Pursuant to call of the Mayor, the City Council met in specifl session at 3.00 o'clock p. m. on the above date and the following were present: T. W. Conely, Jr., .- Mayor, H. H. DeYarman, President City Council, Councilmen H. T. Bass and J. Denham Bird with L. W. Jennings, City Attorney, Alma Camp, Deputy City Clerk and Clint Bass, : Chief of Police in attendance. Mayor Conely Stated that the meeting had been called for the purpose of con- sidering an ordinance providing for the inspection of buildings and collection of building inspection fees and such other business as may come before the Council. Ordinance No. 92 was offered by Councilman Bass, secon44d by Councilman Bird and adopted by unanimous vote. ORDINANOE NO. 92 AN ORDINANCE PROVIDING FOR THE INSPEOTION OF BUILDINGS INSPEOTION FEES TO BE PAID BY THE OWNERS OF BUILDINGS; PRESORIBING THE AMOUNTS OF SUCH FEES AND MAKING SUCH FEES A LIEN ON THE BUILDING INSPECTED, AND PROVIDING FOR THE ENFOROEMENT OF SUCH LIENS. BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA. ~ Section 1. From and after the passage and approval of this ordinance the City Building inspector of the City of Okeechobee,Shall, and is hereby required to inspect all buildings under construction at the time of the passage hereof, and all building8 erected whOlly or in part after the passage hereof. Such inspection or inspections shall be made by the building inspector as often as may be necessary in order to ascertain whether or not such building or buildings are being erected in compliance to the building ordinances of the City of Okeechobee. The term building as used herein shall be construed to include not only new buildings but any extensions or enlargement of a building already erected. Section 2. That there is hereby assessed against any building being erected or - to be erected in the City of Okeechobee as set out in Sec. 1 of this ordinance, an inspection fee as follows: Buildings costing up to and including $25,000.00, one half of l% of the cost of such building. Buildings costing from $25,000.00 to and including $100,000.00, one half of 1% for the first $25,000.00 of the cost of such buildings, and one fourth of 1% of the remaining cost thereof; --"-.... . ~ 34 - - ....-..-----..-- '--'----- ------..-."----"-------'-----,---, ..--..-..-..------------ .--... -..- -..---..--.. -.. --- ..--- - --.-- ---------- Buildings costing above $100,000.00 , one half of 1% for the first $25 000.00, one fourth of 1% from $25,000.00 to $100,000.00, and one eighth of 1% for all over ~ $100,000.00. Such fees shall be paid by the owner, builder or contractor to the City build- ing inspector, and shall be paid in full within five days after such building is completed. Section 3. The owner of any building now under construction, or hereafter con- the structed is required to show to the building inspector upon/request of such inspector any plans, contracts, or other information or data tending to show the cost of any such building. Section 4. Said lien shall become such upon and s.fter the' first inspection made by the building inspector, and shall remain such until paid, but shall not be subject to foreclosure until after five days from the completion of the building, after which time it shall be enforced in the manner provided by law for the enforce,emt of liens generally. Section 5. This ordinance is declared severable, and if any line sentence, sec- tion, or paragraph be held invalid it shall not effect the remainder hereof. Section 6. This ordinance shall take effect upon its passage and approval by the Mayor. Read a first time and passed to a se~ond reading. Read a second time and passed to a third and final reading. Motion was made by OouncilITan Bird seconded by Councilman Bass, that the City Attorney be instructed to prepare an ordinance concerning certain nuisances within given limits in the City of Okeechobee. Motion passed. Supt. W. R. Terrell appeared before the Council relative to closing Second ~ Street between Miami and Kissimmee streets. Motion was made by Councilman Bird, seconded by Councilman Bass, that City close Second Street between Kissimmee Street and Miami Street and execute quit claim deed to Okeechobee Company for the portion of street closed.
