Councilman Collins made a motion to accept peti tion 342R to rezone
property located at Southeast 9th Avenue from Holding (H) to
Residential Single Family (RSF) upon the recommendation of the
City/County Planning Commission to recommend approval with the
seventy foot (70') right-of-way running North and South along the
East border; seconded by Councilman Kirk.
Councilman Watford questioned the verbal agreement concerning the
70 foot easement and its location as being the East end of the
lower ten (10) acres.
Mr. Dick Ward (of Hunt Real Estate, representing Steve Hogg fr
the Estate of Hiram Hogg) explained traffic control was an issue
and the development would have a maximum of 42 houses. The
purpose of the 70 foot right-of-way on the East side of the
property to 13th Avenue would allow this street to be opened to
traffic, which in return would help the traffic flow.

Sales was recognized, she stated that she lived in front of Lisa Ammons and that semi trucks were running
up and down the road and that they were not safe. She passed out copies of letters from Mike McNamee
and Dale Milita. She stated that there is only a 30' right.of-way and she objects to this variance. Dan
Delagall and Roger Jones agree that Precision Alwninwn has suffered but feel that the Ordinance will
not allow this variance. There were no letters and no more comments. Jerry Bryant made a motion to
deny the petition. Dan De1aga1l seconded. The motion carried unanimously.
PETITION #342-& ESTATE OF HIRAM HOGG. HOLDING TO RSF.
Richard Ward presented the petition. He stated that they had 14 acres between 8th. and 9th. Street
within the city limits. They came once before in 1989 for a rezoning to RG, which was later withdrawn.
There was some discussion. It was noted that they would have to go before the Subdivision Regulation
Committee. Darrell Fernau was recognized. He stated his concern was traffic. Richard Ward replied that
they would have a maximwn of 42 houses. Jim Baughman was recognized. He stated that he had given
a 70' right-of way to 13th. Avenue and wanted the applicant to do the same. There was a verbal
agreement to do this. John Cassels stated that before the subdivision review process was complete there
must be written consent for this easement on the east side of the property, north of Blue Heron. The was
some discussion. The permitted uses for holding were discussed. There were no letters and no comments.
Roger Jones made a motion to recommend approval with the 70' rillht-of-way runninll north and south
alonll the east border. Seconded by Jerry Bryant. The motion carried unanimously.
PETITION #339-& TWENTAR. INC. INDUSTRIAL TO RSF.
Jack Williamson presented the petition. He stated that Twentar was a company that he owned. More
specifically the old Rock-A-Way asphalt plant. He stated that when he applied for the Industrial zoning
he promised that when the use was no longer there that he would rezone to RSF. He is here today to

STAFF RECOMMENDATIONS TO THE BOARD.
PETITION #339-R TWENTAR INC. I TO RSF
I would recommend the rezoning of this property in this manner. It represents good land use planning
and it allows the owner to proceed with future planning which will be complimenting to the community.

PETITION #342.R ESTATE OF HIRAM HOGG HOLDING TO RSF
I would recommend this rezoning. It is compatible with surrounding land uses.
PETITION #344-R THOMAS DAILY/BISHOP HOLDING TO RG
I would recommend the rezoning, it is in conformance with the present and long range zoning of the city.
PETITION #336-S THOMAS DAILY/BISHOP LICENSED GROUP HOME
I would recommend granting the special exception on the above rezoned property. A licensed group home
is permitted in the City Zoning Ordinance by the approval of the Board of Adjustment. The Board may
impose conditions and safeguards. The Board may wish to consider the same conditions as a hospital or
nursing home, i.e., no structure shall be closer than 50' to any boundary line in separate ownership and
no off street parking shall be located closer than 25' to any property boundary line in separate ownership.

PETITION #345-R SHIRLEY & DONALD WILDES AC TO RR
I would recommend the rezoning of this parcel to RR from AC. It will permit one mobile home per 5 acres.
PETITION #348-R LAMARIANA & HALL AC TO RR
The current zoning of AC will allow one residence per 20 acres. The access easement leading to this parcel
is approximately 114 of a mile long. The RR zoning would allow one single family dwelling per every 2
acres or one mobile home per every 5 acres. Therefore it appears that the rezoning is an attempt to
establish several residential parcels. With this being the case, I would recommend the rezoning subject
to the Subdivision Regulations or to table until this complies with the Subdivision Ordinance. The reason
for this is that this would prevent the subdivision and sale of property until parcels are recorded and the
Subdivision Regulations have been met.
PETITION #349-R WILLARD & JANET MAYS AC TO I
This rezoning has serious implications, proper safeguards may need to be implemented. Traffic and space
for buffering against any future residential growth are just two items that need to be considered.
PETITION #33-S WILLARD & JANET MAYS SLAUGHTER-HOUSE
This is a request to establish a slaughter-house on the preceding parcel of property. This is a unique usage
most appropriately place in an Industrial zoned district. If we are to spot zone to place a slaughter-house
adjacent to AC or RR zoning, safeguards would be very appropriate. Some of the considerations are: 1)
This use has a potential of generating traffic, we may consider a requirement for paving the road.
2) Since this is adjacent to RR and AC, with a potential for more residential, we may want a 30' to 50'
landscaping buffer, with only an easement across this buffer.
