PAGE 1 OF 3 In Chairperson Boyd's Absence Kelly Hill, representative of LaRue Planning and Management, called the August 31,2004 Technical Review Committee meeting to order at 10:05 a.m. Each member stated their name and organization they are representing for the record. Absent Present Present Present Present Present Present Present Absent Absent Present Fire Chief Smith explained that 2 hydrants were necessary at the proposed site, there is currently only one shown on the plans. Chief Smith also requested that the hydrant that was shown on the plans be moved farther away from the building. There was a brief discussion between property owner, project engineer, and Chief Smith to fully understand the request. Kelly Hill requested that landscaping plans be provided to the City, recommending that this be included in the motion. Mr. Hill expressed concern with the two lots sharing one entrance, as well as the development of lot 7 running over onto lot 8. He continued by explaining that a Unity of Title is usually required in an instance like this. The property owner, Mr. Myer, explained that he wanted the lots to remain separate, in case he wanted to sell lot 8 in the future. The Committee instructed General Services Coordinator Vinson to get a determination from the City Attorney regarding the requirement of a Unity of Title. AGENDA I 11/. New Business, continued. A. Okeechobee Commerce Center, LLC, continued. Administrator Veach instructed Committee Secretary, Katrina Vinson, to get a determination by the City Attorney of what will be required of the applicants. City Engineer Bermudez requested that drainage calculations be provided. . LC Fortner, Executive Director of Okeechobee Utility Authority, requested that the water meters be moved from being located next to the building to being located near the 8 inch water main, which is closer to the property line and City Right-of-Way. This would allow the applicants to provide a small easement for Okeechobee Utility Authority, instead of requiring one running along the water lines all the way up to the building. Chris Lips, Project Engineer, questioned if two water meters would be okay. Mr. Fortner responded yes, however an easement would need to be provided to both meters. . Administrator Veach motioned to approve the Okeechobee Commerce Center, LLC, Federal Cast Stone, Site Plan with the following conditions: 1. Two hydrants provided on site plan; 2. Move the existing hydrant farther away from the building; 3. Landscaping plan provided to the City, and approved; 4. Drainage Calculations provided to the City, and approved; 5. Work with Okeechobee Utility Authority regarding water meters, as well as required easements; 6. Determine if a Unity of Title is required for the development of both lots. Seconded by Chief Smith. After talking with the applicant and getting revised site data, staff is satisfied that individual lot coverage for pervious requirements and parking seem to be met for Lots 7 and 8 of the Commerce Center. Landscaping, as per Section 90-531 to 90-543 is not shown and must be met for site plan approval. Approval can be contingent upon landscaping plans showing the proper number oftrees, shrubs, and buffer areas. Also, these lots seem to share a driveway. Only Lot 7 has direct access which makes it difficult to separate ownership for each lot. Since there is no buffer between the two parking areas they cannot be sold separately without meeting this criteria. Re: Robert Meyer project I reviewed the LDR's with Katrina in reference to the issue of unity of title that was mentioned at the technical review committee meeting for the Robert Meyer project. Unity of title is an optional requirement that may be imposed on a developer as a condition of permit; it purpose is to require the developer to maintain the parcels together due to an overlap of development on more than one lot, which can create set back problems if the parcels are thereafter divided. For our purposes, we can allow the project to proceed without making unity of title a condition. However, I would suggest that we impose on the developer a requirement that in the event the subject lots are to be divided and sold in the future, that they understand that any problems with set backs, encroachment, impervious surface and the like be brought up to current city codes at that time.
