THIS CAUSE came before the Special Magistrate, City of Okeechobee, for public
hearing on August 11 , 2020. After due notice to the respondent, the Special Magistrate
having heard evidence on the alleged violation by witnesses or affidavit makes the following
findings:
A. FINDINGS OF FACT:
Lots:5 and 6 Blk: 176 Section: Okeechobee, Plat Book 5, Page 5,
Parcel: 3 -15 -3 73 5-0010-0176-00 5 0
Property location: 201 Southwest 51h Street
Property owner: Aaron and Karla Parriott
B. CONCLUSIONS OF LAW:
The owner of the property described above has been found inviolation of: Chapter 30 Section 30-43 Public
Nuisance, Section 30-44 General Cleaning and Beautification and Section 30-41 Inoperable/Abandoned
Vehicle. The fenced area on the back side of the building need to be cleaned up of all debris and mowed.
There is a huge pothole in the parking lot that needs to be filled in. A few days before the hearing we notice
a vehicle on the property with no tag on it. This vehicle needs to be removed or have a tag put on the
vehicle.
C. ORDER: The City of Okeechobee Code Enforcement Special Magistrate has
determined you have violated the Code of Ordinances Ch 30 Sec 30-41, 30-43 and 30-44
concerning your property located at 201 Southwest 5th Avenue.
If you do not correct the violation For Sections 30-43 and 30-44 an immediate fine of $100.00 per
day due to being repeat offenders. On Section 30-41 a fine of $25.00 per day to start 14 days after
proper notification, or notify the
Code Enforcement Officer of the correction, the Magistrate imposes a fine of $ 100.00 per day
for Section 30-43 and 30-44 and a fine of $25.00 per day 14 days after proper notification for
Section 30-41, Also a onetime fee of 50.00 for administrative fees, commencing that date and
continuing daily until the violation is corrected or the city is notified by you and verifies the
correction, which ever first occurs. Further, if you do not correct the violation by said date, a
copy of this order as a claim of lien, shall be recorded in the office of the Clerk of Circuit Court,

Sec. 30-43. - Pubiic nuisances
(a) "Public nuisance" as defned in �this section, means the existence of excessive accumulation of litter
or untended vegetation, garbage, weeds, or oth�r dead or living plant life; or places holding stagnant
water, and all other objectionable, unsightly or urisanitary matter upon �ny loi, track ofi land within the
city whether uncovered or under shelter, to the extent and in the manner �that such lot or parcel of
land is, or may reasonably become infested or inhabited by rodents, vermin or wilci anim�ls, or may
furnish a breeding place for mosquitoes, or threatens or endangers the public health, safiety or
welfare, including such condition causing or te�nding to cause disease, or by reason o�f such a
condi#ion, tends to impair the economic welfare of adjacent property; including abandoned or junk
property as defined by this article; unsightly, cierelict or unsafe building or structure which may
constitute a hazard to safety, health, welfare or sense of public aesthetics by reason of inadequa4e
maintenance, dilapidation, obsolescence, or abandonment.
(b) All nuisances are cleclared to be a public nuisance and illegal within the municipal boundaries ofi the
city, and shall be removed, corrected or otherwise satisfied at the direciion of the city as provided in
this article.
(c) Any nuisance, except such nuisance as would be determined to be an emergency, existing within
the ciiy shall be brought before the code enforce�ment board of the city as provided in F.S. ch. 162.
Upon determinaiion by the board that a nuisance does in fiact exist, the landowner or custodian
thereof shall take whatever corrective measures as directed by the board, within the time period
provided by the board. The remedies available t� the code enforcement board, in addition to those
set fiorth in F.S. ch. 162, shall include the authority to authorize clean up or repair of the property to
come into compliance; to recommend suspension or revocation of an occupational license until the
property comes into compliance; and such further remedies as provided by law. If the code
enforcement officer has reason io believe a violation or the condition causing the nuisance presents
a serious threat to the public heal#h, safety or w2lfare, or is irreparable or irreversible in nature, he
shall make a reasonable effort to notify the violator, and may immediately notifiy the code
enforcement board and request a hearing.
(d) If the owner, agent or person in custody of any property upon which such nuisance should exist, fail,
neglect or refuse to comply with the direction of the code enforcement board within the time
provided, and such is verified by ihe code enforcement o�cer, and the code enforcement officer
confirms that the person responsible was noticed of the board action by certified mail, the code
enforcement officer is empowered to authorize the property to be cleaned and the nuisance abated
by his own agents or authorized contractors. Prior to commencing such abatement, the code
enforcement officer shall obtain a reasonable estimate for such abatement and present the estimate
to the city administrator for approval. If in the opinion of the city administrator the cost of abatement
exceeds the reasonable value of the property or is otherwise not warranted, then enforcement of the
order of the code enforcement board may proc:eed via other available alternatives. under law. Ifi
abatement is approved, the code enforcement officer, his agents or contractors are authorized to
enter upon such property and take whatever remedial measures are necessary to abate the
nuisance to comply with the order of the code enforcement board, and to protect the health, welfare
and safety of the citizens of the city. Notwithstanding this procedure, if the city administrator should
determine that the nuisance is in the nature of an emergency or of such an immediate danger or risk
to the public as to imminently affect the public he�ilth, safety or welfare of the general public, then the
city may enter upon such p�operty at any time to take whatever remedial action as is deemed
reasonable and necessary to abate the nuisance to ensure the public health and safety. In such
instance, the city shall attempt all reasonable means to give the landowner, agent or person in
custody of the property advance notice of the proposed actions of the city, although failure to achieve
actual notice shall not prevent such abatement.
(e) All costs incurred under this section for the abatement of the nuisance, including administrative
code enforcement expenses; labor, equipment �nd material expenses; and any costs reasonably
related to the abatement shall be the responsibilifi� of the landowner. The total costs as calculated by
the code enforcement officer shall be included in ,� resolution presented to the city council, who shall
levy a special assessment lien against such lot. Such resolution shall describe the landowner, parcel

(a) In ihe interpreta�tion or' this sec�ion, the city h��s determined that all lands in the city fall into the
foilowing ca�tegories, and this Code vviil be enforced in ihis section to conform to these categories:
(1) Unplai�ed a�d undev�loped lands are cons�der�d to be raw land or unimproved land.
{2) Platfed and uncleveloped lands ar� considered to be raw land or unimproved lancl.
(3) Pl�tted and developeci lands are considereci to be developed or improved land.
(4) Unplarted and partialfy dev�loped lands ar�� considered as developed and improved land only
for that portion o� th� �hole parcel that includes actual developed land.
(b) All o�,vners or improved property shall cut anci keep cut all �,veeds, grasses or undergro�Nth on the
eniire property, to a height not to exceecJ eight inches. Also, all landscaping shall be trimmed and
kept in a neat appearance so as not 7o adversely affect the aesthetic appearance of fhe properiy and
adjacenr properties.
(c) When determined by fhe code enTorcemenz officer or the cifij that a public nuisance exists, owners
of all unimproved property shall cut and Reep all weeds, grasses and und�rgrowth to a height not io
exceed 12 inches, in � sfrip 100 feet wide arourn9 the perimeter of such property, which fronts on a
public street, drainag� or utili�ty easement or is contiguous io occupied proper�y. Aiso, the owner shall
remove any abandoned property, garbage, li�ter, stagnant water, untended vegefation or noxious
matter on the entire property.
(d) All owners are deemed io be in conirol of and responsible for areas on or adjoining iheir properry
such as easements.
(e) All lands in ihe ciiy shall be kept free of untendeci vegetation or any other marter, which by reason of
height, proximity to neighboring structures, physical conditions; disease such as, buf not limited to:
lethal yellowing palms or ofher peculiar characteristics which might in time of high winds, prevalent in
this region, cause damage to life or property within the immediate area surrounding such region.
(� It shall be unlawful for any person to cause, maintain, permit or allow to be caused, maintained or
permitted, the accumulation of any litter, garbae�e, abandoned property, stagnant water, untended
vegetation or weeds on any construction or building site before, during or after completion of such
construction or building. It shall be the dufij of the owner or his agent to make adequate provisions
for the disposal of such items and to have, on thE construction or building site, adequate facilities for
the disposal of such items and to make appropria•te arrangements for the collection thereof.
(g) It shall be the responsibility ofi all owners of improved property to mainiain proper ground cover on
their property (such ground cover including, but not limited to, grasses, concrete, asphalt, decorative
stones) and driveways (driveway ground cover including, but not limited to, concrete, asphalt,
decorative stones, in-laid brick, tile and sheil ro�k) to prevent a condition that could endanger the
health, safety and welfare of any member of the community; maintained as required in this section.
Furthermore, appropriate landscaping shall be in:�talled, replaced and mainiained, in living condition,
so as not to adversely affect the aesthetic appearance of the properiy and adjacent properties.
(h) No persons shall sweep into or deposit in any gutter, ditch, street or other public place within the city
the accumulation of liiter from any building or lot c�r from the public sidewalks. Nor shall any owner or
tenant abutting a public thoroughfare allow or suffer to remain litter upon the adjacent public
sidewalk, including medians, so that liiier, rubbish and refuse shal! not be allowed to pile up or
accumulate on such public right-ofi-way.
(i) No merchant or business within the city shall allow litter to accumulate, and shall clean and
otherwise rid his premises, including sidewalks, ofi waste matter and litter although the same may not
have been deposited by him, his agents or his patrons.
