OFFICIAL MINUTES
I. CALL TO ORDER
Special Magistrate Azcona called the Code Enforcement Special Magistrate Hearing to
order on Wednesday, October 21, 2020, at 6:30 P.M. in the City Council Chambers,
located at 55 Southeast 31d Avenue, Room 200, Okeechobee, Florida. The Pledge of
Allegiance was led by Magistrate Azcona.
II. ATTENDANCE
Deputy City Clerk Bobbie Jenkins called the roll in the absence of Code Enforcement
Secretary Close. Special Magistrate Roger Azcona, Esquire, City Attorney Carlyn
Kowalsky, Police Lieutenant Justin Bernst, and Code Officer Fred Sterling were present.
II1. CHANGES TO AGENDA
A. Magistrate Azcona asked whether there were any agenda items to be added,
deferred, or withdrawn; City Attorney Kowalsky withdrew the following items:
Items V.A., VII.B, VII.C, VII.E, VII.F, VII.G, VII.H, VII.I, VII.K, VII.L, VII.M, and
VII.P. The September 8, 2020 minutes were deferred to the November Hearing.
This being a Quasi -Judicial proceeding, Deputy Clerk Jenkins collectively
administered an Oath to Mr. Jeffery Newell, Mr. Francisco Guerrero, Code Officer
Fred Sterling, and Mr. Benjamin Purvis; all affirmed. Code Officer Sterling advised
all events occurred within the corporate limits of the City of Okeechobee. The
Officer's notes, testimony, photographs, and support documents were all entered
as part of the official record.
IV. APPROVAL OF MINUTES
A. The approval of the September 8, 2020 Hearing minutes was deferred to the
November 2020 Hearing.
V. CASES COMPLIED OR CONTINUED
A. Case No. 200605007 was withdrawn from the agenda.
VI. REPEAT VIOLATIONS
A. There were no repeat violations on the agenda.
VII. NEW CASES
A. Case No. 200915020; A/C Today Air Conditioning and Heating, LLC, Licensee:
Mr. Francisco Guerrero, 1604 Northwest 7t" Avenue, Okeechobee. City Building
Official Mr. Jeffery Newell testified that Mr. Guerrero has demonstrated disregard
for established procedures by State law and local ordinances regarding
permitting, was found to be in violation of City Code of Ordinances Chapter 70,
Section 70-302, for working without a building permit. Mr. Guerrero has failed to
pay for and pickup authorized permits on multiple occasions. He has also failed
to submit affidavits for final inspections for approximately 10 permits from 2015
to 2020. Mr. Guerrero has made this a continual practice for his business and
has progressed to a state of mind to ignore State law and local ordinances
governing the contracting laws that are required to be enforced by building
departments. A Statement of Violation and Notice of Hearing was sent by certified
mail on September 16, 2020 and was signed for by O. Cruz on September 21,
2020. The City is seeking relief in the form of an Administrative Order compelling
A/C Today Air Conditioning and Heating, LLC to comply with the permitting
process as required by the Florida Building Code, City Ordinances, and
permitting policies set forth by the City's building department, a requesting the
minimum penalty of $100.00 per open permit as per City Code Ordinances
Appendix G, Table 3, and a one-time administrative fee of $100.00.
Mr. Guerrero responded that he agreed with the evidence provided by Mr. Newell,
apologized, and explained he lacks help from his office. He is also willing to
comply with Mr. Newell's requests, but asked to be given 30-days to comply with
the Magistrate's ruling.

Special Magistrate Azcona found that A/C Today Air Conditioning and
Heating, LLC, was in violation of City Code of Ordinances Chapter 70,
Section 70-302, for working without a building permit. An Administrative
Order will be issued compelling A/C Today Air Conditioning and Heating,
LLC to comply with the permitting process as required by the Florida
Building Code, City Ordinances, and permitting policies set forth by the
City's building department, along with a $1,000.00 penalty plus a one-time
administrative fee of $100.00 totaling $1,100.00 to be paid within 30-days of
this Hearing.
B. Case No. 200617006 was withdrawn from the agenda.
C. Case No. 200611034 was withdrawn from the agenda.
D. Officer Sterling offered testimony on Case No. 200318009; Daniel Meara 905
Southwest 3rd Avenue, Okeechobee (Legal Description: Lot 9 of Block 5, SOUTH
OKEECHOBEE, Plat Books 1 and 5, Pages 12 and 7, public records of
Okeechobee County). The property was initially inspected on March 18, 2020,
and found to be in violation of City of Okeechobee Code of Ordinances Chapter
30, Section 30-41 Inoperable/Abandoned Vehicles, 30-42 Public Nuisance, and
30-4.4 General Cleaning and Beautification due to the property needing to be
mowed and debris removed, as well as a vehicle with no tag. On March 19, 2020,
a courtesy card was mailed that included copies of the Code Sections the
property owner was in violation of. A Statement of Violation and Notice of Hearing
was mailed on July 28, 2020 and was returned. On July 31, 2020, the property
was found to be in compliance of Sections 30-42 and 30-44. The second
Statement of Violation and Notice of Hearing was mailed on September 22, 2020
for violation of Chapter 30, Section 30-41 Inoperable/Abandoned Vehicle. The
notice was signed for by Krystal Carter. The property was not posted.
Officer Sterling stated the City recommends providing the property owner with 14
days to correct the violation. Should this not be met, a fine of $25.00 per day plus
a one-time administrative fee of $50.00 is recommended. Based on the evidence
provided, Magistrate Azcona found that the property was in violation of
Chapter 30, Section 30-41 Inoperable/Abandoned Vehicle. A fine of $25.00
per day plus a one-time administrative fee of $50.00 will be imposed should
the property owner fail to come into compliance within the 14-day grace
period.
E. Case No. 200929003 was withdrawn from the agenda.
F. Case No. 200928005 was withdrawn from the agenda.
G. Case No. 200824014 was withdrawn from the agenda.

Case No. 200605020 was withdrawn from the agenda.
J. Officer Sterling offered testimony on Case No. 191030022; William R. Grigsby
JR, Hwy 70 East, four vacant unplatted parcels totaling approximately 9.592
acres on the North side of State Road 70/East North Park Street, Okeechobee.
The parcels have been found to be in violation of City Code of Ordinances
Chapter 30, Sections 30-43 Public Nuisance, and 30-44. General Cleaning and
Beautification due to overgrown vegetation. Due to an existing Lien Order, a fine
totaling $5,400.00 is owed to the City (fine accrued from March 11, 2020 to June
24, 2020). The property was re -inspected on July 3, 2020, and was, again, found
to be in violation. A Statement of Violation and Notice of Hearing was mailed on
October 9, 2020. The City is recommending this Case be considered a repeat
violation and requests a fine of $100.00 per day commencing on July 3, 2020
plus an administrative fee of $50.00. This fine is in addition to the existing balance
from the previous Lien Order.

Based on the testimony of Officer Sterling and the evidence provided, Magistrate
Azcona found that the property was a repeat violator and in violation of
Chapter 30, Sections 30-43 Public Nuisance, and 30-44 General Cleaning
and Beautification beginning July 3, 2020. A fine of $100.00 per day plus a
one-time administrative fee of $50.00 will be imposed.
K. Case No. 15-010 was withdrawn from the agenda.
L. Case No. 190215011 was withdrawn from the agenda.
Officer Sterling offered testimony on Case No. 190412010; South Florida
Barbeque of Okeechobee, Inc., 102 Southwest 141" Street, Okeechobee (Legal
Description: Lots 4, 5, 6, 10, 11, and 12 of Block 22, together with a 15-feet wide
Alley running North to South between Lots 4, 5, 6, and 12, 11, and 12 of Block
22, SOUTH OKEECHOBEE, Plat Books 1 and 5, Pages 12 and 7, public records
of Okeechobee County). A Lien Order was filed with the Okeechobee County
Clerk's Office on August 29, 2019, as a result of Magistrate Azcona's ruling at the
June 25, 2019, Code Enforcement Magistrate Hearing. The property continues
to be in violation of City Code of Ordinances Chapter 30, Sections 30-43 Public
Nuisance and 30-44 General Cleaning and Beautification, and International
Property Maintenance Code Chapter 3, Section 304.2 Protective Treatment. The
building on the property is vacant, and has vagrants living in the patio portion of
the building. On February 27, 2020, a letter was sent notifying the property owner
that the fine has been accruing for more than 90-days and the property was at
risk for foreclosure. On September 22, 2020, a Statement of Violation and Notice
of Hearing was sent via certified mail. The letter was signed for and the return
receipt was received by the City on September 25, 2020, with an illegible
signature. The City is recommending foreclosure at this time.
Special Magistrate Azcona found that the property was in violation of
Chapter 30, Section 30-43 Public Nuisance, Section 30-44 General Cleaning
and Beautification, and International Property Maintenance Code Chapter
3, Section 304.2 Protective Treatment. Magistrate Azcona recommended
the Case be sent to the City Council for foreclosure action.
M. Officer Sterling offered testimony on Case No. 190411010; Kemp Properties of
Okeechobee, 909 South Parrott Avenue, Okeechobee (Legal Description.
unplatted acres). A Lien Order was filed with the Okeechobee County Clerk's
Office on August 20, 2019, as a result of Magistrate Azcona's ruling at the August
13, 2019, Code Enforcement Magistrate Hearing. The property continues to be
in violation of City Code of Ordinances Chapter 30, Sections 30-43 Public
Nuisance and 30-44 General Cleaning and Beautification. On August 6, 2020, a
letter was sent notifying the property owner that the fine has been accruing for
more than 90-days and the property was at risk of foreclosure. It was returned
unclaimed on August 17, 2020. A Statement of Violation and Notice of Hearing
was sent via certified mail informing the property owner of the foreclosure
recommendation. Nothing has been returned signed or unclaimed to date. As of
September 30, 2020, the accrued fine totals $18,725.00. Pictures were taken of
the property on October 7, 2020, showing the property is still in violation of
Sections 30-4-3 and 30-44.
Mr. Benjamin Purvis, the property owner's son, testified to his mother's
unforeseen health circumstances. Upon notification of this Hearing, he
questioned his mother and was told she had hired a local individual to bring the
property into compliance in August or September 2019. The individual informed
Ms. Kemp the property was brought into compliance and that a conversation was
had with Ms. Close at the Code Enforcement Office stating the same. Ms. Kemp
then issued the individual a check for the services rendered. Mr. Purvis asked for
time to bring the property into compliance, as he has already reached out to an
electrician to begin work.
City Attorney Kowalski recommended the Case be sent to the City Council with
Mr. Purvis providing evidence of work on the property to the Council at that time.
Should no progress be made, the Council should consider foreclosure.

Jeff Newell, City Building Official, for the record the contractor is present. The reason we are
here, violation is work without a permit, based on this particular case fbc 109.1, should have
that in your packet "read into record". This is the accord for this particular complaint. 70-251
ciyt ordinances, 553.79 FS. In this particular case, explain that the building dept has been very
department with the contractor, accepting his explanations and excuses. Pattern of behaviour
has been established, submitting the permit, doing the work, not paying for the permit but doing
the work anyway. Verbal warnings have been given. We can no longer do that. He was noticed,
receipt on 9/21/20. Is the respondent a repeat violator, yes, but we were working with him.
History will be found in G36. This is one of the notifications he received. May 14 2018, installing
an ac change out without a permit. Caught him in the field, failed to submit affidavits for final
inspections. On G1 you will see another violation that was sent 8/20/2019. The permit was
applied for and failed to pay, 109.4 as adopted by City. G2 through G6. Had 10 incidents here
where final inspections were not scheduled. Go as far back as 2015 through 2020. In G6/7 he
emailed in the application on these two properties. I was requiring of him that he was required
to pay up front because of the past behaviour. I was informed he brought this current late today.
He responded that he will take care of it, thank you. It's a pattern we simply can't do anymore.
What we are seeking, page 3, Administrative order to compel ac today to comply with fbc, city
ordinances, and building dept policies, $100 penalty be applied, rescheduling the final
inspections.

done. City recommends 14 days to correct the violation, a fine of $25 per day plus admin fee
of $50 if violoation not in compliance after the 14 day grace period.

Fred-I have pictures (passed to Roger), Picture was taken yesterday and back in august.
Roger-exhibits submitted on or about October 10, also a picture aug 6, 2020 at 9 am and shows
a vehicle without tag and overgrown vegetiation. Do you have any proof of citiation notice
delivery.

Roger-city has also provided certified return receipt. Statement of Violation of notice, it says on
the 8th of September, 2020. Did he have notice for tonight.

from today.
Fred-as far as I know. We have had an administrative problem. He has received courtesy card,

Roger-finding in the case of city vs. Meara, case #200318009, decision is based on the
testimony and exhibits by the certified code enforcement officer, pictures established facts,
respondent has been served previously, and we did defer it from the September meeting. He
did not appear on that day either. And the City circumstances $25/day fine after 14-days with
$50 admin fee.

Fred-the property is basically across from the post office on 70. I believe there are five lots
involved in this. Description of violation, courtesy card sent out 8/15/19, notice of
violation/appear sent out on 8/27/19 for September Hearing, but was cancelled. Another notice
11/2019, they were returned as unable to forward, not delivered as addressed, but then back
on 3/18/20 he did sign for it. We posted the property on 2/25/20. It was found in violation by the
magistrate on 3/10/20, came into compliance 6/24/20, July 3/20 violation again. Recommends
repeat violator. Fine $100/day starting on July 3, 2020 until property comes into compliance.
The amount owed for the first violation is $5350.00, plus the $100 per day starting in July.
Roger-do we know what the figure is today mr. sterling
Fred-she did not tabulate the fine. Plus there is a$50 admin fee.
Roger-110 days x$100per day plus the $50 admin fee and the $5350.00. SO what is the city
asking for at this time.
Fred-asking for total amount of fine. If he wants to request a reduction,
Roger-$17000, shouldn't the City go ahead and foreclose the property.
Fred-couldn't do it until it came before the magistrate; now we can bring it back for foreclosure
recommendation. I'm wrong, the state mandates 90-days before we can foreclose. We will
send them a letter.
Roger-but it has already run 90-days.
Fred-but we have to send the notice first
Roger-can I see the city's exhibits? This is everything that was posted on the property.
Fred-yes only posted on one lot because couldn't differentiate.
Roger-signed receipt received. Make a finding based on the testimony and the exhibits
presented today in this case, the respondent in violation I see the respondent has been property
noticed. Statement of Violation was provided stating today's hearing date. First found in vilation
8/15/19 did not come into compliance until 3/10/20 and violated again 7/3/20, which
accumulated a fine of $5350. Based on the testimony since 7/3 to current, property not
incompliance and based on the previous hearing, the total assessment of approvimately
$11000+$50+$5350=$16400. Ok so um we made a finding of the total fines is assessed. Are
we requeting for anything else.

Fred-first inspected 04/2019, mat 21, 2019 statement of violation notice returned unclaimed
6/5/2019. May 30, 2019 notice of date change was sent, nothing was returned. We posted the
property and you can see all of the pictures there. We've had no response at all from the
property owners. They've moved a pile of concrete in the back, all the vegetation in the front is
dead. There's vines growing in the back, patio has vagrants living in it. I happened to be over
in ft. pierce and just happened to talk to a chain. He said they were waiting on the hobby shop
lease to end. That ended a year ago. The next excuse is Sonny's franchise is wanting all to
remodel. Nothing has been done on this property. Lien order has been filed as of 3/11/20 the
fine was

Roger-looks like they were served. I'll make a finding in this case, that the respondent in this
case is in violation 30-43 and 30-44, and the IPMC chapter 304.2 city exhibits presented.
4/15/19 in voiolation, proper notice was sent, respondent was also properly noticed for this
hearing. I see the certified return receipt that retains a signature. Under the circumstances, the
fines have accumulated to $13200 as of 9/30. Recommend foreclosure.
N. Case Number 190411010; Kemp Properties of Okeechobee 909 South Parrott

Ordinances. Recommendation for Foreclosure.
Fred-located at 909 S parrott avenue, come before the Magistrate and they were issued a fine
of $50/day. The fine has been running and the City is recommending foreclosure.
Roger-how much is that fine.
Fred-she may have it on here, let me take a look. The fine right now as of 9/22 $18,725.00.
$50/day and they were given 30 days after the order to come into compliance, and did not.
There is also a one-time $25 administrative fee.
Benjamin Purvis-Brenda Kemp is my mom, alright so I try to explain this the best I can.
Approximately 2.5 years ago, she started deteriorating health wise. Extreme diabetic, heart
attack, stroke, so she has been in and out of the hospital for at least two years. Last Aug/Sep
timeframe. I just found out about all of this 10am yesterday morning. Last aug/sep time, she
had a code violation and she had a code violation, she called me and I asked what do we have
to do, told her to just call somebody to have it taken care of. She called a local guy, I don't have
his name at the moment, locally he did some pressure cleaning, replaced lights, mowed, and
he had told her and she told me back then that the guy she hired had worked with the lady at
code enforcement, I'm assuming Ms. Close, not sure if she worked here last year. I spoke to
fred about it yesterday. He said he found out what needed to be done, charged us $3k for the
work and said everything was good.
Roger-yesterday
BP-no last year, I didn't know I needed to do anything. Since that itme, shes had 5 amputations.
She is 100% dependent on 24-hour care, she has moved from her house in with my brother.
Most of the time she's been in the hospital the past year. The City has sent letters but we never
got them because they sent them to the other house. They've sent letters to me and my brother,
but they sent it to her address.

Roger-nobody called code enforcement to inspect it again to determine its in compliance. Once
its in compliance, the fines stop. Did anyone call?
BP-the guy we hired said he called Code Enforcement. So my mom sent a check. I need to go
to the bank to get a copy of the check. Its hard because she is so sick.
Roger-you understand the fine is, what are you asking for?
BP-no foreclosure, the other is if I can find out who the person was?
Fred-have a name Donald Duhnam. That was back in August or 2019. I've got some pictures
to show you from December of 2019 of the property.
Roger-so you took these pictures back in December, what did you find.
Fred-here are pictures taken on the 7th of this month (passed to Roger)
Roger-I want to show this to Mr. Purvis. If he agrees that this is the actual property location.
The city is alledging that the property was not in compliance.
BP-showed Roger where the property line was.
Roger-Mr. Sterling, based on your
Fred-the vacant property is not theirs. Mold on walls and driveway. The City main objective is
not to fine but voluntary compliance, the only reason we go to this extreme is after you've
exhausted all of your avenues, he's an absentee owner, the problem with him not getting the
mail, his brother does. We're not trying to put a hardship, we just want the property cleaned up.

BP-got with my brother last night to get it cleaned up. Bill Fredricks is an electrician and he's
going to fix 3 parking lot lights in the parking lot.
Fred-tenants have been complaining on the walkway on the north and they're scared to do
business at night.
BP-we think it's just light bulbs. I don't see anything broken. Pressure cleaning, I don't have
anyone at the moment, but im sure I can get someone to pressure clean. I know it needs to be

CK-come back to the next City Council meeting, we were going to take this to the City Council
in 2 weeks to allow us to foreclose. You come to the meeting in two weeks and show evidence
that you have gotten it cleaned up and then see what they recommend.
BP-I live in Okeechobee County, my question is since the FS says you have to mail it. PA won't
let me change her address.

Special Magistrate public hearing scheduled for October 6, 2020, has been
rescheduled to Wednesday, October 21, 2020, 6:30 at PM, or as soon
thereafter as possible at City Hall, 55 SE 3�d Avenue, Council Chamber,
Room 200, Okeechobee, Florida.
The public is invited and encouraged to attend, but seating is limited in the
