THIS CAUSE came before the Code Enforcement Board, City of Okeechobee, for public
hearing on June 25 , 20 19 . After due notice to the respondent, the Board having heard
evidence on the alleged violation by witnesses or affidavit makes the following findings:
A. FINDINGS OF FACT:
Lots: 9 & 12 Blk: 15 Section: Wrights First Addition to Okeechobee
Parcel: 3-22-37-35-0230-00150-0090
Property location: 700 Blk SE 12' Avenue, Okeechobee, FL
Property owner: Marie Fenton
Property has been found to have overgrown vegetation and debris.
B. CONCLUSIONS OF LAW:
The owner of the property described above has been found in violation
of Chp 30 Sec 30-43 Public nuisance and Sec 30-44 General cleaning and
beautification.
C. ORDER: The City of Okeechobee Code Enforcement Special Magistrate determined
you violated the Code of Ordinances, Ch 30 Sec 30-43 Public nuisance and Sec 30-44 General
cleaning & beautification concerning your property located at 700 Blk SE 12'h Avenue
Okeechobee, FL . If you do not correct the violation within thirty days of receipt of this
notice , or notify the Code Enforcement Officer of the correction, the Magistrate imposes a fine
of $ 25.00-- per day commencing that date and continuing daily until the violation is corrected or
the city is notified by you and verifies the correction, which ever first occurs. Further, if you do
not correct the violation by said date, a copy of this order as a claim of lien, shall be recorded in
the office of the Clerk of Circuit Court, Okeechobee County, Florida, and once recorded,
becomes a lien on real and personal property pursuant to Florida Statute 162. You have a right
within thirty days, to appeal this finding and order by Writ of Certiorari to the Circuit Court,
Okeechobee County, Florida. If you correct the violation prior to the above date, it is your
obligation to contact the Code Enforcement Officer to verify such compliance.

Mayor Watford called the regular session of the City Council for the City of Okeechobee to order
on Tuesday, December 3, 2019, at 6:28 P.M. in the City Council Chambers, 55 Southeast 31d
Avenue, Room 200, Okeechobee, Florida.
A. The invocation was offered by Pastor Don Hanna of the First United Methodist Church.
B. The Pledge of Allegiance was led by Mayor Watford.

City Clerk Lane Gamiotea called the roll. Mayor Dowling R. Watford, Jr.; Council Members Wes
Abney, Monica Clark, Bob Jarriel, and Bobby Keefe were present.

Motion by Council Member Abney to approve the consent agenda items A through D
[approve the November 19, 2019, minutes; approve the appointment of Mrs. Donna

Police Chief Peterson explained Coda Enforcement has come to an impasse with these
property owners and all options have been exhausted. The Cases were presented to the
Code Enforcement Special Magistrate on November 12, 2019. Magistrate Azcona is
recommending foreclosure. Case No. 18-024 began accruing a fine of $50.00 per month
on November 1, 2018, remains non -compliant, and has accrued $1,550.00 in fines as of
October 31, 2019. Case No. 18-043 is currently accruing a fine of $25.00 per day, remains
non -compliant, and has accrued $3,225.00 in fines as of October 31, 2019. Case No. 08-
173 came into compliance April 20, 2009, but the accrued fine of $900.00 remains unpaid.

Chapter 162 the City possesses the ability to file a foreclosure action against the property to
