship
on the applicant.
Applicant Comment: This property has been my childhood home site and the desired
homesite of my family for years. To purchase another suitable property is not economically
viable — even if another property is available- which it is not.
Staff Comment: Most of the RSF-1 lots are at least 50 feet wide, which would allow for at
least a 30 foot wide single family residence, considering the 10 foot required side setbacks.
Without a variance, the applicant would only be able to construct a 20 foot wide residence.
4. The variance, if granted, is the minimum variance necessary to make possible the
reasonable use of the land or structure.
Applicant Comment: Modern housing layouts less than 24' in width do not allow an
adequate layout and will be architecturally undesirable but will adversely affect value.
Staff Comment: We agree.
5. Granting the variance request will not confer on the applicant any special privilege(s) that is
(are) denied by the Land Development Code to other land or structures in the same zoning
district.
Applicant Comment: There are narrow lots in abundance in the vicinity. This will only
serve to improve the area in general
Staff Comment: Granting approval of this variance request will only confer the ability to
build a structure with a maximum width of 25 feet, which is not a special privilege in the RSF-
1 district.
6. Granting the variance will be compatible with the intent and purpose of the Land
Development Code, and the variance will not be injurious to the neighborhood or detrimental
to the public welfare.
Applicant Comment: This will serve to increase quality housing stock, replace an aging MH
and architecturally enhance the area.
Staff Comment: Code Section 66-5 provides several purpose and intent statements for the
land development code including the encouragement of the most appropriate use of land and
development of an economically stable and healthful community. These statements are
consistent with allowing the applicant to construct a 25 foot wide structure instead of a 20 foot
wide structure.
Though it is not ideal to reduce the setback adjacent to the city park, it should not be injurious
to the neighborhood or detrimental to the public welfare.

Good Morning Aaron.
I wanted to let you know that the ad for the above mentioned Petition was not ran in today's newspaper as
requested by staff. Florida Statute requires an ad in the local newspaper to run twice at least 15 days
prior and 5 days prior to the scheduled meeting. The Clerk's Office is checking with the Okeechobee
News to find out the reason why this happened and to see what measures they will put in place to make
sure this doesn't happen again in the future. Unfortunately, this means the Petition will need to be re-
scheduled for the March 18, 2021 meeting instead of February 18tn.

Unfortunately right now we do not have Zoom capabilities. The City is doing a complete new install of our
audio/visual equipment to add close captioning and better sound for Zoom. You are not required to be

I've been searching using the zoning map and property appraiser site to find out if there are any other 40 foot wide lots
� zoned RSF-1. I've found quite a few 50 foot wide lots but none that are 40 foot wide except the subject property for 21-
� 001-V. In the staff report, I'm making the statement that this narrowness is a unique condition that qualifies as a

I've reviewed the old staff report and minutes and I see how this was previously handled. However, based on my
interpretation of Section 90-32(a), I don't see that a variance is necessary for the lot width or lot area. The subject
property is 40 feet wide and over 4,000 sf in area. Section 90-32(a) states:
A lot in a residential zoning district which is nonconforming because of insufficient area, which has at least 4,000
square feet and 40 feet frontage, and was in separate ownership on the date of enactment of these regulations,
may be used to build a single family dwelling.
Also, I've reviewed the application and it looks ready for advertisement. I just want to check with Jeff and make sure that
he doesn't have any issues with the site plan. I will copy you on my email to him.

The subject property is a long and narrow rectangular parcel fronting on SE 6th Avenue
and extending about 233 feet eastward to Taylor Creek. The property is an unplatted
parcel only 40 feet wide and encompasses approximately 9,391 square feet (just under
0.22 acre). Therefore, the property is nonconforming to both the minimum lot width (75')
and minimum area (10,000 sfl.
The principal structure now on the lot is a small, 24-foot wide mobile home with a 4' x 6'
entry feature on the north side. This is a nonconforming use, as mobile homes are not
permitted in the RSF 1 zoning district. There are also a couple accessory structures which
appear to be sheds just west of the mobile home. All the existing structures have
inadequate setbacks from the soufh property line but appear to have adequate setbacks
from the north property line.
The owner intends to remove all three structures and replace them with a conventionally
built, 2-story, 24-foot wide home; a covered carport; and a two-story, conventionally built
home workshop.
Description of the Requested Variances
The Applicant is requesting three variances:
1. Because the subject property is an unplatted 9,391 sf parcel, a variance of 609
square feet from the minimum required 10,000 square foot lot is necessary to
allow the proposed structures to be built.
2. Because the subject property is an unplaited parcel with a lot width of just 40
feet, a variance of 35 feet from the minimum required lot width of 75 feet is
necessary to allow the proposed structures to be built.
3. In order to build a home with a minimum conventional width of 24-feet, the
Applicant is asking for approval of a four-foot variance to allow a 6-foot seiback
from the south property line.

1. Demonstrate fhat the variance is needed to overcome a hardship caused by the unique
physica! condifions of the site (and not merely for economic reasons or the convenience of the
applicant).
"A residence narrower than 24' (exterior dimensions) is not suitable for construction."
Staff Comment: The property has existed as an undersized, RSF1-zoned, noncon-
forming, unplatted, parcel with only 40-foot frontage for over 40 years. Section 9Q-40(c)
prohibits the replacement of a nonconforming mobile home. Since the mobile home
has reached the end of its useful life, in order to redevelop the parcel with a single-
family home, the applicant must receive a variance to both the minimum lot area and
frontage, otherwise the property is undevelopable. The narrow parcel width also
presents a significant hardship to the construction of a 24-foot wide home, a width that
most people would consider minimally acceptable for a single-family home. In order to
build a 24-foot wide single-family home, a four-foot variance is needed to at least one
of the required side yards.
2. Specify the minimum variance required including heighf, lot area, size of sfructure, size of yard,
setback, buffer or apen space. (Applicant should explain why fhe requested variance is fhe
minimum necessary to overcome the hardship.)
"Allowing a 6' setback on the south side allows for a 24' wide structure. There are no neighbors
on this side of the structure. The north side remains 10' and will not impinge on the neighbor."
Staff Comment: It is not possible to increase the existing Iot area of 9,391 square feet
to the 10,000 square-foot minimum because additional land cannot be obtained from
the City-owned park to the south because of a condition of the original grant of the land
to the City forbids it. The size of the lot to the immediate n�rth, and the location of the
existing home on the RSF1 lot, preclude the possibility of obtaining the needed six feet
from this property owner. Therefore, the requested six-foot variance to the north _
setback is the minimum necessary to build a minimally acceptable single-family home.

This section states the Board of Adjustment must find that the following six conditions
exist. The Applicant has provided responses in his Application to each of the six required

"The city was unable to sell any additional land due to the conditions of the grant monies to
construct the park. So, any building must be limited to the existing lot size."
Staff Comment:
We agree that none of the special conditions and circumstances that result in the need fo� a
variance are due to actions by the applicant.
3. Literal inferpretation and enforcement of the Land Development Code would deprive the
applicant of rights commonfy enjoyed by other properties in the same zoning districts under
fhe terms of the Land Development Code, and would work unnecessary and undue hardship
on the applicant.

Staff Comment:
We agree, without the requested variances, the mobile home could not be replaced; and more
importantly, a normal width single-family home could not be built on the property, thereby

4. The variance, if granted, is the minimum variance necessary to make possible the reasonable
use of fhe land or structure.
"Adjusting the south setback allows for a 24' wide structure without adjusting the north
setback."
Staff Comment:
The Applicant had originally contemplated requesting vaciances to both the north and south
side yard requirements. After we discussed the matter, he realized that he could build a new
single-family home with a minimally acceptable width without reducing the north setback which
could affect the �esident to the north. The minimal variance of six feet to the required south
side setback will have no practical impact on the adjoining park use and permit the Applicant
to replace the mobile home with a single-family home.
5. Granting the variance request will not confer on the applicant any specia! privilege(s) that is
(are) denied by the Land Development Code to other land or structures in tf�e same zoning
district.
"We are only seeking to build a residence on family property where I was raised. "
Staff Comment:
Granting of the variances will only allow the Applicant the ability to build an acceptably sized
single-family home on an existing parcel in the RSF 1 Dist�ict.
6. Granting the variance will be compatible with the intent and purpose of the Land Development
Code, and the variance will not be injurious to the neighborhood or detrimenta/ to the public
welfare.
" The proposed residence will be far superior than the existing structure and will only
improve the area."
Staff Comment: The grant of the variance will allow the construction of a single-family home
in the RSF 1 District without adversely affecting any of the surrounding properties, occupants
or users of the surrounding properties. Construction of a single-family home will allow removal
of an old mobile home that is incompatible with the zoning of the property.

Section 90-102. - Permitted uses.

(6) Limited agriculture of a commercial nature on properties on which there is an active agricultural

(1) Boardinghouse.
(2) Bed and breakfast establishments with six or fewer sleeping rooms.

(a) Residential lot in separate ownership. A lot in a residential zoning district which is nonconforming
because of insufficient area, which has at least 4,000 square feet and 40 feet frontage, and was in
separate ownership on the date of enactment of these regulations, may be used to build a single-
family dwelling.
(b) Nonresidential lot in separate ownership. A lot nonconforming because of insufficient area, which
was in separate ownership on the date of enactment of these regulations, may be used, provided
that all other zoning district regulations are complied with. No use that requires a lot area greater
than the district minimum lot area is permissible on a nonconforming lot.
(c) Contiguous lots. When three or more vacant nonconforming lots with continuous frontage are in
single ownership, they shall be resubdivided in such a manner as will make them conforming lots.
If resubdivision to eliminate nonconforming lots is impossible, application shall be made for a
variance prior to development of the lots. This subsection shall not apply to contiguous
nonconforming lots in single ownership if a majority of the lots on the street or within 500 feet of
such lot in the same zoning district are also nonconforming.
(d) Creation ofnonconforminglot. No division of land shall be made which creates a lot or parcel
which does not meet the minimum lot requirements for the zoning district in which such lot or
parcel is located.
