1981-16 Eminent Domain LegislationRESOLUTION NO. 81-16 • WHEREAS, House Bill #387 filed by Representative C.R. Smith would remove the authority of municipalities to utilize the authority of eminent domain outside of the city limits for water and sewer purposes; and WHEREAS, in the case of the City of Okeechobee, all water and sewer for the entire county is handled by the city and it may be necessary at some future date to use the authority of eminent domain to acquire the necessary rights-of-way for force mains, gravity sewer lines, lift stations, etc.; and WHEREAS, the City of Okeechobee opposes this unnecessary restriction on municipalities which could severely hinder the expansion and extension of water and sewer services to outlying areas, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Okeechobee, Florida as follows: 1. That the legislative delegation for Okeechobee County consisting of the Honorable Dale Patchett, the Honorable William (Doc) Meyers, the Honorable Pat Neal, be and they hereby are respectfully requested to vote against House Bill #387 and Senate Bill #964 which would prohibit the exercise of eminent domain for water and sewer facilities outside the corporate limits of a city. 2. That certified copies of this resolution be furnished to each member of the legislative delegation representing Okeechobee County and also to the Florida League of Cities. 3.
