RESOLUTION NO. 89-11
A RESOLUTION OF THE CITY OF OKEECHOBEE,
FLORIDA FORMALLY ACCEPTING A DEDICATION OF
EASEMENT FROM HERITAGE PLACE, INC., PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, by dedication dated October 31, 1989, the
development known as Heritage Place, Inc. has conveyed to the City
of Okeechobee an easement ten feet in width over all water and
sewer lines within the development, and outside the development to
the City's force mains, as well as conveying complete ownership of
said lines, and
WHEREAS, the City of Okeechobee will hereafter operate
and maintain said lines from time to time as part of the water and
sewer distribution system;
THEREFORE, by majority vote of the city council t7e
dedication of October 31, 1989 by Heritage Place, Inc. is formal;
accepted by the City, its successors or assigns, for th.;,�rzeti+;
and use of the public.
This resolution shall become effective immediately upon
its tdoption.,

grantor is lawfully seized of the land, gocds, chattels or
personalty conveyed hereby in fee simple; that grantor has the
right and corporate authority to sell and convey such items;

that grantor warrants fully the title to said land and goods and

will defend same against the lawful claims of all persons whom_

soever; that such conveyance is not violative of any other
it existing contract, mortgage, agreement, document t or claim of any
I nature, and that grantor shall defend, indemnify and hold Y d harmless
the grantee if such violation exists.
ANE that this dedication and sale is a final and absolute
i conveyance, and grantor releases, waives and otherwise abandons
