1950-05-08 Reg. Adjourned May 8, 1950 The City Council of the City of Okeechobee, Florida, met in regula~ adjourned session at the City Hall on the above date at 7:50 P. M. with the following present: Mayor H. H. Raulerson, President R. E. Chandler, Councilmen Mc Dougald and Nix with G. C. Durrance, City Attorney and Lorena Peamce, City Clerk. Minutes of the meeting held April 5, 1950 were read and approved as read. Waterinte~estDept.on ' Mrs. F~ed Hull requested that 16th Avenue be opened, ac that, she would have excess to her propex-ty. Matter was referred t o Ma~vin Mobley. Residents from north sectlo~ of the city appeared before the Council asking that something be done in regard to the odor caused by the Okeechobee Tallow Company. Mr. Smullin, owner of the plant was called before the Council in regard to this matter and he assu~ed the Council that the odor would be done away with as soon as the plant was completed ~nd in geed working o~der. Mr. Smullin requested that the culvert to the plant be put in and it was reported that the culvert had been ordered and would be put in as soon as they arrived. Albert Ezell appeared in regard to moving the white way on North Park Street for the road improvemeat. It was repo~ted that the county had agreed to take care of the expense on such things therefore the Council suggested that he contact the County Commissioners for further information. Councilman Mc Dougald suggested that all the white way lights on North and' South Park Street be nd i~eplaced. Mrs. Fred Hull reported that tomatoes and beans from Markham Canning Plant were being dmmped south of the canal in the north section of city and was causing flies The Clerk was instructed to notify Mr. Markham of same and request him to correct matte'. A1 Corell in behalf of the Vol. Fire Dept. requested that the City give $50.00 a month to the Vol. Fire Dept. for them to operate on. ( Thid would cancel the $1.00 paid to each fireman for attending a fire.) Also requested help in repairing the old fire truck to be uesed for grass fires. Mr. Corell stated that the County had agreed to employ a man for three days if the City would employ him for two days. Councilman M~ Dougald moved to employ a white man to help the Street and Sanlta~y Dept Thrusday and Friday and Fire Dept. Saturday. Beconded by Councilman Nix and carried. Councilman Mc Dougald moved to instruct the City Attorney to prepare Resol~Ation in regard to paying the Vol. Fire Dept, $50.00 per month, seconded by Councilman Nlm and carri ed. Filmore Sloan requested that water be piped to his property on South Osceola Street. The matter was referred to Water Committee and Water Supt. S. H. ~c Dougald reported that the Committee appointed by the City and the City Attorney ~e.i:prepare a suggested Zoning Ordinance had met and discussed with the Council the suggested Ordinance. After discussion/Council talbled.~ntil next regular meeting. Mr. Mc Dougald requested that the City close 14th Street west of Par~ott Avenue - beginning one block west of Parrott'.Avenue for a distance of two or three blocks. Mr. ac Deugald also stated that the Govei~or's Day Committee had a defict of the approximately $1,600.00 and requested aid from the 'city. After discussion/Council postponed action until Friday, May 12, lgSO, at 5:$0 P. M. Ma~vin~ Motley representing the County Commiss~ oners, stated that the Court y was going to pave S blocks int~e city limits in and around the property purchased by the county '£o build the old folk's home and requested ~hat a Resolution be drawn giving them the authority to do same. Councilman Mc Dougald moved that. the City. Attorney prepare a Resolution regarding above matter, seconded by Councilman Nix and car~,ied. The material salvaged from the condemned building belonging to Joe Bongiovann was discussed and the City Attorney was instructed to prepare notice of sale of materia and have it published in the Okeechobee News. Councilman Mc Dougald suggested that Nathan Zelmenovitz be requested to attend the next regular meeting of the Council also to have n$tice in Okeechob~e~:News regarding the condemnation of Lot 12, Block 165 City of Okeechobee (known as the Albert Hotel) and requested all interested people to appear before the Council June 5, 1~50 at their regular meeting. Building permits and Building Ordinance was discussed but no definite action taken. Mayor Raulerson stated that he had invited police from bordering towns to attend the Governor~ Day Celebration and suggested that a Resolution be prepared to show appreciation for their services. A letter from Mrs. E.E. Raiford and Earl Raiford in regard to the closing of streets by the City .on property belonging to R. E. Hamrfck, in so doing ~r. Hamrtck agreed to deed certain p~operty to property owner's desiring same at a nc~imal fee but to this time he had not carried out his agreement and they were requesting information from the city as to how they might persuade Mr. Hamrick to give them a deed to the desired property. The Council stated that it was out of th&&.r hands and they had no authority to force action. Upon motion the Council adjourned to meet Ma~e.12, 1~50. The matter of the defecit of Governor's Day w.as brought before the Council red q and discussed. Councilman Mc Dougald moved that $200.00 be transfe~from the Utility Tax Collection to Contingency Fund and to .donate same amount to Governor's Day Committee seconded by Councilman Warlord and unanimously carried. The City Attorney advised the Council that the expenditure of money from the Utility Tax Fund was an illegal and un- authorized expenditure of city funds. A building Ordinance was discussed. Councilman Mc Dougald moved that the City Attorney prepare a Building Ordinance and present at the next regular meeting of the City Council and tt~e rates to be as follows: Any building up to $1,000.O0 permit to cost $5.00. ~ of 1% ove~.::$1, O00.O0 and,,up to and including $5,000.00 and all over ~_~ $5,000.00 flat rate of $25.00, seconded by Councilman Warlord and unanimously carried ~ Councilman Watford moved to repeal Ordinance No. 79 seconded by Councilman ~o° Mc Dougald and unanimously carried. 0 R D I N A N C E NO. 241 AN O~DINANCE P.]~P~]~LING ORDINANCE NO. 79 OF THE CITY OF OKEECROBEE, FLORIDA; THE SAME BEING AN ORDINANCE CREATING THE OFFICE OF BUILDING INSPECTOR: PROVIDING FOR FIRE LIMITS AND THE CONSTRUCTION EQUIPMENT AND INSPECTION" OF BUILDING IN THE CITY OF OKEECHOBEE, FLORIDA. BE IT ORDAINED BY THE MAYOR AND ~tfE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA: SECTION ONE: That Ordinance number 79 of the city of Okeechobee, Florida, be, and the same is hereby repealed.
