0486 Annexation of Property• ORDINANCE NO. 486 SCR. 255 ?E 604 AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE CITY OF OKEECHOBEE; ACCEPTING PETITIONS FOR VOLUNTARY ANNEXATION OF CERTAIN PARCELS OF LAND IN THE UNINCORPORATED AREA OF OKEECHOBEE COUNTY, FLORIDA, CON- TIGUOUS TO THE PRESENT BOUNDARIES OF THE CITY OF OKEECHOBEE; PROVIDING FOR REDEFINING OF THE MUNICIPAL BOUNDARIES TO INCLUDE SAID PARCELS; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING AN EFFECTIVE DATE. WHEREAS, the owner of real property in an unincorporated area of Okeechobee County has petitioned the City Council for annexation of said property; and WHEREAS, said property is contiguous to the boundary lines of the City of Okeechobee and reasonably compact; and WHEREAS, the City Council of the City of Okeechobee wishes to accede to the request of the owner of said real property for becoming a part of the municipality of Okeechobee; and WHEREAS, Florida Statutes, Chapter 171.044 provides a means for a voluntary annexation of real property contiguous to a municipality and reasonably compact, NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OKEECHOBEE, FLORIDA, AS FOLLOWS: SECTION I: In accordance with Chapter 171.044, Florida Statutes, the City Council has ascertained a petition for annexation of real property adjacent to Okeechobee City municipal boundaries bears the signature of all owners of the property in the area proposed to be annexed and upon adoption of this ordinance said boundary lines of the municipality shall be redefined to include said property described as follows: Beginning at the Southeast corner of Section 9, Township 37 South, Range 35 East and bear North along the East line of said Section 9 a distance of 325.12 feet to the South boundary of that property described in Official Records Book 207, page 177, public records of Okeechobee County, Florida; thence bear S 89 °59'53" W along the South boundary of said property described in Official Records Book 207, page 177, a distance of 351.67 feet to a point on the East right -of- way line of S.R. 15 (Parrott Avenue); thence bear S 00 °00'07" W along said right -of -way line a distance of 301.12 feet; thence bear N 89 °52'43" E along said road right -of -way line a distance of 20.00 feet; thence bear S 00 °00'07" E along said road right -of -way line a distance of 24.69 feet to a point on the South line of said Section 9; thence bear N 89 °52'43" E along the South line of said Section 9 a distance of 331.66 feet to the P.O.B. AGENDA ITEM #IV - APPROVAL OF MINUTES Councilman Watford moved that the minutes of the April 11, 1983, Special Meeting be approved as presented, seconded by Councilman Chapman. Notion carried. AGENDA ITEMS #V & #VI- PETITION FOR ANNEXATION AND INTRODUCTION OF AN ORDINANCE FOR VOLUNTARY ANNEXATION Chairman Douglas noted receipt of a Petition for Annexation from Mr. Harvey Hamrick for a parcel of property north of and adjacent to the city limits of Okeechobee for the location of a proposed nursing hone. Douglas read the Petition as follows: The undersigned is the president of Hamrick & Sons, Inc., the sole owner of real pro- perty in an unincorporated area of Okeechobee County, lying generally along a portion of the north limits of the City of Okeechobee. This unincorporated area is bounded on the west by State Road 15 (Parrott Avenue) and is more particularly described as follows: (Iegal description and map a portion of Petition) The proposed ordinance for voluntary annexation was read by title only as follows: AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE CITY OF OKEECHOBEE; ACCEPTING PETITIONS FOR VOLUNTARY ANNEXATION OF CERTAIN PARCELS OF LAND IN THE UNINCORPORATED AREA OF OKEECHOBEE COUNTY, FLORIDA, CONTI- GUOUS TO THE PRESENT BOUNDARIES OF THE CITY OF OKEECHOBEE; PROVIDING FOR REDEFINING OF THE MUNICIPAL BOUNDARIES TO INCLUDE SAID PARCELS; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING AN EFFECTIVE DATE. The floor was opened for discussion. Councilman Watford asked the attorney to explain the procedure for annexation. Conlon advised that the city must go through a separate notification - publication procedure as set out in the Florida Statutes. Since the land is contiguous and the request is voluntary, the petition will have to be advertised four consecutive weeks and hold a public hearing. With no further discussion, Councilman Chapman moved to set a second and final hearing on June 6, 1983, seconded by Councilman Knight. Notion carried. AGENDA ITEM #VII - RESOLUTION - DOUBLE TAXATION Chairman Douglas presented for discussion and adoption a resolution to the Board of County Commissioners of Okeechobee County asking that the matter of Double Taxation be addressed fcr the fiscal year beginning October 1, 1983. Chairman Douglas read the title as follows: A RESOLUTION REQUESTING ACTION BY THE OKEECHOBEE BOARD OF COUNTY COMMISSIONERS IN ACCORDANCE WITH CHAPTER 125.01(6)(A) FLORIDA STATUTES. The Chair called for discussion and /or comments. It was noted that the resolution r r 83 -46 83 -44 3317 were: Lola Parker, Clerk's Office; William Pokusa, Water Department; Jeffrey Elders, Water Department; and Bernice Elders, Public Works Department. On behalf of the Council and himself, the Mayor thanked the employees for their dedicated service to the City. AGENDA ITEM #VI - REZONING REQUEST - WALLACE NORTON Chairman Douglas read for second and Final Hearing an ordinance rezoning the property at the corner of Southwest llth Avenue and Southwest Park Street from residential, single family to commercial, as requested by Mr. and Mrs. Wallace Norton. The title was read as follows: AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE CITY OF OKEECHOBEE, FLORIDA; AMENDING APPENDIX A BEING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF OKEECHOBEE WHICH ESTABLISHES ZONING REGULATIONS AND PROVIDES FOR THE ADMINISTRATION, ENFORCEMENT AND AMENDMENT THEREOF; PROVIDING FOR A CHANGE IN THE CLASSIFICATION OF SPECIFIED LAND FROM RESIDENTIAL SINGLE FAMILY TO DIAL. Chairman Douglas noted the Planning Board recommendation to grant the rezoning, and called for comments and /or objections fran those present in the audience. Citizen Rick Jordan asked the Council to take into consideration the dangerous inter- section and if the rezoning is approved, asked that certain stipulations be required (IE: 4 -Way Stop, Etc.). With no further ocmnents voiced, Councilman Knight coved to grant the rezoning request from residential, single family to commercial, seconded by Councilman Thomas. Councilman Watford asked and was advised by the attorney, that a rezoning could be granted with certain stipulations. The Council reviewed the parking plans submitted. Norton advised that the three parking spaces facing South Park Street will be eliminated to allay for a drive -thru window. With no further discussion, the Chair called for a vote on the motion to grant the rezoning. Councilman Thomas, Knight and Chapman voted yes. Councilman Watford opposed. Motion carried. Councilman Watford stated, "I realize that all of Park Street will be commercial eventually, however, all the problems concerning this request have not been addressed and resolved ". AGENDA ITEM #VII - ORDINANCE - PETITION FOR ANNEXATION Chairman Douglas presented for second and Final Hearing an ordinance annexing certain property in the unincorporated areas of Okeechobee County to the City of Okeechobee. The title was read as follows: AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE CITY OF OKEECHOBEE; ACCEPTING PETITIONS FOR VOLUNTARY ANNEXATION OF CERTAIN PARCELS OF LAND IN THE UNINCORPORATED AREA OF OKEECHOBEE COUNTY, FLORIDA, CONTIGUOUS TO THE PRESENT BOUNDARIES OF THE CITY OF OKEECHOBEE; PROVIDING FOR REDE- FINING OF THE MUNICIPAL BOUNDARIES TO INCLUDE SAID PARCELS; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING AN EFFECTIVE DATE. 3318 83 -56 83 -38 The Chair called for objections or ccrments form those present with regard to the annexation of this property to the City of Okeechobee. None were voiced. Due to a need for expediency, councilman Knight moved to adopt the ordinance annexing the said parcel of land as commercial, seconded by Councilman Thomas. Due to the fact this was not a rezoning proceeding, Attorney Conlon clarified, The motion should be, upon accepting the Petition granted the parcel of land should be designated as ocm ercial" . Councilman Knight agreed to the wording of the motion, seconded by Councilman Thar s. Petitioner Jack Williamson asked about the procedures to allow the nursing home to be built. Williamson was advised that the portion of property to be used for the nursing home will have to be rezoned CPO through the Planning Board and a special exception requested. The Chair called for a vote on the Motion to grant the annexation and designate the parcel as corn rcial. Vote on Motion carried. AGENDA ITEM #VIII - BID TABULATIONS - PAINTING WATER 'ROWER Chairman Douglas noted receipt of the bid tabulations for the painting of the water tower east of City Hall. The low bid being Suncoast Painting Company, Largo, Florida, in the amount of Fiftean Thousand Two Hundred Sixty Five Dollars ($15,265.00). Director Fortner asked Council to set aside any action on awarding the bid. Fortner advised that he is still waiting for a list of job references from Suncoast Painting. The next regular meeting is within the thirty day time limit for the bids. Council agreed to postpone any action until the next meeting. AGENDA ITEM #IX - FIRST HEARING - ORDINANCE AUTHORIZING ISSUANNCE OF $3,212,900 IN BONDS Chairman Douglas advised that due to the number of people involved in putting together the bond ordinance for the City's Water and Sewer expansion, several revisions have been found to be necessary and it is the opinion of the bond Council the City should introduce a new ordinance and set a Final Hearing for Mnnday, June 20, 1983. The title was read as follows: AN ORDINANCE AUTHORIZING THE ACQUISITION AND CONSTRUCTION OF EXTENSIONS AND I4P30VEMENTS TO THE WATER SEWER SYSTEM AND THE REFUNDING OF CERTAIN OUTSTANDING OBLIGATIONS OF THE CITY OF OKEECCHOBEE, FLORIDA; PROVIDING FOR THE ISSUANCE OF NOT EXCEEDING $3,212,900 WATER AND SEWER REVENUE BADS, SERIES 1983, TO FINANCE PART OF THE COST OF SUCH PROTECT AND THE REFUNDING; PROVIDING FOR THE PAYMENT THEREOF; PROVIDING FOR THE RIGHTS OF THE HOLDERS OF THE BONDS; MAKING CERTAIN OTHER COVENANTS AND AGREE- MENTS IN CONNECTION THEREWITH; AMENDING ORDINANCE NO. 356 OF THE CITY, RELATING TO THE CITY'S OUTSTANDING WATER AND SEWER REVENUE BONDS, SERIFS 1972, IN CERTAIN RESPECIS SO AS TO ENHANCE THE MARKETABILITY OF THE BONDS; REPEALING.
