THIS CAUSE came before the Special Magistrate, City of Okeechobee, for public
hearing on September 8 , 20 20. After due notice to the respondent, the Special Magistrate
having heard evidence on the alleged violation by witnesses or affidavit makes the following
findings:
A. FINDINGS OF FACT:

B. CONCLUSIONS OF LAW:
The owner of the property described above has been found in violation
of. Chapter 30 Section 30-43 Public Nuisance and Section 30-44
General Cleaning and Beautification. Vacant lot needs to be mowed
and all debris removed
C. ORDER: The City of Okeechobee Code Enforcement Special Magistrate has
determined you have violated the Code of Ordinances Ch 30 Section 30-43 and Section 30-44
concerning your property located at Northeast 9th Avenue, Okeechobee, Fl.
If you do not correct the violation 14 days after proper notification, or notify the
Code Enforcement Officer of the correction, the Magistrate imposes a fine of $ 100.00_per day,
Also a onetime fee of 50.00 for administrative fees, commencing that date and continuing daily
until the violation is corrected or the city is notified by you and verifies the correction, which
ever first occurs. Further, if you do not correct the violation by said date, a copy of this order as a
claim of lien, shall be recorded in the office of the Clerk of Circuit Court, Okeechobee County,
Florida, and once recorded, becomes a lien
on real and personal property pursuant to Florida Statute 162. You have a right within thirty
days, to appeal this finding and order by Writ of Certiorari to the Circuit Court, Okeechobee
County, Florida. If you correct the violation prior to the above date, it is your obligation to
contact the Code Enforcement Officer to verify such compliance.

August 3, 2021 Spoke with Mr. Gad about the keeping the property in compliance. I(A.
Smith) advised him that keeping the bush and grass cut back off the
property of the residents of the park. He agreed to keep the grass cut back
away the resident yards.
August 6, 2021 Spoke with Mr. Dobbs about the cutting of the property. He advised that
the property was flooded in some spots and that they were going to cut as
much as they can. I advised him I would come take some pictures once
the job was completed.
August 9, 2021 Spoke with Mr. Gad this morning about the property being in compliance.
He advised me that the property was in compliance, and I advised him that
I was going to inspect the property today. I also advised him that he did
not have to come to the hearing tomorrow evening.
Inspected the property: in compliance, property was cut back about
30ft away from the park's residents' property. Photos in file.
August 10, 2021 Case presented to the Special Magistrate for fine reduction request. Special
Magistrate Azcona ruled to reduce the fine to zero. The property owner
will be charged the $50.00 administrative fee. No further action on this
matter was requested but was noted for the record to have been in
violation of Code of Ordinances Chapter 30, Sections 30-43 Public
nuisance and 30-44 General cleaning and beautification.
September 24, Code Officer Curl called Mr. Gad Reggen in reference to the payment for
2021 the administrative fee to close the file. He asked for a letter to be emailed
to him advising where to send the payment and the amount. Email
address: Gad4545(a�qmail.com. Emailed Settlement letter as requested.
September 29, Received payment in the amount of $50.00 payable by check #2255.
2021 Payment turned into City Hall.
September 29, Release of Lien prepared for the Mayor's signature.

May 19, 2021 Assistant Chief Hagan spoke with Gad Reqqev reference to open lien and
case status. He requested that the case be scheduled for the next Special
Magistrate Hearing on June 8tn
May 19, 2021 Received call from City Attorney Kowalsky advising that she spoke with
Steve Dobb's today and he was advised to provide a plan of action in
writing and once the property is in compliance, we will then move forward
with presenting the case to the Special Magistrate for a fine reduction.
May 19, 2021 Assistant Chief Hagan spoke with Steve Dobb's and advised him to also
provide us with a plan of action and to let us know as soon as the property
is in compliance, so that Code Officer Smith can verify that the property is
in compliance then the case can be presented to the Special Magistrate
for a Fine Reduction.
June 3, 2021 Spoke with Phil Bowman of B& B Site Development and he explain that
the equipment will be move to the property this evening and that they
would be starting to bring the property into compliance in the morning.
June 4, 2021 Code Enforcement Officer A. Smith follow up visit: B& B site development
has started clearing the property.
June 16, 2021 Inspected the property: Not in compliance, progress has been made
since the last inspection but there is a great deal more work needed
to be completed to bring the property into compliance.
June 25, 2021 Was advised to check and see if the property was in compliance and call
Phil Bowman and discuss the situation. Inspected the property and
concluded that the property was not in compliance. Photos in file.
Spoke with Mr. Bowman and advised him that the property was not in
compliance.
July 1, 2021 Spoke Mr. Bowman with the Assistant Chief about the property in
compliance. Mr. Bowman advised us that he did all he could with the
property and that the mowing of the property was up to the property
owner. Property inspected: Assistant Chief and the Code Enforcement
Officer (A. Smith) surmises that the property was cleared as well as
could be and that the property in need of being mowed and that
would only happen until the property dried out first. Property in
compliance. Photos in file. Call the property owner and Mr. Bowman
that the property is in compliance. Advised Mr. Gab that the next step
was to take care of the fine. He can fill out a fine reduction form and
that it would be heard at the August hearing.

April 13, 2021 Received email from Dispatcher Adele Nunez advising that Steve Dobs
with B& B Site Development called advising that they have a burn permit
to burn debris in the area of NE 8th Ave, its North of Riverrun and South of
the City Industrial Park. Mr. Dobs advised they have a permit for the next 6
months and will be burning 60 days in the next 6 months. For any
questions he can be reached at (863) 634-0194.
April 13, 2021 Inspected the property: Not in compliance Property owner has made
no attempts to bring the property into compliance. The property is
terribly overgrown and in need of being cut and cleared.
April 13, 2021 Case presented to the Special Magistrate he ruled despite the
attempts to resolve the matter with the owner, seeing no progress
being made, recommended foreclosure.
May 5, 2021 Inspected the property: Still not in compliance, however property
owner has started to clear the land. Photos in file.
May 14, 2021 90 Day Letter mailed certified return receipt. Received by Blue Springs
Holdings LLC on 5/17/2021 not signed due to COVID-19.
May 19, 2021 Mr. Gad Reqqev called and spoke to the code enforcement officer (A.
Smith). I explained to Mr. Gad that a lien order was placed on the property
and that a fine was accruing on the property owner. That he had the option
to request a fine reduction. That the case also was recommended to go to
foreclosure, but a 90-day letter was not sent out, so foreclosure was
stopped. Mr. Gad asked who my supervisor was, and I told him, and he
requested if I could have my supervisor to call him.

June 2, 2020 Mr. Baughman called and stated that he went out to Forestry Dept. again
to try and get another burn permit and was informed that he could not burn
unless the winds were out of the southwest and that the wind needed to be
under 7 miles per hour. He also stated that they told him that if he were to
burn now and the winds went anywhere near the hospital, he would have
to pay for them to evacuate. Mr. Baughman stated that he has a fork for
his loader, and he is trying to find it, that way he does not have to rent a
$6,000.00 piece of equipment to only be able to burn one pile at a time per
day. As soon as the weather permits and he has the piece to the machine
he owns, he will get the permit and start the process. I told him that we are
going to defer this month and to keep us in the loop as to what is going on.

July 28, 2020 Code Officer Sterling spoke with Mr. Baughman @ B&B Excavating he
stated that he is still waiting on the front loader rake to be installed and the
land to dry up. SOV/NOH prepared for the September 8th Hearing.
August 31, 2020 Posted property with Notice to Appear for the September 8th Hearing.
September 2, 2020 Mr. Dobbs called said he would get ahold of Mr. Baughman (B&B) and let
us know something. Did not hear anything back from him.
September 8, 2020 Case was presented to the Special Magistrate and was found in
violation CH 30 Sec 30-43-Public nuisance and Sec 30-44- General
cleaning and beautification. Fine imposed of $100.00 per day to start
14 days after proper notification, with a$50.00 administration fee.
October 13, 2020 Chief Peterson spoke with Mr. Dobbs he stated he would be clearing on
October 14, 2020
October 13, 2020 Lien/Order recorded at the Okeechobee Clerk of Courts.
October 14, 2020 Code Officer Sterling inspected property to see if any clearing had been
done. No one on site.
October 16, 2020 Lien order mailed certified return receipt. No return receipt received
back.
October 20, 2020 Spoke to B& B the property is flooded, equipment on site.

In between this time the property owner had the property mowed and
cleaned up, but they left all the piles of debris on the property.
April 28, 2020 Rec'd email advising that the burn ban had been lifted in Okeechobee
County and City.
May 1, 2020 A resident that lives out near the property called and complained that the
property was still not cleaned up (the piles) and that he was worried about
snakes etc.
May 5, 2020 Spoke with Gad reference to the burn ban being lifted, he gave me Philip
Baughman's numbers, (863) 634-7194 and B&B Site Development (863)
763-6053. He stated he was going to start burning piles in the next week

May 6, 2020 A Statement of Violation and Notice of Hearing was mailed certified
return receipt for the June 9t'' Hearing. The return receipt was sent
back without being signed or stamped on May 11, 2020
The property owner Mr. Gad called Fred and asked us to call,
Mr. Philip Baughman and see when he was going to start burning the
piles.
Code Officer Close called Mr. Baughman and he stated that he could not
get a burn permit due to the wind and he did not want to rent a$6,000.00
air curtain destructor for it to just sit out on the property. I asked Mr.
Baughman to keep in touch with us regarding when he would start burning
the pile etc. so we could get the property in compliance.
May 21, 2020 Mr. Baughman called and advised he went out to the Forestry Dept. trying
to get a burn permit. Mike said the fire warning was a level 3 so no permit
could be issued. Mike at Forestry told Mr. Baughman to try back on
Tuesday May 26, 2020

I. CALL TO ORDEFd
Special Magistrate Azcona called the Code Enforcement Special Magistrate Hearing to
orde� on Tuesday, August 10, 2021, at 6:00 P.M. in the City Council Chambers, located
at 55 Southeast 3rd Avenue, Room 200, Okeechobee, Florida. The Pledge of Allegiance
was led by Special Magistrate Azcona.
II. ATTENDANCE
Assistant Code Enforcement Officer Christina Curl called the roll. Special Magistrate
Roger Azcona, Esquire, Police Lieutenant Justin Bernst and Code Enforcement Officer
Anthony Smith were present.

Special Magistrate Azcona asked whether there were any agenda items to be added,
deferred, or withdrawn; there were none.
APPROVAL OF MINUTES AND ADMINISTRATiON OF OATH
A. Special Magistrate Azcona approved the July 13, 2021, Hearing minutes.
B. This being a Quasi-Judicial proceeding, Special Magistrate Azcona collectively
administered an Oath to: Code Officers Smith and Curl, and Mr. Steve Dobbs; all
affirmed. Code Officer Smith stated for the record all events regarding the Cases
to be discussed occurred within the corporate limits of the City of Okeechobee.
The Officer's notes, testimony, photographs, and support documents were all
entered as part of the official record.

A. Case No. 191115015; Blue Springs Holdings LLC, NE 9t" Avenue [Legal
Description: Unplatted lands of the City the Southwest (SV� quarter of the

00°20'48" west along a line parallel with the East line of said NW quarter of the
SE quarter a distance of 208.70-feet; thence departing said parallel line, run
North 89°21'13" East, a distance of 208.70-feet; thence run South 00°20'48" East
along a line parallel with and 70.00-feet West of (as measured at right angles to)
the aforesaid East line of the NW quarter of the SE quarter of Section 15, a

Code Officer Smith testified that this was an old Case from 2019. Upon review of
the file, it was discovered that fihe property owner did not receive proper
notification of the Hearing date, nor of the recorded Lien/Order. Officer Smifih
reported that the property came into compliance on July 1, 2021. The City
requests the Magistrate to order that, based on the facts presented concerning
deficient notice, the fine be reduced to zero and for the property owner to pay the
$50.00 administrative fee. A Satisfaction of Lien will be recorded to close the
Case. However, the City requests it be noted for the record to have been in
violation of Code of Ordinances Chapter 30, Sections 30-43 Public nuisance and
30-44 General cleaning and beautification.
Based on the evidence provided, Special Magistrate Azcona ruled to reduce
the fine to zero. The property owner will be charged the $50.00
administrative fee. No further action on this matter was requested but was
noted for the record to have been in violation of Code of Ordinances
Chapter 30, Sections 30-43 Public nuisance and 30-44 General cleaning and
beautification.
B. Case No. 210127003; Georganna Hedges, 1901 SW 7th Avenue [Legal
Description: Lots 4, 5, and 6 and West 35.00-feet of Lot 3 of Block 42,
MCMULLIN'S WOODLAND PARK, Plat Book 2, Page 23, Okeechobee County
public records]. Violation of Code of Ordinances Chapter 90, Section 90-
81(d)(1)(c) Minimum code compliance review. Code Officer Smifih reported that
the property came into campliance on July 19, 2021. No action on this matter was
requested but was noted for the record to have been in violation of Code of
Ordinances Chapfier 90, Section 90-81(d)(1)(c) Minimum code compliance
review.
C. Case No. 210317013; Be A Man Buy Land LLC, 1208 South Parrott Avenue
[Legal Description; Lots 3 and 4 of Bfock 17, SOUTH OKEECHOBEE, Plat Book
5, Page 7, �keechobee County public records]. Violation of Code of Ordinances
Chapter 30, Sections 30-43 Public nuisance and 30-44 General cleaning and
beautification. Code Officer Smith reported that the property came into
compliance on June 29, 2021. No action on this matter was requested but was
nofied for the record to have been in violation of Code of Ordinances Chapter 30,
Sections 30-43 Public nuisance and 30-44 General cleaning and beautification.

Description: Lots 1, 2, 3, 6, and 7 through 12, and the East to West Alley between U.S.

adjacent to the South Line of Lots 1, 2, 3 and 6 and the South line of North/South Alley
located in said Block 154 and North of and adjacent to the North line of Lots 7, 8, 9, 10,
11 and 12 of Block 154, CITY OF OKEECHOBEE, according to plat thereof recorded in
Pfat Book 5, Page 5, less and except that portion of said Lots 7 and 8 taken for right of
way by order of taking recorded in Official Records Book 334, Page 1449, Okeechobee
County public records]. No action on this matter was requested but was noted for
the record that the lien in the amount of $4,900.00 was paid on August 3, 2021,

C. Case No. 210127006; Agustin Mendoza and Metinda Hernandez, 901 Southwest 11tn
Avenue [Legal Description: Lots 9 and 10 of Block 20, SOUTHWEST ADDITION, Plat
Book 2, Page 7, Okeechobee County public records]. Violation of Cude of Ordinances
Chapter 30, Sections 30-43 Public nuisance and 30-44 GenEral cleaning and
beautification.
Code �fficer Smith testified a courte�sy card was mailed via regular USPS on January 27,
2021 for violation of Chapter 30 Se�ction 30-44 General cleaning and beautification and
Section 30-43 Public nuisance, active building permit required for the permanent structure
that is in the process of being built, overgrawn with grass and shrubs, debris, and trash
on the property. The courtesy card provided for seven days to correct the violations; it
was returned on February 18, 2021 with no mail receptacle/unable to forward. The
property was inspected on March 4, 2021 and found not in compliance. Statement of
Violation/Notice of Hearing mailed via certified USPS mail on March 15, 2021 for the April
13, 2021 Hearing. The Notice was r�sturned on March 22, 2021 no mail receptacle/unable
to forward. The property was inspE�cted again on March 22, 2021, not in compliance,
overgrown grass, unfinished structure, and debris. Assistant Code Officer Curl
researched the property further and discovered a Post Office Box address related to the
property owners. The Statement of Violation/Notice of Hearing was r�mailed on March
23, 2021. The praperty was posted on March 30, 2021 with a Notice to Appear for the
April 13, 2021 Hearing. The pro��erty was inspected again on April 13, 2021, the
overgrown grass was mowed, some� of the debris was removed, the unfinished structure
remains without a permit and overgrown weeds remained along the property facing
Southwest 11th Avenue.
Based on the evidence provided, S��ecial Magistrate Azcona noted Fte would be more
comfortable in impasing a fine in Case No. 2.10127006 as there is a. factual basis for
the allegations of violation of Chapter 30, Snction 30-43, and Section 30-44 if it had
been posted since January and all correspondences mailed had n�t been returned.
The violation was noted in Janu;ary, only the Notice to the Pos1: Office Box was
delivered to the owner and the ��roperty was posted less than two weeks from
today. He ruled to defer the Cas�: to the n�xt hearing to allow more time for the
owners to bring the property into c:ornpliance and instructed the Cnde Enforcement
staff to make every attempt to obt,ain a mailic�g address to send the certified Notice.
Whether or not the certified Nc�tice is able to be mailed, he would be more
comfortable imposing the fine at i:hat time.
D. Case No. 191115015, Blue Spririgs Holdings, LLC, Northeast 9th Avenue [Legal
Description: Unplatted lands of the �:,ity, the Southwest quarter of the Northeast quarter
and North half of the Northwest quarter of the Southeast quarter 5outh of the SAL
Railroad right-of-way; Southwest quarter of the Northwest quarter of the Southeast
quarter; the Southeast quarter of the Northwest quarter of the Southe�st quarter; North
half of the Northeast quarter of the S��uthwest quarter; and the South half of the Northeast
quarter of the Southwest quarter lyir�g East of Taylor Creek; fractional I�orthwest quarter
East of Taylor Creek and South of tlie SAL Railroad; and all that portion of land located
in the Northeast quarter of the South�west quarter and the Southeast quarter of Northwest
quarter, South of the SAL Railroad in Section 15, Township 37 South, Ranger 35 East,
that lies East of Taylor Creek imprcved channel as recorded in Plat Book 3, Page 29,
Public Recards of Okeechobee Cc�unty, Florida: Less and except: a portion of the
Southeast quarter and a po�tion of the Southwest quarter of Section 15, Township 37
South, Range 35 East, Okeechobee� County, 1=lorida]. Violation of Code of �rdinances
Chapter 30 Section 30-43 Public nuisances and Section 30-44 General cleaning and
beautifrcation.
Code Officer Smith testified this casE; started November 18, 2019. (t is approximately 50
acres of vacant land [located East o�F Taylor Creek, North and East of River Run Mobile
Home Park, West of Northeast 12t" Avenue, South of the railroad, and Nflrth of East North
Park Street (State Road 70). It is extremely overgrown, needs to be cleared and cleaned.
Notice of Violation was mailed certified USPS on November 18, 2019, property was
mowed and cleaned. However, the c�ebris was collected into large piles throughout the
property. �n April 28, 2020, an email was received from Fire Chief Smith to Code
Enforcement that the County burn-b�in had been lifted.

D. Case No. 191115015 continued.
On May 1, 2020, a resident contacted Code Enforcement to report the property still had
not been cleaned. Code Officer Sterlinc� spoke with the property owner, Mr. Gad, on May
5, 2a20 in reference to the burn-ban being lifted. Un May 6, 2020, a Statement of Violation
and Natice of Hearing was mailed via c��rtified USPS mail. It was returned unclaimed. Mr.
Gad contacted Code Officer Sterling arid requested that he contact Mr. Philip Baughman
of B and B Site Development to inquire when the debris piles would be burned. Code
Enforcement Secretary Close contacte�� Mr. Baughman who advised he could not obtain
a burn permit due to the wind and he did not want to rent an $6,000.00 air curtain
destructor to be able to burn in windy ccmditions. Mr. Baughman was asked to keep Code
Enforcement updated on the status of this project. The property was inspected several
times and continues to be out of compliance.
The Case was found in violation of Cha��ter 30 Section 30-43 Public nuisance and Section
30-44 General cleaning and beautifical:ion on September 8, 2020. A fine of $100.00 per
day, beginning 14-days after proper notificatian, plus a$50.00 administrative fee was
impased. The fine has accumulated to $�16,4Q0.00 plus the $50.00 administrative fee. The
City recommends foreclosure. Special Magistrate Azcona ruled, despite the attempts
to re�solve the matter with the owner, seeing no progress being made, recommend
foreclosure.
E. Case No. 210210008, Sam Lane, 800 block Northwest 10th Street, [Legal Description:
Lots 1 and 2 of Block 41, OKEECHOE3EE, Plat Book 1, Page 10, Okeechobee County
public records]. Violation of Code of Ordinances, Chapter 30 Section 30-44 General
cleaning and beautification and Sectior� 30-41 Disabled vehicles.
These vacant lots are located at Narthwest 10�h Street and 8th Avenue, have finro
abandoned vehicles parked on the pro��erty. A courtesy card was mailed on February 10,
2021, giving 10-days to correct the viol�ations. The property inspected on March 3, 2Q21,
not in compliance. However, the car had laeen removed, the RV remained, and the grass
needed to be mowed. On March 4, 2021, a Statement of Violation and Notice of Hearing
mailed certified USPS; and received by the owner, Mr. Lane an March 5, 2021. Mr. Lane
contacted Code Officer Smith on March 22, 2021 inquiring as to best method of removing
the �bandoned RV. He was advised to contact a local junk yard. On April 13, 2021, the
prop�rty was not in compliance due to c�vergro�Nn grass; the RV had been removed.
Based on the evidence provided, S�pecial Magistrate Azcona found Case No.
210210008 to be in violation of Ch��pter 3� Section 30-44 General cleaning and
bea�atification and Section 30-41 Di�cabled vehicles and imposed a fine of $50.00
per day, plus a one-time administrati�ve fee af $50.00 should the property owner fail
to came into compliance within the 14-days after proper notification.
VII. REPEAT VIOLATORS
A. Case No. 210317014, Spirit CV Okeechobee FL LLC (CVS), 106 North Parrott Avenue,

The Violation was Naticed on March 17, 2021 �s a repeat violator of Chapter 30 Section
30-4� General cleaning and beautificai:ion, dead vegetation that needs to be replaced.
Given 7-days to correct. Statement of Violation and Notice of Hearing was mailed certified
USPS mail on March 17, 2021 to the Corporate OfFice and signed by Fosiy and COVID-
19. The property was inspected on Mar��h 24, 2021, March 31, 2021, and April 13, 2021,
founcl not in compliance and in the same condition as on March 17, 2021. No attempts
have been made to correct the violation. The property is located within the main business
corridor of the City, the landscaping shc�uld be maintained.

Block 92] Officer Sterling was sworn in and testified that Mrs. Medrano
called and told him they had a place out in the county they were going to
move the heavy equipment to and asked to give her a month to get this
done. Sterling asked that this case be deferred until the next scheduled
hearing.

Officer Sterling was sworn in and testified that this piece of property is behind
RIVER RUN RESORT and is 50.19 acres and runs all the way North up to gtn
street at the industrial park. He stated this case has been going on for quite a
while now. Have had contact with the contractor that was hired to clear the
property and it has been one thing or another. Sterling stated that this cannot be
put off any longer. The neighbors are complaining about all the pile of debris due
to rodents and snakes. And the grass is extremely high.
Special Magistrate Azcona found that case 191115015 be found in violation
of Chapter 30 Section 30-43 Public Nuisance and Section 30-44 General
Cleaning and Beautification due to Officer sterling's testimony. Azcona
imposed a fine of $100.00 per day to start 14 days after proper notification,
with a $50.00 Administrative Fee.
