I. CALL TO ORDER
Special Magistrate Azcona called the Code Enforcement Special Magistrate Hearing to
order on Tuesday, December 8, 2020, at 6:30 P.M. in the City Council Chambers,
located at 55 Southeast 3rd Avenue, Room 200, Okeechobee, Florida. The Pledge of
Allegiance was led by Magistrate Azcona.
II. ATTENDANCE
City Clerk Lane Gamiotea called the roll. Special Magistrate Roger Azcona, Esquire,
City Attorney Carlyn Kowalsky, Police Lieutenant Justin Bernst, and Code Officer Fred
Sterling were present.
III. CHANGES TO AGENDA
A. Magistrate Azcona asked whether there were any agenda items to be added,
deferred, or withdrawn; City Attorney Kowalsky deferred Items VI.A., VI.B, VI.C,
VI.E, and VI.F.
IV. APPROVAL OF MINUTES
A. Special Magistrate Azcona approved the September 8, 2020, and October 21,
2020, Hearing minutes.
B. This being a Quasi -Judicial proceeding, City Clerk Gamiotea collectively
administered an Oath to Code Officer Fred Sterling, Mr. Benjamin Purvis, and
Mr. Jose Cruz; all affirmed. Code Officer Sterling advised all events occurred
within the corporate limits of the City of Okeechobee. The Officer's notes,
testimony, photographs, and support documents were all entered as part of the
official record.
V. CONTINUED CASES
A. Case Number 190411010; Kemp Properties of Okeechobee, 909 South Parrott
Avenue, Okeechobee. Violation of City Code of Ordinances Chapter 30, Sections
30-43 Public Nuisance, and 30-44. General Cleaning and Beautification.
Officer Sterling testified that an inspection was performed prior to the meeting,
and progress has been made. Special Magistrate Azcona granted an
extension of 30-days from today for the property to become compliant. Mr.
Purvis was further instructed that he did not have to wait the entire
extension, and to notify Code Officer Sterling when he had completed the
clean up to inspect the property in order to stop the fine from accruing. He
could then move forward with a fine reduction request.

A. Case Number 200824009 was deferred.
B. Case Number 190723008 was deferred.
C. Case Number 200824014 was deferred.
D. Case Number 200318009; Daniel Meara, 905 Southwest 3rd Avenue,
Okeechobee [Legal Description: Lot 9 of Block 5, SOUTH OKEECHOBEE, Plat
Book 1, Page 12, Okeechobee County Public Records]. Violation of City Code of
Ordinances Chapter 30, Section 30-41 Disabled Vehicle (no tag).
Officer Sterling testified there were two vehicles parked on the property without
tags. On September 21, 2020, a Notice of Violation/Notice of Hearing was mailed
and received by Krystall Cafter on September 25, 2020. The Notice of
Violation/Notice of Hearing was posted on the property November 17, 2020.

ITEM D CONTINUED: Special Magistrate Azcona found the property to be in
violation of City Code of Ordinances Chapter 30, Section 30-41 Disabled
Vehicle (no tag). A fine of $25.00 per day }plus an administrative fee of $50.00
will begin to accrue 14-days after proper notification.

VII. FINE REDUCTION REQUESTS
A. Case Number 190917011; Manuel Serrana Pineda, 1124. Southwest 8t" Street,
Okeechobee [Legal Description: South 50.5-feet of Lot 11 and West 33-feet of
the South 50.5-feet of Lot 12, in Block 15, SOUTHWEST ADDITION TO
OKEECHOBEE, Plat Book 2, Page 7, Okeechobee County public records and
the abandoned portion of First Street lying south of and contiguous to said Lot 11
and the aforementioned West 33-feet of Lot 12 of said Block 151. The property
owner is requesting a Fine Reduction from $9,350.00 to $935.00 plus a $50.00
Administrative Fee.
After a brief testimony from Code Officer Sterling and Mr. Jose Cruz, representing
the property owner, Special Magistrate Azcona recommended approval of
the request for Fine Reduction from $9,350.00 to $935.00 plus a $50.00
Administrative Fee and to allow payments to be made; half to be paid in
January and the balance by February 10. The recommendation will be
forwarded to the City Council for final action.
D. Case Number 190718010; Fortex Holdings, LLC, 501 East North Park Street,
Okeechobee. Requesting reduction from $8,450.00 to $50.00 Administration
Fee.
Code Officer Sterling testified the building has been painted, the property
cleaned, and is currently in compliance. He recommended a Fine Reduction of
10 percent of the accrued amount, which is $845.00 plus a $50.00 Administration
Fee. Special Magistrate Azcona agreed with the recommendation of a Fine
Reduction from $8,4.50.00 to $0845.00 plus a $50.00 Administrative Fee. The
recommendation will be forwarded to the City Council for final action.

Mowing every other week on schedule. Lighting done, Bass Electric repaired the flood lights, lights on the building
working. Working toward replacing ali them to update since old. Pressure cleaning got with company, main problem
is building is worn and needs to be painted. Contacted a friend thaYs a painter. Rain caused issues. Painting
ourselves w/ brotrier. Have done east side to north corner, N& W are mostly brick, small areas above windows and
doors need to be pressure cleaned before painting and work on painting it. South almost all done.

company to pressure clean and take care of the building, He did the work, in code board notes Donald Dunham he
contacted lady that works with code enforcement said the building was good. Apparently it wasn't. How do we do a
fine reduction?

recommendation to the City Council.

City Attorney Carlyn Kowalsky stated for the record that the Code Enforcement

the last Hearing and turned it over to Mr. Gainer. Mr. Gainer was sworn in and
stated that the light fixture had been fixed, but he was having a hard time finding
a contractor to pull a permit and do the drawings. Officer Sterling stated that he
could pull an owner permit and do the drawing himself. Gainers said he had been
in to see Gail at the Building Department and she had not told him that. Mr. Gainer
stated he would go back and schedule an appointment with the City Buitding
official Jeff Newell.
Special Magistrate Azcona found that case #200128021, was in violation of
Chapter 30 Section 30-43 Public Nuisance, Chapter 30 Section 30-44
General Cleaning and Beatification and Chapter 70 Section 70-251 Building
Without a Permit. (City of Okeechobee Ordinances) Special Magistrate
Azcona stated that due to Officers Sterling's testimony he had 10 days to
get with the City of Okeechobee Building Official and get a permit for the
work that had been done. lf not resolved after the 10 days a$100.00 per day
fine would be imposed along with a$50.00 Administrative Fee.

Okeechobee, Florida 34972. [CITY OF OKEECHOBEE, Lots 1,2 and 3, Block 48]
Officer Sterling was worn in and testified that this case was continued from the
last hearing and that nothing has been done to the property since. Sterling stated
that we have been in communication with the owner's sister. She told us her
brother had the virus and could not get the keys to the building. Sterling stated
that they did not need to get into the building, they need to remove the old tires
on the property and all the debris. He also stated that the old truck needs to be
removed from the property as well. Sterling stated that the truck is a safety hazard
as it is up on jacks and missing a tire. Sterling went on to say that they either
need to get with us and let us know what is going on or impose a fine.
Special Magistrate Azcona stated that due to Officer Sterling's testimony
he found case 200226002 to be in violation of Chapter 30 Section 30-41
Disabled Vehicle, Chapter 30 Section 30-43 Public Nuisance and Section
30-44 General Cleaning and Beautification. (City of Okeechobee
Ordinances) Azcona imposed a fne of $100.00 per day to start 10 days after

that this case, property owners were repeat offenders. Sterling went on to say
this couple does not have very much income and that they are hoarders. Officer
Sterling stated that we need to do something that will get their attention and
possibly stop them from bringing in anymore items and get the place cleaned up.
Special Magistrate Azcona stated that due to Offcer Sterling's testimony
he found case 190927020 Harry and Betly Schock to be in violation of
Chapter 30 Section 30-43 Public Nuisance and Section 30-44 General
Cleaning and Beautification. (City of Okeechobee Ordinances) Azcona
imposed a fine of $100.00 per day to start 14 days after proper notification.
A$50.00 Administrative fee was to be included also.
B. Case Number 200521014 Frank Prescott 1009 Southwest Park Street,
Okeechobee, Florida 34974. [SOUTHWEST ADDITION TO OKEECHOBEE, Lot
3 and West one half of Lot 2, Block 4, Plat Book 2, Page 7] Officer Sterling was
sworn in and testified that this property is all but 5% in compliance, and
would like to defer until the next scheduled hearing.
C. Case Number/Citation #0120 Kay's Lace Boutique 410 Southeast 2"d Avenue,
Okeechobee, Florida 34974. [Lots 11 and 12, Block 216, Plat Books 1 and 5,
Pages 11 and 6] Officer Sterling was sworn in and testified that Kay's Lace
Boutique, owner Katelyn Shaw is running her business without a Business Tax
Receipt. Sterling stated that he has spoken to her and told her she needed to go
see Kim Barnes at the City Hall, Finance Department and get her BTR. Sterling
stated that as of today's date she has done nothing. Sterling stated that
according to our code we can impose a�ne of $125.00 per day.
Special Magistrate Azcona found that case/citation 0120 Kay's Lace
Boutique is in violation of Chapter 50 Section 50-32 Operating a Busines
without a BTR. Azcona imposed a fine of $125.00 per day to start 14 days
after proper notification. A$50.00 Administrative fee was also imposed.
D. Case Number 200623029 Joaquin Dominguez 217 Northwest 5'�' Avenue,
Okeechobee, Florida 34972. [THE ESTATES AT TAYLOR CREEK, Lot 4, Plat
Book 7, Page 33] Officer Sterling was sworn in and turned the table over to Mr.
Kelly of Nation Star Mortgage Company. Mr. Kelly was sworn in and asked if the
property was complying, and if not, what needed to be done. Officer Sterling
stated that this property came into compliance on September 8, 2020.

Okeechobee, Florida 34974. [SOUTH OKEECHOBEE, Lot 9, Block 5, Plat Book
1 and 5, Page 12 and 7] This case was skipped for some reason. Code
Secretary Melissa Close will have this case on the October 21, 2020
Hearing.
F. Case Number 200601018; Joseph Billie Freeman 811 Southeast 12'h Street,
Okeechobee, Florida 34974. [THE FIRST ADDITION TO OKEECHOBEE
ESTATES, AN ADDITION TO OKEECHOBEE, Lot 98, Plat Book 3, Page 23]
Officer Sterling was sworn in and testified that this property look like is has been
abandoned. The grass is knee high and need to be cleaned up. Sterling stated
that he wanted to do some research on the property to see who the owner is and
if they have a mortgage. Sterling stated that this property has been vacant for the
last few months.
Special Magistrate Azcona stated that due to Officer Sterling's testimony,
he found case 200601018 in violation of Chapter 30 Section 30-44 General
Cleaning and Beatification and imposed a fine of $100.00 per day 14 days
after proper notification, with a$50.00 Administrative Fee.
G. Case Number 200528024; Kevin and Melissa Deese 1612 Northwest 7�' Avenue,
Okeechobee, Florida 3497. [CONNERS HIGHLANDS, Lot 11 and North one half
of Lot 12, Block 76, Plat Book 1, Page 21] Officer Sterling was sworn in and
testified that the property is in need of mowing and debris needs to be cleaned
up. Sterling stated that the grass is 8-9" in highest spots and tons of debris from
household items to gardening tools. He also stated that these property/owners
are repeat violator and we do not have to give them any notice.
Special Magistrate Azcona found case 200528024 to be in violation of
Chapter 30 Section 30-43 Public Nuisance and Section 30-44 General
Cleaning and Beautification due to Officer Sterling's testimony. Azcona
imposed a fne of $200.00 per day to start 10 days after proper notification,
with a $50. Administration Fee.
H. Case Number 200303022; Aaron Kinty and Charles Waldington 911 Northwest
11�' Street, Okeechobee, Florida 34972. [CITY OF OKEEECHOBEE, Lots 4 and
5, Block 25] Officer Sterling was sworn in and testified that these
property/owners are repeat violators. He stated this is two lots together and they
have not been mowed. Sterling stated that this property has been a problem for
the City for the last 10-15 year. Sterling stated that this property is still overgrown
to date not only the grass, but the vines are taking over all the trees on the
property.
Special Magistrate Azcona found that case 200303022 to be in violation of
Chapter 30-43 Public Nuisance and Section 30-44 General Cleaning and
Beautification due to Officer Sterling's testimony. Azcona imposed a fine
of $250.00 per day to start 10 days after proper notification, with a$50.00
Administration Fee.
Case Number 200710021; Baldemar and Maria Medrano 203 Northwest 6�n
Street, Okeechobee, Florida 34972. [CITY OF OKEECOHBEE, Lots 4,5 and 6,
Block 92] Officer Sterling was sworn in and testified that Mrs. Medrano
called and told him they had a place out in the county they were going to
move the heavy equipment to and asked to give her a month to get this
done. Sterling asked that this case be deferred until the next scheduled
hearing.

RIVER RUN RESORT and is 50.19 acres and runs all the way North up to 9�'
street at the industrial park. He stated this case has been going on for quite a
while now. Have had contact with the contractor that was hired to clear the
property and it has been one thing or another. Sterling stated that this cannot be
put off any longer. The neighbors are complaining about all the pile of debris due
to rodents and snakes. And the grass is extremely high.
Special Magistrate Azcona found that case 191115015 be found in violation
of Chapter 30 Section 30-43 Public Nuisance and Section 30-44 General
Cleaning and Beautification due to Officer sterling's testimony. Azcona
imposed a fine of $100.00 per day to start 14 days after proper notification,
with a $50.00 Administrative Fee.
K. Case Number 200717010 Hugo Manresa 1006 Southeast 14"' Court,
Okeechobee, Florida 34974. [BLUE HERON GOLF AND COUNTRY CLUB,
PHASE 4A, Lots 218 and 219, Plat Book 6, Pages 66 and 69] Officer Sterling
was sworn in and testified that this case was now in compliance.

A. Case No. 200915020; A/C Today Air Conditioning and Heating, LLC, Licensee:
Mr. Francisco Guerrero, 1604 Northwest 7ih Avenue, Okeechobee. City Building
Official Mr. Jeffery Newell testified that Mr. Guerrero has demonstrated disregard
for established procedures by State law and local ordinances regarding
permitting, was found to be in violation of City Code of Ordinances Chapter 70,
Section 70-302, for working without a building permit. Mr. Guerrero has failed to
pay for and pickup authorized permits on multiple occasions. He has also failed
to submit affidavits for final inspections for approximately 10 permits from 2015
to 2020. Mr. Guerrero has made this a continual practice for his business and
has progressed to a state of mind to ignore State law and local ordinances
governing the contracting laws that are required to be enforced by building
departments. A Statement of Violation and Notice of Hearing was sent by certified
mail on September 16, 2020 and was signed for by O. Cruz on September 21,
2020. The City is seeking relief in the form of an Administrative Order compelling
A/C Today Air Conditioning and Heating, LLC to comply with the permitting
process as required by the Florida Building Code, City Ordinances, and
permitting policies set forth by the City's building department, a requesting the
minimum penalty of $100.00 per open permit as per City Code Ordinances
Appendix G, Table 3, and a one-time administrative fee of $100.00.

Mr. Guerrero responded that he agreed with the evidence provided by Mr. Newell,
apologized, and explai�ed he lacks help from his office. He is also willing to
comply with Mr. Newell's requests, but asked to be given 30-days to comply with
the Magistrate's ruling.

Heating, LLC, was in violation of City Code of Ordinances Chapter 70,
Section 70-302, for working without a building permit. An Administrative
Order will be issued compelling A/C Today Air Conditioning and Heating,
LLC to comply with the permitting process as required by the Florida
Building Code, City Ordinances, and permitting policies set forth by the
City's building department, along with a$1,000.00 penalty plus a one-time
administrative fee of $100.00 totaling $1,700.00 to be paid within 30-days of
this Hearing.
B. Case No. 200617006 was withdrawn from the agenda.

D. Officer Sterling offered testimony on Case No. 200318009; Daniel Meara 905
Southwest 3� Avenue, Okeechobee (Legal Description: Lot 9 of Block 5, SOUTH
OKEECHOBEE, Plat Books 1 and 5, Pages 12 and 7, public records of
Okeechobee County). The property was initially inspected on March 18, 2020,
and found to be in violation of City of Okeechobee Code of Ordinances Chapter
30, Section 30-41 Inoperable/Abandoned Vehicles, 30-42 Public Nuisance, and
30-44 General Cleaning and Beautification due to the property needing to be
mowed and debris removed, as well as a vehicle with no tag. On March 19, 2020,
a courtesy card was mailed that included copies of the Code Sections the
property owner was in violation of. A Statement of Violation and Notice of Hearing
was mailed on July 28, 2020 and was returned. On July 31, 2020, the property
was found to be in compliance of Sections 30-42 and 30-44. The second
Statement of Violation and Notice of Hearing was mailed on September 22, 2020
for violation of Chapter 30, Section 30-41 Inoperable/Abandoned Vehicle. The
notice was signed for by Krystal Carter. The property was not posted.
Officer Sterling stated the City recommends providing the property owner with 14
days to correct the violation. Should this not be met, a fine of $25.00 per day plus
a one-time administrative fee of $50.00 is recommended. Based on the evidence
provided, Magistrate Azcona found that the property was in violation of
Chapter 30, Section 30-41 Inoperable/Abandoned Vehicle. A fine of $25.00
per day plus a one-time administrative fee of $50.00 will be imposed should
the property owner fail to come into compliance within the 14-day grace
period.

J. Officer Sterling offered testimony on Case No. 191030022; William R. Grigsby
JR, Hwy 70 East, four vacant unplatted parcels totaling approximately 9.592
acres on the North side of State Road 70/East North Park Street, Okeechobee.
The parcels have been found to be in violation of City Code of Ordinances
Chapter 30, Sections 30-43 Public Nuisance, and 30-44 General Cleaning and
Beautification due to overgrown vegetation. Due to an existing Lien Order, a fine
totaling $5,400.00 is owed to the City (fine accrued from March 11, 2020 to June
24, 2020). The property was re-inspected on July 3, 2020, and was, again, found
to be in violation. A Statement of Violation and Notice of Hearing was mailed on
October 9, 2020. The City is recommending this Case be considered a repeat
violation and requests a fine of $100.00 per day commencing on July 3, 2020
plus an administrative fee of $50.00. This fine is in addition to the existing balance
from the previous Lien Order.

Based on the testimony of Officer Sterling and the evidence provided, Magistrate
Azcona found that the property was a repeat violator and in violation of
Chapter 30, Sections 30-43 Public Nuisance, and 30-44 General Cleaning
and Beautification beginning July 3, 2020. A fine of $100.00 per day plus a
one-time administrative fee of $50.00 will be imposed.

Officer Sterling offered testimony on Case No. 190412010; South Florida
Barbeque of Okeechobee, Inc., 102 Southwest 14�' Street, Okeechobee (Legal
Description: Lots 4, 5, 6, 10, 11, and 12 of Block 22, together with a 15-feet wide
Alley running North to South between Lots 4, 5, 6, and 12, 11, and 12 of Block
22, SOUTH OKEECHOBEE, Plat Books 1 and 5, Pages 12 and 7, public records
of Okeechobee County). A Lien Order was filed with the Okeechobee County
Clerk's Office on August 29, 2019, as a result of Magistrate Azcona's ruling at the
June 25, 2019, Code Enforcement Magistrate Hearing. The property continues
to be in violation of City Code of Ordinances Chapter 30, Sections 30-43 Public
Nuisance and 30-44 General Cleaning and Beautification, and International
Property Maintenance Code Chapter 3, Section 304.2 Protective Treatment. The
building on the property is vacant, and has vagrants living in the patio portion of
the building. On February 27, 2020, a letter was sent notifying the property owner
that the fine has been accruing for more than 90-days and the property was at
risk for foreclosure. On September 22, 2020, a Statement of Violation and Notice
of Hearing was sent via certified mail. The letter was signed for and the return
receipt was received by the City on September 25, 2020, with an illegible
signature. The City is recommending foreclosure at this time.
Special Magistrate Azcona found that the property was in violation of
Chapter 30, Section 30-43 Public Nuisance, Section 30-44 General Cleaning
and Beautification, and International Property Maintenance Code Chapter
3, Section 304.2 Protective Treatment. Magistrate Azcona recommended
the Case be sent to the City Council for foreclosure action.
M. Officer Sterling offered testimony on Case No. 190411010; Kemp Properties of
Okeechobee, 909 South Parrott Avenue, Okeechobee (Legal Description:
unplatted acres). A Lien Order was filed with the Okeechobee County Clerk's
Office on August 20, 2019, as a result of Magistrate Azcona's ruling at the August
13, 2019, Code Enforcement Magistrate Hearing. The property continues to be
in violation of City Code of Ordinances Chapter 30, Sections 30-43 Public
Nuisance and 30-44 General Cleaning and Beautification. On August 6, 2020, a
letter was sent notifying the property owner that the fine has been accruing for
more than 90-days and the property was at risk of foreclosure. It was returned
unclaimed on August 17, 2020. A Statement of Violation and Notice of Hearing
was sent via certified mail informing the property owner of the foreclosure
recommendation. Nothing has been returned signed or unclaimed to date. As of
September 30, 2020, the accrued fine totals $18,725.00. Pictures were taken of
the property on October 7, 2020, showing the property is still in violation of
Sections 30-43 and 30-44.
Mr. Benjamin Purvis, the property owner's son, testified to his mother's
unforeseen health circumstances. Upon notification of this Hearing, he
questioned his mother and was told she had hired a local individual to bring the
property into compliance in August or September 2019. The individual informed
Ms. Kemp the property was brought into compliance and that a conversation was
had with Ms. Close at the Code Enforcement Office stating the same. Ms. Kemp
then issued the individual a check for the services rendered. Mr. Purvis asked for
time to bring the property into compliance, as he has already reached out to an
electrician to begin work.
City Attorney Kowalski recommended the Case be sent to the City Council with
Mr. Purvis providing evidence of work on the property to the Council at that time.
Should no progress be made, the Council should consider foreclosure.

Special Magistrate Azcona found that the property was in violation of
Chapter 30, Sections 30-43 Public Nuisance and 30-44 General Cleaning
and Beautification. Magistrate Azcona recommended the Case be sent to
the City Council for a status report from Mr. Purvis. Should there be no
progress, he recommends foreclosure action.
