Attorney Fumero read proposed Resolution No. 2020-18 by title only as follows- "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OFOKEECHOBEE, FLORIDA, ESTABLISHING THE FLAGLER." Exhibit 5 included a memorandum issued from Attorney Fumero explaining that at the October 6, 2020, City Council meeting, a discussion occurred about the proposed Flagler Park improvements. -The City Council decided to create an advisory committee to participate in, and make recommendations on, specified aspects of the Flagler Park design and improvements and to solicit citizen input regarding proposed and potential improvements and enhancements to the Park. As proposed, the Flagler Park Design Review Advisory Committee (FPDRAC) would be comprised of seven members appointed by the City Council along with two alternate members. The terms of the FPDRAC would be for a one-year term. As an advisory body, FPDRAC members are subject to state of Florida Sunshine, Ethics and Public Records laws. Among other things, the resolution outlines the FPDRAC charge as well as the rules of conduct and authority of the chair. Consideration of City of Okeechobee/Okeechobee Agreement (Exhibit 6). County Fire Services Interlocal Exhibit 6.included a memorandum from Attorney Fumero explaining the following: The collective City/County goal is to have a finalized Fire Services Interlocal Agreement, with exhibits, for City Council consideration at the October 20 meeting. City fire personnel were informed. that they must submit completed County employment applications on or before October 16, 2020, if they wish to be considered for County employment. Background: At its meeting on July 21, 2020, the City Council directed the City Attorney to directly negotiate with Okeechobee County to develop a proposed FSIA. Since fhat time, we have conducted numerous conference calls with the Okeechobee County Administrator and County Attorney to discuss specific FSIA terms and conditions. To maintain open and up-to-date communications, Attorney-Fumero provided updates on negotiations and outstanding issues concerning the FSIA at the August 28, 2020, September 3, 2020, September 21, 2020, and October 6, 2020 City Council meetings. On September 18, 2020, Administrator MDO and Attorney Fumero conducted one-on-one briefings with each City Council Member. City Council Direction: At the October 6 City Council meeting, Attorney Fumero reported on the outstanding FSIA items as set forth in his October 2, 2020 memo. Final City Council direction and subsequent negotiations with the County encompassed the following: 1. City shall fund a maximum of up to 3 temporary positions at the County for a period of no longer than 2-years. There are 3 City A4 P employees who are not currently in paramedic training but who may enroll in the future. The County will consider these individuals for employment as temporary employees. In this regard, we developed additional FSIA language to set forth the conditions for up to 3 temporary. positions at the County. These temporary positions are intended to allow additional time for City fire personnel to - successfully obtain paramedic certification. 2. City. Council directed that, in the event that any 1 of those 7 City fire personnel currently in the paramedic program are unsuccessful in obtaining paramedic certification, such individuals shall have priority preference (based upon its seniority at the City) in taking one or more of the 3 temporary City funded positions at the County. 3. Regarding the FSIA commencement date, to allow ample time for City fire personnel to complete paramedic training and become certified, the City Council signed off on a FSIA commencement date of June 1, 2021. 4. White outside the scope of the FSIA, City Council agreed on the separation packages for each of the affected fire personnel. Each affected City fire personnel will be provided with a separation agreement specifying payment terms and related issues. Pension and Union issues: Certain aspects of the FSIA are subject to review and approval by pension and union consultants retained by the City. Two experts were retained for the limited purpose of reviewing the pension, labor, and union issues raised by the FSIA. Mainly affects children under the age of 5. 350k cases in 125 countries in 1988. Afghanistan and Pakistan still have cases. We are optimistic we can eliminate polio. Rotary's commitment is $50million per year with $100million matched by Bill Gates Foundation. Asking establishments to put polio pigs to put in each department to collect money. V. We became aware of several issues with it and the FLU of SF. The permitted uses in the RMH district was not very clear in terms of how those uses were defined, also the required setbacks, and the allowable density in a SF and RMH district. Public Comments: Steve Dobbs, question I know that there are a number of parcels in the city that are inconsistent, my question is if someone came in and had that situation, could that be a city initiated? I also know that there are parcels that have Commercial uses, with MF zoning. In those situations, there some of them out there, could that be, even if the applicant came in and wanted to do that, they have to do something with the parcel. Could that be classified as City initiated. DW-great question, Ben Ben -preview of what the planning board is working on. There are a lot of discrepancies. We were directed to start looking at properties zoned holding first, workshops moving forward with creation of a program that would allow for property owners to come forward and request the change, but the city would be adopting an ordinance initiating a temporary program reducing the requirements, run for a limited time, maybe a reduced application fee. Still a little more work to be done. Our next step is to go property by property to create recommendations for what the map changes would be, to see if the City would approve. If the property owner would come in with what the city would support, it would be a very streamlined process. Applicant could get it done very quickly. Jenkins Handwritten Minutes, October 20, 2020, Page 6 of 10 Exhibit 5 included a memorandum issued from Attorney Fumero explaining that at the October 6, 2020, City Council meeting, a discussion occurred about the proposed Flagler Park improvements. The City Council decided to create an advisory committee to participate in, and make recommendations on, specified aspects of the Flagler Park design and improvements and to solicit citizen input regarding proposed and potential improvements and enhancements to the Park. As proposed, the Flagler Park Design Review Advisory Committee (FPDRAC) would be comprised of seven members appointed by the City Council along with two alternate members. The terms of the FPDRAC would be for a one-year term, unless council action to the contrary. As an advisory body, FPDRAC members are subject to state of Florida Sunshine, Ethics and Public Records laws. Among other things, the resolution outlines the FPDRAC charge as well as the rules of conduct and authority of the chair. The City Administrator, or his designee, would serve as a non -voting ex officio member and support staff for the FPDRAC would be provided by his office. MC-i would like to see us expand the ex-officio member group, consensus of the board to encompass the entire community. Denise is very experienced in grant writing, meeting at TDC, if our parks look good, her parks look good. We need to work together. WA-7 members, is there any minimal requirements other than live in the County. Various affiliations? JF-Section 5 basically says....... looking for language of residency. MC-i think we did not want to limit: them. BK-if it needs to be stated, Okeechobee county at large. MC -conversation because of Seminole Tribe. Thought we could WA -do agree with MC adding additional ex-officio's. DW-there may be other areas of expertise to be added to that. Maybe landscape architect. Do we want committee to determine who the ex-officio members are? JF-once they become a member, they're subject to sunshine. They can't: react outside the meeting. Obviously you can't force anyone to come to meetings. I stated this the last meeting, I want participation from all the stakeholders that will be impacted by this. Jenkins Handwritten Minutes, October 20, 2020, Page 7 of 10 D. Consideration of City of Okeechobee/Okeechobee County Fire Services Interlocal Agreement (Exhibit 6). Latest agreement distributed by Attorney at meeting JF-appreciate county attorney and administrator for working with us. Exhibit 6 included a memorandum from Attorney Fumero explaining the following: The collective City/County goal is to have a finalized Fire Services Interlocal Agreement, with exhibits, for City Council consideration at the October 20 meeting. City fire personnel were informed that they must submit completed County employment applications on or before October 16, 2020, if they wish to be considered for County employment. Background: At its meeting on July 21, 2020, the City Council directed the City Attorney to directly negotiate with Okeechobee County to develop a proposed FSIA. Since that time, we have conducted numerous conference calls with the Okeechobee County Administrator and County Attorney to discuss specific FSIA terms and conditions. To maintain open and up-to- date communications, I provided updates on negotiations and outstanding issues concerning the FSIA at the August 28, 2020, September 3, 2020, September 21, 2020, and October 6, 2020 City Council meetings. On September 18, 2020, the City Administrator and I conducted one-on-one briefings with each City Council member. City Council Direction: At the October 6 meeting I reported to City Council on the outstanding FSIA items as set forth in my October 2, 2020 memorandum. Final City Council direction and subsequent negotiations with the County encompassed the following: 1. City shall fund a maximum of up to three temporary positions at the County for a period of no longer than two years. There are 3 City employees who are not currently in paramedic training but who may enroll in the future. The County will consider these individuals for employment as temporary employees. In this regard, we developed additional FSIA language to set forth the conditions for up to three temporary positions at the County. These temporary positions are intended to allow additional time for City fire personnel to successfully obtain paramedic certification. 2. City Council directed that, in the event that any one of those 7 City fire personnel currently in the paramedic program are unsuccessful in obtaining paramedic certification before commencement date, such individuals shall have priority preference (based upon its seniority at the City) in taking one or more of the 3 temporary City funded positions at the County. I have retained an attorney in Tallahassee well versed in Pension Law. He is reviewing the agreement. He may have some minor comments. However, in that regard, the Florida Division of Retirement is reviewing this matter. Somebody in Tallahassee who specifically oversees City FF pension funds. Making sure there are no implications. They would not commit to a timetable. Directed Pension attorney to make sure it is doable for the FF to maintain with the City Pension plan or transferred. We are having an actuarial study conducted to assess the liability to the City, suggested by the Pension attorney. There are a lot of moving parts. Bottom line this agreement is pretty much the final form. The County Attorney and Administrator are supportive of the agreement. There are now 4 exhibits, but have not been finalized. 3. Regarding the FSIA commencement date, to allow ample time for City fire personnel to complete paramedic training and become certified, the City Council signed off on a FSIA commencement date of June 1, 2021. 4. While outside the scope of the FSIA, City Council agreed on the separation packages for each of the affected fire personnel. Each affected City fire personnel will be provided with a separation agreement specifying payment terms and related issues. Pension and Union issues: Please note that certain aspects of the FSIA are subject to review and approval by pension and union consultants retained by the City. Two subject matter experts were retained for the limited purpose of reviewing the pension, labor and union issues raised by the FSIA. With regard to pension issues, we retained an attorney who is a specialist in pension law to review the City's obligations and options regarding City fire personnel pension obligations. We retained an attorney who is a specialist in labor and employment issues for the limited purpose of reviewing union and separation agreement terms. B. Jenkins Handwritten Minutes, October 20, 2020, Page 8 of 10 While the body of the FSIA is generally complete, at the time this memorandum was prepared, the exhibits are in a process of being finalized. The FSIA included four substantive exhibits that are incorporated by reference. Exhibit A - Listed employees to be hired by County Exhibit B - Temporary positions Exhibit C - Pension election form Exhibit D - City's inventory fire vehicles and equipment to be transferred to County DW-a motion is in order to approve the ILA at this point. BJ-move to approve ILA between substantial conformance with draft (get what he read from); MC second. WA -longevity is still being worked out, extra pays to the FF. JF-I actually spoke to WA and Personnel Admin. We are going to get it done, make revisions to whatever is needed. We are not sure where, but its going to be a priority. Ordinances had to be changed so longevity pay can be made to these FF"s. MDO-if we change that in the Code, it will be for all employees. WA -my understanding something had to be changed in the ordinance to facilitate what we want to do. JF- I haven't made a deep dive into this, confident that MDO and CC will jump on this. MDO-dollar figures seemed dated, up to council to address the dollar figure. WA -including the payout structure. DW-I don't think we can commit to that at this moment. JF-staff can commit to bring back recommended changes to make a decision. WA -when would we see that? Next meeting JF/MDO-within a month. DW-do we know what vehicles they are going to request. One pumper, ladder truck? HS-I've been in touch with Chief Franklin and asked him what he needs. I don't know if this has been worked out. DW-can somebody tell me the vehicles? DW-you're correct she did make that comment JF-I specifically addressed that and have a detailed email where that is not her position. DW-I think what we're saying, I assumed he was paid out of the fire fees. MC-i thought it was not to exceed what we would pay for fire assessment. DW-originally but that's out of the window now. JF-that went away about 13 drafts ago. DW-the fee we are paying is what the assessment will be in the City. Chief Smith -just for clarification. Thank you for trying to take care of everybody. One of the 7 will bump one of the three positions who are already engaged in employment, J F-yes MDO-because we committed to the County we would be sending 7 paramedics, we are still going to get billed for 7 paramedics. So what happens through attrition, those people will fill through attrition JF-so the county, based on historic attrition rates, easily absorb the 3 positions in two years. I have been downsized, laid off, there is a life after that. I appreciate all of you guys, I know you've been attacked personally, and this is happen in a public forum and its difficult. I was talking to someone today and they said it's a business decision, it's a difficult thing to go thru but life goes on. Done the best job you could do with the tools that you had. Council Comments DW-everyone knows how I'm going to vote. First of all if we want to save tax money, I think it's an issue, saving tax money vs. services. The city is here to provide services, that's the only reason it exists. Are the savings worth the services will be giving up? If you wanted to save tax money, just do away with the city and you won't have city taxes. There are times when you have to save money. Major change to our city, our city has provided fire services since 1915, for over a 100 years, this is a major change, I would have preferred a referendum to let the voters decide. We have a great crowd tonight, one of the biggest crowds in a long time. Very few come to council meetings. The number of people to attend on this subject is far above, the majority that have come to the meetings have spoken against. If you truly want to save the taxpayers money, you would create a fire tax in the city through the county, therefore we would not be paying for this with tax money. Let the county take the service and they do the fire tax. I object to completely giving the county those vehicles at no charge. The vehicles will be used for the taxpayers and unincorporated areas. We should be getting some type of collection fee. This decision is going to be made by 5 people, one will not be here after January, two may not be here after two years as they have been indicated. I just wanted to make those comments, because I've held my peace for a long time. I just want to let everyone know my reasons. This is going to be unpopular. I'm disappointed by your comments tonight. We are obligated to do things during our term. My obligation is to the city taxpayers. That why I'm here, if I'm on the losing side, when I leave here I respect this council. I'm not going to put you down. I hope I don't hear in the radio or in the paper. We've taken 18 months to decide it. The vote tonight was on the facts. They Firemen due their job, no complaints, I'm happy that some of our council wanted to make sure they were taken care of. I thank them and there will be a lot of things between now and next June when this happens. I see so many councils around the state that fight each meeting. BK-nothing MC -thank everybody for all of their hard work. Very happy we came to a decision after 18 months. I talked to the firemen and they were very appreciative of the severance package. Lacked the initial communication with them. I gave an event calendar from the County TDC. One of the things is we have a slight reduction in tourist tax coming in, but is very small. They have not stopped trying to bring events in. no hotel rooms left for the football tournament. Important we give this info to the hotels, restaurants, businesses, etc. IX.
