RESOLUTION NO. 90-13
A RESOLUTION OF THE CITY OF OKEECHOBEE ESTABLISHING A
GENERAL DISPLACEMENT PLAN FOR THE COMMUNITY DEVELOPMENT
BLOCK GRANT PROGRAM, PROVIDING FOR AN EFFECTIVE DATE.
BE IT RESOLVED by the City Council of the City of
Okeechobee as follows:
Section One: General Displacement Plan.
It is not the intention of the City of Okeechobee to
involuntarily displace any family, tenant, or business through the
use of CDBG funds.
The City of Okeechobee will conform to the Uniform Relocation
requirements should permanent involuntary relocation become so
necessary.
The City of Okeechobee will, when so notified of any effective
mandatory date for implementation follow, the replacement
requirements. The interim rule at 570.606(b) (1) (i) and
570.496a(b) (1) (i) implements section 104(d) (2) (A) (i) of the
Act. Whereby the Rule provides that all occupied and vacant
occupiable low/moderate-income dwelling units that are demolished
or converted to a use other than as law/moderate-income
dwellings... will be replaced within a three year period. This will
include the notification to the DCA of;
1. The activity description
2. Location
3. Time of commencement
4. Type and location of replacement dwelling
5. Source of funding for replacement dwellings
6. Statement of Conclusion, that the units will remain
low/moderate-income.
Section Two: Effective Date.
This resolution shall be effective October 2, 1990.
