RESOLUTION NO. 92-9
. A RESOLUTION ADOPTED BY THE CITY OF OKEECHOBEE, FLORIDA,
CONCERNING DESIGNATION OF WETLANDS WITHIN THE MUNICIPAL
BOUNDARIES AS DEFINED IN FLORIDA STATUTES 403.91;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City has been informed by South Florida Water
Management District that the following area within the City is
considered to be a wetland;
THAT area of the City of Northeast 9th Street at its
intersection with Northeast 5th Avenue;
WHEREAS, one Charles Farmer, a citizen and landowner, has
without the consent of the City caused to be constructed a road or
grade from Northeast 3rd Avenue to the end of Northeast 9th Street
to lands owned by him along a platted City street or way which has
never before been constructed or used by the City, and that such
road or grade crosses the area considered to be a wetland; and
WHEREAS, the City has been informed that Charles Farmer did
not seek or obtain a permit from any governmental agency to
construct his road or grade; and
WHEREAS, the City considers it to be in its best interest to
cooperate with the relevant State agencies concerning development
in this area of the City; and
THEREFORE BE IT RESOLVED THAT, pursuant to Florida Statutes
403.817 and 403.929, in which the Department of Environmental
Regulation and the Water Management District set forth, designate
and monitor areas defined as wetlands; and the provisions of the
Wetlands Protection Action, Florida Statutes 403.91, which sets for
the permitting process for dredging or filling of such area, the
City does recognize that the following described area within the
municipal boundaries of the City is considered a wetland, and
hereby designates and dedicated the area described below as a
wetland conservation area, to be protected in perpetuity, subject
to State regulation and permitting under Florida Statue 403.91;
THAT area being a strip of land platted for roads, but
presently unimproved an unused, commencing at Northeast 9th Street
and Northeast 5th Avenue from the railroad track to the South side
of Northeast 9th Street, and North side of Northeast 9th Street up
to its intersection with Northeast 10th Street.
INTRODUCED AND PASSED by the City Council of the City of
Okeechobee on this 17th day of March , 1992.
This Resolution shall become effective immediately upon its
adoption.
