practicable after Guch excavation be replaced in as good condition as it was at the i~
time of excavation.
SECTION 10. That failure on the part of the Grantee to comp.ly in any"'substanti 1
respect with any of the rÚovisions of this franchise, shall be grounds for a forfei t-
ure of this grant, ~ut no such forfeiture shall take effect if the reasonableness or
propriety thereof if pDotested by the Grantee until a court of a competent jurisdicti n,
