M. on the above date and the following were present: H. H. DeYarman, President City Council, Coun- cilmen J. Denham Bird, L. F. Scharfschwerdt, H. T. Bass and H. H. Hancock with --- R. P. Fletcher,. Clerk, F. E. Lawrence, City Engineer and L. W. Jennings, City Attor- ney in attendance. Minutes of meetings held June 2nd, June gth and June 9th were read and approved. City Engineer Lawrence made report to Council relative to bids for furnishing pumps and motor for City water plant. Motion was made by Councilman Bass, seconded by Councilman Hancock that Council award contra.at for furnishing pumps and motors for City water plant to Fairbanks, Mo~se & Company. Upon motion by Councilman Hancock, seconded by Councilman Bass and duly carried, the Council appointed L. C. Tootle as water superintendent at a salary of $250.00 per month. Upon motion by Councilman Bird, seconded by Councilman Hancock and carried, the City Attorney Was intructed to prepare an ordinance providing the following building tnspection fees: All amounts up to $25,000.00 t of l~; From $25,000.00 to $100,000.00 t of 1%; All amounts over $100,000.00 liS of 1%. . Upon motion ~y Councilman Bird, seconded by Councilman Scharf schwerdt and carried the Council appropriated $300.00 to be used in filling in pond west of School House. Upon motion by Councilman Bird, secon44d by Councilman Hancock the Clerk was authorized to have 100 copies of the building ordinance printed in pamphlet form. duly Upon motion by Councilman Ba~seconded apd carried, the Council authorized the ~rchaBe of 200 feet o~to be placed in ditch ~ north såde of North ~ñ street near F. M. Mobley's . Upon motion by Councilman Bird, seconded by Councilman Bass and carried, F. J. ,- Godwin was authorized to employ all additional man to help with Oi ty work. Motion was made by Councilman Bird, seconded by Councilman Scharfschwerdt that Council employ C. A. Steed to open up drainage ditches where needed under supervision of City Engineer. I - ..--..--.. .. ---'.--------.---- - - 30 ---- - -..-..-- ,-----. ---- Ordinance No. 90 was offered by Councilman Scharfschwerdt, seconded by Council- man Bird and passed by unanimous vote. -, ORDINANOE NO. 90 AN ORDINANCE TO PROVIDE FOR THE LIOENSING AND REGULATION OF SOLICITORS IN THE CITY OF OKEECHOBEE, MAKING THE VIOLATION OF A~Y OF SAID REGULATIONS UNLAWFUL AND PRESCRIBING A PENALTY THEREFOR. - . BE IT ORDAINED by the Mayor and City Council of the City of Okeechobee, County of Okeeohobee, State of Florida: Section l.-DEFINITION: A solicitor within the meaning of this article is defined to be any person who goes from house to house or from place to place in the City of Okeechobee, selling or taking orders for, or offering to sell or take orders for goods, wares or merchandise or any article for future delivery, or for services - 11:0 be performed in the future, or for the making, manufacturing or repairi,ng of ---- any article or thing whatsoever for future delivery, provided, however, that this.. article shall apply only to solictors who demand, accept or receive payment or de- posit of money in advance of final delivery. a Section 2.- LIOENSE: It sball be unlawful for any person to act as/solicitor within the meaning and application of this art19le without first securing a 1i- bense from the Clerk of the City Council so to do. Section 3.-APPLICATION-BOND: Any person desiring a license to engage as a so- 1ictor within the City of Okeechobee shall make application to the Clerk ~f the City Council, stating the name and address of the applicant, the name and address of the person, firm or corporation which he represents, and the kind of goods offered for sale, or the kind of services to be performed. Such applicati~n shall be accompanied by a bond in the penal sum of $500.00 executed by a surety company or by two responsible freeholders residing in the City of Okeechovee ( or in lieu tþereof a cash bond of equal amount), conditioned upon the making of final delivery ~ of the goods order'ed, or services to, be performed, in accordance to the terms of --- such order, or failing therein, that the advance payment on such order be refunded. Any person aggrieved by the action of any such solicitor shall have a right of action on the bond for the recovery of money or damages, or both. Such bond shall remain in full force and effect, and in case of a cash deposit, such deposit shall be retained by the City of Okeechobee for a period of ninety days after the expi- ration of any such license, unless sooner released by the Council. Section 4. President DeYarman stated that the meeting of the Council had been called for the purpose of considering the matter of decreasin~ the outer fire limits. Upon motion by Councilman Bass, seconded by Councilman Bird and duly carried, the City Attorney was instructed to prepare an ordinance eliminating territory be- I ~- tween Eighth and Ninth Streets from outer fire limits.
