IV. New Business - Chairperson
A. A.M.S.A Holdings LLC, 08-009-TRC. The application was submitted by Loris C. Asmussen,
P.E. on behalf of the property owner for property located at 111 NE 11th Street, Okeechobee,
Florida to construct an assisted living facility with parking, in a single phase - Senior Planner.
Mr. Nooruddin withdrew the application.
B. Visiting Nurse Association of Florida Inc. 08-010-TRC. The application was submitted by Loris
C. Asmussen, P.E. on behalf of the property owner for property located at 203 SE 2nd Street,
Okeechobee, Florida to construct an assisted living facility with parking, in a single phase - Senior Planner.
Mr. Bill Brisson, Senior Planner for LaRue Planning and Development addressed the committee on introductory thoughts as
regard to the Special Exception granted by the Board of Adjustment and Appeals for the Visiting Nurses Association of
Florida, Inc. assisted living facility (ALF). When special exceptions are approved, it approves the use, it does not relate as
to how the site is developed. There are criteria in the special exception that tend to be subjective more so than usual. The
Board of Adjustment and Appeal's approval incorporated a recommendation that during the site plan review the Technical
Review Committee (TRC) take note of the paving, amount of landscaping, delivery schedule, and that the TRC ensure that
the size of the building be consistent with the size of the lot and considerate of the area in which it is located (i.e.,
surrounding neighborhood). These concerns by the Board are consistent with the standards set forth in Sec. 70-373(b),
specifically requiring that the Applicant:
(2) Demonstrate how the site and proposed buildings have been designed so they are compatible with the adjacent
uses and the neighborhood, or explain why no specific design efforts are needed.
(3) Demonstrate any landscaping techniques to visually screen the use from adjacent uses; or explain why no visual
screening is necessary. "
When you a doing site plan review for special exceptions, yes it is allowed in the district, but it may require conditions to
make it appropriate for the location. There are minimums and maximums regarding setbacks, side yards, the coverage and
the height, in the zoning codes. To go lower than the minimum and higher than the maximums would be inappropriate, but
that does not mean that an applicant can automatically expect to achieve every minimax, and in reality that is what the staff
report reflects. All the minimums were used, some violated, all the maximums are used, a little violation and what we have
is 7-71/2 pounds in a 5 pound bag. You cannot achieve this development and meet all minimax of the codes.
Mr. Brisson than addressed the violations. 2nd Front yard setback (Sec 90-447). Setback from SE 2nd Av. is only 18',
Parking setback from SE 2nd Av. is 8 feet. The Applicant is applying the 75% factor to this setback; but, the minimum buffer
along a roadway is 10' and therefore parking may not be set back only 8'. Maximum lot coverage & other impervious
surfaces (See 90-225) 60.2% (28,429 sf). Off- street parking (Sec. 90-512). The first space off SE 2nd Av. is only 10 feet
from the property line, is this adequate? Off-street loading(Sec. 90-513) & [Sec. 90-511 (c)] Space is 15' wide, but the
required 30-foot length appears to extend into the driveway. Parking & Vehicular Use Areas (Sec. 90-533, per Ord. 1010,
adopted 2-19-08) The islands on either side of the entrance walkway are of generous size, but the island next to space
#18 looks to be slightly shy of the required 5-foot width.

B. Visiting Nurse Association of Florida Inc. 08-010-TRC continued.
A lighting plan should be submitted that meets the standard adopted by the City under Ordinance 1010 on February 19,
2008 of an average of one-half horizontal foot-candle power of artificial lighting.
The committee discussed all issues listed above along with compatibility to surrounding areas, fire flow, building size,
potable water and waste water, and open space. The applicant will revise the ALF plans and present them to the committee
at the next available meeting.
V. Adjournment - Chairperson.
There being no further items on the agenda, Chairperson Whitehall adjourned the Technical Review Committee meeting at
11 :27 a.m.

Traffic, Ingress and Egress:
Based on the ih Edition, ITE Trip Generation Manual, an assisted living facility has an average
trip generation rate of 2.66 trips per assisted living unit per day and 0.22 trips/day at peak: hour.
Using these figures, a 14-unit assisted living facility could be expected to generate about 82 trips
per day and seven trips during the PM peak: hour. Staff does not believe this level of traffic will
either adversely affect the City's ability to maintain its adopted levels of service or result in undo
traffic congestion in the area.

In addition to the general requirements and limitations applicable to all uses in the RMF district,
the Applicant must comply with the supplementary regulations for adult family care homes and

such potential problems. "
The general scale of the facility is not particularly out-of-scale with the surrounding
neighborhood, and the Applicant has proposed a six-foot high wall which will somewhat buffer
the single-family residence to the north. However, the setbacks proposed in the site plan are
seriously deficient with respect to the minimums required under the special exception
requirements. In fact the only setback that has been met is that from NE 11 th Street, and this is
because of the location of the parking between the road and the building. The greater setbacks
required for assisted living facilities are intended to provide a buffer for nearby residentially
zoned properties and to buffer an assisted living facility from other uses, notably adjacent
commercial or other nonresidential uses.
While the minimum lot size for an assisted living facility is 20,000 square feet, with the greater
setbacks required, such a small lot does not work well when it is adjacent to residentially zoned
properties.
Recommendation:
There are serious problems with the deficiencies in the setbacks from residential property lines
on the north and east, and even the setback from the commercial property to the west is
inadequate. These deficiencies will require major reconfiguration of the overall site plan since
variances are not applicable to special exception requirements.

Sec. 70-373. Special exception use by board of adjustment.
(a) Authorization. The board of adjustment shall:
(1) Hear and decide only petitions for a special exception use under the zoning districts
in these regulations.
(2) Decide such questions as are involved in determining whether a special exception
use should be granted, and to grant a special exception use with such conditions and
safeguards as are appropriate under these regulations.
(3) Deny a special exception use when not in the public interest or in harmony with the
requirements of these regulations.
(b) Standards for granting a special exception use. Applicants for a special exception
use shall address the following issues in their presentation:
(1) Demonstrate that the proposed location and site is appropriate for the use.
(2) Demonstrate how the site and proposed buildings have been designed so they are
compatible with the adjacent uses and the neighborhood.
(3) Demonstrate any landscaping techniques to visually screen the use from adjacent
uses.
(4) Demonstrate what is proposed to reduce the impact of any potential hazards,
problems or public nuisance generated by the use.
(5) Demonstrate how the utilities and other service requirements of the use can be met.
(6) Demonstrate how the impact of traffic generated will be handled, off site and on site.
(c) Findings required. In granting a special exception use, the board shall find that:
(1) The use is not contrary to comprehensive plan requirements.
(2) The use is specifically authorized as a special exception use in the zoning district.
(3) The use will not have an adverse effect on the public interest.
(4) The use is appropriate for the location proposed, is reasonably compatible with
adjacent uses, and is not detrimental to urbanizing land use patterns.
(5) The use will not adversely affect property values or living conditions, nor be a
deterrent to the improvement or development of adjacent property.
(6) The use may be required to be screened from surrounding uses, to reduce the impact
of any nuisance or hazard to adjacent uses.
(7) The use will not create a density pattern that would overburden public facilities such
as schools, streets, and utility services.
(8) The use will not create traffic congestion, flooding or drainage problems, or
otherwise affect public safety.
(d) Special exception use not granted. The board of adjustment shall not grant a special
exception use petition where there is an existing violation of these regulations.
(e) Change of ownership. If ownership of property subject to a grant of a special
exception by the board of adjustments is transferred, including by sale or inheritance, the
special exception use and the conditions and length thereof shall continue as provided in
the original grant.
(f) Nonuse. If the special exception use granted by the board of adjustment should fail
to exist or fail to be used for a continuous period of 180 days, then such use shall lapse
and the current owner be required to reapply as provided in this division. In case of
hardship, where the loss of such special exception would materially affect the integrity of
any mortgage or other fmancing arrangement on the subject real property, the board of
adjustment may consider such hardship in granting a renewal of such special exception.

General Description:
The Visiting Nurse Association of Florida received approval from the Board of Adjustment and
Appeals (BOAA) on July 18, 2008 for a special exception to allow an assisted living facility on
the subject property which is located in the CPO zoning district. The facility will provide care
for up to 37 residents and will have about 18 employees. The facility will operate 24 hours-a-
day, but the Applicant offered that deliveries will be limited to between the hours of 7 am and 7
pm.
The Board's approval included a recommendation that the TRC take note of the paving, amount
of landscaping, delivery schedule, and that the TRC ensure that the size of the building be
consistent with the size of the lot and the area in which it is located (i.e., surrounding
neighborhood).

trip generation rate of 2.66 trips per assisted living unit per day and 0.22 trips/day at peak hour.
Using these figures, a 31-unit assisted living facility could be expected to generate about 82 trips
per day and seven trips during the PM peak hour. Staff does not believe this level of traffic will
either adversely affect the City's ability to maintain its adopted levels of service or result in undo
traffic congestion in the area.
Comparison of Proposal with Dimensional Standards:
In addition to the general requirements and limitations applicable to all uses in the CPO district,
the Applicant must comply with the supplementary regulations for adult family care homes and
assisted living facilities set forth in Section 90-695. In addition the site plan should be reviewed

Other Requirements and Considerations:
Sidewalks (Sec. 78-36): Five-foot sidewalks are shown along all three street frontages.
A lighting plan should be submitted that
meets the standard adopted by the City under Ordinance 1010 on February 19, 2008 of an
average of one-half horizontal foot-candle power of artificial lighting.
Dumpster Location: The dumpster location is shown between the building and dry retention
area, just behind the loading zone.
The Board of Adjustment and Appeal's approval incorporated a recommendation that during the
site plan review the TRC take note of the paving, amount of landscaping, delivery schedule, and
that the TRC ensure that the size of the building be consistent with the size of the lot and
considerate of the area in which it is located (i.e., surrounding neighborhood). These concerns
by the Board are consistent with the standards set forth in Sec. 70-373(b), specifically requiring
that the Applicant:
"(2) Demonstrate how the site and proposed buildings have been designed so they are
compatible with the adjacent uses and the neighborhood, or explain why no specific
design efforts are needed.
(3) Demonstrate any landscaping techniques to visually screen the use from adjacent uses;
or explain why no visual screening is necessary. "
In light of the comments received during the public hearing on the special exception and the
Board's concern over the possible size of the building in relation to the character of the
surrounding neighborhood, Staff is also concerned over the massiveness of the use. Most
particularly, we find the combination of three-stories and a width of 200 feet to be out-of-scale
with the surrounding residential area. With the parking, building, and drainage detention areas
encompassing virtually the entire site, the area available as a buffer to the properties to the south,
those that are most affected, barely meets the minimum standard required of a use permitted by
right.. We believe the project is simply too intense for the size of the parcel. It provides for
minimal buffering and landscaping, and little or no open space for the residents to just walk
around landscaped grounds, much less any area for passive recreation.
One way of looking at the proposed intensity is to compare it to the size of a professional office
building one would usually expect in the CPO district. Given a building and other impervious
surface limitation of 60% of the lot area, and a parking requirement of one space per 300 square
feet of professional office space, one would usually expect about a 21,000 square foot, three-
story building. This would mean, the building would occupy a 7,000 square foot footprint (about
150 feet wide and 45-50 feet deep) compared to the 200 foot long building with a 9,200 square

foot footprint that is proposed. The only reason such a large building can be proposed is because
of the lower parking requirement for assisted living facilities. However, Staff does not believe
that the lower parking requirement should be translated into greater structure size. Rather, the at
least some of the reduction in parking area should be applied to buffer the surrounding
neighborhood and provide for some on-site open space for the residents.
Recommendations:
1. The size of the building should be reduced to be more compatible with the surrounding area
and to provide adequate space for buffering from nearby residential uses and to provide on-
site open space for the residents.
2. If it is determined that the driveway onto SE 2nd Avenue is too close to the intersection, the
site plan will need to be reconfigured to accommodate a new driveway location
Under any circumstances, the following specific deficiencies need to be addressed.
3. The building setback from SE 2nd Avenue should be increased to at least 30 feet and the
setback of the parking area from SE 2nd Avenue should be increased to at least 10 feet to
comply with the 10- foot buffer requirement and possibly more if necessary to avoid conflicts
with traffic entering from SE 2nd A venue.
4. Total impervious surface coverage (building and other impervious surfaces) should be
reduced to comply with the allowed 60% maximum.
5. The off-street loading space should be located in a manner that allows for a full 30-foot
length without infringing into the driveway/drive aisle.
6. The parking island next to space #18 should be enlarged to comply with the minimum five-
foot width.
7. The Applicant should submit a lighting plan meeting the standard adopted by the City
under Ordinance 1010 on February 19, 2008 of an average of one-half horizontal foot-
candle power of artificial lighting.

Sec. 70-373. Special exception use by board of adjustment.
(a) Authorization. The board of adjustment shall:
(1) Hear and decide only petitions for a special exception use under the zoning districts
in these regulations.
(2) Decide such questions as are involved in determining whether a special exception
use should be granted, and to grant a special exception use with such conditions and
safeguards as are appropriate under these regulations.
(3) Deny a special exception use when not in the public interest or in harmony with the
requirements of these regulations.
(b) Standards for granting a special exception use. Applicants for a special exception
use shall address the following issues in their presentation:
(1) Demonstrate that the proposed location and site is appropriate for the use.
(2) Demonstrate how the site and proposed buildings have been designed so they are
compatible with the adjacent uses and the neighborhood.
(3) Demonstrate any landscaping techniques to visually screen the use from adjacent
uses.
(4) Demonstrate what is proposed to reduce the impact of any potential hazards,
problems or public nuisance generated by the use.
(5) Demonstrate how the utilities and other service requirements of the use can be met.
(6) Demonstrate how the impact of traffic generated will be handled, off site and on site.
(c) Findings required. In granting a special exception use, the board shall find that:
(1) The use is not contrary to comprehensive plan requirements.
(2) The use is specifically authorized as a special exception use in the zoning district.
(3) The use will not have an adverse effect on the public interest.
(4) The use is appropriate for the location proposed, is reasonably compatible with
adjacent uses, and is not detrimental to urbanizing land use patterns.
(5) The use will not adversely affect property values or living conditions, nor be a
deterrent to the improvement or development of adjacent property.
(6) The use may be required to be screened from surrounding uses, to reduce the impact
of any nuisance or hazard to adjacent uses.
(7) The use will not create a density pattern that would overburden public facilities such
as schools, streets, and utility services.
(8) The use will not create traffic congestion, flooding or drainage problems, or
otherwise affect public safety.
(d) Special exception use not granted. The board of adjustment shall not grant a special
exception use petition where there is an existing violation of these regulations.
(e) Change of ownership. If ownership of property subject to a grant of a special
exception by the board of adjustments is transferred, including by sale or inheritance, the
special exception use and the conditions and length thereof shall continue as provided in
the original grant.
(f) Nonuse. If the special exception use granted by the board of adjustment should fail
to exist or fail to be used for a continuous period of 180 days, then such use shall lapse
and the current owner be required to reapply as provided in this division. In case of
hardship, where the loss of such special exception would materially affect the integrity of
any mortgage or other financing arrangement on the subject real property, the board of
adjustment may consider such hardship in granting a renewal of such special exception.
