1983-04 Utility EasementY , RESOLUTION NO. 83-4 i b BE IT RESOLVED by the Council of the City of Okeechobee, Florida, that: WHEREAS, the City has a 12 foot utility easement across lots 203 and 204, of the First Addition to Okeechobee Estates, according to the plat thereof recorded in Plat Book 3, page 23, public records of Okeechobee County, Florida, and WHEREAS, the owner of said lots 203 and 204 is willing to grant the city a 12 foot wide utility easement completely across lot 203 and at the northern most boundary of said lot, in exchange for the city abandoning it's existing 12 foot easement which splits lots 203 and 204, and WHEREAS, it is in the best interest of all concerned to relocate said utility easement, NOW THEREFORE, be it resolved by the City Council of the City of Okeechobee, Florida, as follows: That the 12 foot utility easement currently held by the city running in a southwesterly direction between lot 203 and 204 in the First Addition to Okeechobee Estates, according to the plat thereof' recorded in Plat Book 3, page 23, public records of Okeechobee County, Florida, be, and it is hereby abandoned, and vacated in all respects. This resolution shall take effect immediately upon it's adoption. Introduced and passed in regular session assembled this 8th day of March 1983. Mayor ATTEST: zz -�-o �- City Clerk V C GRANT OF EASEMENT STATE OF FLORIDA COUNTY OF OKEECHOBEE 253 Ptd THIS INDENTURE. made and entered into this day of March, 1983, by and between DARRELL FERNEAU, d/b/a COACHER INVESTMENTS, hereinafter referred to as Grantor and the CITY OF OKEECHOBEE, Okeechobee, Florida, a municipal corporation organized and existing under the laws of the State of Florida, hereinafter referred to as the Grantee, WHEREAS, the Grantor is seized in fee simple and in possession of lands lying in Okeechobee County, Florida, as more particularly described below, and WHEREAS, Grantor is willing to grant to Grantee an easement or right of way through, over, across, and on the land described below, for the purposes and in the manner hereinafter described, NOW, THEREFORE, in consideration of the premises and of the sum of Ten Dollars ($10.00) and other good and valuable consideration, receipt of which is hereby acknowledged, Grantor hereby conveys and transfers unto Grantee or its successors or assigns a perpetuaL non-exclusive easement for construction, installation, and maintenance of utilities and drainage through, over, across, and on the following land of Grantor, particularly described as follows: The North twelve (12) feet of Lot 204, FIRST ADDITION TO OKEECHOBEE ESTATES, according to the plat thereof recorded in Plat Book 3, Page 23, Public Records of Okeechobee County, Florida, provided, however, and upon the condition that any so constructed utilities or drainage be constructed underground at the expense of the Grantee. TO HAVE AND TO HOLD such easement unto the Grantee and its successors and assigns forever.
