1952-03-03 Regular March 3, 1952 The City Council of the City of Okeeehobee, Florida, met in regular session at the City Hall at ?:~0 P. M. on the above date with the following present: Mayor ~H. H. Raulersc~, Fresident CHandler, Councilmen Roe, Warlord and Williams with G. C. Durranee, City Attorney and Lorena Spivey, City Clerk. Minutes of the meeting held Februar,y 4, 1982, were read and approved as read. Co. - Clyde Hancock appeared before the Council in regards to the city license for his store on wheels. ~e Council advised the Clerk to issue license in same amount as 1951. Mr. Hancock also requested that the city do some drainage around his property in East 0keechobee and Southwest Addition also requested that a street be opened in North section of town to give him passage to his lots. After discussion the above were referred to Marvin Mobley. Water Supt. Kinsaul reported on his investigation of water line in East 0keechobee belonging to Ernest Evans. After discussing the matter the Council advised Kinsaul to measure the distance if the pipe was laid in correct manner and rreport to Counc il. T. W. Conely, Jr. appeared before the Council, stating that he was preparing to improve his property in South 0keechobee (Miami Street) and requested that the City extend the water line to said property. After discussion Councilman Roe moved to extend the water line, seconded by Councilman Warlord and carried. A discussion on the donation of water to the various churches was heard. Ktnsaul repomted that several of the churches in the oast had been using a great amount of water. Councilman Watford moved that each church be alloted 5,000 gallons of wate~ each month without charge and all water used over said amount would be charged to the individual churches ~ previous bills were not to be held against them. Seconded by Councilman l~oe and carried. Clerk was instructed to notify each church on this mat tar. T. ¥~. Conely, Jr. appeared in hehalf of Judge Carlton in regards to R. E. Hamrick's ag~.eement with the City in deeding adJ6ing property owners enough property I[ from the Railroad Right-of-way to square their property in lots and blocks. Greenly, Sanitary Officer discussed with the Council the sanitation problem. The ground fill garbage disposal plan was discussed, the 0euncil agreed that it would answer their garbage disposal situation. An investigation of the cost of a machine to ~e used would be made~ also it was agreed to meet with the Commissioners and find out if the Coumty would aid in such a program. Mr. Plumber, State Board of Health, Engineer, reported that he was making a survey of the waste at Markham's Canning Plant and when the survey.was completed he suggested that the .Council meet with Markham's and endeavor tow ork out some ~lan to releive the sewer problem. The need of a new door for the fire station was brought before the Council by Fire Chief Hancock who submitted a bid from 0tin Lee for the door. After discussion the matter was referred~ to Presiden~ Chandler. Councilman Roe brought be2ore the Council a compliant from Mrs. M. C. Pitts regarding the noise from trucks sto~ping at the signal light late at night. THe Council discussed this situation and due te the hazzard it might ~ause if the light was turned off du~ing the night the Council agreed to place a caution light under the signal light and to tums off said light after a certain hou~ and use the caution light untiI the next morning· Parking of ca~s in t he Post Office area was discussed. Fifteen minute park- ing in the Post Office area was thought to be an elimation to the problem. Councilman ~atford moved to adopt Fifteen minute parking in this area from 8 A. M. to 6 P. M. seconded by Councilman Roe and carried. Due to the businesses in this area the matter was tabled until the Council could contact personally each businese owner in the area and get their opinion. The following 0rdinanee was presented by Councilman Roe who moved its adopt- ion, and upon being seconded by Councilman Watford was put to a vote and unanimously adopted: 0RDII~ANCE NO ~5 ~ · AN ~RDINANCE ADOPTING AS THE CITY SANITARY CODE THE RULES AND REGULATIONS PROMULGATED BM THE FL0~DA ~TATE BOARD OF HEALTh, PURSUANT TO CHAPTER ~81, FLORIDA STATUTES I~A~, AND A~ENDNNNTS ~HERET0. K~O~N A~"THE EANITAR'~ CODE OF THE STATE OF FLORIDAW; AND PROVIDING A PENALTY FOR THE VIOLATION THEREOF. ~.~EREAg ~ection ~81.$~ of Chapter $81, Florida Btatutes I~A~, and amendments thereto, provides that the Sanitary Code of the State of Florida shall, as to public health matters to which it relates, supersede all ordinances heretofore or hereafter enacted, and ~HEREAS it appears to be to the best interest of the citizens of the City of Okeechobee to adopt ~aid State Sanitary Code as the City Sanitary Code. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COU~CtL OF THE CITY OF 0KEECHOBEE, FLOHI DA. 321' SECTION 1: That the rules and regulations now promulgated or hereafter promulgated by the Florida State Board of Health, pursuant to Chapter 381, Florida Statutes 1949, or any amendments thereto, known as "The Sanitary Code of the State of Florida", excepting Chapters 1, 3, 4 and 19, is hereby adopt- ed as the Sanitary Code of the City of Okeechobee, Florida. SECTION 2: Any person, firm or corporation violating within the corporate limits of the City of Okeechobee the provisions of the State Sanita~y ~code or of this Ordinanee Shall be puniahed, u~on conviction thereof, by a fine not exeeeding $. 300.00 or by improspnment in t he city Jail for a period not to exceed 90 days, or both, such fines or imprisonment in the discretion of the Mayor. SECTION 3: Ail ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4: The provisions of this Ordinance are severable and if any section, sentence, clause or phrase thereof is, for any reason, held to be unconsitutional or invalid, the decision of the Court shall not affect the validity of the remaining portions of this Ordinance. SECTION 5: This Ordinance shall become effective immediately upon its passage and approval by the Mayor, or its becoming a law withsut his aOproval as provided by law. After dismussion the Council agreed to have Mayor Raulerson contact Belcher Oil Company and get a figure on the proposed sewer line from Markham's Canning Plant to the creek alse to obtain price
