CE AND GENERAL RELEASE A
This Severance Agreement and General Release (hereinafter the

and CITY OF OKEECHOBEE as
WHEREAS, CITY OF OKEECHOBEE shall at all times include any and each and every
one of the City's current and former officials, employees, and attorneys, in both their representative
and individual capacities, as well as their successors and assigns.
1. City of Okeechobee has entered an Interlocal Agreement with Okeechobee County
wherein Okeechobee County will assume fire rescue services for the City effective
2. City of Okeechobee has provided notice of the contemplated elimination of its fire
department, with fire services for the City to be assumed by Okeechobee County.
3. The Collective Bargaining Agreement (hereinafter ACBA@) between the City of
Okeechobee and IAFF Local 2918 specifically addresses a possible elimination of the City's fire
department through a takeover of fire services by the County. The City has complied with Article
23 and all other applicable provisions and bargaining unit members, including
have been provided an opportunity to apply for employment with
Okeechobee Fire Rescue. The Interlocal Agreement between the City of Okeechobee and
Okeechobee County, approved by the City Council in substantial conformance on October 20,
2020, specifically provides for the employment of City fire personnel pursuant to the terms and
conditions therein stated subject to modification.

5. Upon the final adoption and execution of the Interlocal Agreement and the effective
date for Okeechobee County to commence fire rescue services for the City, 3s
employment with the City of Okeechobee will end and will no longer be
employed by the City of Okeechobee.
6. In consideration for service to the City of Okeechobee and in consideration of the
covenants and releases contained herein, the City will pay a lump
sum payment to be paid on or before June 15, 2021 within 15 days after the last day of employment.
This severance payment to which would not otherwise be entitled represents
payment based on for years of service.
7. does hereby release and forever discharge CITY OF
OKEECHOBEE from any and all actions, causes of action, claims, charges, demands, damages,
expenses or costs (including attorney's fees) of whatever nature, known or unknown, foreseen or
unforeseen, whether in tort or contract, at law or in equity, or arising under or by virtue of any
federal, state or local statute, ordinance or regulation, for injuries, losses and damages of any and
every kind, including but not limited to employment and employment benefits of every kind, from
the beginning of the world to today.
8. City will also provide payment of all unused and accrued sick leave and annual
leave as of the date of separation. (Estimate attached). In the event that will accept
employment with County, may elect, in the alternative to a payout of said amounts,
to transfer unused sick and annual leave on such terms and in such amounts as permitted pursuant
to the terms of the Interlocal Agreement.

With the finalization of the dissolution of the City Fire Department and the transition of services
already underway, it has come to our attention that there are is the matter of City Fire employee
severance packages still unresolved. The appointed officers of Local 2918 would appreciate the
opportunity to discuss this matter with the appropriate personnel, Mr. Montes De Oca, Ms. Gamiotea,
and Ms. Riedel. We feel this meeting will be the swiftest resolution while representing the joint
interests of the City and the City Fire employees.
It is our belief that with our officers and the above listed we can host a very constructive,
