Official Records File#2020005966 Pageis)A Sharon Robertson Clerk of the Circuit Court & Comptroller Okeechobee, FL Recorded 6/26/2020 10:32 AM Fees: RECORDING $35.50 M DOCTAX PD $0.00 REVOCABLE LICENSE AGREEMENT (Use of Right -of -Way) THIS AGREEMENT, by and between the CITY OF OKEECHOBEE, FLORIDA, a Florida Municipal Corporation (hereinafter "CITY"), and MASON JAMES LOOKABILL S UMATE (hereinafter "OWNER"), dated thisday of 20-& WHEREAS, OWNER holds fee simple title to the following described real property in Okeechobee County, Florida, to wit: LEGAL DESCRIPTION: LOTS 1, 2, 3, AND 4 OF BLOCK B, EVANS ADDITION, ACCORDING TO PLAT THEREOF RECORDED IN PLAT BOOK 2, PAGE 31 OF THE PUBLIC RECORDS OF OKEECHOBEE COUNTY, FLORIDA; and WHEREAS, the CITY owns the following platted right-of-way: THAT PORTION OF SOUTHWEST 12 STREET (FORMERLY KNOWN AS HYBICUS AVENUE) AN UNIMPROVED RIGHT-OF-WAY BEING APPROXIMATELY 50 -FEET WIDE, LYING EAST TO WEST BETWEEN SOUTHWEST 11TH DRIVE AND SOUTHWEST 12th AVENUE (FORMERLY KNOWN AS CANAL STREET); and WHEREAS, the OWNER made an official request to the CITY requesting permission to erect a fence across the portion of the aforementioned right-of-way. Upon a field study conducted by the Public Works Department, which confirmed the acceptance of the OWNERS request; and WHEREAS, the OWNER filed with the Office of the City Clerk a letter of consent executed by the adjoining landowners, Billy J. Simmons, Sr., and Katherine A. Simmons, Lots 5 through 8 of Block A, in said EVANS ADDITION; and WHEREAS, the Office of the City Clerk received verification from the Okeechobee Utility Authority that there are no utilities within the portion of the aforementioned right-of-way. Further, received verification from City Code Enforcement, to ensure there were no active or pending code violations related to the OWNERS property. NOW, THEREFORE, in consideration of the mutual promises and covenants set forth herein, the parties agree as follows: 1. The CITY hereby grants this Revocable License for the use of a portion of the right-of-way as described below, and as shown on Attachments A and B, for the purpose of erecting a fencing/gates, no other improvements shall be permitted within the right-of-way: THAT PORTION OF THE UNIMPROVED RIGHT-OF-WAY OF SOUTHWEST 12TH STREET AS FOLLOWS: BEGIN AT THE NORTHEAST CORNER OF LOT 1 OF SAID BLOCK B; THENCE NORTH APPROXIMATELY 50 -FEET ALONG THE WEST RIGHT-OF-WAY LINE OF SOUTHWEST 11TH DRIVE TO THE SOUTHEAST CORNER OF LOT 8 OF SAID BLOCK A; THENCE WEST APPROXIMATELY 193.7 -FEET ALONG THE SOUTH PROPERTY LINE OF LOTS 8, 7, 6, AND 5 OF SAID BLOCK A TO THE SOUTHWEST CORNER OF LOT 5 OF SAID BLOCK A; THENCE SOUTH APPROXIMATELY 50 -FEET ALONG THE EAST RIGHT-OF-WAY LINE OF SOUTHWEST 12TH AVENUE TO THE NORTHWEST CORNER. OF LOT 4 OF SAID BLOCK B; THENCE EAST APPROXIMTELY 193.7 -FEET ALONG THE NORTH PROPERTY LINE OF LOTS 4, 3, 2, AND 1, OF SAID BLOCK B TO THE POINT OF BEGINNING. 2. The OWNER is required to maintain the entire 50 -feet wide portion of the aforementioned right-of-way up to the south boundary line of Lots 5, 6, 7, and 8 of Block A, in said EVANS ADDITION. 3. Should it ever become necessary to remove any fencing/gates, in order to allow either the installation or maintenance of water, sewer, or other utility lines or any other type of installation or construction, or for any other reason chosen by the CITY, the fencing/gates, or any improvement 'thereon, will be removed by the Page 1 of 4 OWNER or their agents and/or assignees at the OWNERS expense within seven days of receipt of written request by the CITY for such removal. Should the CITY, for valid reasons, require the removal of the fencing/gates thereon, less than seven days' notice, the OWNERS agree to exercise reasonable efforts to comply with such requests. 4. OWNERS shall modify their insurance coverage to obtain an endorsement to their General Liability Insurance policy listing the CITY as an additional insured with a Certificate of Insurance, as well as a certified copy of the endorsement, furnished to the CITY showing that part of the aforementioned right-of-way as herein described, to be used by them, insuring the CITY against any liability directly or indirectly related to any activities in, on, and/or over right-of-way. In any event, OWNERS shall hold the CITY harmless for any and all action, suit, claim, injury, or cause of action of any nature arising out of OWNERS activities or use, and shall indemnify the CITY for such, including, but not limited to, any costs and attorney fees. 5. OWNERS agree to furnish the CITY annually, upon renewal, a copy of the Certificate of Insurance listing the CITY as an additional insured, as well as a copy of the policy endorsement from their insurance carrier. 6. OWNERS agree this license is non -assignable without the express written consent of the CITY; and if OWNERS sell or transfer the subject property, the purchaser shall be placed on notice that their covenants, and agreements shall run with the land. 7. The City Clerk shall cause this license to be recorded in the public records of Okeechobee County, Florida. 8. OWNERS agree to reimburse the CITY all recordings costs. OWNERS agree to contact their insurance company and require an endorsement be added to their General Liability Insurance policy listing the CITY as an additional insured with a Certificate of Insurance, as well as a certified copy of the endorsement, furnished to the CITY showing the part of the aforementioned right-of-way as herein described, to be used by them, insuring the CITY against any liability arising out of alleged injuries or other activities which may occur within the right-of-way. In any event, OWNERS agree and shall hold the CITY harmless for any and all action, suit, claim, injury, or cause of action of any nature arising out of OWNERS permissive use, and indemnify CITY for such, including costs and attorney fees. 5. OWNERS agree to furnish the CITY annually upon renewal, a copy of the Certificate of Insurance listing the CITY as an additional insured, as well as a copy of the policy endorsement with their insurance carrier. 6. OWNERS agree this license is non -assignable without the express written consent of the CITY; and if OWNERS sell or transfer the subject property, their covenants, and agreements shall run with the land. 7.
