ORDINANCE NO. 1019
.
AN ORDINANCE CLOSING, VACATING AND ABANDONING A PORTION
OF NORTHEAST 2ND STREET AS DESCRIBED HEREIN; RESERVING
UNTO THE CITY ITS SUCCESSORS AND ASSIGNS, A NONEXCLUSIVE
EASEMENT FOR PUBLIC UTILITIES PURPOSES; RETAINING A RIGHT
OF REVERSION; AND DIRECTING THE CITY CLERK TO RECORD THE
ORDINANCE IN THE PUBLIC RECORDS OF THE CLERK OF THE
CIRCUIT COURT IN AND FOR OKEECHOBEE COUNTY, FLORIDA;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City has received a Street Closing Application (No. 88) from property
owner(s) David and Anita Nunez, for the closing of a certain right-of-way as
described in this ordinance to adjoin their properties and develop a multi-functional
building; and
WHEREAS, a review of such application reveals that it is in the best interest of the citizens
of the City of Okeechobee as a whole to grant said application; and
WHEREAS, the granting of the application will serve a legitimate public interest and is a
proper exercise of the municipal authority of the City of Okeechobee as a
discretionary function;
NOW, THEREFORE, BE IT ORDAINED by the City Council for the City of Okeechobee,
Florida; presented at a duly advertised public meeting; and passed by majority vote
of the City Council; and properly executed by the Mayor or designee, as Chief
Presiding Officer for the City:
Section One.
The right-of-way described hereafter is hereby closed, vacated and
abandoned by the City of Okeechobee, Florida to-wit:
That portion of Northeast 2nd Street from Northeast 7th Avenue East to
the dead-end as situated between Blocks 147 and 148, City of
Okeechobee Subdivision, according to the plat thereof as recorded in
Plat book 5, Page 5, of the public records for Okeechobee County,
Florida.
Section Two.
The City of Okeechobee, Florida hereby reserves unto itself, its
successors or assigns, a perpetual non-exclusive easement 30 feet
in width for public utility purposes, in, over or under the right-of-way
as described herein, and in addition, by separate document, that
portion of adjoining property of owner that extends Easterly from the
dead end of Northeast 2nd Street, between Blocks 147 and 148, to the
Westerly boundary of Taylor Creek. The precise length, width, and
description of such easements shall be reduced to writing in a
separate grant of easement from owner to the City of Okeechobee
and recorded in the Public Records of Okeechobee County Florida.
Such easement shall include but is not limited to overhead and
underground utilities, drainage improvement and facilities, culverts,
baffle box or clean-out, as needed and in the sole discretion of the
Department of Public Works, and at no expense to the landowner, its
successors or assigns. Should it become necessary however, for the
placement of such utility service, to re-Iocate improvements, facilities,
pavement, fencing, or structures found or placed within the described
right-of-way, the expense of such shall be born by the owner, its
successors or assigns.
Section Three.
In the event that said property owner, or his heirs, successors or
assigns should fail to execute the easements described in Section
Two within 60 days of final adoption of this Ordinance, or should fail
to obtain from the City of Okeechobee, Florida a Certificate of
Occupancy for the complete commercial development anticipated by
owner on Blocks 147 and 148 within twenty-four (24) months of date
of this ordinance, then said right-of-way shall revert to the City of
Okeechobee without further action, be considered an open City street,
and this ordinance declared null and void. The time period(s) herein
may be extended by the City upon good cause shown.

Section Four.
The City Clerk shall cause a certified copy of the ordinance to be
recorded in the public records of Okeechobee County, Florida.
Section Five.
This ordinance shall be set for final public hearing the 20th day of
May, 2008, and shall take effect immediately upon its adoption.

City Streets closing application for Anita Nunes (NE 2nd St. 7 Ave.)
We are aware of the critical drainage problems on City of Okeechobee and for that
reason the Engineering Office will not recommend approving the request for the City
R/W Closing until future Master Drainage Plans for the City of Okeechobee are
finalize and we can determine drainage flow paths.
