1016 #08-003-SSA ORDINANCE NO. 1016 . AN ORDINANCE OF THE CITY OF OKEECHOBEE, FLORIDA AMENDING THE CITY OF OKEECHOBEE COMPREHENSIVE PLAN, ORDINANCE NO. 635 AS AMENDED, BY REVISING THE FUTURE LAND USE MAP ON A CERTAIN TRACT OF LAND MORE PARTICULARLY DESCRIBED HEREIN FROM SINGLE FAMIL YTO COMMERCIAL; PROVIDING FOR INCLUSION OF ORDINANCE AND REVISED FUTURE LAND USE MAP IN THE COMPREHENSIVE PLAN; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Okeechobee recognizes the need to plan for orderly growth and development; and WHEREAS, Chapter 163, Florida Statues, and Rule 9J5i, Florida Administrative Code provide for amendment to Adopted Comprehensive Plans; and WHEREAS, the City has received and reviewed certain apphication(s) (No. 08-003-SSA), submitted by Muhammad Nooruddin, on behalf of property owner(s), Muzaffar Husain, Trustee, for a small-scale amendment to the Future Land Use Map of the City's Comprehensive Plan, and said application(s) be ing reviewed by the City's Planning Board, acting as the Local Planning Agency, at a duly advertised meeting held on March 20, 2008, which determined such applicant(s) to be consistent with the Comprehensive Plan and appropriate to the future land uses within the City; and WHEREAS, the City has agreed with the recommendations of the Planning Board that the proposed application(s) complies with the requirements of Florida Statutes 163, Part II, and that the proposed applications are consistent with th'e Comprehensive Plan and appropriate to the future land uses within the City; NOW, THEREFORE, it is ordained before the City Council for the City of Okeechobee, Florida; presented at a duly advertised public meeting; and passed by majority vote of the City Council; and properly executed by the Mayor or designne, as Chief Presiding Officer for the City: SECTION 1. SHORT TITLE. THIS ORDINANCE shall be known as the "City of Okeechobee SmaLl Scale Development Activities Comprehensive Plan Amendment," pursuant to F.S. 163.3187, and shall be effective within the City limits of the City of Okeechobee, Florida. SECTION 2. AUTHORITY. This City of Okeechobee Small Scale Development Activities Comprehensive Plan Amendment is adopted pursuant to the provisions of Chapter 163.3187, Part II, Florida Statutes, . Ordinance NO.1 016 - Page 1 of 2 SECTION 3. REVISIONS TO THE FUTURE LAND USE MAP. 1. The following described land consisting of approximately 0.405 acre(s) is hereby re-designated for purposes of the Future Land Use Map of the City of Okeechobee Comprehensive Plan: a. Application No. 08-003-SSA. from Single Family to Commercial. The Legal Description of Subject Property is as follows: LOTS 19 AND 20 OF BLOCK 15, OKEECHOBEE, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 5, PAGE 5, PUBLIC RECORDS OF OKEECHOBEE COUNTY, FLORIDA. SECTION 4. INCLUSION OF ORDINANCE AND REVISED FUTURE LAND USE MAP IN THE COMPREHENSIVE PLAN. It is the intention of the City Council of the City of Okeechobee, Florida and it is hereby provided, that the provision of the Ordinance, and the revisions to the Future Land Use Map more particularly described as "Future Land Use: 2000 City of Okeechobee, March 19,1991, as amended December 6,1994", which is incorporated herein by reference, shall become and be made a part of the City of Okeechobee Comprehensive Plan (City of Okeechobee Ordinance No. 635, as amended). SECTION 5. SEVERABILITY. If any provision or portion of this ordinance is declared by any court of competent jurisdiction to be void, unconstitutional, or unenforceable, then all remaining provisions and portions of this ordinance shall remain in full force and effect. SECTION 6. EFFECTIVE DATE. The owner of the property also owns lots 17 & 18 (0.327 acres zoned CHV) immediately to the west and lots 21 & 22 (0.346 acres zoned Holding) immediately to the east. It appears the Applicant will be using lots 17 through 20 for the construction of a professional office building. A. Consistency with the Land Use Categories and Plan Policies. The proposed professional office use for the property is consistent with the Commercial Future Land Use Category and the policies that govern this category. The proposed use, Commercial land use designation, and proposed CHV zoning appear to be consistent with the general pattern and the limits of commercial expansion evident in the area east of US 441 northward from NE 9�h Street. As such, Staff believes the requested amendment is consistent with the Comprehensive Plan, particularly the Goal set forth on page 1 of the Future Land Use Element, and which reads as follows: "Through a well-planned mix of compatible land uses, the City of Okeechobee shall continue to maintain a high quality living environment, preserve its distinctive natural and historic resources, and provide public services to its residents at a minimum cost." B. Adequacy of Public Facilities The subject property is cunently vacant. Development and subsequent occupation of the site will impact the City's ability to provide public facilities (i.e., roads, water, and sewer). The applicant has not submitted information regarding the projected demand on City water and sewer facilities nor an estimate of traffic generation. However, the adjoining property to the west has received site plan approval at which time we believe the availability and adequacy of water and sewer facilities was confirmed. While the Applicant is proposing a professional office use for the property, Staff has prepared a rough analysis of the likely traffic generation for the most intense use likely allowable under a commercial land use designation and CHV zoning. This would be a three-story, 12,500 square foot commercial building, with retail on the ground floor and offices above. By contrast, under the current Single-Family land use designation, the maximum development would be two single-family units. Following is a brief comparison of the projected demands upon public facilities under the current and reyuested Future Land Use designations. 2 Staff Report Small-Scale Comprehensive Plan Amendment Potable Water: � Appiicant: Muhammad Nooruddin Petition No.: 08-003-SSA LOS — 114 gallons per person per day Projected demand: 2 Single-family units= 5.4 persons @ 114 gpd = 570 gpd Projected demand retail/office use: OUA uses a standard of 250 gallons per day per unit. In this case, each unit would be each store or office. Unfortunately, it is impossible at this stage to estimate the nurnber of units, but the prior site plan approval identified the availability of water service to the site. Sewer: LOS — 130 gallons per person per day Projected demand: 2 Single-family units= 5.4 persons @ 130 gpd = 702 gpd Projected demand retail/office use: OUA uses a standard of 250 gallons per day per unit. In this case, each store or office would be considered a unit. Unfortunately, it is impossible at this stage to estimate the number of units, but the prior site plan approval identified the availability of sanitary service to the site. Solid Waste: The County has recently confirmed a considerable level of excess capacity available to serve the solid waste disposal needs of other major developments in the City. It appears reasonable that the volume of solid waste associated with a development of this size can also be accommodated within the capacity of the County's Solid Waste Facility. Traffic: While the Applicant has indicated that he will be developing a single-story professional office building, upon approval of the Small Scale Amendment and subsequent rezoning, the Applicant will have the right to develop any use that is permitted within the CHV zoning district. Consequently, Staff has assumed significantly more intensive use of the property in its estimate of traffic generation than specifically proposed by the Applicant. Specifically traffic generation has been estimated based on a 5,000 square foot, high-turnover sit down restaurant and 7,500 square feet of inedical/dental office space on the 2°a and 3rd floors. Based on the Seventh Edition ITE Trip Generation Manual, the weekday PM peak hour trip generation associated with the project could potentially approximate the following: 5,000 sf high-turnover sit down restaurant (ITE code 932) @ 10.92 trips per 1,000 sf = 55 trips 7,500 sf of inedical/dental office space (ITE code720) @ 3.72 trips/1,000 sf = 28 trips Total Trips = 93 trips Staff Report Small-Scale Comprehensive Plan Amendment App�icant: Muhammad Nooruddin Petition No.: 08-003-SSA The number of trips likely to be generated under the above assumptions is less than 100 peak hour trips and therefore no traffic impact statement is necessary and the use change is not likely to be considered to have a significant traffic impact. C. Compatibility with Adjacent and Nearby Land Uses There appears to be an increasing interest in medical/health care-related uses and other professional offices in the northern part of the City due, at least partially to the hospital just north of the city limits. The requested land use change is consistent with this trend and the pattern of land uses in the general vicinity. Such uses are compatible with the multi-family uses scattered in this vicinity as well as the vacant lands now designated for multi-family use on the Future Land Use Map.
