REVOCABLE LIMITED USE LICENSE �4GREEMENT
(Use of Alleyway)
THIS AGREEMENT, by and between the CITY OF OKEECHOBEE, FLORIDA, a Florida
Municipal Corporation (hereinafter "CITY"), and IIdIITCHELL G. HANCOCK, INC.
(hereinafter "OWNER"), dated this 5�'h day of /1/%(,�,/"� , 2021.
WHEREAS, OWNER holds fee simple title to the following described real property in
Okeechobee County, Florida, to wit:
LEGAL DESCRIPTION: LOTS 1 THROUGH 10, AND 11 THROUGH 20, INCLUSIVE
OF BLOCK 62, OKEECHOBEE, ACCORDING TO PLAT THEREOF RECORDED IN
PLAT BOOKS 1 AND 5, PAGES 10 AND 5 OF THE PUBLIC RECORDS OF
OKEECHOBEE COUNTY, FLORIDA; and
WHEREAS, the CITY owns the following platted alleyway:
A 15-FOOT WIDE ALLEYWAY WITHIN SAID BLOCK 62, LYING NORTH TO SOUTH,
BOUNDED ON THE EAST BY LOTS 1 THROUGH 10, AND ON THE WEST BY LOTS
11 THROUGH 20; and
WHEREAS, the OWNER requested permission of the CITY to erect a fence across the portion
of the aforementioned alleyway. A field inspection conducted by the Public Works
Department confirmed the location of the proposed �fence line and acknowledged no
objection to the OWNER'S request; and
WHEREAS, the CITY received verification from the Okeechobee Utility Authority that there are
no existing utilities within the portion of the aforementioned alleyway. Further, City Code
Enforcement verified that there were no active or pending code violations related to the
OWNER'S property.
NOW, THEREFORE, in consideration of the mutual promises and covenants set forth herein,
the parties agree as follows:
The CITY hereby grants this Revocable Limited Use License for the use of the
alleyway as described below, and as shown on Attachment A, for the purpose of
erecting fencing/gates. No other improvements shall be permitted within the alleyway
without prior CITY approval:
A 15-FOOT WIDE ALLEYWAY WITHIN SAID BLOCK 62, LYING NORTH TO
SOUTH, BOUNDED ON THE EAST BY LOTS 1 THROUGH 10, AND ON THE
WEST BY LOTS 11 THROUGH 20.
2. The "revocable°' designation means that the CITY, at any time, for any reason in its
sole discretion, may revoke this permit at which time the owner is fully responsible
for immediately removing any structures or facilities in, on, or over the CITY alleyway.
3. The OWNER is required to maintain the entire 15-feet wide portion of the
aforementioned alleyway.
4. Should it ever become necessary to remove any fencing/gates, in order to allow either
the installation or maintenance of water, sewer, or other utility lines or any other type
of installation or construction, or for any other reason chosen by the CITY, the
fencing/gates, or any improvement thereon, will be removed by the OWNER or their
agents and/or assignees at the OWNER'S sole expense within seven days of receipt
of written request by the CITY for such removal. Should the CITY, for any reason,
require the removal of the fencing/gates thereon, less than seven days' notice, the
OWNER agrees to exercise reasonable efforts to comply with such requests as soon
as possible.
5. Prior to any encroachment in, on, or over CITY alleyway, OWNER shall modify their
insurance coverage to obtain an endorsement to their General Liability Insurance
policy listing the CITY as an additional insured with a Certificate of Insurance, as well
as a certified copy of the endorsement, furnished to City Clerk Lane Gamiotea at the
CITY showing that part of the aforementioned alleyway as herein described, to be
used by them, insuring the CITY against any liability directly or indirectly related to

any activities in, on, and/or over alleyway. In any event, OWNER shall hold the CITY
harmless for any and all action, suit, claim, injury, or cause of action of any nature
arising out of OWNER'S activities or use, and shall indemnify the CITY for such,
including, but not limited to, any costs and attorney fees.
6. OWNER shall furnish the CITY annually, upon renewal, a copy of the Certificate of
Insurance listing the CITY as an additional insured, as well as a copy of the policy
endorsement from their insurance carrier.
7. OWNER shall be responsible for any and all damages to property or injury to persons
arising out of the exercise of the permit or the construction, installation or
maintenance of any device or structure in, on, or over CITY alleyway or other
easement area.
8. OWNER shall indemnify and save harmless the CITY, and all its officers, agents and
employees from all suits, action or claims of any type brought for or on account of
any injuries or damages received or sustained by any person or property related to
the exercise of the permit, any act or omission of the permittee, the permittee's agents
or employees, or the failure of the permittee to maintain the structure or device or to
provide necessary safety devices. OWNER shall agree to defend against any suit,
action, or claim and pay any judgement with costs, which may be obtained against
the CITY, its officers, employees or agents growing out of the injury or damage.
9. OWNER agrees this license is non-assignable without the express written consent of
the CITY; and if OWNER sells or transfers the subject property, the purchaser shall
be placed on notice and shall be furnished with legible copies of this Revocable
Limited Use License for the use of the alleyway.
10. The City Clerk shall cause this Revocable Limited Use License for the use of the
alleyway to be recorded in the public records of Okeechobee County, Florida.
11. OWNER agrees to reimburse the CITY all recordings costs.

WHEREAS, the CITY owns the following platted right-of-way:

BOUNDED ON THE EAST BY LOTS 1 THROUGH 10, AND ON THE WEST BY LQTS 11

WHEREAS, the OWNER,requestecl �ermission of the CITY,to erect a fence across the portion

the OWNER'S property.
NOW, THEREFORE, in consideration of the mutual promises and covenants set forth herein, the
parties agree as follows:
1. The CITY hereby grants this Revocable Limited Use License forthe use ofthe right-of-
way as described below, and as shown on Attachment A, for the purpose of erecting a
fencing/gates, f�,o other improvements shall be permitted within the right-of-way

5. Should it ever become necessary to remove any fencing/gates, in orderto allow either
the installation or maintenance ofwater, sewer, or other utility lines orany othertype of
installation or construction, or for any other reason chosen by the CITY, the
fencing/gates, or any improvement thereon, will be removed by the OWNER or their
agents and/or assignees at the OWNER'S s�le expense within seven days of receipt
of written request by the CITY for such removal. Should the CITY, for a� reason,
require the removal of the fencing/gates thereon, less than seven days' notice, the
OWNER agrees to exercise reasonable efforts to comply with such requests as sooii

The Director of Public Works for the City of Okeechobee, David Allen has no objecitons to tfie use agreement.
However, there are a few requirements that must be met:
• Adjoining Property Owners agreement not needed unless required by the City Clerk's Office. The entire
block is owned by Mitchell G. Hancock, Inc. On the North end is an unimproved ROW and on the South
end is the 7th Avenue Ditch.
• Approval will be required by Okeechobee Utility Authority (OUA).
• All standard insurance requirements must be met.
In order to obtain an agreement with the City to have use of the alley in Block 62, as described in the legal description below:
The entire alleyway within Block 62, CITY OF OKEECHOBEE, as recorded in
Plat Books 1 and 5 and Pages 10 and 5, Okeechobee County public records;
Specifically described as the alleway running North to South, bounded on the
East by Lots 1 to 10 and on the West by Lots 11 to 20 of said Block 62.

The alleyway legal description needs to be revised since the act�al plat map providing the exact width
of the alleyway isn't provided.
The easiest method to word it would be: The entire alleyway within Block 62, CITY OF
OKEECHOBEE, as recorded in Plat Books 1 and 5 and Pages 10 and 5, Okeechobee County public
records; specifically described as the alleyway running North to South, bounded on the east by Lots 1
to 10 and on the west by Lots 11 to 20 of said Block 62.
Also note that in the PDF you originally sent, page 5 is a duplicate of what was on page 2, page 5
should have identified Lots 11-20.
Apologies for the delay in reviewing, my office has been swamped with additional workloads. In the
future, you may want to go ahead and provide the letter, and I will correct the legal when its provided

The Director of Public Works for the City of Okeechobee, David Allen has no objecitons to the use agreement.
However, there are a few requirements that must be met:
• Adjoining Property Owners agreement not needed unless required by the City ClerKs Office. The entire
block is owned by Mitchell G. Hancock, Inc. On the North end is an unimproved ROW and on the South
end is the 7th Avenue Ditch.
• Approval will be required by Okeechobee Utility Authority (OUA).
• All standard insurance requirements must be met.
