1951-11-05 Regular November 5, 1951 The City Council of the City of 0keechobee, Florida, met in regular session at the City Hall on the above date at 7:30 P. M. with the following present: Mayor Raulerson, President. Chandler, Councilmen Thomas, Roe, Warlord and Williams with Lorena Spivey, City Clerk. seconded by Council Williams. E. Stello - Insurance ...... 40.81 Councilman Watford reported that repairs were being made on street lights and that it would be completed soon. A Request ~l~om Prin. Garth requesting that the south end of Miami Street, West of the football field be closed ~uring the homecoming game. The Council adivsed that they were una~· to close the street but suggested that no parking signs be place along the street opposite the field. Councilman Roe moved that orior Ordinance on MILK be nul and void and moved to adopt New Ordinance No. ~. Seconded by Councilman Williama and carried. The vote as follows: Voting Yea - Councilman Roe, Thomas and Williams and Councilman Watford not voting. Mr. Greenly, State Board of Health Sanitary Officer, discussed with the Council the ~bove Ordinance. (Ordinance No. 247 on page 308) Mr. J. Ram~eur, Engineer State Board of Health discussed with the Council the sewer problem at Markhams Canning Plant. The.Engineer agreed to come to Oke®chobee and make a survey of the sewer problem and offer reccomendations to the City Council as soon as possible. Mr. J. R. Durrance appeared in regard to the sew~er project, with him was Mr. Gilbert W. Clifford, Engineer from Miami Springs who discussed the pro~ect with the Council. After discussion Council Williams moved to enter contract on making the survey of the new sewer project with Gilbert W. Clifford, subject to change of the contract a rider to be placed on the contract as follows: Payment~of fee to Engineer to be made upon sale of Certificates Seconded by Council~an V~atfo~d and c~¥~±e .... ~ Bill Bailey ente-~ed application for parks employee work. After discussion t t Councilman Watford moved to employ Bill Bailey as maintenance man, seconded by Council- man Thomas and carried. Councilman Roe suggested that R. Greene now employed as parks man be employed at present in the Street and ~anitary Dept. The need of new dumping grounds for the Snnitary Department was discussed. The matter was refered to Narvin Nobley for investigation of property. .A letter from the Weslyn Service Guild was read and ~iscussed by the Council and ordered filed in Clerk's Office. The Clerk was requested to make reply to the lette~ a.~ state t~st tho Covn¢il hop~s by ~]~e first of the year to be financially able to employ a night policeman and that ever effort would be made to curb ~the sale of intoxicants to minors. The Council sugoested that the.Na¥or run a notice in the local paper to this effect. Councilman Roe moved to have the Christmas Lights e~ected, seconded by Council- man Watfor~ and ca-~rled. The Clerk was advised to write a letter to this effect to the Florida Power and Light Company. Lorena Spivey, City Tax Assessor, presented the City Tax Assessment Roll for the year 19~l as completed by her to the City Council for examination by the Coumcil. ~--~ Upon motion ~y Councilman Watford, seconded by Councilman Roe and carried, the Council accepted the City Tax Assessment Roll for the year 1951, as prepared and presented by the City Tax Assessor. ' Lorena Spive~ Tax ~ssessor for th~ City of J Okeeohobee~ Florida 0 R D I N A N C E N O. 947 AN ORDINANCE TO GOVERN THE PRODUCTION, TRANSPORTATION, PROCESSING, HANDLING GRADING, LABELING, REGARDING AND SALE OF MILK AND MILK PRODUCTS; THE INSPECTION OF DAIRY HERDS, DAIRY AND MLIK PL&NTS; THE ISSUING AND REVOCATION OF PERMITS TO MILK PRODUCERS AND DISTRIBUTORS; THE FIXING OF PENALTIES; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF 0KEECHOBEE, FLORIDA. SECTION 1. PERMITS. It shall be unlawful for any person to bring into or receive into t the City of 0keechobee, Florida, or its police Jursidiction for sale, or sell, or offer for sale therein, or to have in storage where milk products are sold or served, any -~ .... ~-~ ar~ ~^~ ........ ~ any milk or milk products as defined in the latest edition of the united states Pulbic Health Service Milk Code and the Sanitary Regulation of the Florida State Department of Agriculture, Chap. 502, Florida Statutes 1941, revise and amended 1947, sec. 50~.~1, who does not possess a permit from the County Health Department. Ail permits shall expire on December 31 of~each year. The application for ~ permit shall show: A. The name, residence, post office address and location of the dairy farm or business place, the number of cows from which milk is obtained for sale. B. If the applicant buys part or all of his milk supply, state the amount, the name and address of the person from whom he obtained the milk and if the applicant be a shipper o~ milk or milk products into the city, he shall. in addition to the above, state the route of his shipment~ SECTION ~. APPLICATION FOR PERMITS. Ail ~pplications for permits shall be signed by the applicant and ~hen received by the Health Officer shall be placed on file. As seon as possible after an application has been received, the Health Officer or his authorizedi agent shall visit the d~iry or place of business of such applicant and make such observations and inspections as will enable him to properly consider such application; whereupon, if the Healt~ Officer finds that the provisions of this Ordinance have been complied with, he shallI issue such permit. M~nen a permit is granted, the Health Officie ~- will give the holder thereof an official number, and this number shall be used to ma~k the products of the dairy or dairy f~nm as herein provided. SECTION 3. REVOKING PERMITS. If, after issu_ing a permit to any person, firm, or corporation to sell milk or milk products, the Health Officer shall become satisfied that the provisions of this ~rdinance are being violated, he shall at once revoke such permits, and no new permit will thereafter be issued until all insanitary conditions hay been rectified, .................... o~- ~---~- ~ t ....... ~_a!._se2retion free from c~!ostr,~_m of th-- Ordinance. If anyone doing business under a permit from the County Health Department shall change the location of such business without notifying the li.alth Officer of such change and giving opportunity for inspectior of s~ch new location, then such unauthorized change of location shall constitute a cancellation of said permit. - SECTION 4. INSPECTION NOR PERMITS. The Health Officer or his authorized agent will not issue any-permit unless he is satisfied, after inspection, that the require~.mts of this 0rdinanc. are met. SECTION 5. ENFORCEMENT INTERPRETATION. The Ordinance shall be enforced by the Health Officer in accordance with the interpretations thereof contained in the latest edition o: the United States Public Health Servic. Milk Code and sanitary regulations of the State Department of Agricultur., Chapter 502. Florida Statutes 1941, revised and amended 1947 -sec. 502-21. Certified Copies of ~hich shall be on file in the City Clerk's 0ffic.. (a) Within 2 months after the adoption of this Ordinance, all milk and milk pro- ducts sold or offered for sale within the city limits of 0keechobee, Florida, shall b. from herds that are free from Bangs Dis.as. as shown by blood serum tests for agglutins against Bruc®lla abortus made in a laboratory approved by the Health Officer for such a test. All herds shall be retested and all reactors disposed of in accordance with the requirements of the "test and slaughter" plan of the Bureau of Animal Industry of the United States Department of Agriculture. A certificate identifying the animals by tag number, signed by the laboratory making the test and filed with the Health 0fficier shall be evidence of the abov. test. Provided however, that if the milk is to be pastenrlzed in a plant equipped to process milk properly and which is operated in strict accordance with the requirements o~ the Sanitary Regulations of the State Department of Agriculture, Chapter 502, Florida 1941-Revised and am®nded 1947-S.c. 509-21, the so-called "Vaccination Plan" against Bruc.lla abortus as recommended by the U. S. Bureau of Animal Industry and the Florida State Livestock Sanitary Board may b. substitu~d for the so-called "Test and Slaughter" plan. Notice in writing together with any substantiating eveidence that the Health Officer d. ems necessary, shall be filed with the Health Officer by the herd owner, if th~ so-called "Vaccination Plan" is adopted. Any subsequent change in herd status in this regard shall likewise b. immediately reported. (b) A dairy or dairy farm is any place or premises where one or more cows are kept a part of all of the milk products from which is sold or offered for sale. Provided further that goat milk is the lacteal secretion free from colostrum obtained from complete milking of healthy goats and shall comply with all requirements of the Ordinance. The word "Cow" shall be interpreted to include goats. SECTION 6. Within six (6) months from da~. on which this Ordinance takes effect no milk or milk products shall be sold to the final consumer within the city limits of Okeechobee, Florida or its police Jurisdiction except that a grad. A pastenrtzed and or grad. A raw quality, as defined in the Sanitary Regulations of the Florida Stat. Dep~ t- ment of Agriculture, S.c. 502-91, revised 1948; provided, however, that no milk or pro- ducts may be sold to the final consumer as such at any time unless items lr, 10r, llr, 13r, and 25r of the Sanitary Regulations of the Florida State Department o~f Agriculture, sec. 502.21 are complied with; provided further that when any milk distributor failes to ~--. qualify for the above grade the health officer is authorized to revoke his permit, or in ~ I lieu thereof to degrade his product and permit its sale during a temporary period not exceeding 30 days or in emergencies such~ longer period as he may deem necessary. SECTION 7. DEFINITION OF HEALTH OFFICER. The term Health Officer as used in this Ordinance shall' be defined as the duly appointed Director of the 0keechobee County Health Department. SECTION 8. PUNIEHNENT. The violation of any provision of this 0rdin~nce or the evasion or interference with enforecement of any provision of this Ordinance shall be sufficient cause for revoking the permit of the person, firm or corporation so violating, evading or interfering with such enforcement either personally or through any agent or employee. Any person violating any provision of this Ordinance or preventing or interfering with the enforcement by the Health Officer or his representative or any police officer, shall be guilty of a misdemeanor whether 'the permit of such a person has been revoked or not, upon convitton, shall be fined not more than two hundred($200.O0) or imprisonment at hard labor for not more than thirty (30)days, or both such fine and imprisonment. SECTZON 9. All Ordinances and parts of Ordinances in conflict with this Ordinance are hereby repealed and this Ordinance shall take effect if adopted and published. gITY OF 0KEECHOBEE, FLORIDA ! N. at the City Hall' on the above date with the following present: Nayor H. H. Raule~son, President ~handler, Councilmen Roe, Thomas and Watford with Durrance City Attorney and Spivey, City Clerk. Nayor Raulerson stated that the purpose of the meeting was to discuss the contract presented by Gilbert W. Clifford, Engineer on the sewer project and any other business that might~ Come before the Council. The contract was read. and discussed and Councilman Watford moved to reject contract in present form, due to the fact, that the rider was not placed on the contract as agreed in the minutes of November 5, 1951.
