THIS CAUSE came before the Special Magistrate, City of Okeechobee, for public
hearing on September 8 , 20 20. After due notice to the respondent, the Special Magistrate
having heard evidence on the alleged violation by witnesses or affidavit makes the following
findings:
A. FINDINGS OF FACT:

B. CONCLUSIONS OF LAW:
The owner of the property described above has been found in violation
of. Chapter 30 Section 30-43 Public Nuisance and Section 30-44
General Cleaning and Beautification. Property needs to be mowed and
debris needs to be cleaned up/thrown away.
C. ORDER: The City of Okeechobee Code Enforcement Special Magistrate has
determined you have violated the Code of Ordinances Ch 30 Section 30-43 and Section 30-44
concerning your property located at 1612 Northwest 7 h Avenue, Okeechobee, Fl.
If you do not correct the violation 10 days after proper notification, or notify the
Code Enforcement Officer of the correction, the Magistrate imposes a fine of $ 200.00 per day,
Also a onetime fee of 50.00 for administrative fees, commencing that date and continuing daily
until the violation is corrected or the city is notified by you and verifies the correction, which
ever first occurs. Further, if you do not correct the violation by said date, a copy of this order as a
claim of lien, shall be recorded in the office of the Clerk of Circuit Court, Okeechobee County,
Florida, and once recorded, becomes a lien
on real and personal property pursuant to Florida Statute 162. You have a right within thirty
days, to appeal this finding and order by Writ of Certiorari to the Circuit Court, Okeechobee
County, Florida. If you correct the violation prior to the above date, it is your obligation to
contact the Code Enforcement Officer to verify such compliance.

ihis r�gion, caus� damagz to lif� or property within the immedia�e area surrounding such region.

constiruciion or building. !t shall be ihe du'ry ofi the owner or his agenr to make ad�quate provisions
for ihe disposal ofi such iiems and to have, on the construciion or building sit�, adequate facilities for
ihe disposal of such ifems and to make appropriate arranyemenis r"or the coll�crion ihereof.
(g) It shall 6e the r�sponsibilifij of all o�rvners o� improved property io mainiain proper ground cover on
'their property (such ground cov�r including, but not limitecJ to, grasses, concrete, asphali, decorative
stones) ancJ driveways (driveway ground cover including, but noi limited fo, concrete, asphalt,
deco�afive srones, in-►aid brick, iile and shell rock} to prevent a condifion ihat could endanger the
healih, safeiy and w�ITar� ofi any member of the community; main4ained as required in this seciion.
Furthermore, appropriare (andscaping shall be insialied, replaced and mainYained, in living condition,
so as not io adversely affecit the aesihetic appearance of the propert� and adjacent pro4erties.
(h) No persons shall sweep inzo or deposii in any gutier, ditch, sireet or other public place within the city
ihe accumulaiion ofi liiter firom any building or lot or from ihe public sidewafks. Nor shall any owner or
tenant �butiing a public thoroughfare allow or suffer to remain liiier upon the adjacenz public
sidewalk, including medians, so that litter, rubbish and refuse shall no't be allo�ved to pile up or
accumulate on such public right-of-way.
(i) No m�rchani or business within the city shall allow litter io accumulaie, and siiall clean and
otherwis� rid his premises, including sidewalks, ofi wasie matter and liiter although the same may not
have been deposited by him, his agents or his patrons.

SQc. 30-43. - Public nuisances.
(a) "Puolic nuisance" as der"ined in this section, means the exisience oz excessive accumulation of litier
or uniend�d veg�faYion, garbag�, weeds, or other d��d or fiviny olani lir"�; or places holding siagnanr
wazer, �nd �il oih�r o9ajectionabie, unsightly or unsanifiary ma�rer upon any loc, irack or lancl wiihin ihe
city Nih�fh�r uncov�red or uncJer shelier, to ihe exYen4 and in �he rnarnier iha� such lot or parc�l or
land is, or rnay reasona6fy 6�corne infesfed or inha�iY�d by rodents, varrnin or wild anirnals, or may
rurnish a bre�ding pl�c� r"or mosquiioes, or ihrea��ns or endang�rs rhe pub(ic healeh, saf�fiy or
welr'�r�, including such condition causinc� or t�nding io cause disease, or by r�ason of such a
condiiion, t�nds io impair ih� economic welfare oT adjacent property; inclucling abandoned or junk
proAeri�j as de��ined by �his article; unsighi�y, derelict or unsaie 6uilding or scructure which may
consYifuf� a ha?ard to s��f�'ry, heal�h, welr'are or sense oi public a�srhe�ics by r�ason or` inadec�uaie
m�in��nanc�, dilapidation, obsolescei�ce, or abandonrnenr.
(b) All nuisances are dc-clar�d ro be a public nuisance and ill�gal within ihe municip�l boundaries of the
ciiy, �nd si�all be remov�d, correcied or ofherwis� safisfi�d ai �he direc�ion of ih� cigy as pro��icl�d in
ihis articl�.

by his own agenfs or authorized contractors. Prior io commencing such abatemen�c, ih� co�e

determine �hat ihe nuisance is in the naiu�e oz an emergency or of such an immediaie danger or risk
to ihe public as to imminently a'rF�cr fh� public health, safieiy or welfare of the general public, then the
ciiy may enier upon such properry at any #ime to take whatever remedial action as is deemed
reasonable and r�ecessary to abate the nuisance to ensure the public healih and safeiy. 1n such
instance, rhe ciiy shall a�iempt all reasonable means to give the landowner, agent or person in
custody or the property advance noiice of the proposed actions of ihe ci'ry, alfhough Tailure 'to achieve
acivai no3ice shall not preventi such abaiernen�.
(e) All costs incurred under this seciion for the abatemen� of the nuisance, including adminisccativ�
code enforcemeni exQenses; labor, equipment and materia! expenses; and any costs reasonably
related to the abaYem�nf shatl be the responsibility of the iandowner. The iotal costs as calculated by
the code enforcemeni o#ricer shali be included in a resolution presented to the city council, who shall
levy a special assessment lien against such lo't. Such resolution shall desc�ibe the landowner, parcel
