PETITION #311-R. REBA NEWHOUSE. RSF TO CII,
John Cassels and Reba Newhouse presented the petition. Mr. Cassels <attorney for
Reba Newhouse) stated that the property was located on Hwy, 441 South West of
the OIL CAN and North of METCALF AUTO SALES. He stated that one year ago the Reba
Newhouse and Lyda Heath came before the Board, they were. denied. Now his client
comes alone with only her property. He also stated thqt there was much more commer-
cial activity in this area now. There was some discussion. Jerry Bryant made a
motion to recommend approval of the petition. Dan Delagall seconded, The motion car-
ried unanimously.
,PETITION #311-5. REBA NEWHOUSE. TO ALLOW A SALES LOT FOR NEW OR USED MOTOR VEHICLES.
John Cassels and Reba Newhouse presented the petition. There was much discussion.
Brenda O'Connor made a motion to grant the petition with the following conditions:
1) The Special Exception runs with the owner. 2) No other conmercial uses while
conducting the sales lot for new or used motor vehicles. 3) Begin within 12 months.
4) The drive way and display area must be shelled within 12 months. 5) No parking
in the !ight.:.of-way. 6) All automobiles are to be in working condition, 7) The
area is to be kept in a clean. neat and orderly fashion. Frank Marsocci seconded,
The motion carried unanimoulsy,
PETITION H312-R. M.E. & BEVERLY ANN FULWIDER. RM TO I,
Mr. Fulwider presented the petition, He stated that the property was located in
Play land Park and that the property was totally surrounded by trees and thick
shrubs, He stated that he wanted the Industrial Zoning so that he could conduct
recycling at this location, He stated that his main entrance was off of Hwy. 98.
He has AC property to the. North,. Comnerc-ial- to' the-East- and-RM to the"iVest-amt
South. Jerry Bryant made a motion to reccOlTlTlend denial stating : A. B. E. G, K.
Land P of the Factors, Frank Marsocci seconded. The motion failed 2 to 4, There
was some discussion, Brenda 0' Connor made a motion to recorrmend approval, Dan
Delagall seconded. The motion carried 4 to 2,

Mr, Fulwider presented this petition also. There was more discussion. Brenda O'Connor
made a motion to grant the petition with the conditions listed in Ordinance #74-
1. Section 7. 15 on page 26 and that the Special Exception run with the owner.

Mr. Kelly presented the petition. He stated .that he had two tracts, one is 5 acres
and the other is 6 acres that he would like to rezone to RR. He stated that this
property is also surrounded by property zoned RR. There was some discussion.
Brenda 0' Connor made a motion to recomnend approval. Chris Hooker seconded, The
motion carried unanlmoulsy,

ttorney Cassels represented Reba Newhouse (petitioner) who is
eeking the rezoning. Attorney Cassels presented the Council
ith photographs of all the surrounding area which is zoned
ommercial.
s. Lyda Heath protested against the rezoning but explained she
would retract the protest if a privacy fence could be put up at
no expense to her. Ms. Heath had previously sent the Council
a letter explaining her protest and she also presented the
Council with photographs of the area surrounding her house.
Attorney Cassels agreed a privacy fence will be installed and
stated Ms. Newhouse had no objection to building the fence at
no expense to Ms. Heath.
Councilman Watford made a motion to uphold the recommendation of
the City/County Planning Commission for approval of Rezoning
Petition #331-R from RSF to crr; seconded by Councilman Collins.
